CIRCULAR
Regarding the announcement of the Port Waters Area within the jurisdiction of Binh Thuan Province
and the management area of the Binh Thuan Marine Port Authority

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 71/2006/NĐ-CP dated July 25, 2006 of the Government on port management and shipping channels;
Based on the opinions of the People's Committee of Binh Thuan Province at Official Letter No. 55/UBND-KT dated January 6, 2010 and the People's Committee of Ba Ria-Vung Tau Province at Official Letter No. 89/UBND-VP dated January 11, 2010;
The Minister of Transport hereby announces the Port Waters Area within the jurisdiction of Binh Thuan Province and the management area of the Binh Thuan Marine Port Authority as follows:
Article 1. Announcement of the Port Waters Areas within the jurisdiction of Binh Thuan Province
1. The Port Waters Areas within the jurisdiction of Binh Thuan Province, including:
a) The waters before offshore oil port jetties and berths at the Golden Lion, Red Jade, and Black Lion oil fields;
b) The waters before Phu Quy marine port jetty;
c) The waters of the port channel, branch port channel, pilot reception area, quarantine area, anchorage area, transshipment area, and storm shelter area of the ports specified in Point a and Point b of this Clause.
2. Other waters before port jetties, berths, anchorage areas, transshipment areas, and storm shelters shall be announced in accordance with the provisions of the law.
Article 2. Scope of the Port Waters Areas within the jurisdiction of Binh Thuan Province
The scope of the Port Waters Areas within the jurisdiction of Binh Thuan Province is defined based on the highest tidal level as follows:
1. The waters of offshore oil ports at the following oil fields:
a) Golden Lion Oil Field: limited by a circle with a radius of 01 nautical mile, centered at position STV with the following coordinates:
STV: 10021’52”7 N, 108022’30”6 E;
b) Red Jade Oil Field: limited by a circle with a radius of 01 nautical mile, centered at position HN with the following coordinates:
HN: 10022’32” N, 108030’01” E;
c) Black Lion Oil Field: limited by a circle with a radius of 01 nautical mile, centered at position STĐ with the following coordinates:
STĐ: 10025’24” N, 108023’38” E;
2. The waters of Phu Quy marine port:
a) Seaward boundary: limited by straight lines connecting positions where maritime navigation aids are installed along the channel leading to Phu Quy marine port;
b) Landward boundary: limited by straight lines connecting points PQ1, PQ2, PQ3, and PQ4 with the following coordinates:
PQ1: 10030’12” N, 108057’05” E;
PQ2: 10030’11” N, 108057’05” E;
PQ3: 10030’10” N, 108057’01” E;
PQ4: 10030’11” N, 108057’02” E.
Article 3. Pilot Reception Area, Quarantine Area, Anchorage Area, Transshipment Area, and Storm Shelter Area
The pilot reception area, quarantine area, anchorage area, transshipment area, and storm shelter area for vessels arriving at and departing from ports within the jurisdiction of Binh Thuan Province are defined as follows:
1. Pilot Reception Area and Quarantine Area
a) For offshore oil ports at the oil fields:
i. Golden Lion Oil Field:
- In normal weather conditions: the waters limited by a circle with a radius of 01 nautical mile, centered at the position with the following coordinates:
10020’03”7 N, 108025’57”6 E;
- In adverse weather conditions: the waters limited by a circle with a radius of 01 nautical mile, centered at the position with the following coordinates:
10049’03”7 N, 108017’25”6 E;
ii. Red Jade Oil Field:
- In normal weather conditions: the waters limited by a circle with a radius of 01 nautical mile, centered at the position with the following coordinates:
10020’00” N, 108033’00” E;
- In adverse weather conditions: the waters limited by a circle with a radius of 01 nautical mile, centered at the position with the following coordinates:
10016’00” N, 107005’00” E;
iii. Black Lion Oil Field:
- In normal weather conditions: the waters limited by a circle with a radius of 01 nautical mile, centered at the position with the following coordinates:
10021’24” N, 108023’38” E;
- In adverse weather conditions: the waters limited by a circle with a radius of 02 nautical miles, centered at the position with the following coordinates:
10049’00” N, 108017’32” E.
b) For Phu Quy marine port: the waters limited by a circle with a radius of 0.5 nautical mile, centered at the position with the following coordinates:
10030’00” N, 108055’30” E.
c) In adverse weather conditions, in addition to the pilot reception areas specified in Points a and b of this Clause, vessels may enter the pilot reception area within the Port Waters Area of Binh Thuan Province, limited by a circle with a radius of 01 nautical mile, centered at the position with the following coordinates:
10016’00” N, 107005’00” E.
