RESOLUTION
The eleventh session of the Ninth National Assembly
OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM
Pursuant to Article 84 of the Constitution of the Socialist Republic of Vietnam in 1992;
On the basis of considering reports and proposals from relevant agencies of the National Assembly, the Government, and other related agencies, and opinions of National Assembly deputies;
RESOLUTION:
I. ON THE WORK OF THE NINTH NATIONAL ASSEMBLY SESSION
1- Achievements
During the Ninth National Assembly term, there have been many organizational and operational reforms, increasingly fulfilling its tasks and powers as prescribed by law. The principle of democratic centralism has been respected, democracy in the activities of the National Assembly has been promoted. The formal nature of the National Assembly's activities has gradually decreased. Public trust in the National Assembly has increased.
a) The activities of the National Assembly have been strengthened, achieving good results in many areas, especially legislative work:
The National Assembly enacted numerous laws, and the Standing Committee of the National Assembly issued many ordinances. These laws and ordinances have institutionalized the Party's policies and concretized the 1992 Constitution; contributing step-by-step to perfecting the legal system, meeting the requirements of national renewal across all political, economic, cultural, social, defense, security, and foreign affairs sectors.
Decisions on important national issues such as socio-economic matters, state budget, high-level organizational structure and personnel, administrative boundary adjustments have been implemented more effectively.
Supervisory activities have been strengthened, with relatively comprehensive content, improved forms, and a close combination between listening to reports and answering questions and sending inspection teams to ministries, sectors, localities, and some overseas representative offices. Some supervisory outcomes have contributed to reviewing, passing, or amending and supplementing legal documents.
Petitions from voters nationwide have been listened to and promptly reflected by National Assembly deputies, studied and resolved step-by-step by state agencies, and summarized for the National Assembly to consider.
Foreign relations have been carried out effectively according to the independent, self-reliant foreign policy of peace, friendship, international cooperation, and the policy of openness, diversification, and multilateralization.
b) The organization and methods of operation of the National Assembly have undergone changes:
The organization of National Assembly agencies has been reformed according to the 1992 Constitution. The quality of National Assembly deputies has improved, with a relatively reasonable composition. The number of full-time National Assembly deputies has increased. The activities of National Assembly delegations have been intensified.
National Assembly agencies have proactively closely coordinated with state agencies in preparing content for National Assembly sessions, Standing Committee meetings, and other important tasks; while conducting supervision over state agency operations.
The National Assembly has strengthened its relationship with the people, the Vietnam Fatherland Front, and member organizations. National Assembly deputies have regularly reported on the results of National Assembly activities, met with and listened to voter opinions; publicized and encouraged the people to participate in building the government and implementing National Assembly resolutions.
Relations between National Assembly agencies, National Assembly delegation, and National Assembly deputies with People's Councils and related agencies at the local level have become tighter.
2- Shortcomings and remaining issues
a) In the implementation of the National Assembly's tasks and powers, on some aspects of activity, effectiveness has not been high, still having a formalistic nature: Legislative work lacks initiative and coordination. The National Assembly does not have a program for legislative construction throughout the term, annual legislative programs often need adjustment. The quality of some laws and ordinances is not high, with some provisions only stopping at general regulations, requiring guiding documents to be implemented. Work on propaganda, explanation, dissemination, and guidance on the implementation of laws is weak.
Considering and deciding on important issues, particularly the state budget, sometimes still has a formalistic nature. The review work of National Assembly agencies in this field is limited.
Supervisory activities are weak, with low effectiveness. Many recommendations through supervisory activities have not been timely researched and resolved by responsible agencies. There is no specific supervision law to regulate mechanisms and methods.
Supervision of judicial organs in investigative, prosecution, trial, enforcement, arrest, detention, and release activities has not been adequately focused. Supervision of the implementation of National Assembly resolutions on thrift, anti-waste, anti-corruption, and anti-smuggling has achieved low results.
Handling of citizens' complaints and denunciations, although efforts have been made, still has many limitations, failing to meet public demands and aspirations.
b) Although organizational and operational methods of the National Assembly have changed, they still do not fully meet requirements:
Some National Assembly deputies do not allocate sufficient time for National Assembly activities. They do not frequently meet with voters and do not effectively carry out propaganda and mobilization work for the people to implement National Assembly resolutions.
