DETAIL REGULATIONS IMPLEMENTING CERTAIN ARTICLES OF THE ENVIRONMENTAL POLICE ORDINANCE

Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing certain articles of the Environmental Police Ordinance, which took effect from December 5, 2015, has been amended and supplemented by:

Decree No. 157/2024/NĐ-CP dated December 16, 2024 of the Government amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing certain articles of the Environmental Police Ordinance, which took effect from December 20, 2024.

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Environmental Police Ordinance dated December 23, 2014;

At the proposal of the Minister of Public Security,

The Government promulgates this Decree to detail the implementation of certain articles of the Environmental Police Ordinance.^[1]

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree details the implementation of certain articles of the Environmental Police Ordinance regarding tasks, powers, ensuring operations, and systems and policies for the environmental crime prevention and combat force.^[2]; relations coordinating in preventing, combating crimes and administrative violations related to the environment, natural resources, food safety.

Article 2. Applicability

This Decree applies to the environmental crime prevention and combat force;^[3]; agencies, units responsible for preventing, combating crimes and administrative violations related to the environment, natural resources, food safety (hereinafter referred to as the environment, natural resources, food safety); agencies, organizations, enterprises, Vietnamese citizens and agencies, organizations, enterprises, foreign individuals residing, operating on the territory of the Socialist Republic of Vietnam.

Article 3. Explanation of Terms

In this Decree, the following terms shall be understood as follows:

1. Violations of laws on natural resources related to the environment are administrative violations in activities of investigation, exploration, exploitation, processing, utilization of mineral resources, land resources, water resources, forest resources, marine and island resources.

2. Violations of laws on food safety related to the environment are administrative violations in activities of production, business, transportation of foodstuffs, medicines, health products; genetically modified foods; animal feed, fertilizers, veterinary drugs, plant protection chemicals, growth promoters, crop and livestock seeds; products for environmental remediation.

Chapter II. TASKS AND POWERS OF THE ENVIRONMENTAL CRIME PREVENTION AND COMBAT FORCE^[4]

Article 4. Advising and directing work on preventing and combating crimes and administrative violations related to the environment, natural resources, food safety

The environmental crime prevention and combat force^[5] shall perform the following tasks:

1. Organizing the collection of information, analysis, evaluation, forecasting the situation of crimes and administrative violations related to the environment, natural resources, food safety to advise and propose competent authorities to issue, direct and directly organize the implementation of policies, laws, strategies, programs, plans, measures for preventing and combating crimes and administrative violations related to the environment, natural resources, food safety.

2. Organizing research, application, mobilization of scientific and technological achievements to serve the prevention and combating of crimes and administrative violations related to the environment, natural resources, food safety.

3. Building and managing databases to serve the prevention and combating of crimes and administrative violations related to the environment, natural resources, food safety.

4. Participating in emergency response activities for environmental incidents, protecting natural resources, preventing and controlling environmental pollution in accordance with the law.

Article 5. Measures of work and operational measures shall be applied to organize prevention and combat against criminal offenses and administrative violations concerning the environment, natural resources, and food safety.

The environmental crime prevention and combat force^[6] The following measures of work and operational measures shall be applied:

1. Mobilization of the masses, legal measures, diplomacy, economy, science and technology, operational measures, and armed forces in accordance with the Law on People's Police; other operational measures as prescribed by relevant legal documents.

2. Deployment of personnel to infiltrate and understand the activities of criminals and violators of laws concerning the environment, natural resources, and food safety.

3. Deployment of forces to monitor the activities of individuals who have signs of committing crimes or although they do not yet have signs of committing crimes but there is clear evidence that they are directly related to criminal offenses and violations of laws concerning the environment, natural resources, and food safety.

Article 6. Requesting agencies, organizations, enterprises, and individuals to provide information, documents, and objects related to criminal offenses and administrative violations concerning the environment, natural resources, and food safety.

Environmental crime prevention and suppression police force^[7] may request agencies, organizations, enterprises, and individuals:

a) To provide information, documents, and objects related to criminal offenses and administrative violations concerning the environment, natural resources, and food safety for verification and clarification of such criminal offenses and administrative violations when there are reports or tips about criminal offenses or administrative violations within their jurisdiction or where violations occur under their management;

b) To explain actions that have signs of criminal offenses and administrative violations concerning the environment, natural resources, and food safety.

2. Information, documents, and objects provided by agencies, organizations, enterprises, and individuals must be managed, used, and processed according to the intended purpose and requirements for inspection; in case of loss, damage, or theft causing losses to agencies, organizations, enterprises, and individuals, compensation must be made and legal sanctions applied.

