Detailed Implementation of Certain Provisions of the Law on Encouragement and Reward

On the basis of Law d.1. Amount of taxable income in Vietnam:Government Organization No. 63/2025/QH15;

On the basis of Law d.1. Amount of taxable income in Vietnam:encouragement and reward No. 06/2022/QH15;

Pursuant to Resolution No. 190/2025/QH15 of the National Assembly regarding the handling of certain issues related to the restructuring of state administrative apparatus;

On the basis of Decree No. 152/2025/NĐ-CP of the Government on decentralization and delegation of authority in the field of encouragement and reward; detailed regulations and guidance on implementing certain provisions of the Law on Encouragement and Reward;

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decision provides detailed implementation of Clause 2 Article 12; Clause 2 Article 14; Clause 3 Article 81; Clause 7 Article 83; Clause 2 Article 85; Clause 3 Article 96 of the Law on Encouragement and Reward according to the delegation of authority under Decree No. 152/2025/NĐ-CP dated June 14, 2025 of the Government on decentralization and delegation of authority in the field of encouragement and reward; detailed regulations and guidance on implementing certain provisions of the Law on Encouragement and Reward.

Article 2. Applicability

This Decision applies to:

1. State agencies.

2. Organizations and individuals within Vietnam and foreign organizations and individuals.

3. Other relevant agencies, organizations, and individuals.

Chapter II

AUTHORITY TO AWARD REWARDS, APPLICATION FOR AWARDS FOR ENTERPRISES AND OTHER ECONOMIC ORGANIZATIONS; SIMPLIFIED AWARD PROCEDURES; RESPONSIBILITIES OF VIETNAMESE INDIVIDUALS AND ORGANIZATIONS WHEN RECEIVING AWARDS FROM FOREIGN INDIVIDUALS AND ORGANIZATIONS

Article 3. Authority to award rewards, application for awards for enterprises and other economic organizations

1. The Chairman of the People's Committee of the province shall be responsible for awarding rewards and applying for higher-level awards for:

a) Enterprises, other economic organizations, industrial zones, economic zones, export processing zones, or collectives, individuals belonging to enterprises, other economic organizations, industrial zones, economic zones, export processing zones under their management;

b) Enterprises, other economic organizations, or collectives, individuals belonging to enterprises, other economic organizations not under their management but with outstanding contributions to the locality outside the main office location of the enterprise.

In cases where a request for national-level awards is made for enterprises, other economic organizations, or collectives, individuals belonging to enterprises, other economic organizations not under their management, opinions must be obtained in writing (on the awarding of rewards, forms of rewards) from the People's Committee of the province where the enterprise has its main office and the ministry or sector managing the industry or field of the enterprise, other economic organization.

The agency requested for opinions shall be responsible for replying in writing within ten working days from the date of receipt of the opinion request and shall bear responsibility under the law for the content of the opinion given.

2. Heads of ministries, sectors shall be responsible for awarding rewards and applying for higher-level awards for:

a) Enterprises, other economic organizations, industrial zones, economic zones, export processing zones, or collectives, individuals belonging to enterprises, other economic organizations, industrial zones, economic zones, export processing zones under their management;

b) Enterprises, other economic organizations, or collectives, individuals belonging to enterprises, other economic organizations not under their management but with outstanding contributions to the field managed by the ministry, sector.

In cases where a request for national-level awards is made for enterprises, other economic organizations, or collectives, individuals belonging to enterprises, other economic organizations not under the management of the ministry, sector, opinions must be obtained in writing (on the awarding of rewards, forms of rewards) from the People's Committee of the province (if the enterprise is under provincial management) or the ministry (if the enterprise, other economic organization is under central ministry management).

The agency requested for opinions shall be responsible for replying in writing within ten working days from the date of receipt of the opinion request and shall bear responsibility under the law for the content of the opinion given.

3. For enterprises, collectives, individuals belonging to state-owned enterprises:

a) State-owned corporations, state-owned joint-stock companies holding more than 50% of the capital shall implement the principle that the ministry, sector delegated by the Government to exercise the rights and responsibilities of the state owner representative for the enterprise shall award rewards or apply for higher-level awards for enterprises, collectives, individuals of the enterprise under its management;

b) The ministry managing the industry, field, People's Committee of the province or the organization delegated by the Government to exercise the rights and responsibilities of the state owner representative for the enterprise shall award rewards or apply for higher-level awards for enterprises, collectives, individuals of the enterprise established or managed by itself;

c) Subsidiaries of the enterprise operating and fulfilling obligations in a locality where they do not have their main office shall be awarded rewards by the head of the enterprise within his/her authority or apply for higher-level awards.

4. For enterprises, collectives, individuals belonging to enterprises (including foreign-invested enterprises)

a) Enterprises, collectives, individuals belonging to enterprises operating in the locality where the transaction office is located (including within industrial zones, export processing zones and outside industrial zones, export processing zones) shall be awarded rewards by the head of the enterprise or apply for rewards from the Chairman of the People's Committee of the commune or the Chairman of the People's Committee of the province where the transaction office is located;

b) Subsidiaries of the enterprise, but independently accounting and fulfilling obligations in a locality where they do not have their main office, in addition to being awarded rewards by the head of the enterprise within his/her authority, the head of the subsidiary shall also award rewards within his/her authority and apply for rewards from the Chairman of the People's Committee of the commune or the Chairman of the People's Committee of the province where the subsidiary has its office and fulfills obligations to the state.

Article 4. Documents and simplified procedures for commendation

1. Cases of commendation examination through simplified procedures shall be carried out in accordance with the provisions of Article 85 of the Law on Competition and Commendation.

2. The application dossier for commendation through simplified procedures consists of 01 set (original copy), including:

a) A proposal for commendation;

b) A summary report of achievements of individuals, groups, households, or directly managing agencies, organizations, units according to Model 06, 07, 08 attached to Decree No. 152/2025/NĐ-CP.

3. The head of Ministries, sectors, provincial authorities; the head of agencies, organizations, units having the authority to grant commendations and propose commendations shall immediately do so after individuals or groups achieve outstanding and sudden merits as stipulated in point b, Clause 1, Article 85 of the Law on Competition and Commendation.

4. The time for assessment and submission for commendation for cases proposed for commendation as stipulated in points a, c, d, đ, Clause 1, Article 85 of the Law on Competition and Commendation shall be implemented in accordance with the provisions of Article 35 of Decree No. 152/2025/NĐ-CP.

5. Submitting documents for State-level commendation:

a) The submission of commendation documents through simplified procedures shall be carried out in accordance with the provisions of Clause 12, Article 33 of Decree No. 152/2025/NĐ-CP;

b) The Ministry of Home Affairs shall send the Proposal along with the list of commendation proposals and commendation documents in electronic file format to the Government Office;

c) The dossier submitted by the Ministry of Home Affairs to the Prime Minister includes: The Proposal of the Ministry of Home Affairs along with the list of commendation proposals and electronic files of the commendation dossier (excluding commendation documents containing state secrets).

Article 5. Responsibilities of Vietnamese individuals and organizations when receiving Orders, Medals, titles, and awards from foreign individuals and organizations

1. To use award items for their intended purposes, in accordance with the customs and traditions of the Vietnamese people and Vietnamese social ethics.

2. Strictly prohibit the abuse of foreign individual or organizational award forms to carry out acts:

a) Violating Vietnamese laws;

b) Propagandizing, inciting, or instigating actions contrary to Vietnamese cultural traditions and national interests;

c) Infringing upon national security, opposing the Socialist Republic of Vietnam.

Chapter III

PROCEDURES FOR CONSIDERING AND BESTOWING THE MEDAL OF OUTSTANDING YOUTH VOLUNTEERS AND THE COMMEMORATION OF MERITS IN THE RESISTANCE WAR

Section 1

PROCEDURES FOR CONSIDERING AND BESTOWING THE MEDAL OF OUTSTANDING YOUTH VOLUNTEERS

Article 6. Applicability

1. Youth volunteers who have achieved merits in resistance wars and national defense, completed tasks, and served in youth volunteer forces continuously for at least 24 months.

2. Youth volunteers who died while performing duties during resistance wars and national defense and were recognized as martyrs.

Article 7. Rights and obligations of Youth Volunteers when being considered for bestowal of the "Medal of Outstanding Youth Volunteers"

1. Youth volunteers who are considered for bestowal of the "Medal of Outstanding Youth Volunteers" shall receive Certificates, frames, Medals, and Medal boxes as prescribed.

