JOINT CIRCULAR

Guidelines for managing and using state budget funds to implement the Project on Environmental Pollution Control in Transportation Activities pursuant to Decision No. 855/QĐ-TTg dated June 6, 2011 of the Prime MinisterPursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 60/2003/NĐ-CP dated June 10, 2003 of the Government detailing and guiding the implementation of the State Budget Law;

Pursuant to Decree No. 116/2008/NĐ-CP dated November 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 28, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 855/QĐ-TTg dated June 6, 2011 of the Prime Minister approving the Project on Environmental Pollution Control in Transportation Activities;

The Ministers of the Ministry of Transport, the Ministry of Planning and Investment, and the Ministry of Finance hereby issue this Joint Circular guiding the management and use of state budget funds to implement the Project on Environmental Pollution Control in Transportation Activities.

Article 1. This Circular guides the management and use of state budget funds to implement tasks and projects under the Project on Environmental Pollution Control in Transportation Activities approved by competent authorities according to Decision No. 855/QĐ-TTg dated June 6, 2011 of the Prime Minister.

Article 1. General Provisions

2. Sources of funding for the project

a) Funding for the Project is raised from sources including state budget funds; funds from organizations, individuals, domestic enterprises; foreign support funds; and other lawful sources.

b) State budget funds for implementing the Project include administrative management expenses, public service expenses, and development investment capital.

- Central budget ensures funding for tasks and projects under the Project managed by central ministries and sectors.

- Local budgets ensure funding for tasks and projects under the Project managed by localities.

3. Tasks and projects that have been newly approved by competent authorities and meet conditions for budget allocation and implementation shall be included in the plan.

4. Organizations, units, and individuals using funds to implement tasks and projects must comply with the contents approved by competent authorities, adhere to regulations, and achieve effectiveness; they are subject to inspection and supervision by competent authorities; and they must settle accounts annually and upon completion of tasks and projects in accordance with current regulations.

Article 2. Contents of expenditures from state budget funds for tasks and projects under the Project

a) Establishing and promulgating economic and technical standards, environmental technical procedures in the field of transportation.

1. Expenditure from environmental service funds

b) Promoting awareness of environmental protection in transportation through publicity campaigns.

c) Developing noise pollution maps and solutions to reduce noise pollution caused by transportation activities on major traffic routes (including surveys and assessments).

d) Updating and maintaining databases on the environment in transportation.

đ) Establishing models for organizing and managing waste from road passenger transport and applying them on public passenger transport routes.

e) Supporting the renovation and upgrading of systems for collecting and treating liquid medical waste at transportation hospitals.

g) Developing databases on the environment to serve research, evaluation, and management of environmental issues related to transportation development activities.

2. Expenditures from public service science funds

a) Establishing and promulgating environmental standards in the field of transportation.

b) Researching and applying science and technology in transportation to control and reduce environmental pollution.

c) Studying and implementing solutions to promote the development of public passenger transport in large cities.

d) Developing and implementing investment plans for equipment to serve research, evaluation, and management of environmental issues related to transportation development activities.

3. Expenditures from public service training funds

Training to enhance management capabilities regarding environmental protection for organizations and agencies managing the environment in the transportation sector.

4. Expenditures from administrative management funds

Reviewing and developing proposals to join international conventions, international and regional programs, and action plans on the environment in the transportation sector (including surveys and assessments).

5. Expenditures from development investment funds

a) Developing models for organizing waste management at seaports and piloting centers for collecting and treating waste from ships.

b) Piloting treatment of waste from inland waterway transportation at some ports.

c) Supporting industrial facilities to invest in and build systems to control pollutants from transportation industry activities.

d) Supporting enterprises to pilot the application of liquefied petroleum gas (LPG) and compressed natural gas (CNG) in public passenger transport by bus in Hanoi, Ho Chi Minh City, and Da Nang.

đ) Supporting the design and installation of self-cleaning toilet systems on passenger train cars.

e) Supporting the construction of new systems for collecting and treating liquid medical waste at transportation hospitals.

g) Supporting the piloting of centralized wastewater treatment systems at Danang International Airport.

g) Support the construction of a pilot centralized wastewater treatment system at Da Nang International Airport.

Article 3. Budget Allocation Levels

1. The budget allocation levels for tasks and projects implemented according to current financial expenditure standards and regulations shall be determined by competent state authorities.

