This Circular amends and supplements some provisions of Circular No. 12/2020/TT-BGTVT dated May 29, 2020, on the organization and management of road passenger transport activities and supporting services. CIRCULAR
Amending and supplementing certain provisions of Circular No. 12/2020/TT-BGTVT dated May 29, 2020 of the Minister of Transport on the organization and management of road passenger transport activities by motor vehicles and related support services.
On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Circular No. 05/2024/TT-BGTVT amending and supplementing some articles of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers, based on the following:
Pursuant to Decree No.Decision No. 177/2013/NĐ-CPdated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices; Decision No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing certain provisions of Decision No.Decision No. 177/2013/NĐ-CPdated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices;
Pursuant to Decree No. 30/2020/NĐ-CP dated March 5, 2020 of the Government on archival work;
Pursuant to Decree No.Decision No. 12/2017/NĐ-CPpursuant to Decision No. 58/2017/NĐ-CP dated February 10, 2017 of the Government detailing certain provisions of the Maritime Code of Vietnam on managing maritime activities;
At the request of the Director of the Transport Department and the Director General of the Vietnam Highway Administration,
The Minister of Transport issues this Circular to amend and supplement certain provisions of Circular No. 12/2020/TT-BGTVT dated May 29, 2020 of the Minister of Transport on the organization and management of road passenger transport activities by motor vehicles and related support services.
Article 1. Amending and supplementing certain provisions of Circular No. 12/2020/TT-BGTVT dated May 29, 2020 of the Minister of Transport on the organization and management of road passenger transport activities by motor vehicles and related support services.
1. Unit prices for construction projects published by the People's Committee of the province in accordance with Clause 2, Article 26 of Decree No. 10/2021/NĐ-CP serve as the basis for determining and managing construction investment costs within the province. The unit prices for construction projects published by the People's Committee of the province are determined based on construction norms issued by competent authorities and the cost factors' prices specified in Clause 3, Clause 4, and Clause 5 of this Article, consistent with the time of determining the unit price for construction projects. Cost factors' prices include: material prices, labor unit prices, machinery and equipment rental prices.
"Article 8. Provisions on managing image data from cameras installed on motor vehicles
1. Transport business units shall install cameras on motor vehicles for commercial transport operations in accordance with Clause 2 of Article 13 and Clause 2 of Article 14 of Decision No. 10/2020/NĐ-CP and ensure the following minimum requirements:
a) Data stored at the camera on the vehicle must be in video format according to standard (MP4 or H.264 or H.265) and include the following minimum information: license plate number (control plate number), location (coordinates), time; video stored on the memory card or hard drive of the camera must have a minimum frame rate of 10 frames/second and a minimum resolution of 720p. Images captured by the camera must be clearly visible under all lighting conditions (including at night).
b) Data from the camera must be transmitted to the server of the transport business unit and the server of the Vietnam Highway Administration in image format according to standard .JPG and must have a minimum resolution of 640x480 pixels. In case of signal transmission loss, the data from the camera must be resent fully and accurately to the server as soon as the transmission resumes.
c) All data recorded and stored at the camera installed on the vehicle and at the server of the transport business unit must be ensured not to be deleted or altered during the entire storage period as prescribed.
2. Transport business units shall determine the position and number of cameras installed on their own motor vehicles to ensure full observation of the driver's working area, passenger compartment, and vehicle entry and exit doors. Transport business units shall post instructions for extracting data from the camera in easily observable locations for drivers to monitor. Information posted includes:
a) Contact phone number and address of the camera installation unit.
b) Status of device operation and data transmission through signals or indicators.
c) Connection procedures between the camera and a computer or specialized device for reading and extracting data.
3. Transport business units and commercial transport drivers may not use technical measures, peripheral equipment, or other methods to interfere with the operation, jam (or interfere with) GPS, GSM signals, or alter camera data on motor vehicles."
2. Amend and supplement Clause 3 of Article 19 as follows:
"3. Post the following information at the ticket counter: name of the transport business unit, route name, fare (tariff) declared according to the model specified in Appendix 22 issued together with this Circular, departure schedule of each trip, passenger services along the journey, free baggage allowance."
