CIRCULAR

CThe Minister of Transport issues this Circular to announce the port waters within the territory of Da Nang City and under the management of the Da Nang Maritime Port Office.

Pursuant to the Vietnam Maritime Code on November 25, 2015;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

1. Amending Clause 2 Article 2 as follows:

At the proposal of the Director of the Legal Department and the Director General of the Vietnam Maritime Administration;

The Minister of Transport shall issue a Circular promulgating the maritime port waters area within the part of Da Nang City and the area under the management of the Da Nang Port Maritime Administration.

Article 1. Announcement of the port waters within the territory of Da Nang City

The port waters of Da Nang City within the territory of Da Nang City include the following areas:

1. The port waters of Da Nang City in the Da Nang Bay area;

2. The port waters of Da Nang City in the My Khe area.

Article 2. Scope of the port waters within the territory of Da Nang City

The scope of the port waters of Da Nang City within the territory of Da Nang City, measured according to the highest tidal water level, is specified as follows:

1. The scope of the port waters of Da Nang City in the Da Nang Bay area:

a) Seaward boundary: limited by the straight line connecting two points DN1 and DN2 with the following coordinates:

DN1: 16012°34.00'N, 108012°24.00'E (southern edge of Son Tra Island);

DN2:16009°20.04'N, 108014°56.52'E (northwestern edge of Son Tra Peninsula).

b) Landward boundary: from point DN2 along the coastline of Da Nang Bay towards the west of Son Tra Peninsula, continuing through the safety channel downstream of Man Quang Bridge and the coastline of Da Nang Bay to point DN3 with the coordinates 16°06'37.00'N, 108°13'36.00'E; from point DN3 connected by a straight line to point DN4 with the coordinates 16°06'37.00'N, 108°13'03.00'E; from point DN4 connected by a straight line to point DN5 (located on the right bank of Han River counting from the sea) with the coordinates 16°05'40.00'N, 108°13'06.00'E; from point DN5 continuing along the coastline towards the west of Da Nang Bay, passing through Cape Nam O and Cape Isabelle, northwards to point DN6 with the coordinates 16°12'34.00'N, 108°11'41.00'E (eastern edge of Hai Van Pass, bordering Thua Thien Hue Province); from point DN6 connected by a straight line to point DN7 with the coordinates 16°12'41.00'N, 108°12'03.00'E (southwestern edge of Son Tra Island) and following the southwestern coast of Son Tra Island, ending at point DN1.

2. The scope of the port waters of Da Nang City in the My Khe area:

a) Seaward boundary: limited by the straight lines connecting the following points MK1, MK2, MK3, and MK4 with the following coordinates:

MK1: 16003°06.0'N; 108014°57.0'E;

MK2: 16003°06.0'N; 108018°13.0'E;

MK3: 16005°09.0'N; 108018°13.0'E;

MK4: 16005°09.0'N; 108018°13.0'E;

b) Landward boundary: limited by the shoreline waterline, starting from point MK1 to point MK4.

3. The boundaries of the port waters stipulated in this Article are determined on Chart number VN50021 (reprinted in 2015) of the Northern Marine Safety Assurance Corporation. The coordinates of the points specified in this Article are applied according to the WGS 84 coordinate system and converted to the VN 2000 coordinate system as follows:

Article 3. Pilot reception areas, quarantine zones, vessel turning areas, anchorage zones, cargo transfer zones, storm shelter zones, and other related water areas

The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception areas, quarantine zones, vessel turning areas, anchorage zones, cargo transfer zones, and storm shelters for vessels entering Danang seaports and other water areas as prescribed.

Article 4. Responsibilities of the Danang Marine Port Supervision Authority

1. Implement tasks and authorities as stipulated by the Vietnam Maritime Code and relevant legal regulations concerning maritime activities at seaports, port waters, and maritime areas within the jurisdiction of Danang City.

2. Based on actual conditions regarding weather, waves, tides, vessel capacity, and cargo characteristics, designate specific positions for vessels to receive pilots, undergo quarantine, turn around, anchor, transfer cargo, and seek storm shelter in accordance with prescribed water areas, ensuring maritime safety, maritime security, and environmental protection.

Article 5. State Management Responsibilities for Maritime Affairs in the Sea Area within the Jurisdiction of Danang City

Outside the water areas specified in Article 2 of this Circular, the Danang Marine Port Supervision Authority is responsible for state management of maritime safety, maritime security, and prevention of environmental pollution in the sea area within the jurisdiction of Danang City.

Article 6. Effectiveness

This Circular takes effect from April 1, 2019. Circular No. 25/2015/TT-BGTVT dated June 18, 2015, issued by the Minister of Transport on the announcement of water areas of seaports within the jurisdiction of Danang City and the management area of the Danang Marine Port Supervision Authority, and Circular No. 44/2015/TT-BGTVT dated August 27, 2015, issued by the Minister of Transport amending and supplementing certain provisions of Circular No. 25/2015/TT-BGTVT dated June 18, 2015, on the announcement of water areas of seaports within the jurisdiction of Danang City and the management area of the Danang Marine Port Supervision Authority, are hereby abolished.

Article 7. Implementation Organization

The Head of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Inland Waterways Administration, Directors of the Department of Transport of Danang City, Directors of the Danang Marine Port Supervision Authority, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
