Approving the "Radio Frequency Band Plan for Fixed and Mobile Terrestrial Communication Systems in the 406.1 - 470MHz Band in Vietnam" with the main contents as follows:

THE MINISTER OF POSTS AND TELECOMMUNICATIONS

Pursuant to the Ordinance on Posts and Telecommunications dated May 25, 2002;

Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

Pursuant to Decree No. 24/2004/NĐ-CP dated January 14, 2004 of the Government detailing implementation of certain provisions of the Ordinance on Posts and Telecommunications regarding radio frequencies;

Pursuant to Decision No. 85/1998/QĐ-TTg dated April 16, 1998 of the Prime Minister approving the "Radio Frequency Spectrum Planning for Vietnam's Communication Services";

At the proposal of the Director of the Radio Frequency Management Department,

DECISION:

 Article 1. The plan applies to fixed and mobile terrestrial communication systems in the 406.1 - 470MHz band in Vietnam.

Radio Frequency Band Plan 406.1 - 470

FIXED MOBILE TERRESTRIAL

 406,1         430            440        445         450          452,73       457,02      462,73      467,02        470

- 430 - 440MHz: For wireless positioning services.

- 440 - 445MHz and 445 - 450MHz: For low-channel microwave systems and fixed and mobile terrestrial radio communication systems with channel spacing of 12.5kHz or 25kHz, with a transmit-receive separation of 5MHz but not limiting the use of fixed and mobile terrestrial systems with channel spacing of 12.5kHz or 25kHz using a single frequency.

- 452.73 - 457.02MHz and 462.73 - 467.02MHz: For mobile terrestrial radio communication systems and wireless local loop (WLL) systems using CDMA technology.

BT = Base station transmit segment (Transmit frequency band of base station)

BR = Base station receive segment (Receive frequency band of base station)

3.1. Communication radio systems currently using frequencies not in accordance with the purposes specified in this Plan shall be required to change frequencies to comply with the Plan.

3. Organization of Implementation

3.2. Time limit for changing frequencies:

3.2.1. In cases where equipment can adjust frequencies according to the Plan without requiring conversion costs, organizations and individuals must immediately change the frequency of the equipment upon the effective date of the Plan.

3.2.2. In cases where equipment cannot adjust frequencies according to the Plan or equipment can adjust frequencies but requires conversion costs, organizations and individuals must change the frequency of the equipment within a period not exceeding five years from the effective date of the Plan. Conversion costs shall be implemented in accordance with the provisions of the law.

3.3. The Radio Frequency Management Department is responsible for guiding the implementation of this Plan.

The Head of the Office, the Director of the Radio Frequency Management Department, the Heads of agencies and units under the Ministry of Posts and Telecommunications, and related organizations and individuals are responsible for implementing this Decision.

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