2. Youth volunteers or relatives of Youth Volunteers have the responsibility to truthfully and accurately declare, provide complete documents and dossiers proving their work process in Youth Volunteer units when preparing commendation application dossiers. Individuals making declarations must bear legal responsibility for the content of their declarations and the legality of supporting documents and dossiers.

Article 8. Competence to Examine and Propose the Awarding and Posthumous Awarding of the "Venerable Youth Volunteer Medal"

1. The Chairman of the People's Committee at the commune level shall direct the examination of the dossier for the proposal to award and posthumously award the "Venerable Youth Volunteer Medal" within their jurisdiction, and submit it to the Chairman of the People's Committee at the provincial level for consideration and proposal of commendation.

2. The Chairman of the People's Committee at the provincial level shall direct the examination of the dossier for the proposal to award and posthumously award the "Venerable Youth Volunteer Medal" within their jurisdiction, and submit it to the Prime Minister for examination, then to the President for decision on awarding and posthumously awarding the "Venerable Youth Volunteer Medal" through the Ministry of Interior.

3. The Ministry of Interior shall examine the dossier submitted to the Prime Minister for examination, and then submit it to the President for decision on awarding and posthumously awarding the "Venerable Youth Volunteer Medal".

Article 9. Time Periods for Commendation

1. The period of resistance against French colonialism from July 15, 1950 to July 20, 1954.

2. The period of resistance against the American imperialists from July 21, 1954 to April 30, 1975, including:

a) Resistance against the American imperialists in the Northern region;

b) Resistance against the American imperialists in the Southern region;

c) Performing tasks to assist friendly Laos from May 1972 to December 1975.

3. The period of war for national defense and international missions:

Individuals directly participating in combat or directly serving combat operations. The time periods are defined as follows:

a) War for defending the Southwest border from May 1975 to January 7, 1979;

b) War for defending the Northern border from February 1979 to December 31, 1988;

c) Performing tasks to assist friendly Laos from May 1975 to December 31, 1988;

d) Performing international missions in friendly Cambodia from January 1979 to August 31, 1989;

đ) Performing tasks to eliminate Fulro from May 1975 to December 1992.

Article 10. Principles for Awarding and Posthumously Awarding the "Venerable Youth Volunteer Medal"

1. A Youth Volunteer may be awarded the "Venerable Youth Volunteer Medal" only once and uniquely.

2. When Youth Volunteers are considered for commendation, the time they spent working during the time periods specified in Article 9 of this Decision shall be accumulated to ensure they meet the criteria for awarding and posthumously awarding the "Venerable Youth Volunteer Medal".

3. The "Venerable Youth Volunteer Medal" shall not be awarded or posthumously awarded in the following cases:

a) Being convicted by a court judgment or decision with legal effect for one of the crimes that endanger national security or other crimes subject to imprisonment;

b) Participating in activities to undermine the regime, the Party, the State, desertion, betrayal, or surrender, and being deprived of preferential treatment according to the laws on preferential treatment for those who have contributed to the revolution.

Article 11. Dossier for Proposal to Award and Posthumously Award the "Venerable Youth Volunteer Medal"

1. Application Form for Proposal to Award the "Venerable Youth Volunteer Medal":

a) For Youth Volunteers who self-report, they shall fill out according to Model No. 01 in Appendix I attached to this Decision;

b) For elderly, weak, or deceased Youth Volunteers, the application form shall be filled out by a representative of their relatives according to Model No. 02 in Appendix I attached to this Decision.

2. Supporting Documents: If the individual is a Youth Volunteer during the periods specified in Article 9, they must indicate the unit they served in and the cumulative time of service as a Youth Volunteer of at least 24 months (abbreviated as: information about the time served as a Youth Volunteer), or if they are martyrs, there must be proof of martyrdom when they were a Youth Volunteer.

Supporting documents can be one or several documents ensuring legal validity (including original or certified copies as prescribed):

a) Officer's resume or personal record or party member's resume (including the resume of relatives as prescribed) showing the time served as a Youth Volunteer before the issuance of Decision No. 104/1999/QĐ-TTg by the Prime Minister; specifically, for grassroots Youth Volunteers in the South, the resume must be completed before 1995. The party member's resume must be certified as a true copy by the party committee where the party member participates;

b) Retirement decision or social insurance payment decision indicating the information about the time served as a Youth Volunteer as prescribed;

c) Decision on allowance or policy benefits for Youth Volunteers who completed their mission during the resistance and national defense, issued by the competent authority; clearly stating the individual's information about the time served as a Youth Volunteer and the amount of allowance provided according to state regulations, which must match the time served as a Youth Volunteer in the decision on benefits and policies;

d) Decision on one-time benefit according to Decision No. 176-HĐBT dated September 9, 1989 of the Council of Ministers now the Government regarding the reorganization of labor in state-owned economic units, including information about the time served as a Youth Volunteer as prescribed;

đ) Certificate (confirmation) of Youth Volunteer issued by the General Association of Youth Volunteers at the time the individual completed their mission;

Specifically, for cases where the certificate (confirmation) or commemorative medal of Youth Volunteer issued by the General Association of Youth Volunteers, Provincial Youth Volunteer Associations after 1999, showing the time served as a Youth Volunteer and the unit's nameplate, must be accompanied by the basis for confirmation and issuance of the certificate;

e) Documents issued by the competent authority before the Youth Volunteer completed their mission and returned to their hometown such as: Certificate of completion of mission from the Youth Volunteer management unit; Medical transfer certificate, health record; Commendation certificate during the time serving in the Youth Volunteer force; Transfer of duty, appointment, assignment... containing information about the time served as a Youth Volunteer;

g) In cases where individual resistance achievements have been recognized with awards, the following may be submitted: A certified copy of the Resistance Order, Resistance Medal, or Certificate of Merit issued by the Prime Minister, or by a Minister, Head of a ministerial-level agency, or Chairman of a provincial People's Committee, according to Decision No. 98/2006/QĐ-TTg of the Prime Minister, along with the achievement report when applying for the resistance award. The approved achievement report must include information on the time served in the Youth Volunteer Corps.

h) For martyrs: A certified copy of the National Memorial Certificate indicating that the person was a member of the Youth Volunteer Corps. If the National Memorial Certificate does not indicate membership in the Youth Volunteer Corps, there must be a document from an authorized authority confirming that the martyr was a member of the Youth Volunteer Corps at the time of sacrifice (extract from the martyr’s file).

3. The dossier to be submitted to the Chairman of the Provincial People's Committee (one original set and electronic files of the award application dossier) shall include:

a) A proposal from the Commune People's Committee accompanied by a list of cases proposed for awarding or posthumously awarding the "Venerable Youth Volunteer Corps Medal";

b) Minutes of the meeting to confer or posthumously confer the "Venerable Youth Volunteer Corps Medal" at the commune level;

c) The application dossier of the Youth Volunteer Corps member as stipulated in Clause 1 and Clause 2 of this Article;

d) Results of publicizing the cases proposed for awarding according to regulations.

4. The dossier to be submitted to the Prime Minister (one original set and electronic files of the award application dossier) shall include:

a) A proposal from the Provincial People's Committee accompanied by a list of cases proposed for awarding or posthumously awarding the "Venerable Youth Volunteer Corps Medal";

b) The application dossier of the Youth Volunteer Corps member as stipulated in Clause 1 and Clause 2 of this Article. The application form must be confirmed by the provincial dossier examination authority and clearly state the date of the award review.

Article 12. Procedures and formalities for conferring and posthumously conferring the "Venerable Youth Volunteer Corps Medal"

1. The Youth Volunteer Corps member or their relatives shall prepare the application dossier in accordance with Clause 1 of Article 11 of this Decision and submit one set directly or through postal service to the Commune People's Committee where the Youth Volunteer Corps member is registered to reside (for living members) or where the relative resides who is filing the application (for deceased members).

2. Within fifteen working days from the date of receipt of the complete dossier, the Commune People's Committee shall be responsible for:

a) Publicly announcing the list of cases proposed for conferring and posthumously conferring the "Venerable Youth Volunteer Corps Medal" on communication media and posting it on the commune's electronic information website (if available) within ten working days;

b) Organizing a meeting to confer and posthumously confer the "Venerable Youth Volunteer Corps Medal", including representatives from the leadership of the Commune People's Committee, the leadership and staff of the Cultural and Social Department responsible for commendation work, representatives from the Association (Contact Board) of Former Youth Volunteer Corps members at the commune level (if available), representatives from the Veterans' Association at the commune level, representatives from the Police and Military Command at the commune level, and representatives from the People's Council at the commune level;

c) Submitting to the Chairman of the Provincial People's Committee for consideration and recommending awards for cases meeting the conditions, standards, dossiers, and procedures as prescribed. The application dossier for conferring and posthumously conferring the "Venerable Youth Volunteer Corps Medal" shall comply with Clause 3 of Article 11 of this Decision.