3.^[8] Authority to request provision of information, documents, and objects; requesting explanations about actions with signs of criminal offenses and administrative violations:

a) Director of the Environmental Crime Prevention and Control Police Bureau;

b) Provincial Public Security Director;

c) Head of the Provincial Public Security Department's Anti-Corruption, Economic, Smuggling, and Environmental Crime Investigation Division;

d) Head of the Public Security Department at the district level.

Article 7. Inspection of compliance with laws concerning the environment, natural resources, and food safety.

1. Based on Clause 5, Article 7 of the Ordinance on Environmental Police, the environmental crime prevention and suppression police force^[9] may conduct inspections of compliance with laws concerning the environment, natural resources, and food safety by agencies, organizations, enterprises, and individuals if any of the following grounds exist:

a) When directly discovering signs of criminal offenses and administrative violations concerning the environment, natural resources, and food safety;

b) When receiving reports or tips about criminal offenses and administrative violations concerning the environment, natural resources, and food safety;

c) Requests for handling complaints and denunciations in the prevention and suppression of criminal offenses and administrative violations concerning the environment, natural resources, and food safety.

2.^[10] Authority to issue inspection decisions:

a) Director of the Environmental Crime Prevention and Control Police Bureau;

b) Provincial Public Security Director;

c) Head of the Provincial Public Security Department's Anti-Corruption, Economic, Smuggling, and Environmental Crime Investigation Division;

d) Head of the Public Security Department at the district level.

3. The Minister of Public Security shall specify in detail the procedures, formalities, and powers for inspections.

Article 8. Inspection of means, objects, and locations related to crimes and administrative violations concerning the environment, natural resources, and food safety.

Environmental crime prevention and suppression police force^[11] Such inspections may be conducted when there is one of the bases prescribed in Clause 5, Article 7 of the Environmental Police Ordinance.

2.^[12] Authority to issue inspection decisions:

a) Director of the Environmental Crime Prevention and Control Police Bureau;

b) Provincial Public Security Director;

c) Head of the Provincial Public Security Department's Anti-Corruption, Economic, Smuggling, and Environmental Crime Investigation Division;

d) Head of the Public Security Department at the district level.

3. The Minister of Public Security shall specify in detail the procedures, formalities, and powers for inspections.

Article 9. Handling Administrative Violations Concerning the Environment, Natural Resources, and Food Safety.

Environmental crime prevention and suppression police force^[13] When directly discovering violations or receiving administrative violations concerning the environment, natural resources, and food safety transferred by other forces, they shall handle such administrative violations in accordance with the provisions of the law on handling administrative violations.

2.^[14] (Repealed)

Article 10. Delegation of Authority

1.^[15] The person authorized under Clause 3, Article 6; Clause 2, Article 7; and Clause 2, Article 8 of this Decree may delegate their authority to their deputy to perform their duties.

2. The delegation must be in writing, clearly defining the scope, content, and duration of the delegation, which can be carried out regularly or on a case-by-case basis. The deputy who is delegated must bear responsibility for their decisions before the law and before the superior. The person delegated may not further delegate to another person.

Article 11. Implementation of Testing and Appraisal Work Related to the Environment, Natural Resources, and Food Safety

Environmental crime prevention and suppression police force^[16] Directly testing or coordinating with competent agencies and organizations to test and appraise to verify, detect, and handle crimes and administrative violations concerning the environment, natural resources, and food safety, specifically:

a) Seizing, preserving, and using evidence and samples regarding the environment, natural resources, food, and other related samples.

For evidence and samples that need to be sealed, sealing must be done immediately after seizure; sealing must have the signatures of the seizing officers and representatives of the organizations or individuals whose evidence or samples are seized. In cases where the representatives of the organizations or individuals whose evidence or samples are seized are absent, a record of absence must be made. Evidence and samples sealed in these two situations have equal legal value. Testing and appraisal agencies, upon receiving evidence and samples, must make a record confirming the condition of the seal. When opening the seal, representatives from the testing and appraisal agency and the sample/evidence collection agency must be present.

b) Conducting measurements, analyses, testing, appraisals, and environmental monitoring.

c) Evaluating the results of measurements, analyses, testing, appraisals, and environmental monitoring and drawing conclusions. The results of testing and appraisal serve as grounds for handling crimes and administrative violations concerning the environment, natural resources, and food safety.

2. The list and procedures for using technical equipment for testing and appraising the environment, natural resources, and food safety shall be implemented in accordance with the regulations of the Government, the Ministry of Public Security, and relevant ministries and sectors.

