The Minister of Information and Communication issues this Circular on regulations regarding receiving citizens, handling and resolving complaints, reports, petitions, and reflections of the Ministry of Information and Communication."Article 1. Amending and supplementing some articles of Circular No. 48/2013/TT-BNNPTNT dated November 12, 2013 on inspection and certification of food safety for aquatic products for export:""1. Documents, procedures, and authority for inspection, assessment, issuance, and revocation of the Food Safety Certificate (hereinafter referred to as the ATTP Certificate) for establishments producing and trading aquatic food products with exports (hereinafter referred to as the Establishment)."From 100 million VND to less than 300 million VNDAt the proposal of the Director of the Plant Protection Department, the General Director of the Fisheries General Department, and the Director of the Livestock Production Department;

"2. Documents, procedures, and authority for inspection and issuance of Export Certificates (hereinafter referred to as the Certificate) for exported aquatic products at the request of importing countries."of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs"Article 9: Fees"

"The collection of fees for the assessment and issuance of the ATTP Certificate for Establishments and the Certificate for exported aquatic product consignments as stipulated in this Circular shall be carried out in accordance with the Law on Fees and Charges, regulations of the Ministry of Finance, and related legal documents.", amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPPursuant to the Law on Public Investment dated November 29, 2024;No. of Circular No.No. "2. If the application documents are valid, within three working days from the date of receipt of complete and valid documents, the Inspection and Certification Authority will notify the Establishment of the scheduled time for the on-site assessment but not later than seven working days from the date of receipt of complete and valid documents.""e) The Establishment has been issued the ATTP Certificate but has postponed the post-issuance inspection for more than twelve months;"developmentliệu trong trường hợp có sự cố.tr"2. "a) Post-issuance inspections: This is a form of unannounced inspection aimed at monitoring the maintenance of food safety conditions for Establishments that have been issued the ATTP Certificate according to the following frequency: Class 1 and Class 2 Establishments: once every year; Class 3 Establishments: once every six months; Class 4 Establishments: the inspection time depends on the degree of violation of the Establishment inspected and is decided by the Inspection and Certification Authority but not later than three months from the previous inspection date."

"b) Unannounced inspections: This is a form of unannounced inspection applied to Establishments that show signs of violations of food safety as specified in point b, Clause 3, Article 17, Clause 3, Article 31, and Clause 2, Article 36 of this Circular or when there are complaints from organizations or individuals."

"5. Amending point d, Clause 1, Article 14 as follows:"

"d) Sampling for analysis to assess the effectiveness of hygiene control during production according to Appendix IA attached to this Circular."

"Within six working days from the end of the inspection and assessment, the Inspection and Certification Authority will review the Inspection Report and notify the results to the Establishment."

"2. Post-issuance inspections and unannounced inspections:"

"a) Establishments with satisfactory results (Class 1, Class 2, and Class 3): Notify the Establishment about the inspection results and the frequency of post-issuance inspections to be applied in the future."

"b) Establishments with unsatisfactory results (Class 4): Implement as prescribed in point b, Clause 1 of this Article."

"2. The Directorate of Quality Assurance for Agricultural Products, Forestry Products, and Aquatic Products will establish a priority list for Establishments meeting all the criteria below up to the time of consideration:"

"a) The Establishment is included in the list of Establishments participating in the export seafood certification program for each export market;"

"b) The Establishment has exported consignments without any consignment being found to violate food safety by Vietnamese authorities and import markets for at least three months since the Establishment was classified as Class 1 or 2."

"8. Amending point c, Clause 1, Article 27 as follows:"

"c) Sampling rate: Determined based on the classification of food safety assurance conditions; history of food safety assurance; risk level of the product; scale, capacity, or production volume of the Establishment according to Appendix IIA attached to this Circular."

"Based on the evaluation of the implementation results, the Directorate of Quality Assurance for Agricultural Products, Forestry Products, and Aquatic Products will periodically submit to the Ministry of Agriculture and Rural Development for consideration and updating the contents of Appendix IIA to be appropriate."

"9. Amending Clause 2, Article 28 as follows:"

"2. Assessment and issuance of certificates:"

"Within one working day from the date of receiving complete information, the Inspection and Certification Authority will conduct the assessment and issue the Certificate for the export consignment based on the corresponding import market model upon reviewing the effectiveness of food safety hazard control measures as stipulated in Article 27 of this Circular or provide a written response stating the reasons for not issuing the Certificate for the export consignment."

"Article 32. Assessment and issuance of certificates"

"1. Within two working days from the date of export, the Shipper must provide in writing all necessary information required in the Certificate model according to the requirements of the competent authority of the importing country to the Inspection and Certification Authority for the issuance of the Certificate. Within one working day from the date of receiving complete information, the Inspection and Certification Authority will conduct the assessment and issue the Certificate for the export consignment based on the corresponding import market model if the inspection and testing results of the consignment meet the requirements."