3. Within fifteen working days from the date of receipt of the complete dossier, the Provincial People's Committee shall be responsible for:

a) Directing the Department of Home Affairs to accept the award application dossier, coordinating with the Association (Contact Board) of Former Youth Volunteer Corps members at the provincial level (if available) to examine the application dossier for conferring and posthumously conferring the "Venerable Youth Volunteer Corps Medal" and signing confirmation of the examination results on the individual's achievement report.

If verification is required, the Department of Awards and Honors under the Provincial Department of Home Affairs shall coordinate with the Provincial Police, Provincial Military Command, and related agencies to conduct verification in accordance with regulations; the verification results shall be attached to the award application dossier.

b) Submitting to the Prime Minister (through the Ministry of Home Affairs) for consideration and recommending awards for cases meeting the conditions, standards, dossiers, and procedures as prescribed. The application dossier for conferring and posthumously conferring the "Venerable Youth Volunteer Corps Medal" shall comply with Clause 4 of Article 11 of this Decision.

4. Within twenty working days from the date of receipt of the complete dossier, the Ministry of Home Affairs shall be responsible for:

a) Examining the dossier and soliciting opinions from relevant agencies (if necessary);

b) Submitting to the Prime Minister for review and to the President for decision on conferring and posthumously conferring the "Venerable Youth Volunteer Corps Medal". The dossier shall include: A proposal from the Ministry of Home Affairs accompanied by a list of recommended awards and electronic files of the award dossier (excluding award dossiers containing classified national secrets).

5. If the Youth Volunteer Corps dossier lacks supporting evidence, the receiving agency at the commune level shall be responsible for notifying and guiding the Youth Volunteer Corps member to complete the dossier and resubmit it within five working days from the date of guidance by the receiving agency.

6. If the conditions, standards, and procedures for awarding are not met, within ten working days from the completion of the examination and approval at that level, the receiving and examining agency shall be responsible for returning the dossier in writing to the award recommending unit; the notification must clearly state the legal basis for returning the award dossier.

7. The receiving agency at the provincial and commune levels for applications to confer and posthumously confer the "Venerable Youth Volunteer Corps Medal" shall organize verification for cases with unclear achievements, complaints, or indications of falsified award application dossiers.

Article 13. Announcing the results of commendation and organizing the presentation

1. The Ministry of Home Affairs shall be responsible for sending the decision on commendation to the entity that proposed the commendation. In cases where the conditions, criteria, procedures, and files are not met, within ten working days from the date of completing the review, the Ministry of Home Affairs shall notify the results of the review to the entity that proposed the commendation.

2. The People's Committee of the province, upon receiving the decision on commendation from the President of the State, shall direct the organization of the presentation and acceptance of the "Brave Volunteer Youth Medal" for those who have been commended in a solemn and appropriate manner according to the tradition and the category of former volunteer youth as stipulated in Decree No. 152/2025/NĐ-CP. In cases where the conditions, criteria, procedures, and files are not met, within five working days from the date of receiving the notification from the Ministry of Home Affairs, the People's Committee of the province shall be responsible for notifying the results of the review to the People's Committee of the commune to inform the individual who proposed the commendation.

Section 2

RESPONSIBILITIES OF ORGANIZATIONS, ENTITIES, AND INDIVIDUALS IN THE ACTIVITY OF CONSIDERING AND PRESENTING "VOLUNTEER YOUTH MEDAL"; GUIDELINES FOR COMMENDATION AND SUMMARY OF ACHIEVEMENTS IN THE RESISTANCE WAR

Article 14. Responsibilities of the Chairpersons of People's Committees at all levels

1. Directly lead, guide, promote, publicize, and organize the implementation of work related to considering and presenting the "Volunteer Youth Medal" in accordance with the provisions of the law and manage state administration in this field at the local level.

2. Implement inspection, audit, complaint resolution, accusation handling, and violation processing within their management authority; simultaneously carry out statistical and reporting work in accordance with the provisions of the law.

3. Publicize administrative procedures, results of administrative procedures, and ensure funding for the implementation of considering and presenting the "Volunteer Youth Medal" in accordance with current laws.

4. Responsibilities for proposing commendation:

a) The Chairman of the People's Committee of the commune shall be responsible under the law for the procedures and contents of the file submitted to the Chairman of the People's Committee of the province, including: Files, procedures, conditions, standards, processes, accuracy of achievements, and other relevant contents related to implementing the Party's policies and state laws.

b) The Chairman of the People's Committee of the province shall be responsible under the law for the procedures and contents of the file submitted to the Prime Minister, including: Files, procedures, conditions, standards, processes, accuracy of achievements, and other relevant contents related to implementing the Party's policies and state laws.

Article 15. Responsibilities of organizations and entities in commendation work

1. The Ministry of Home Affairs shall be responsible for organizing guidance, urging, and inspecting the implementation of work related to considering and presenting the "Volunteer Youth Medal" and advising the Government on summarizing the work of considering and presenting the "Volunteer Youth Medal".

2. The Ministers, Heads of ministerial-level agencies, and government-affiliated agencies within their respective duties and powers shall be responsible for directing, guiding, promoting, and organizing the implementation of legal regulations on considering and presenting the "Volunteer Youth Medal"; coordinating with the Ministry of Home Affairs and related agencies during the implementation process.

3. The Vietnam Association of Former Volunteer Youth shall organize the promotion and dissemination of regulations on considering the "Volunteer Youth Medal" to members at all levels; guide levels of the Association to cooperate with related agencies, organizations, and units in guiding members to declare, establish files, and propose confirmation of their service in volunteer youth units during resistance wars and national defense; participate in confirming and certifying the service of volunteer youth when requested by competent authorities.

4. News and communication agencies shall be responsible for promoting the Party's policies and state laws on commendation and presenting the "Volunteer Youth Medal"; promptly reflecting and combating violations of laws on commendation.

5. Organizations, entities, and units providing advisory and support services for competition and commendation work shall be responsible for guiding, urging, and inspecting the implementation of work related to considering and proposing the presentation of the "Volunteer Youth Medal"; receiving, examining, and reviewing files within their authority; submitting to the competent authority for decisions on commendation.

Article 16. Funding for the organization and implementation of awarding and posthumously awarding Medals

The funding for the organization and implementation of awarding and posthumously awarding the "Brave Volunteer Medal" shall be carried out in accordance with the provisions of the law on competition and rewards.

Article 17. Guidelines for rewarding achievements in resistance wars and national defense

The rewarding of achievements in resistance wars and national defense for individuals, groups, and families meeting the conditions and criteria shall continue to be implemented according to the documents and legal system stipulating rewards for achievements during the resistance period and national defense that remain in effect.

Chapter IV

AWARDS AND RECOGNITION OF BUSINESS PERSONS, BUSINESSES, AND OTHER ECONOMIC ORGANIZATIONS

Section 1

OBJECTS, PRINCIPLES, SCOPE, TIME PERIOD, AUTHORITY FOR AWARDS AND RECOGNITION OF BUSINESS PERSONS, BUSINESSES, AND OTHER ECONOMIC ORGANIZATIONS

Article 18. Objects for awards and recognition

1. Authorities with the right to organize awards and recognition for business persons, businesses, and other economic organizations include:

a) Ministries, ministerial-level agencies, government agencies; central agencies of political-social organizations, the Vietnam Chamber of Commerce and Industry (hereinafter referred to as ministries, sectors, and central mass organizations);

b) People's Committees of provinces and centrally-administered cities (hereinafter referred to as provincial People's Committees).

2. Objects eligible for awards and recognition:

a) Business persons are Vietnamese or foreign nationals engaged in production and business activities within the territory of Vietnam in accordance with the law;

b) Enterprises belonging to various economic sectors and other economic organizations engaged in production and business activities in accordance with Vietnamese law.

Article 19. Principles for organizing awards and recognition

1. The principles for organizing awards and recognition shall be implemented in accordance with Clause 2 of Article 81 of the Law on Competition and Rewards.