2. Specific budget allocation levels are as follows:

a) Expenses for work, conferences, and training sessions shall be carried out in accordance with Circular No. 97/2010/TT-BTC dated July 6, 2010, issued by the Ministry of Finance, which stipulates work expense regimes and conference organization expense regimes for state agencies and public service units.

b) Expenses from environmental public service funds shall be carried out in accordance with Joint Circular No. 45/2010/TTLT-BTC-BTNMT dated March 30, 2010, issued by the Ministry of Finance and the Ministry of Natural Resources and Environment, guiding the management of environmental public service funds.

c) Expenses from scientific public service funds shall be carried out in accordance with Joint Circular No. 44/2007/TTLT-BTC-BKHCN dated May 7, 2007, issued by the Ministry of Finance and the Ministry of Science and Technology, guiding the establishment and distribution of budgets for scientific and technological projects using state funds.

d) Training and capacity-building expenses for transportation sector staff on environmental protection activities shall be carried out in accordance with Circular No. 139/2010/TT-BTC dated September 21, 2010, issued by the Ministry of Finance, which stipulates the preparation, management, and use of state budget funds for training and capacity-building for civil servants.

đ) Expenses for drafting legal regulations and policies for environmental management in transportation activities shall be carried out in accordance with Joint Circular No. 192/2010/TTLT-BTC-BTP-VPCP dated December 2, 2010, issued by the Ministry of Finance, the Ministry of Justice, and the Government Office, guiding the preparation, management, use, and settlement of state budget funds for legal regulation drafting and system completion.

e) Expenses for implementing waste treatment projects in transportation activities from investment capital shall be carried out in accordance with current investment capital regulations.

g) State budget support levels at points c, d, đ, g, Clause 5, Article 2 shall not exceed 30% of the total approved project investment amount. Conditions and criteria for support shall be implemented according to guidelines set by the Ministry of Transport. Specifically, the support level at point e, Clause 5, Article 2 shall be implemented according to Decision No. 58/2008/QĐ-TTg dated April 29, 2008, issued by the Prime Minister regarding targeted state budget support aimed at thoroughly addressing, mitigating, and reducing environmental pollution and degradation for certain public welfare entities.

Article 4. Preparation, Execution, and Settlement of State Budget

The preparation, allocation, execution, and settlement of funds for tasks and projects under the Program shall be carried out in accordance with the State Budget Law and related guiding documents; this Circular provides additional specific guidance on the following matters:

1. Preparation, Review, and Approval of Tasks and Projects Based on the tasks and projects as per Decision No. 855/QĐ-TTg dated June 6, 2011, issued by the Prime Minister, and the provisions of Article 3 of this Circular, relevant ministries, central agencies, and localities shall assign tasks to implementing units.

Implementing units shall cooperate with related agencies and units to develop tasks and projects in accordance with regulations and propose funding sources for the tasks and projects, providing detailed explanations of the budget bases and phased funding deployment annually. Depending on the nature of each project, project preparation shall be conducted as follows:

a) For projects funded from development investment capital: Project preparation, review, and approval shall be carried out in accordance with current investment and construction management regulations.

b) For tasks and projects funded from administrative and public service funds: Based on the objectives, contents, and nature of the tasks and projects, units shall prepare budgets for specific workload volumes and current financial systems, submitting them to competent authorities for approval.

2. Preparation of Budget Estimates, Allocation, and Assignment of Budget Estimates for Tasks and Projects

a) Tasks and projects implemented by ministries and central agencies:

- Based on approved tasks and projects, implementing units shall annually prepare budget estimates, reporting to the main ministries and central agencies for consideration and consolidation into their annual state budget estimates, which will then be submitted to the Ministry of Finance and the Ministry of Planning and Investment for consolidation and reporting to the Government for submission to the National Assembly for approval.

- The allocation and assignment of budget estimates to implementing units shall be carried out in accordance with current State Budget Law regulations and related guiding documents.

b) Tasks and projects implemented by localities:

- Based on approved tasks and projects, local agencies and units shall prepare budget expenditures within their annual state budget estimates, reporting to their main management agencies.

Local main management agencies shall consolidate the budget estimates and submit them to local finance, planning and investment, science and technology, education, and training agencies for consideration and consolidation into the local budget estimates for reporting to the People's Councils for decision-making.

- The allocation and assignment of budget estimates to implementing units shall be carried out in accordance with current State Budget Law regulations and related guiding documents.

Article 5. Inspection work

1. Ministries, central agencies, and localities assigned to lead tasks and projects shall coordinate with financial agencies and planning and investment agencies at the same level to regularly and randomly inspect the implementation and use of funds for such tasks and projects, ensuring that the management and use of funds are in accordance with their intended purposes and are effective.

2. Annually, ministries, sectors, and localities assigned tasks and projects shall prepare reports to send to the Ministry of Transport for consolidation and reporting to the Prime Minister; copies shall be sent to the Ministry of Planning and Investment and the Ministry of Finance.

Article 6. Implementation Organization

This Circular takes effect from March 23, 2013.

During implementation, if there are any difficulties, ministries, central agencies, and localities are requested to report them to the Ministry of Transport, the Ministry of Planning and Investment, and the Ministry of Finance for study and resolution./.