Chapter III. COOPERATION IN PREVENTING AND COMBATING CRIMES AND ADMINISTRATIVE VIOLATIONS CONCERNING THE ENVIRONMENT, NATURAL RESOURCES, AND FOOD SAFETY

Article 12. Principles of Cooperation

1. Cooperation is based on the functions, tasks, and authorities of agencies and forces as prescribed by law; it does not obstruct legitimate activities of participating parties, ensuring unified state management according to each specialty.

2. Ministries and sectors, during their operations, cooperate with each other to promptly resolve cases and support each other in performing their functions, tasks, and authorities as prescribed by law.

3. During operations, if crimes and administrative violations concerning the environment, natural resources, and food safety are discovered, the Environmental Crime Prevention and Suppression Police Force^[17] shall handle them within their authority.

4. Other forces, when performing their duties and discovering crimes and administrative violations concerning the environment, natural resources, and food safety that fall outside their authority, have the responsibility to report and transfer them to the Environmental Crime Prevention and Suppression Police Force.^[18]The Environmental Crime Prevention and Suppression Police Force^[19] has the responsibility to notify in writing the results of investigations and handling of crimes and administrative violations to the transferring force.

5. For administrative violation cases concerning the environment, natural resources, and food safety that fall within the authority of multiple functional forces of ministries, sectors, and localities, the unit that discovers first shall take charge of processing the case and lead the administrative handling.

Article 13. Content of Cooperation

1. Studying, drafting, and promulgating legal normative documents and other documents related to cooperative work.

2. Exchanging information and materials on prevention, combating crimes and violations of laws concerning the environment, natural resources, and food safety.

3. Receiving and handling reports and accusations regarding crimes and violations of laws concerning the environment, natural resources, and food safety.

4. Inspecting, detecting, and handling crimes and administrative violations concerning the environment, natural resources, and food safety.

5. Testing, examining, analyzing, and monitoring to assist in verifying, detecting, and handling crimes and administrative violations concerning the environment, natural resources, and food safety.

6. Mobilizing people and means to prevent and combat crimes and violations of laws concerning the environment, natural resources, and food safety.

7. Remedying environmental incidents, protecting natural resources, and preventing and combating environmental pollution.

8. Summarizing and concluding preventive and combat work against crimes and violations of laws concerning the environment, natural resources, and food safety.

9. Propagating, disseminating, and educating the public about laws to protect the environment; preventing and combating crimes and violations of laws concerning the environment, natural resources, and food safety.

10. Training, instructing, and enhancing officers and soldiers of the Environmental Crime Prevention Police Force.^[20].

11. International cooperation activities.

12. Other cooperative activities related thereto.

Article 14. Responsibilities for Cooperation

1. Ministry of Public Security

a) Taking the lead and coordinating with the Ministry of Natural Resources and Environment, the Ministry of Health, and other relevant ministries and sectors in building and implementing strategies, policies, and plans for preventive and combat work against crimes and administrative violations concerning the environment, natural resources, and food safety;

b) Directing the Environmental Crime Prevention Police Force to establish cooperation regulations; taking the lead and coordinating with functional agencies under relevant ministries and sectors in inspecting, detecting, and handling crimes and administrative violations concerning the environment, natural resources, and food safety;^[21] c) Receiving and processing information on crimes and administrative violations concerning the environment, natural resources, and food safety;

d) Exchanging necessary information and materials on investigation, detection, and handling of administrative violations concerning the environment, natural resources, and food safety with relevant ministries and sectors;

e) Taking the lead or participating in cooperative activities as stipulated in Article 13 of this Decree.

2. Ministry of National Defense

Directing and guiding functional agencies to coordinate with the Environmental Crime Prevention Police Force

in the following activities:^[22] a) Reporting situations of violations of laws concerning the environment, natural resources, and food safety and other necessary information related to the functions and tasks of the Environmental Crime Prevention Police Force

in maritime, island, continental shelf, and border areas;^[23] b) Inspecting, detecting, and handling administrative violations concerning the environment, natural resources, and food safety in maritime, island, continental shelf, and border areas within their authority. Pursuing and arresting violators of laws concerning the environment, natural resources, and food safety when requested;

c) Handing over to the Environmental Crime Prevention Police Force

files, materials, means, and objects of cases involving violations of laws concerning the environment and natural resources within the authority of the Environmental Crime Prevention Police Force to handle.^[24] 3. Ministry of Natural Resources and Environment^[25].

