Regulations on certain forms of documents concerning lawyers and the practice of law

On the basis of The Lawyers Law No. 65/2006/QH11 dated June 29, 2006, amended and supplemented by the Law Amending and Supplementing Certain Provisions of the Lawyers Law No. 20/2012/QH13 dated November 20, 2012;

Pursuant to Decree No. 123/2013/NĐ-CP dated October 14, 2013 of the Government detailing certain provisions and measures for the implementation of the Lawyers Law;

On the basis of Decree No. 22/2013/NĐ-CP dated March 13, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of the Director of the Department of Judicial Support;

To ensure uniform management and use of forms of documents concerning lawyers and the practice of law, the Minister of Justice promulgates and guides the use of forms of documents concerning lawyers and the practice of law as follows:

Article 1. Scope of Regulation

This Circular stipulates certain forms of documents concerning lawyers and the practice of law (hereinafter referred to collectively as forms of documents) and the codes of provinces and centrally governed cities, and the codes of forms of the practice of law in Vietnam.

Article 2. Applicability

Individuals requesting issuance of a Lawyer Practice Certificate; Vietnamese lawyers; foreign lawyers requesting issuance of a Permit to Practice in Vietnam; persons submitting applications for registration of activities of lawyer practice organizations/branches of Vietnamese lawyer practice organizations; persons submitting applications for establishment of branches/law firms of foreign countries, registration of activities of branches/law firms of foreign countries; Vietnamese lawyer practice organizations; foreign lawyer practice organizations in Vietnam; state management agencies for lawyers and the practice of law.

Article 3. Forms of documents, codes of provinces and centrally governed cities, and codes of forms of the practice of law in Vietnam

Attached to this Circular are forms of documents and codes of provinces and centrally governed cities, and codes of forms of the practice of law in Vietnam, as follows:

Article 4. Method of numbering the Registration Certificate for the operation of lawyer practice organizations and individual lawyer practice registration

The method of numbering the Registration Certificate for the operation of lawyer practice organizations and individual lawyer practice registration shall be implemented in accordance with Article 6 of Circular No. 17/2011/TT-BTP dated October 14, 2011, issued by the Minister of Justice guiding certain provisions of the Lawyers Law, Decree detailing and guiding the implementation of certain articles of the Lawyers Law, and Decree guiding the implementation of provisions of the Lawyers Law regarding the organization of lawyers' social-professional associations.

Article 5. Publishing and Using Forms

The forms prescribed in Clause 1 of Article 3 of this Circular shall be published on the Ministry of Justice's electronic portal. Individuals and organizations may access the Ministry of Justice's electronic portal (www.moj.gov.vn/bttp) to print and use these forms.

Article 6. Effectiveness

This Circular takes effect from March 5, 2015.

The contents guiding the responsibility for establishing files and records of lawyers' social-professional organizations, Vietnamese lawyer practice organizations, foreign lawyer practice organizations in Vietnam, and individual practicing lawyers as stipulated in Article 34; Article 36 and Annexes 1 and 2 issued together with Circular No. 17/2011/TT-BTP shall cease to be effective from the date this Circular takes effect.

Documents according to the forms prescribed in Article 36 of Circular No. 17/2011/TT-BTP issued before the date this Circular takes effect shall remain valid.

Article 7. Implementation Organization

Heads of units under the Ministry of Justice, Directors of Provincial Departments of Justice, and relevant agencies, organizations, and individuals are responsible for implementing this Circular. In case of difficulties or obstacles during implementation, agencies, organizations, and individuals should promptly report in writing to the Ministry of Justice for research and guidance on resolution.
