JOINT CIRCULAR
Guidelines for adjusting the monthly allowance from May 1, 2010, for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975, of the Council of Ministers, and Decision No. 111-HĐBT dated October 13, 1981, of the Council of Ministers.

Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Clause 2, Article 4 of Decree No. 29/2010/NĐ-CP dated March 25, 2010, of the Government adjusting pensions, social insurance allowances, and monthly allowances for village cadres who have retired;
After consultation with relevant ministries, the Ministry of Home Affairs and the Ministry of Finance provide guidelines for adjusting the monthly allowance from May 1, 2010, for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975, of the Council of Ministers, and Decision No. 111-HĐBT dated October 13, 1981, of the Council of Ministers as follows:
Article 1. Scope of application
The subjects to which this Circular applies are village cadres who have retired and are receiving monthly allowances according to Decision No. 130-CP dated June 20, 1975, of the Council of Ministers, and Decision No. 111-HĐBT dated October 13, 1981, of the Council of Ministers (hereinafter referred to as retired village cadres).
Article 2. Adjustment of Monthly Allowance
From May 1, 2010, the monthly allowance for retired village cadres shall be adjusted according to the provisions of Article 2 of Decree No. 29/2010/NĐ-CP dated March 25, 2010, of the Government adjusting pensions, social insurance allowances, and monthly allowances for village cadres who have retired (hereinafter referred to as Decree No. 29/2010/NĐ-CP), increasing the monthly allowance by 12.3% over the amount of the allowance received at the time of April 2010, specifically as follows:

In which: The monthly allowance received at the time of April 2010 is the allowance prescribed in Clause 2, Section II of Circular Joint No. 02/2009/TTLT-BNV-BTC dated April 22, 2009, of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of adjustments to the monthly allowance from May 1, 2009, for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975, of the Council of Ministers, and Decision No. 111-HĐBT dated October 13, 1981, of the Council of Ministers.
2. The monthly allowance received from May 1, 2010, for retired village cadres (rounded off according to the calculation formula in Clause 1 of Article 2 hereof) is as follows:
a) For cadres who were originally Secretaries of the Party Committee, Chairmen of the People's Committee of the commune: VND 921,000/month
b) For cadres who were originally Deputy Secretaries, Deputy Chairmen, Permanent Members of the Party Committee, Secretaries of the People's Committee, Secretaries of the People's Council, Commune Militia Battalion Leaders, Chiefs of Public Security Stations: VND 887,000/month
c) For other positions: VND 814,000/month
Article 3. Implementation Organization
1. Provincial People's Committees and municipal people's committees directly under the central government guide and implement the payment of monthly allowances from May 1, 2010, according to the guidelines set forth in this Circular for the subjects within their jurisdiction.
2. The source of funds for adjusting the monthly allowance for retired elderly village cadres shall be implemented according to the guidance of the Ministry of Finance.
3. Retired village cadres who move to a new legal place of residence within the same district must present a transfer certificate issued by the People's Committee of the commune; within the same province, a transfer certificate issued by the Department of Home Affairs of the district; outside the province, a transfer certificate issued by the Department of Home Affairs; the transfer certificate must be accompanied by the file and decision on retirement (in case of loss, there must be a confirmation letter from the competent authority at the same level). The local department where the cadre moves to will continue to pay the allowance to the transferred cadre. If retired village cadres moved to a new legal place of residence before the effective date of Decree No. 29/2010/NĐ-CP, the current paying location will continue to pay the allowance to the subject.
Article 4. Effective date
1. This Circular takes effect from May 10, 2010.
2. The regulations stipulated in this Circular shall be implemented from May 1, 2010.
3. Abolish Circular Joint No. 02/2009/TTLT-BNV-BTC dated April 22, 2009, of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of adjustments to the monthly allowance from May 1, 2009, for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975, of the Council of Ministers, and Decision No. 111-HĐBT dated October 13, 1981, of the Council of Ministers.
During the implementation process, if there are any difficulties, ministries, sectors, and localities should report to the Ministry of Home Affairs for coordination with the Ministry of Finance to study and resolve them./.
