Guidelines on the content and procedures for preparing provincial comprehensive transportation development master plans

Pursuant to Decree No. 116/2008/ND-CP dated November 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;

Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government on the preparation, approval, and management of comprehensive socio-economic development master plans;

Pursuant to Decree No. 04/2008/NĐ-CP dated January 11, 2008 of the Government amending and supplementing certain articles of Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government on the preparation, approval, and management of comprehensive socio-economic development master plans;

The Minister of Planning and Investment and the Minister of Transport hereby issue guidelines on the content and procedures for preparing provincial comprehensive transportation development master plans as follows:

Article 1. Scope of Regulation and Applicability

Article 1. These Circulars guide the work of preparing provincial comprehensive transportation development master plans (hereinafter referred to as Master Plans), except for the transportation development master plans for Hanoi Capital and Ho Chi Minh City.

Article 2. These Circulars apply to agencies, organizations, and individuals involved in the preparation of provincial comprehensive transportation development master plans.

Article 2. Interpretation of Terms

Preparing a provincial comprehensive transportation development master plan involves establishing viewpoints, goals, orientations for solutions, mechanisms, and policies for transportation development during the planning period within the province's territory. A provincial comprehensive transportation development master plan includes contents related to the development of transportation infrastructure and transport services.

Article 3. Period of preparation and adjustment of provincial comprehensive transportation development master plans

Clause 1. Provincial comprehensive transportation development master plans are prepared for a ten-year period with a vision for twenty years.

Clause 2. During the planning phase, it is necessary to review, adjust, and supplement the planning contents and schemes to be consistent with economic and social conditions and overall and specialized transportation sector planning.

Clause 3. It is necessary to prepare a provincial comprehensive transportation development master plan for each development period in accordance with new strategies and socio-economic development plans.

Article 4. Requirements for provincial comprehensive transportation development master plans

Clause 1. Provincial comprehensive transportation development master plans must have a legal basis, implement current Party and State policies, decisions of all levels of authorities; based on basic laws such as the Road Traffic Law, Inland Waterway Traffic Law, Civil Aviation Law, Railway Law, Maritime Code, and Construction Law, etc., and decisions approving relevant planning such as national and regional transportation development strategies and plans, specialized road, railway, inland waterway, maritime, and aviation development plans approved by the Prime Minister and the Ministry of Transport (refer to the list of approved strategies and plans in Appendix 1).

Clause 2. Provincial comprehensive transportation development master plans need to timely orientate to meet transportation needs in the province during the planning period and ensure consistency with natural conditions and socio-economic characteristics of the province.

Clause 3. Provincial comprehensive transportation development master plans need to ensure integration and seamless connection of the transportation infrastructure system within the province with regional and national infrastructure systems, ensuring traffic safety within the province.

Clause 4. Provincial comprehensive transportation development master plans need to be integrated and consistent with socio-economic development plans, urban planning, construction planning, and other economic and technical infrastructure development plans, ensuring seamless connections between different types of infrastructure within the province.

Clause 5. Combining transportation development with national defense, security, sustainable development, and environmental protection.

Clause 6. Transportation planning must clearly define objectives, viewpoints, nature, and scale of development; land use requirements, capital needs, sources of funding, project lists including priority projects; determine mechanisms, policies, and implementation measures for the plan.

Article 5. Procedures for drafting, reviewing, and approving planning

1. Includes the following steps:

Step 1. Preparation work

Step 2. Investigation, survey, and data collection

Step 3. Analysis and drafting of transportation planning report

Step 4. Submission of basic-level planning report (at the Department of Transportation)

Step 5. Revision and supplementation of the report

Step 6. Presentation of the planning report to management agencies (Provincial People's Committee, Provincial People's Council, etc.)

Step 7. Finalization of the final report

Step 8. Review, approval, and publication of the planning Detailed procedures see Appendix 2

2. The process of drafting planning must establish an overall plan and allocate human resources for project implementation (details refer to Appendix 3).

3. The procedure for reviewing and approving planning is based on Decree No. 92/2006/NĐ-CP dated September 7, 2006, and Decree No. 04/2008/NĐ-CP dated January 11, 2008, of the Government on drafting, approving, and managing comprehensive planning for economic and social development. Prior to approving the provincial comprehensive planning for transportation development, opinions from the Ministry of Transport are required. The dossier submitted for the Ministry of Transport’s opinion includes: the provincial People's Committee's request letter detailing the contents requiring the Ministry of Transport's opinion; the provincial comprehensive transportation development planning report (summary report, main report, transportation planning map at scale 1/250,000; 1/100,000 or 1/50,000).

4. After the planning is approved, localities are responsible for publicly announcing and notifying the planning through various media and the province's website, while simultaneously sending it to the Ministry of Transport.

5. During the implementation of the planning, if there are adjustments or supplements to the planning, they must be reported to the Ministry of Transport and the Ministry of Planning and Investment.

Article 6. Main Content of the Planning Proposal

The main content of a provincial comprehensive transportation development planning proposal typically includes five parts:

- Introduction (Necessity, purpose, requirements, legal basis, subjects, scope of planning)

- Part 1. Current Status of Transportation Development

- Part 2. Forecast of Transportation Demand

- Part 3. Planning for Transportation Development until Year ... and Orientation until Year ...

- Part 4. Mechanisms, Policies, and Implementation Measures for Planning

- Part 5. Implementation Organization - Conclusion, Recommendations Detailed content refers to Appendix 4.

Article 7. Implementation Organization

1. This Circular shall take effect 45 days from the date of signature.

2. Provincial People's Committees and relevant organizations and individuals are responsible for implementing this Circular.

3. In the course of implementation, if there are difficulties, the relevant localities and organizations and individuals are requested to send their opinions to the Ministry of Transport for coordination with the Ministry of Planning and Investment to promptly review and adjust./.