2. The titles and awards given to business persons, enterprises, and other economic organizations as stipulated in this Decision are not forms of rewards prescribed in the Law on Competition and Rewards and shall not serve as grounds for calculating achievements when granting state-level rewards.

3. Authorities with the right to organize awards and recognition for business persons, enterprises, and other economic organizations shall have the responsibility to publicly announce the regulations on awarding and the results of awarding titles and awards on their official websites for the people and business community to monitor and supervise.

Article 20. Scope and time period for organization

1. Scope of organization

a) The scope of nationwide organization for awards and recognition includes titles and awards organized by central ministries, sectors, mass organizations, inter-ministerial bodies, or inter-provincial bodies; participants are business persons, enterprises, and other economic organizations throughout the country. Inter-provincial activities must obtain written approval from the higher-level state management agency on competition and rewards and strictly adhere to the organizational regulations issued by the central authority;

b) The scope of provincial-level organization for awards and recognition includes titles and awards organized by provincial People's Committees; participants are business persons, enterprises, and other economic organizations registered in the province under the jurisdiction of the provincial level.

2. Time period for organization

a) The time period for nationwide organization for awards and recognition is every three years;

b) The time period for provincial-level organization for awards and recognition is every two years;

c) The next organization period starts from the date of the award ceremony of the previous organization period.

Article 21. Competence to decide on organizing the recognition and awarding of titles and prizes

1. The head of central ministries, sectors, and mass organizations decides on organizing the recognition and awarding of titles and prizes to business owners, enterprises, and other economic organizations under their sector, field, and scope of management.

2. The Chairman of the People's Committee of a province decides on organizing the recognition and awarding of titles and prizes to business owners, enterprises, and other economic organizations registered for business within the provincial management scope.

3. The Chairman of the Vietnam Chamber of Commerce and Industry decides on organizing the recognition and awarding of titles and prizes to business owners, enterprises, and other economic organizations within the Chamber’s scope and functions.

Section 2

RIGHTS AND RESPONSIBILITIES OF BUSINESS OWNERS AND ENTERPRISES; FUNDS FOR THE RECOGNITION AND AWARDING OF TITLES AND PRIZES TO BUSINESS OWNERS AND ENTERPRISES AND OTHER ECONOMIC ORGANIZATIONS

Article 22. Rights and responsibilities of business owners, enterprises, and other economic organizations receiving titles and prizes

1. They have the right to receive Cups, Certificates, and monetary awards (if applicable), as specified and certified by the organization conducting the recognition and awarding of titles and prizes. They may use and exploit the commercial trademark of the title and prize according to the regulations of the Award Granting Regulation without causing confusion about the nature, quality of products or services, or violating advertising regulations.

2. They must maintain and enhance their achievements, not to abuse the awarded titles and prizes to commit acts that violate the law. In case of law violations that negatively impact the reputation of the title and prize, the competent authority organizing the recognition and awarding as stipulated in Article 21 of this Decision has the right to revoke the awarded title and prize.

Article 23. Organizing funds

1. The funds for organizing the recognition and awarding of titles and prizes are formed from state budget sources and other legitimate funding sources. The mobilization and utilization of other legitimate funding sources must follow the principle of voluntariness and cannot be organized in the form of mandatory fees for participants in the recognition and awarding of titles and prizes.

2. The management and use of funds as stipulated in Clause 1 of this Article shall be carried out in accordance with the provisions of the law and used publicly for the organization of the awarding of titles and prizes.

Section 3

CONDITIONS FOR PARTICIPATION; FILES, PROCEDURES, AND ORGANIZATION OF THE RECOGNITION AND AWARDING OF TITLES AND PRIZES TO BUSINESS OWNERS, ENTERPRISES, AND OTHER ECONOMIC ORGANIZATIONS

Article 24. Conditions for participation of business owners

1. Possess good moral qualities, strictly implement the Party's guidelines and policies, state laws, internal regulations, and rules of the agency, organization, and place of residence.

2. Hold a stable managerial position in enterprises and other economic organizations for at least five years when participating in titles and prizes of central ministries, sectors, mass organizations, and social-professional organizations, and for at least three years when participating in the recognition and awarding of titles and prizes of provinces and centrally-administered cities (as of the date of submitting the application dossier). In cases where business owners manage multiple different enterprises or change jobs, the time spent managing these enterprises and other economic organizations can be accumulated to meet the conditions for participating in the awarding of titles and prizes.

3. Actively study to improve their business management skills and capabilities.

4. Have innovative ideas, management measures, or applications of science and technology, digital transformation in production and business operations that are effective; make many creative changes in production and business activities, contributing to improving productivity, product quality, and competitive capacity of enterprises and other economic organizations.

5. Pay attention to training and improving the qualifications and skills of workers, enhancing the quality of human resources for enterprises and other economic organizations. Fully implement all worker benefits as prescribed by law.

6. Actively participate in competition movements, contribute support, and fulfill corporate social responsibility in the locality; pay attention to developing Party organizations, trade unions, and mass organizations (if any) within enterprises and other economic organizations.

7. Enterprises and other economic organizations managed by business owners must comply with legal regulations; have stable revenue, profits, tax payments to the state budget, and worker income (not lower than the average income level of the industry or field); and achieve positive growth. These stability and growth indicators must be detailed in the Award Granting Regulations of the organizing agencies and units. There should be no complaints, accusations, lawsuits, strikes, collective stoppages; and there should be no fatal workplace accidents.

Article 25. Conditions for participation of enterprises and other economic organizations

1. Comply with all conditions according to the industry and profession registered or granted investment permits, laws on enterprises, investment, labor, land, construction, environmental protection, intellectual property, product quality, goods, and other relevant legal provisions related to production and business activities.

2. Production and business activities generate profits, stable state budget contributions, and positive growth. Profitability, budget contributions, and growth indicators must be quantified in the regulations on awarding titles and prizes of the organizing agencies and units.

3. Have innovative ideas, technical improvements, or apply science and technology, digital transformation effectively in production and business; make many innovations and creative changes in production and business activities, contributing positively to the overall development of society and the country.

4. Fully comply with financial obligations, taxes, and other state budget revenues as prescribed by law; actively contribute to the state budget and social welfare funds.

5. Ensure stable employment and income levels not lower than the average income level of the industry or sector for workers; fully and promptly implement social insurance, health insurance, unemployment insurance, and other policies and laws related to workers.

6. Effectively carry out social security work, actively participate in and contribute to mass movements initiated by ministries, sectors, localities, or the central government; actively develop Party organizations, Trade Union organizations, and mass organizations (if any) within enterprises and other economic organizations.

7. Not subject to complaints, accusations, lawsuits, strikes, or collective stoppages; no fatal workplace accidents.

Article 26. Documents and Procedures for Nationwide Organization

1. Documents

a) Proposing documents from agencies, organizations, and units under ministries, sectors, and central mass organizations;

b) The organizational plan, including the following contents: Name of title, name of prize, and organization content; purpose and requirements of the organization; proposed time and location (the location must ensure fire prevention and security); scope and form of organization; number and structure of titles and prizes; composition of the Organizing Committee and the Awarding and Honoring Council, specifying the number, structure, components, functions, and tasks of the Organizing Committee and the Awarding Council. The head of the Organizing Committee and the Chairman of the Awarding Council are leaders of central ministries, sectors, mass organizations, social-professional organizations, or provincial-level city leaders. Members of the Awarding Council include representatives of relevant agencies, experts knowledgeable and qualified in the industry, field, and content of the title and prize; financial plans, clearly stating sources of revenue, revenue principles, expenditure principles, expenditure content; financial management responsibilities and implementation organization. Commitment of the organizing unit not to charge any fees from participating businessmen and enterprises in any form.

c) Regulations on awarding titles and prizes, stipulating: Industry, participants, award criteria (criteria must be consistent with the name and content of the title and prize and consistent with the conditions specified in Articles 24 and 25 of this Decision), methods of organizing the awarding of titles and prizes, and specific provisions regarding cases where awarded titles and prizes are revoked.

2. PROCEDURE

a) Documents submitted to the head of the central ministry, sector, or mass organization through the agency responsible for implementing commendation and reward work at the ministerial level;

b) Within ten working days from the date of receiving complete documents as prescribed, the agency responsible for implementing commendation and reward work at the ministerial level shall review and submit to the head of the central ministry, sector, or mass organization for decision.