3. Amend and supplement Point b of Clause 4 of Article 19 as follows:
"b) Post on both sides of the vehicle body or doors: name and contact phone number of the transport business unit with a minimum size: length of 20 cm, width of 20 cm; fare (tariff) declared according to the model specified in Appendix 22 issued together with this Circular;"
4. Amend and supplement Point c of Clause 4 of Article 19 as follows:
"c) Post inside the vehicle: license plate number (control plate number), fare (tariff) declared according to the model specified in Appendix 22 issued together with this Circular, travel route, passenger services along the journey, free baggage allowance, mobile hotline number of the transport business unit, local Department of Transport issuing permit plates;"
5. Amend and supplement Point a of Clause 4 of Article 29 as follows:
"a) Post outside the vehicle:
Above the front and rear windows of the vehicle: route number or code, starting point, end point of the route; minimum letter height of 06 cm;
On both sides of the vehicle body: route number or code, contact phone number of the enterprise or cooperative with a minimum size: length of 20 cm, width of 20 cm; fare (tariff) declared according to the model specified in Appendix 22 issued together with this Circular;"
6. Amend and supplement Point b of Clause 4 of Article 29 as follows:
"b) Post inside the vehicle: license plate number (control plate number), route number or code; diagram showing the starting point, end point, and intermediate stops along the route; fare (tariff) declared according to the model specified in the Appendix issued together with this Circular; mobile hotline number of the enterprise or cooperative operating the transport service and local Department of Transport; responsibilities of the driver, onboard staff, and passengers;"
7. Amend Point a of Clause 4 of Article 30 as follows:
"a) The Department of Transport shall announce the model of bus stop shelters applicable within its jurisdiction;"
8. Amend and supplement Clause 2 of Article 38 as follows:
"2. Must post the following information:
a) On both sides of the vehicle doors: name, contact phone number, and logo of the enterprise or cooperative with a minimum size: length of 20 cm, width of 20 cm; tariff chart declared according to the model specified in Appendix 22 issued together with this Circular;
b) Inside the vehicle: a fare table for pricing based on kilometers (km), fare for waiting time according to passenger requests, and other costs (if any) that passengers must pay; the fare table declared according to the form prescribed in Appendix 22 issued together with this Circular;
c) In cases where taxis use billing software, they must also display the declared fare table according to the form prescribed in Appendix 22 issued together with this Circular on the interface for passengers.
9. Amend Clause 1 of Article 48 as follows:
“1. Implement the provisions of Clause 1, Clause 2, Clause 3, and Clause 7 of Article 14, Article 16, and Article 54 of this Circular.”
10. Amend and supplement the content of "NOTES" in Appendix 3 issued together with Circular No. 12/2020/TT-BGTVT dated May 29, 2020 of the Minister of Transport regarding the organization and management of road passenger transport activities and supporting services as follows:
"NOTES"
- Size of Certificate: length 90 mm, width 60 mm.
- Photograph not older than six months. The issuing unit stamps over the lower right corner of the photograph.
- This certificate is only issued to drivers and service personnel on the vehicle who have completed the training course as prescribed.
- This certificate is valid for a maximum of three years from the date of issuance and does not serve as personal identification.
- This certificate will be invalid if it is erased or altered.
11. Delete the phrase: “* Note:"The Department of Transportation stamps the back of the Emblem and Sign issued by its own unit." stipulated in Appendix 4, Appendix 5, Appendix 7, Appendix 8, Appendix 12, Appendix 15, Appendix 16, and Appendix 17 issued together with Circular No. 12/2020/TT-BGTVT dated May 29, 2020 of the Minister of Transport regarding the organization and management of road passenger transport activities and supporting services.
12. Supplement Appendix 22 issued together with Circular No. 12/2020/TT-BGTVT dated May 29, 2020 of the Minister of Transport regarding the organization and management of road passenger transport activities and supporting services corresponding to Appendix 1 issued together with this Circular.
Article 2. Implementation clause
1. This Circular takes effect from March 25, 2021. Repeal Article 3 and Article 4 of Joint Circular No. 152/2014/TTLT-BTC-BGTVT dated October 15, 2014 of the Ministry of Finance and the Ministry of Transport on guiding the implementation of fares for road passenger transport by motor vehicles and supporting services.
2. The posting of information at ticket counters and on motor vehicles as prescribed in Article 4 of Joint Circular No. 152/2014/TTLT-BTC-BGTVT dated October 15, 2014 of the Ministry of Finance and the Ministry of Transport on guiding the implementation of fares for road passenger transport by motor vehicles and supporting services shall continue until September 30, 2021.
3. The Director of the Ministry's Office, the Inspectorate Chief, Heads of Departments, Directors of Provincial Departments of Transportation, Heads of agencies, units, and individuals related to this matter are responsible for implementing this Circular.
