Guidelines on the collection, management, provision, and use
of data on juveniles who violate the law

To serve the work of prevention, handling, and education for juveniles who violate the law, the Minister of Labor - Invalids and Social Affairs, the Minister of Public Security, the Chief Prosecutor of the Supreme People's Procuracy, and the President of the Supreme People's Court issue this Joint Circular to guide the collection, management, provision, and use of data on juveniles who violate the law.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
Article 1. This Circular guides the collection, management, provision, and use of statistical data on juveniles who violate the law subject to administrative educational measures at commune, ward, town level; placed in educational centers; criminally processed; reintegrated into society after serving a fixed-term imprisonment sentence or judicial measure placing them in an educational center (referred to collectively as data on juveniles who violate the law).
Article 2. This Circular annexes the Appendix on the system of statistical indicators for data on juveniles who violate the law.
Article 2. Applicability
This Circular applies to agencies and units under the Public Security, Procuracy, Judiciary, Labor - Invalids and Social Affairs sectors, and other organizations and individuals related to the collection, management, provision, and use of data on juveniles who violate the law.
Article 3. Objectives and requirements for the collection, management, provision, and use of data on juveniles who violate the law
Point 1. Gradually build a database on juveniles who violate the law to serve research, advisory, and policy formulation work aimed at reducing juvenile delinquency, helping them correct their mistakes, and becoming useful citizens for society.
Point 2. Collect complete, timely, and accurate data on juveniles who violate the law subject to administrative educational measures at commune, ward, town level; placed in educational centers; criminally processed; reintegrated into society after serving a fixed-term imprisonment sentence or judicial measure placing them in an educational center.
Article 4. Principles for the collection, management, provision, and use of data on juveniles who violate the law
1. Ensuring truthfulness, objectivity, accuracy, completeness, and timeliness.
Point 2. Ensure uniformity in indicators, forms, calculation methods, classification tables, units of measurement, deadlines, and periods for statistical reporting.
Point 3. Avoid duplication and overlap in data and statistical reports on juveniles who violate the law.
Point 4. Adhere to legal regulations and ensure state secrecy.
Article 5. Funding Implementation
Point 1. The budget for implementing the collection, management, provision, and use of data on juveniles who violate the law shall be allocated annually in the state budget according to the State Budget Law and guiding documents.
Point 2. The content and amount of expenditure shall be implemented according to the provisions of Circular No. 194/2012/TT-BTC dated November 15, 2012, issued by the Ministry of Finance regarding guidelines on the cost of creating electronic information to maintain the regular operation of state agencies and units using the state budget, and the joint Circular No. 19/2012/TTLT-BTC-BKHĐT-BTTTT dated February 15, 2012, issued by the Ministry of Finance, Planning and Investment, and Information and Communications on managing and using funds for the National Program on the application of information technology in the activities of state agencies.
Chapter II
COLLECTION, MANAGEMENT, PROVISION, AND USE OF DATA
ON JUVENILES WHO VIOLATE THE LAW
Article 6. Responsibilities for collecting, managing, providing, and using data on juvenile offenders
The Ministry of Labor, Invalids and Social Affairs, the Ministry of Public Security, the Supreme People's Procuracy, and the Supreme People's Court shall organize the collection of data on juvenile offenders and provide such data to the common database managed by the Ministry of Labor, Invalids and Social Affairs based on the Statistical Indicators System for Data on Juvenile Offenders attached to this Circular.
Article 7. Regime for Collecting, Providing, and Managing Data on Juvenile Offenders
1. The collection of data on juvenile offenders shall be carried out in two statistical periods as follows:
a) Six-month period (from January 1 to June 30);
b) Annual period (from January 1 to December 31).
2. Within thirty days following the end of each statistical period, the Ministry of Public Security, the Supreme People's Procuracy, and the Supreme People's Court shall have the responsibility to provide data on juvenile offenders to the Ministry of Labor, Invalids and Social Affairs for consolidation.
3. The department that collects the data on juvenile offenders shall be responsible for managing such data. The Ministry of Labor, Invalids and Social Affairs shall be responsible for managing the overall system data and serving as the central agency for providing system data to relevant agencies, organizations, and individuals.
Chapter III
IMPLEMENTING PROVISIONS
Article 8. Effective Date
This Circular takes effect from March 25, 2013. During implementation, if difficulties arise, the relevant agencies and units shall report to the Ministry of Labor, Invalids and Social Affairs, the Ministry of Public Security, the Supreme People's Procuracy, and the Supreme People's Court for timely guidance.
Article 9. Responsibility for implementation
Within their respective functions, tasks, and authorities, the Ministry of Public Security, the Supreme People's Procuracy, the Supreme People's Court, and the Ministry of Labor, Invalids and Social Affairs shall organize the implementation and direct, guide, and inspect the implementation of this Circular.