The number of full-time National Assembly deputies is still small. National Assembly agencies lack conditions to deeply study and examine important fields such as the state budget, judicial activities, and public petition work. The method of conducting National Assembly sessions needs further improvement.
Conditions ensuring the activities of the National Assembly, National Assembly delegations, and National Assembly deputies are still limited.
3- Several issues that need attention in the future
After this session, National Assembly delegations and deputies will organize meetings with voters to report on the session's results and their responsibilities during the entire term.
Urgently complete the draft Law on the Organization of the National Assembly (amended) and the draft Education Law to prepare for submission to the Tenth National Assembly for approval; complete drafts of Ordinances on Cadres and Civil Servants, Anti-Corruption, and Thrift and Anti-Waste for approval by the Standing Committee of the Ninth National Assembly.
Continue to draw lessons from the organization and operation of the Ninth National Assembly session, on this basis make necessary recommendations to continue building and perfecting the Socialist Republic of Vietnam State.
II. ON CONTINUING TO IMPLEMENT THE TASKS FOR 1997
It is necessary to continue implementing the tasks, targets, and solutions set out in the Resolutions of the National Assembly at the tenth session, with particular emphasis on the following issues:
1- On economy
Enhance the efficiency of agricultural production linked to the development of rural economies and environmental protection. Implement policies to support capital for farmers to expand production. Establish production insurance funds and crop and livestock insurance funds. Organize well the sale of agricultural products, especially rice in the Mekong Delta.
Regarding industrial production: Continue to restructure state-owned enterprises. Create conditions for enterprises to innovate technology, improve product quality and competitiveness in domestic and foreign markets. Firmly handle state-owned enterprises that have been losing money for a long time; expand and pilot the shareholding of some enterprises firmly. Draw lessons from joint ventures and collaborations between state-owned enterprises and private businesses to gradually expand this form.
Implement the Law on Cooperatives effectively.
Vigorously promote exports, strictly control imported goods, and not guarantee deferred payment for imported consumer goods unless approved by the Government, reduce the trade deficit. Use tax, credit policies, and non-tariff measures to limit imports of non-essential items and those produced domestically. Implement the Trade Law effectively.
Mobilize domestic and foreign capital to develop infrastructure and accelerate economic growth. Build the necessary conditions to soon launch the capital market. Promote loans for production and business development. Implement a strict monetary policy to help curb inflation. Improve the quality of credit and use borrowed funds effectively. Establish a deposit insurance fund. Strengthen management of foreign currency transactions and foreign debt. Bring banking activities into order and discipline.
2- On important investment projects
a) The Government has presented the National Assembly with five important investment projects, including:
The gas-electric-ammonia program.
The first Dung Quat oil refinery project.
The flood control program in the Mekong Delta.
The five million hectare forest planting project.
The North-South expressway project.
These are important basic construction investment projects with strategic significance for the long-term development of the country, large in scale and investment capital, affecting national balances, impacting many industries, fields, economic regions, the environment, defense, and security.
The National Assembly agrees with the principle for the Government to study and prepare the above projects.
b) Assign the Government to prepare for presentation to the Tenth National Assembly:
Standards for major and important projects that the National Assembly needs to consider and decide.
Based on this, select important works to present to the National Assembly for consideration and decision.
3- On the State budget
Continue to implement the State Budget Law well. Prepare conditions to implement new Tax Laws.
Implement solutions to develop production and business to create significant revenue for the budget. Improve methods of managing revenue, enhance the effectiveness of the tax collection machinery, fees, and charges. Strengthen inspection and audit work, prevent revenue loss. Ensure the principle that if revenue does not meet the budget estimate, corresponding expenditure must be reduced.
Implement budget expenditure control according to the State budget estimate. Strictly manage and implement savings in budget spending units and state-owned enterprises. Promptly amend and supplement expenditure systems and standards for each field.
Take strong and resolute measures to deal with financial management violations to recover revenue for the budget.
