Circular No. 02/2009/TT-BGDĐT on Amending and Supplementing Certain Articles of the University and College Regular System Admissions Regulation issued together with Decision No. 05/2008/QD-BGDĐT dated February 5, 2008 of the Minister of Education and Training.

CIRCULAR

Regarding amendments and supplements to certain articles of the University and College Regular System Admissions Regulation issued together with Decision No. 05/2008/QĐ-BGDĐT dated February 5, 2008 of the Minister of Education and Training

THE MINISTER OF EDUCATION AND TRAINING

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

At the proposal of the Director of the Higher Education Department,

CIRCULAR:

Article 1. Amending and supplementing certain articles of the University and College Regular System Admissions Regulation issued together with Decision No. 05/2008/QĐ-BGDĐT dated February 5, 2008 of the Minister of Education and Training, as follows:

1. Clause 3 of Article 2 shall be amended and supplemented as follows:

"3. For schools admitting students for artistic majors, organizing cultural subjects and artistic talent tests:

a) Cultural subjects shall be conducted according to the unified examination questions of the Ministry of Education and Training;

b) Artistic talent tests shall be conducted according to the school's own examination questions. The school principal shall be responsible for organizing all aspects: setting examination questions, conducting examinations, and grading artistic talent tests."

2. Point a Clause 1 Article 5 is amended and supplemented as follows:

"a) Having completed secondary general education through regular education or continuing education, vocational college, secondary technical education, and equivalent (hereinafter referred to collectively as secondary general education)."

3. Supplementing a point after point h Clause 2 Article 10 as follows:

"i) Staff performing the task of bundling envelopes and numbering examination papers shall not participate in the examination marking secretariat and vice versa."

4. Clause 1 Article 33 is amended and supplemented as follows:

"1) Framework for preferential points for admission based on target groups and regions

b) For schools located in ethnic minority areas, the difference in admission scores between different target groups may exceed 1.0 point but shall not exceed 1.5 points to ensure that the proportion of ethnic minority students admitted reaches the required level;

c) Schools allocating quotas for admissions to train personnel for specific users and schools tasked with training human resources for localities, the difference in admission scores between different regions may exceed 0.5 point but shall not exceed 1.0 point to fill the allocated quotas." The Ministry of Education and Training will provide detailed guidance for schools to apply this provision.

5. Supplementing a point after point b Clause 2 Article 33 as follows:

"c) Based on the general principles and the above provisions, schools shall determine admission scores for each preference: the admission score for subsequent preferences shall not be lower than that for previous preferences, ensuring a reasonable ratio of admissions among preferences; no reduction in admission scores. In exceptional cases, the Minister of Education and Training shall examine and decide."

6. Supplementing a clause after Clause 3 Article 36 as follows:

"4. After being officially admitted, the Chairman of the Admissions Board shall issue a Decision recognizing the list of successful candidates."

7. Supplementing a point after point d Clause 4 Article 41 as follows:

"e) Using illegally obtained examination result certificates."

Article 2. This Circular takes effect 45 days from the date of issuance and replaces the contents modified and supplemented by this Circular in Decision No. 05/2008/QĐ-BGDĐT dated February 5, 2008 of the Minister of Education and Training issuing the University and College Regular System Admissions Regulation for 2008. All previous regulations contrary to the provisions of this Circular are hereby abolished.

Article 3. The Heads of the Office, Inspectorate, Higher Education Department, Testing and Quality Assurance Bureau; Heads of relevant units under the Ministry of Education and Training, Ministers of Ministries, Heads of ministerial-level agencies and agencies under the Government, Chairmen of Provincial People's Committees directly under the Central Government, Directors of Departments of Education and Training, Directors of universities and academies; Principals of universities and colleges are responsible for implementing this Decision./.