3. In cases where central ministries, sectors, or mass organizations have issued Decisions promulgating regulations on organizing the awarding of titles and prizes to businessmen, enterprises, and other economic organizations that comply with the provisions of this Decision, the organization of the awarding of titles and prizes shall be carried out in accordance with the regulations of the central ministries, sectors, or mass organizations.

4. The head of the central ministry, sector, or mass organization decides on the organization and is responsible for organizing the awarding of titles and prizes to businessmen, enterprises, and other economic organizations within their management scope.

Article 27. Documents and procedures for organizing at provincial level

1. Documents:

a) A proposal document from departments, agencies, and sectors under the province or city;

b) An organizational project in accordance with point b, Clause 1, Article 26 of this Decision. It must clearly state: industry, participants, criteria for awarding honors and prizes, methods and procedures for granting honors and prizes. Commitment to not collect any fees from participants in any form.

2. Procedures:

a) The dossier shall be submitted to the Chairman of the Provincial People's Committee through the specialized agency responsible for commendation and reward work at the provincial level;

b) Within ten working days from the date of receiving the complete dossier as prescribed, the specialized agency responsible for commendation and reward work at the provincial level shall review and submit to the Chairman of the Provincial People's Committee for decision.

3. In cases where the Provincial People's Committee has issued a Decision promulgating regulations on organizing the assessment and bestowing honors and prizes to business owners and enterprises in compliance with the provisions of this Decision, the organization of such assessments and bestowals shall be carried out in accordance with the regulations of the Provincial People's Committee.

4. The Chairman of the Provincial People's Committee decides on the organization and bears responsibility for the organization of the assessment and bestowal of honors and prizes to business owners, enterprises, and other economic organizations within their management scope.

Article 28. Organization of assessment and bestowal of honors and prizes

1. After making a decision to organize the bestowal of honors and prizes to business owners, enterprises, and other economic organizations, relevant agencies, units, and mass media shall carry out propaganda work and organize related activities concerning the assessment and bestowal of honors and prizes.

2. Agencies and units organizing the assessment and bestowal of honors and prizes to business owners, enterprises, and other economic organizations shall comply with the provisions of the law, organizational projects, and regulations on bestowal; seek opinions from relevant agencies and the public via mass media regarding participating business owners, enterprises, and other economic organizations; compile and explain feedback and publicly announce the results of the assessment and bestowal of honors and prizes on the website of the agency or unit.

3. The bestowal of honors and prizes to business owners, enterprises, and other economic organizations by central ministries, sectors, and mass organizations shall be presented by leaders of these entities; honors and prizes at the provincial or municipal level shall be presented by leaders of the respective provinces or cities.

Article 29. Suspension of the organization of assessment and bestowal of honors and prizes

1. Agencies and units shall be suspended from organizing the assessment and bestowal of honors and prizes to business owners, enterprises, and other economic organizations if they commit any of the following acts:

a) Organizing the assessment and bestowal of honors and prizes without permission from the competent authority;

b) Submitting false documents to request permission from the competent authority to organize the assessment and bestowal of honors and prizes;

c) Organizing the assessment and bestowal of honors and prizes contrary to the approved project and regulations on the assessment and bestowal of honors and prizes for business owners, enterprises, and other economic organizations;

d) Engaging in fraudulent or coercive behavior to force business owners, enterprises, and other economic organizations to participate in the assessment and bestowal of honors and prizes;

đ) Raising funds from individuals and organizations participating in the selection and assessment process for honors and prizes, including mandatory participation fees, compulsory sponsorships, or other undisclosed revenue sources.

2. Based on the conclusion of the competent authority, the advisory agency responsible for commendation and reward work at the ministry level shall submit to the head of the ministry for suspending the organization of national-level honors and prizes; the advisory agency responsible for commendation and reward work at the provincial level shall submit to the Chairman of the Provincial People's Committee for suspending the organization of provincial-level honors and prizes.

3. The dossier for requesting suspension includes:

a) A report from the commendation and reward work agency at the provincial or ministry level;

b) The conclusion of the competent authority regarding the violations committed by the agency or unit organizing the assessment and bestowal of honors and prizes to business owners, enterprises, and other economic organizations.

4. Suspension procedure:

a) Not more than fifteen working days from the date of the conclusion on the violation of laws in organizing honors and prizes for business owners, enterprises, and other economic organizations, the inspection team or the competent authority shall send the conclusion to the specialized agency responsible for commendation and reward work at the ministry or provincial level;

b) Within ten working days from the date of receipt of the conclusion on the violation of laws, the specialized agency responsible for commendation and reward work at the ministry or provincial level shall submit to the head of the central ministry, sector, or mass organization or the Chairman of the Provincial People's Committee for deciding to suspend the organization of the assessment and bestowal of honors and prizes to business owners, enterprises, and other economic organizations.

5. After being suspended, the agency or unit must immediately stop organizing the assessment and bestowal of honors and prizes and revoke the results of the bestowal of honors and prizes already implemented and compensate for any damages (if any) to related organizations and individuals in accordance with the law.

Article 30. Revocation of Results of Commendation and Awarding of Titles and Prizes

1. Businessmen, businesses, and other economic organizations shall have their results of commendation and awarding of titles and prizes revoked if they commit any of the following acts:

a) Falsely declaring achievements to participate in the commendation and awarding of titles and prizes;

b) Misusing awarded titles and prizes to commit acts violating the law;

c) Committing acts violating the law during the period for calculating achievements for the purpose of commendation and awarding of titles and prizes to the extent that criminal responsibility is pursued.

2. Based on the conclusion of the competent authority regarding false declaration of achievements or acts violating the law by businessmen, businesses, and other economic organizations, within fifteen working days from the date of receipt of the conclusion, the organization or unit responsible for awarding titles and prizes shall issue a decision to revoke the results of the awarding, recover the Cup, Certificate, and monetary prize (if any) already given to the businessman, business, or other economic organization, and publicly announce this with the media.

Article 31. Responsibilities of Ministries, Departments, Provincial People's Committees, and Related Organizations in the Process of Commending and Awarding Titles and Prizes to Businessmen, Businesses, and Other Economic Organizations

1. Ministries, ministerial-level agencies, provincial people's committees shall perform state management over the process of commending and awarding titles and prizes to businessmen, businesses, and other economic organizations within their respective duties and powers. They shall implement the commendation and awarding of titles and prizes to businessmen, businesses, and other economic organizations in accordance with this Decision. At the same time, they shall be responsible for regularly or randomly inspecting and supervising the process of commending and awarding titles and prizes to promptly detect and handle violations according to Articles 29 and 30 of this Decision.

2. Central agencies of political-social organizations shall implement regulations on organizing the commendation and awarding of titles and prizes to businessmen, businesses, and other economic organizations within their respective duties and powers in accordance with this Decision.

3. Mass media agencies shall be responsible for publicizing and disseminating legal provisions on the process of commending and awarding titles and prizes to businessmen, businesses, and other economic organizations; identifying and publicizing exemplary models among businessmen, businesses, and other economic organizations. They shall not organize broadcasts or news reports on cases of commending and awarding titles and prizes to businessmen, businesses, and other economic organizations contrary to legal provisions.

Chapter V

SAMPLES OF MEDALS, BADGES, AND MEMORIAL BADGES; SAMPLES OF AWARDS FOR COMPETITIVE TITLES AND REWARD FORMS; SAMPLES OF NATIONAL HONOR AWARDS AND COMPETITIVE FLAGS; SAMPLES OF FRAMES, BOXES, FLAGS FOR COMPETITIVE TITLES AND REWARD FORMS; PROCEDURES FOR ISSUING REPLACEMENTS AND REISSUANCES OF REWARD ITEMS

Section 1

SAMPLES OF MEDALS, BADGES, AND MEMORIAL BADGES; SAMPLES OF FRAMES, BOXES, FLAGS FOR COMPETITIVE TITLES AND REWARD FORMS

Article 32. Sample of Medal

1. Medals under Article 33 of the Law on Competition and Reward consist of ten types, five of which do not have grades and five of which have grades. The graded type is divided into three grades and distinguished by the number of stars attached to the ribbon and medal stem (Grade One has three stars, Grade Two has two stars, and Grade Three has one star).

2. The structure of the Medal consists of three parts: the Medal Stem, the Ribbon, and the Medal Body.

The sample of the Medal is illustrated in Appendix II.1 accompanying this Decision.