4- On culture and society
Implement the tasks of developing education and training, science and technology in the spirit of Resolution No. 2 of the Central Committee. Promote socialization while ensuring state budget investment in education, health, and culture; at the same time, ensure social equity in these areas. Implement preferential policies for people with meritorious service. Strengthen activities to repay debts and benefits, practically commemorate the 50th anniversary of the day of wounded soldiers and martyrs. Vigorously combat social evils, particularly drug trafficking and involving children in social evils. Develop comprehensive policies and solutions to effectively address the issue of free migration.
5- On national defense and security
Strengthen the construction of the whole-people national defense and people's security; improve the quality of the people's armed forces to firmly protect the independence, security, sovereignty, and territorial integrity of the country.
Effectively implement the ordinances on civilian defense, reserve mobilization, and border guard forces.
Vigorously promote mass movements to protect national security, closely combining with law enforcement agencies to maintain public order and safety.
Prevent and punish effectively all criminal activities, especially corruption.
III. ON CIVIL TRANSACTIONS RELATING TO HOUSING ESTABLISHED BEFORE JULY 1, 1991
At this session, the National Assembly discussed and provided opinions on civil transactions relating to housing established before July 1, 1991. The National Assembly recognizes that it is necessary to regulate these civil transactions and they must be resolved step-by-step firmly to ensure the interests of the State, the rights and legitimate interests of citizens. The National Assembly assigns the Government, based on the opinions of National Assembly deputies, to continue researching and surveying to submit to the Standing Committee of the National Assembly for issuance of a Resolution regulating civil transactions concerning privately owned housing established before July 1, 1991, including:
Renting housing;
Borrowing or allowing others to reside in housing;
Buying and selling housing;
Exchanging housing;
Giving or donating housing;
Inheriting housing;
Managing unoccupied housing between individuals.
IV. ON THE WORK OF ELECTIONS FOR MEMBERS OF THE NATIONAL ASSEMBLY, TERM X
The election for members of the National Assembly, Term X, has significant political importance, allowing the people throughout the country to choose worthy representatives who embody their will and aspirations at the highest state power organ. Organizing this election well contributes to promoting the people's right to mastery, continuing to build and perfect the Socialist Republic of Vietnam - a state of the people, by the people, for the people.
The Standing Committee of the National Assembly is responsible for chairing the election for members of the National Assembly, Term X, together with the Government and the Central Committee of the Vietnam Fatherland Front to guide the implementation and widely publicize the Law on Elections of Members of the National Assembly.
Ministries, levels, the Vietnam Fatherland Front and its member organizations, armed forces units, Delegations of the National Assembly, and members of the National Assembly, within the scope of their responsibilities, actively participate in preparing for the election; create conditions for citizens to fully exercise their rights to vote and run for election as prescribed by law; encourage voters to enthusiastically go out to vote and wisely select those who meet the standards to become members of the National Assembly; contribute to ensuring that the election is truly democratic and in accordance with the law.
Along with the election for members of the National Assembly, Term X, for localities holding supplementary elections for members of People's Councils, careful organization must be ensured to achieve good results.
V. IMPLEMENTATION
| Assign the Standing Committee of the National Assembly, the Government, and relevant agencies to direct the implementation of this Resolution according to their responsibilities and authorities. Strengthen propaganda, dissemination, and guidance on the implementation of laws. Pay attention to examining and resolving citizens' complaints and denunciations. Focus on directing the effective implementation of measures to combat corruption and social evils.
National Assembly agencies and National Assembly members strengthen supervision over the implementation of decisions made at this session of the National Assembly.
The Vietnam Fatherland Front and its member organizations mobilize all strata of the people to implement decisions of the National Assembly.
The National Assembly calls upon compatriots and soldiers across the country to uphold their right to mastery, raise the spirit of self-reliance and thrift, actively participate in the election for members of the National Assembly, Term X, to successfully fulfill the tasks for 1997; accelerate the cause of industrialization and modernization of the country.
National Assembly agencies and National Assembly members strengthen supervision over the implementation of decisions made at this session of the National Assembly.
The Vietnam Fatherland Front and its member organizations mobilize all strata of the people to implement decisions of the National Assembly.
The National Assembly calls upon compatriots and soldiers across the country to uphold their right to mastery, raise the spirit of self-reliance and thrift, actively participate in the election for members of the National Assembly, Term X, to successfully fulfill the tasks for 1997; accelerate the cause of industrialization and modernization of the country.