2. Anchorage Area and Storm Shelter Area
a) For offshore oil ports: the waters defined in Clause 1, Article 2 of this Circular.
b) For Phu Quy marine port: the waters defined in Clause 2, Article 2 of this Circular.
3. Transshipment Area within the waters of Phu Quy marine port: as decided by the Director of the Vietnam Maritime Administration.
Article 4. Responsibilities of the Binh Thuan Maritime Port Office and related units
1. Responsibilities of the Binh Thuan Maritime Port Office:
a) Implement tasks and powers as prescribed by the Vietnam Maritime Code and relevant laws concerning maritime activities within the waters of seaports located in the territory of Binh Thuan Province;
b) Based on actual conditions regarding weather, waves, tides, and the load capacity of vessels, designate specific positions for vessels to pick up and drop off pilots, undergo quarantine, anchor, transfer cargo, and avoid typhoons within the waters specified in points a and b, Clause 1, Clause 2, and Clause 3, Article 3 of this Circular, ensuring maritime safety, maritime security, and environmental pollution prevention.
2. Coordination management responsibilities between the Binh Thuan Maritime Port Office and the Vung Tau Maritime Port Office
a) The Binh Thuan Maritime Port Office:
i. Notify the Vung Tau Maritime Port Office of the name, nationality, main technical parameters, and other necessary information of vessels requiring pilotage services at the pilot station area within the waters of seaports located in the territory of Ba Ria - Vung Tau Province at least two hours before the vessel enters the Vung Tau pilot station area for coordinated management in accordance with the law;
ii. Notify the Vung Tau Maritime Port Office of the movement of vessels leaving their anchorage positions designated by the Vung Tau Maritime Port Office to enter the waters under its own management at least one hour before the vessel departs from its position;
iii. Process procedures for vessels arriving at and departing from the port according to regulations for vessels entering the waters of seaports located in the territory of Binh Thuan Province;
iv. Coordinate with the Vung Tau Maritime Port Office to resolve incidents involving vessels entering and exiting seaports located in the territory of Binh Thuan Province when they operate within the waters of seaports located in the territory of Ba Ria - Vung Tau Province.
b) The Vung Tau Maritime Port Office
Based on actual conditions regarding weather, waves, tides, and the load capacity of vessels entering and exiting seaports managed by the Binh Thuan Maritime Port Office but which must pick up and drop off pilots, anchor, and avoid typhoons within the waters of seaports located in the territory of Ba Ria - Vung Tau Province, designate specific positions to ensure maritime safety, maritime security, prevent environmental pollution, and promptly notify the Binh Thuan Maritime Port Office.
Article 5. State Management Responsibilities for Maritime Affairs in the Sea Area within the Jurisdiction of Binh Thuan Province
Outside the waters of seaports defined in Articles 2 and 3 of this Circular, the Binh Thuan Maritime Port Office also has the responsibility to manage state affairs concerning maritime safety and maritime security in the sea areas within the territory of Binh Thuan Province.
Article 6. Effectiveness
1. This Circular takes effect 45 days from the date of signature.
2. The provisions of this Circular replace the relevant provisions in Decision No. 46/2007/QD-BGTVT dated September 5, 2007, issued by the Minister of Transport announcing the waters of seaports located in the territories of Ba Ria - Vung Tau Province, Binh Thuan Province, and the management area of the Vung Tau Maritime Port Office.
Article 7. Responsibility for Implementation
The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterways Administration, the Directors of the Department of Transport of Binh Thuan Province and Ba Ria - Vung Tau Province, the Directors of the Vung Tau Maritime Port Office and the Binh Thuan Maritime Port Office, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