Article 33. Model of Medal

1. The Medals under Article 54 and Clause 2 of Article 96 of the Law on Competition and Rewards consist of five types, of which one type is divided into grades and four types are not divided into grades. The type that is divided into grades is divided into three grades and distinguished by the number of stripes on the ribbon and medal bar (First Grade with three stripes, Second Grade with two stripes, Third Grade with one stripe).

2. The structure of the Medal consists of three parts: the Medal Bar, the Ribbon, and the Medal Body.

The model of the Medal is illustrated in Appendix II.1 attached to this Decision.

Article 34. Model of Emblem for State Honorary Titles, "National Outstanding Worker", and Commemorative Medal

1. The emblem for state honorary titles and the "National Outstanding Worker" emblem consist of two parts: the Emblem Bar and the Emblem Body.

The emblem for state honorary titles and the "National Outstanding Worker" emblem are illustrated in Appendix II.1 attached to this Decision.

2. Commemorative Medal of the Standing Committee of the National Assembly, ministries, agencies, provincial-level authorities, political organizations, political-social organizations, occupational-political-social organizations, social organizations, and occupational-social organizations affiliated with the Communist Party within the Vietnam Fatherland Front Central Mass Organizations.

a) The structure of the Commemorative Medal consists of two parts: the Commemorative Medal Bar and the Commemorative Medal Body;

b) The model of the Commemorative Medal shall be determined by the Standing Committee of the National Assembly, ministries, agencies, provincial-level authorities, political organizations, political-social organizations, occupational-political-social organizations, social organizations, and occupational-social organizations affiliated with the Communist Party within the Vietnam Fatherland Front Central Mass Organizations, in accordance with the significance of each field, profession, and locality.

Article 35. Model of "Golden Star Order"

1. The Order Bar: Core made of red brass plated with gold-nickel-cobalt alloy; dimensions 28 mm x 14 mm; outer edge gold-colored, wrapped in polyester fabric or equivalent material, ensuring durability and beauty with two colors: half left side red flag color, half right side gold.

2. The Order Ribbon: Shaped like stylized letter A, core made of stainless steel plated with gold-nickel-cobalt alloy, wrapped in polyester fabric or equivalent material, ensuring durability and beauty with two colors: half left side red flag color, half right side gold; dimensions 28 mm x 51 mm x 41 mm x 51 mm.

3. The Order Body: Five-pointed star shape embossed, diameter of circumscribed circle of star points 55 mm, center circular background gold with a five-pointed star, surrounded by the inscription "Golden Star Order", "Vietnam" in red; material made of red brass plated with gold-nickel-cobalt alloy.

Article 36. Model of "Ho Chi Minh Order"

1. The Order Bar: Core made of red brass plated with gold-nickel-cobalt alloy; dimensions 28 mm x 14 mm; outer edge gold-colored, wrapped in polyester fabric or equivalent material, ensuring durability and beauty in red flag color, with two gold stripes.

2. The Order Ribbon: Shaped like stylized letter A, core made of stainless steel plated with gold-nickel-cobalt alloy, wrapped in polyester fabric or equivalent material, ensuring durability and beauty in red flag color with two gold stripes; dimensions 28 mm x 51 mm x 41 mm x 51 mm.

Article 37. Model of the "Independence Order" First Class, Second Class, Third Class

1. Article 41. Model of the "National Defense Medal" First Class, Second Class, Third Class

1. Medal Ribbon: Core made of red brass coated with gold alloy Ni-Co; dimensions 28 mm x 14 mm; outer edge gold color, wrapped in polyester fabric or equivalent material, ensuring durability and beauty in two colors: half on the left side green, half on the right side red flag color; attached star according to the class of the Medal.

2. 1. Medal ribbon: Rectangular shape, core made of stainless steel with Ni-Co gold plating, covered with polyester fabric or equivalent material including two colors: Green/Blue and Red/Red. Two parallel green stripes with dimensions 4 mm x 11 mm, green stripes are 2 mm away from both right and left edges; size 28 mm x 14 mm. In the center of the medal ribbon is a 3D red bronze star with Ni-Co gold plating.

2. Medal strip: Pentagon shape, core made of stainless steel with Ni-Co gold plating, covered with polyester fabric or equivalent material including two colors: Green/Blue and Red/Red. 1. Form:

a) Certificate size is printed on A3 paper (dimensions 420 mm x 297 mm); external decorative border size is 360 mm x 237 mm;

b) Decorative patterns around the border:

The border and four corners outside the border are decorated with floral patterns. Specifically, certificates for medals and state honorary titles "outstanding", "Prime Minister's Commendation", and "National Striver" certificate do not have floral patterns in the four corners outside the border.

In the center at the top is the Emblem of the Socialist Republic of Vietnam, with transitional floral blocks between the Emblem and the decorative border on both sides. Specifically, the "National Striver" certificate uses red flags on both sides instead of transitional floral blocks.

The image of the medal or badge is placed in the center below the decorative border. Specifically, the "Ho Chi Minh Medal" uses a lotus flower image instead of the medal body image.

The decorative border around: Uses images directly similar to common and representative tools of the Vietnamese Volunteer Youth Force such as shovels, picks, bicycles, AK rifles... combined with book and gear wheel, rice ear images representing scientific and technical significance with the spirit of "fighting and productive labor".

Background of the Certificate uses decorative patterns and structure of Dong Son drums - symbolizing Vietnamese culture and ethnicity.

2. Content:

1. Form:

a) Size: The certificate is printed on paper with dimensions of 360 mm x 237 mm;

b) Decorative patterns around the border:

The decorative border is adorned with floral patterns but must not resemble or be similar to certificates of merit awarded at the state level.

In the center at the top is the Emblem of the Socialist Republic of Vietnam; for certificates of merit and certificates recognizing outstanding soldiers issued by central Party bodies, political organizations, and socio-political organizations at the provincial level, the emblem is replaced by the symbol of the issuing agency or organization. There are no floral patterns at the four corners outside the decorative border and no transitional floral pattern between the emblem and the decorative border. For certificates recognizing outstanding soldiers, there are additional red flags on both sides of the emblem or the symbol of the agency or organization.

c) Background color of the certificate is determined by the competent authority issuing the decision to ensure it does not resemble the background of certificates presented by the President of the State and the Prime Minister.

The border is decorated with floral patterns but must not resemble or be similar to the patterns on national-level certificates of merit.

In the center at the top is:

The Emblem of the Socialist Republic of Vietnam for Certificates of Merit and the Medal "Model Worker at the Grassroots Level" awarded by the heads of agencies, units under ministries, ministerial-level agencies, government agencies, specialized agencies under provincial people's committees, heads of specialized agencies at the provincial level, and chairpersons of village-level people's committees.

The emblem of organizations for Certificates of Merit and the Medal "Model Worker at the Grassroots Level" awarded by political organizations, political-social organizations, social organizations, and Certificates of Merit awarded by the Chairperson of the Board of Directors, Chairperson of the Board of Members, General Director, or Director of enterprises or cooperatives.

For the Medal "Model Worker at the Grassroots Level," there are additional red flags on both sides of the Emblem or organizational emblems.

There are no floral patterns at the four corners outside the border and the transitional floral pattern between the Emblem and the border.

For Certificates of Merit and Medals "Model Worker at the Grassroots Level" awarded by Party organizations, the National Emblem is replaced by the line "VIETNAM COMMUNIST PARTY" in uppercase letters, upright bold typeface, black color.

b) The third line records the title of the person authorized to decide on the award; in uppercase letters, upright style, bold red color;

c) The fourth line: Reads "PRESENTED" for Certificates of Merit, "AWARDED THE TITLE" for Medals "Model Worker at the Grassroots Level"; in uppercase letters, upright bold typeface, black color.

d) The fifth line records the form of the award or the title of excellence; in uppercase letters, upright style, bold red color;

d) Subsequent lines: Record the name of the unit or individual being honored; address (or position and unit of work for individuals currently working in agencies or units, or the managing agency for groups), achievements of the group or individual being honored; in black color.

e) On the left side at the bottom: "Decision number, date" recorded according to the number, date, month, year of issuance of the decision; "Golden book number" placed below the decision number recording the serial number of the awardee in the decision; the text of the two lines is in lowercase, italic, bold, black color;

g) On the right side at the bottom: Records the place name, date, month, year; in lowercase, italic, bold, black color.

Below the place name is the line recording the position of the person authorized to make the award decision; in uppercase letters, upright bold typeface, black color.

h) Space for signature, stamp, and recording the full name of the person authorized to decide on the award.

Article 62. Model of Commemorative Medal of the Standing Committee of the National Assembly, Commemorative Medal of Ministries, Departments, and Provinces; Certificate of Recognition "Cultural Family"

The Commemorative Medal of the Standing Committee of the National Assembly, Commemorative Medal of Ministries, Departments, and Provinces is printed on paper with dimensions of 360 mm x 237 mm.

The Certificate of Recognition "Cultural Family" is printed on A5 paper with dimensions of 210 mm x 148 mm.

The content and decorative floral patterns on the certificate are specified by the Standing Committee of the National Assembly, Ministries, Departments, and Provinces.

Article 63. Model of Certificate of Title "Outstanding Labor Collective", "Victory Unit"; Outstanding Commune, Ward, Special Administrative Region; Cultural Village, Neighborhood

1. Form:

a) Size: The certificate is printed on A4 paper with dimensions of 297 mm x 210 mm;

b) Decorative patterns around the border:

The border is decorated with floral patterns that must not resemble or be similar to those of national-level certificates of merit.

In the center at the top is the Emblem of the Socialist Republic of Vietnam and two red flags on either side (for certificates issued by the Minister, head of a ministerial-level agency, government agency, Chief Justice of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy, Director of the Office of the National Assembly, Director of the Office of the President, State Auditor General, Chairman of the Provincial People's Committee, Village People's Committee, and heads of agencies and units authorized by the Ministry of Defense); or the emblem of organizations and two red flags on either side (for certificates issued by the heads of Central Party Committees and equivalent bodies, Secretary-General of the Central Party Secretariat, leaders of the Central Committee of the Vietnam Fatherland Front, and mass organizations).

c) The background color is white.

2. Content:

The content is specified by the awarding authorities. Layout, font style, and size should ensure aesthetic appeal and include the following main elements:

a) The first and second lines record:

The National Emblem "SOCIALIST REPUBLIC OF VIETNAM" presented in uppercase letters, upright bold typeface, black color.

The slogan "INDEPENDENCE - FREEDOM - HAPPINESS" presented in lowercase letters, upright style, bold black color, and placed directly below the national motto; the first letter of each phrase is capitalized, hyphenated between phrases, with spaces; below this is a solid horizontal line equal in length to the line of text.

For titles issued by the heads of Central Party Committees and the Secretary-General of the Central Party Secretariat, the National Emblem and Motto are replaced by the line "VIETNAM COMMUNIST PARTY" in uppercase letters, upright bold typeface, black color.

b) The third line records the title of the person authorized to decide on the award; in uppercase letters, upright style, bold red color;

c) The fourth line: Indicates the nature of the award: Reads "AWARDED THE TITLE" in uppercase letters, upright bold typeface, black color.

d) The fifth line: Records the title of the award; in uppercase letters, upright bold typeface, red color.

d) Subsequent lines record the name of the unit receiving the award; address (or managing agency for groups), achievements of the group being honored; in black color.

e) On the left side below: Is the "Decision number, date" recorded according to the number, date, and year of issuance of the decision; "Golden Book Number" placed below the decision number, recording the serial number of the recipient in the decision; text of the two lines in lowercase letters, italic bold typeface, black color.

g) On the right side at the bottom: Records the place name, date, month, year; in lowercase, italic, bold, black color.

Immediately below the place name is the line recording the position of the person authorized to make the award decision; in uppercase letters, upright bold typeface, black color.

h) Space for signature, stamp, and recording the full name of the person authorized to decide on the award.

Article 64. Model of the "Hero Province" Flag, the "Hero City" Flag, the "Heroic Military Forces" Flag, the "Heroic Labor" Flag

Clause 1. Form: The flag has dimensions of (850 mm x 650 mm); material: two-layer silk fabric in red color.

Clause 2. Embroidery content: The flag is embroidered with yellow thread, capital letters, upright font style, bold, font type and size adjusted according to the content of the flag to ensure beauty, solemnity, and includes the following main contents:

Point a) First line: "PRESIDENT OF THE SOCIALIST REPUBLIC OF VIETNAM"; capital letters, upright bold font style;

Point b) Second line: "AWARDING THE TITLE"; capital letters, upright bold font style;

Point c) Below the second line, in the center is a five-pointed golden star;

Point d) Below the star, record the title ("HEROIC LABOR" or "HEROIC MILITARY FORCES" or "HERO PROVINCE" "HERO CITY"), capital letters, upright bold font style, and finally the line "(name of the unit being awarded)".

The model of the flag is illustrated in Appendix II.3 attached to this Decision.

Article 65. Model of the "Flag of Excellence Awarded by the Government"

Clause 1. Form: The flag has dimensions of (850 mm x 650 mm); material: two-layer silk fabric in red color.

Clause 2. Embroidery content: The flag is hand-embroidered with yellow thread, capital letters, upright font style, bold, font type and size adjusted according to the content of the flag to ensure beauty, solemnity, and includes the following main contents:

Point a) First line: "GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIETNAM"; capital letters, upright bold font style;

Point b) Second line: "AWARDING"; capital letters, upright bold font style;

Point c) Below the second line, in the center is a five-pointed golden star;

Point d) Below the star is "(name of the unit receiving the Flag of Excellence Awarded by the Government)" and the line "OUTSTANDING UNIT IN THE COMPETITION MOVEMENT YEAR OR COMPETITION MOVEMENT"; the year recorded is the year when the unit achieved outstanding results for the award, the competition movement recorded is the movement launched by the Prime Minister; capital letters, upright bold font style.

The model of the flag is illustrated in Appendix II.3 attached to this Decision.

Article 66. Model of the Flag of Excellence of Ministries, Departments, Provincial Authorities

Clause 1. Form: The flag has dimensions of (800 mm x 600 mm); material: two-layer silk fabric in red color.

Clause 2. Embroidery content: The flag is embroidered with yellow thread, capital letters, upright font style, bold, font type and size adjusted according to the content of the flag to ensure beauty, solemnity, and includes the following main contents:

Point a) First line: "(record the name of the ministry, department, central mass organization, province, centrally governed city)"; capital letters, upright bold font style;

Point b) Second line: "AWARDING"; capital letters, upright bold font style;

Point c) Below the second line, in the center is a five-pointed golden star;

Point d) Below the star is the line "(name of the unit receiving the Flag of Excellence)" and the line "LEADING UNIT IN THE COMPETITION MOVEMENT YEAR OR COMPETITION MOVEMENT", the year recorded is the year when the unit achieved outstanding results for the award, the competition movement recorded is the movement launched by the ministry, department, provincial authority; capital letters, upright bold font style.

Article 67. Model of the Flag of Excellence of Military Regions, Services, Corps, Arms, General Departments and Equivalent Units under the Ministry of National Defense, State Cryptographic Agency; Flag of Excellence of National University

Clause 1. Form: The flag has dimensions of (750 mm x 550 mm); material: two-layer silk fabric in red color.

Clause 2. Embroidery content: Defined by the Ministry of National Defense and the Ministry of Education and Training.

Article 68. Model of the Frame for the Certificate of Merit Title, Reward Form

The frame is issued together with the certificate of various reward forms and merit titles. The model of the frame is defined as follows:

Clause 1. The frame of certificates of reward forms and merit titles within the purview of the President and the Prime Minister have dimensions and materials ensuring beauty, solemnity, and suitability with the size of the certificate and the reward form.

Clause 2. The frame of certificates of other reward forms and merit titles is defined by the competent authority issuing the reward decision, ensuring beauty, solemnity, and suitability with each reward form.

Article 69. Boxes for medals, orders, insignia of state honorary titles, "National Model Soldier" insignia, Commemorative Medals; Frames for certificates of commendation and awards within the authority to decide of the President, Government, Prime Minister

Clause 1. Boxes for medals, orders, insignia of state honorary titles, "National Model Soldier" insignia shall have dimensions and materials ensuring beauty and solemnity appropriate to each form of award. The lid on the outside top of the box shall bear the National Emblem.

Clause 2. Boxes for Commemorative Medals prescribed in Article 71 of the Law on Encouragement and Reward shall be regulated by the competent agency issuing decisions to present Commemorative Medals with models, dimensions, and materials ensuring beauty and solemnity.

Clause 3. Boxes for frames of certificates of commendation and awards within the authority to decide of the President, Government, Prime Minister shall have models, dimensions, and materials ensuring beauty and solemnity appropriate to the size of the frames of certificates of commendation and awards within the authority to decide of the President, Government, Prime Minister.

Section 2

PROCEDURES FOR ISSUING AND REISSUING AWARD ITEMS

Article 70. Management and distribution of award items

Clause 1. The Ministry of Home Affairs shall be responsible for purchasing, storing, and distributing national-level award items to ministries, sectors, provincial-level agencies where individuals, groups, and households have been awarded; managing, guiding, and inspecting the distribution of national-level award items by ministries, sectors, provincial-level agencies to awarded individuals, groups, and households.

Clause 2. The organization of presenting commendation titles and forms of reward by the President, Government, and Prime Minister accompanied by award items to awarded individuals, groups, and households shall be carried out by the agencies that propose rewards.

Clause 3. For other commendation titles and forms of reward decided by competent authorities, the awarding agencies shall organize the purchase, storage, presentation, and distribution of award items.

Clause 4. Individuals, groups, and households receiving commendation titles and forms of reward have the right to retain, display, store, and use award items for a long time in accordance with their purpose and significance. Groups may use symbols of awarded award items to promote in official documents and materials of the group.

Article 71. Reissuing award items

Clause 1. The application dossier for reissuing national-level award items consists of one set (original) including:

Point a) A letter requesting reissue from a group or an application for reissue from an individual or household when the award item is damaged and no longer usable due to objective reasons such as natural disasters, floods, fires, or printing errors.

Point b) A letter requesting reissue from a ministry, sector, provincial-level agency along with a list according to Model 4.5 of Appendix II.4 of this Decision sent to the Ministry of Home Affairs requesting reissue of national-level award items.

Clause 2. Procedures for reissuing national-level award items:

Point a) Groups submit letters, individuals and households submit applications for reissue (Models 4.1 and 4.2 of Appendix II.4 of this Decision) to the ministry, sector, provincial-level agency that proposed rewards for individuals, groups, and households along with the damaged award item for reissue.

Point b) Ministries, sectors, provincial-level agencies compare with stored files, confirm, compile, and send letters requesting reissue along with lists (Model 4.5 of Appendix II.4 of this Decision), and retain the old damaged award item; carry out disposal and destruction according to the law.

Point c) Confirmation of rewards and issuance of reissued award items:

Based on the letter requesting reissue of award items from ministries, sectors, provincial-level agencies, the Ministry of Home Affairs shall verify, confirm rewards, and issue reissued award items.

Reissued award items shall be purchased and printed by the Ministry of Home Affairs according to the prescribed model. For previous national-level forms of reward (currently not stipulated in the Law on Encouragement and Reward), they shall be issued according to the model at the time the group or individual was decided to be rewarded. Reissued award items shall only be issued for medals, orders, insignia, commemorative medals, and certificates of commendation and awards.

The reissue certificate model signed by leaders who have completed their term shall be printed according to the design at the time the group, individual, or household was awarded, including: the achievement statement written according to the reward decision, the right side of the certificate pre-printed with the seal and signature of the authority granting the reward at that time (the seal and signature model pre-printed are replicated from: the seal and signature in the previously awarded certificate; the reward decision; the signature introduction document of the Office of the President, the Office of the Government, the Office of the National Assembly, the Ministry of Defense; the document stipulating the seal model of the Ministry of Public Security); the left side of the certificate records "Reward Decision number, date, month, year, golden book number" and records "reissue certificate number: .../GCN-BNV". When individuals and groups receive reissued certificates, they will also receive a reissue certificate confirmation (Model 4.7, Appendix II.4 of this Decision).

The reissue certificate model signed by incumbent leaders shall be implemented according to the current certificate model. The Ministry of Home Affairs compiles a list, confirms, and requests the Office of the Government, the Office of the President to stamp the certificate.

Clause 3. Time limit for reissuing national-level award items:

Ministries, sectors, provincial-level agencies shall complete the process within 15 working days from the date of receipt of the reissue request from groups, individuals, and households and submit the dossier to the Ministry of Home Affairs.

The Ministry of Home Affairs shall complete the reissue result within 90 working days from the date of receipt of the dossier and return it to ministries, sectors, provincial-level agencies.

Article 72. Reissuing Award Objects

1. The application dossier for reissuing national award objects consists of one set (original copy) including:

a) A letter requesting reissue from a collective body or an individual's application for reissue from a household when award objects are lost or destroyed due to natural disasters, floods, fires, and such objects were previously submitted to the relevant ministry, agency, or provincial authority for awarding to individuals, collectives, or households;

b) A letter requesting reissue of national award objects from the relevant ministry, agency, or provincial authority, accompanied by a list (Form 4.6, Appendix II.4) sent to the Ministry of Home Affairs.

2. Procedures for reissuing national award objects.

a) Collectives submit letters, and individuals or households submit applications for reissue (Forms 4.3 and 4.4, Appendix II.4 of this Decision) to the relevant ministry, agency, or provincial authority that had previously recommended them for awards;

b) The relevant ministry, agency, or provincial authority will compare with the retained files, confirm, compile, and send a letter along with a list (Form 4.6, Appendix II.4 of this Decision) to the Ministry of Home Affairs;

c) Confirming the award and reissuing award objects:

Based on the letter requesting reissue of award objects from the relevant ministry, agency, or provincial authority, the Ministry of Home Affairs will search, confirm the award, and reissue award objects.

Reissued award objects shall be purchased and printed by the Ministry of Home Affairs according to the prescribed model. For previous forms of national awards not currently stipulated in the Law on Competition and Awards, they will be issued according to the model at the time the collective, individual, or household was decided to be awarded. Reissuance of award objects applies only to medals, badges, commemorative medals, and certificates of commendation.

The reissued certificate (signed by former leaders) will be printed according to the design at the time the collective, individual, or household was awarded, wherein: the achievement statement is written according to the award decision, the right bottom corner of the certificate has a pre-printed seal and signature of the authority figure who awarded at that time (the seal and signature models are reproduced from: the seal and signature in the previously awarded certificate; the award decision; the signature introduction document of the President's Office, Government Office, National Assembly Office, Ministry of Defense; the regulation on seal models of the Ministry of Public Security); the left bottom corner of the certificate records "Award Decision number, date, year, golden book number" and "reissue certificate number: .../GCN-BNV." When individuals or collectives receive the reissued certificate, they will also receive a reissue certificate confirmation (Form 4.8, Appendix II.4 of this Decision).

The reissued certificate (signed by current leaders) will follow the current certificate model. The Ministry of Home Affairs will compile a list, confirm, and request the Government Office and President's Office to stamp the certificate.

3. Timeframe for Resolving Requests for Reissuing National Award Objects

Ministries, agencies, and provinces must submit the dossier to the Ministry of Home Affairs within 15 days from the date of receiving the reissue request from individuals, collectives, or households.

The Ministry of Home Affairs must complete and return the reissue results to ministries, agencies, or provinces within 90 working days from the date of receiving the dossier.

Chapter VI

IMPLEMENTING PROVISIONS

Article 73. Effectiveness and Transitional Provisions

1. This Decision shall take effect from the date of issuance.

2. This Decision shall cease to be effective from March 1, 2027.

3. Applications for awarding and posthumously awarding the "Brave Volunteer Youth Medal" that have been submitted to the Ministry of Home Affairs or other competent authorities in accordance with the law on commendation and reward before the date this Decision takes effect shall continue to be processed according to the provisions of Decree No. 28/2024/NĐ-CP dated March 6, 2024, issued by the Government detailing the procedures and formalities for awarding and posthumously awarding the "Brave Volunteer Youth Medal" and the rewards for summarizing combat achievements.

4. For applications for honoring and presenting awards and prizes to business leaders, enterprises, and other economic organizations that have been received and accepted by competent authorities before the date this Decision takes effect, the provisions regarding time, conditions, and funding for honoring and presenting awards and prizes to business leaders, enterprises, and other economic organizations shall be applied according to the provisions of Decree No. 98/2023/NĐ-CP dated December 31, 2023, issued by the Government detailing certain provisions of the Law on Commendation and Reward.

5. From the date this Decision takes effect, for commemorative items awarded in accordance with Decree No. 85/2014/NĐ-CP dated September 10, 2014, and Decree No. 98/2023/NĐ-CP dated December 31, 2023, issued by the Government, they will continue to be distributed along with commendations and forms of reward until their stock is exhausted.

Article 74. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and municipal People's Committees, relevant agencies, organizations, units, and individuals shall be responsible for implementing this Decision./.