Directing and guiding functional agencies to coordinate with the Environmental Crime Prevention Police Force

a) Exchanging necessary information and materials on state policies and legal normative documents related to environmental protection and natural resource management; reporting situations and results of inspections, examinations, and handling of administrative violations concerning the environment and natural resources;^[26] a) Reporting situations of violations of laws concerning the environment, natural resources, and food safety and other necessary information related to the functions and tasks of the Environmental Crime Prevention Police Force

b) Inspecting, detecting, and handling administrative violations concerning environmental protection and natural resource management in activities of exploration, exploitation, processing, utilization of mineral resources, land resources, water resources, marine and island resources, and biodiversity;

c) Guiding and supporting specialized technical and professional work in environmental and natural resource management; analyzing, monitoring, testing, and examining the environment and natural resources; applying environmental standards to determine violations of laws concerning the environment and natural resources; implementing research projects, training programs, and supervising environmental management and other state management work.

files, materials, means, and objects of cases involving violations of laws concerning the environment and natural resources within the authority of the Environmental Crime Prevention Police Force to handle.^[27] 4. Ministry of Health ^[28];

a) Exchanging necessary information and materials on state policies related to food safety; reporting situations of violations of laws concerning food safety and results of inspections, examinations, and handling of violations of laws concerning food safety, and related health activities;

b) Inspecting, detecting, and handling administrative violations concerning the environment in the health sector and food safety in production, business, transportation of foodstuffs, medicines, and health supplements;

a) Exchanging necessary information and materials on state policies and legal normative documents related to environmental protection and natural resource management; reporting situations and results of inspections, examinations, and handling of administrative violations concerning the environment and natural resources;^[29] a) Reporting situations of violations of laws concerning the environment, natural resources, and food safety and other necessary information related to the functions and tasks of the Environmental Crime Prevention Police Force

c) Training, instructing, guiding, and supporting the Environmental Crime Prevention Police Force

in specialized technical work in the health sector and food safety; analyzing, testing, and examining food safety; applying food safety standards.

files, materials, means, and objects of cases involving violations of laws concerning the environment and natural resources within the authority of the Environmental Crime Prevention Police Force to handle.^[30] 5. Ministry of Agriculture and Rural Development^[31];

d) Training, educating, guiding, and supporting environmental crime prevention police forces^[32] on specialized professional work in the healthcare and food safety sectors; analyzing, testing, and forensic evaluation of food safety; the application of food safety standards and regulations.

5. The Ministry of Agriculture and Rural Development

a) Exchanging necessary information and materials on state policies and legal normative documents related to environmental protection and natural resource management; reporting situations and results of inspections, examinations, and handling of administrative violations concerning the environment and natural resources;^[33] a) Reporting situations of violations of laws concerning the environment, natural resources, and food safety and other necessary information related to the functions and tasks of the Environmental Crime Prevention Police Force

a) Exchange information and necessary documents on policies and guidelines in state management; report situations and results of inspections, examinations, and handling of violations of laws related to the environment, natural resources, food safety in the fields of agriculture, forestry, aquaculture, and rural development;

b) Inspect, detect, and handle administrative violations concerning the environment, natural resources, and food safety in production, business, use of chemicals, plant protection products, environmental treatment products, fertilizers, agricultural waste; veterinary field, livestock breeds, animal feed, slaughtering, and processing products from animals; forest protection and development field; aquaculture, fishing, and seafood processing field; nature conservation activities;

c) Guide and support the Environmental Police Force in professional work;^[34] specialized tasks; inspection and appraisal work in the fields of agriculture, forestry, and aquaculture to detect and handle crimes and administrative violations concerning the environment, natural resources, and food safety;

6. The Ministry of Industry and Trade

a) Exchanging necessary information and materials on state policies and legal normative documents related to environmental protection and natural resource management; reporting situations and results of inspections, examinations, and handling of administrative violations concerning the environment and natural resources;^[35] a) Reporting situations of violations of laws concerning the environment, natural resources, and food safety and other necessary information related to the functions and tasks of the Environmental Crime Prevention Police Force

a) Exchange information and necessary documents on policies and guidelines in state management of industry and trade;

b) Inspect, detect, and handle crimes and administrative violations concerning the environment, natural resources, and food safety in the fields of machinery, metallurgy, electricity, renewable energy, oil and gas, chemicals, industrial materials, mining and mineral processing industries, food industry, other processing industries, export, import, and other areas under the management of the Ministry of Industry and Trade;

c) Guide and support the Environmental Police Force in professional work;^[36] specialized tasks in the fields of industry and trade to detect and handle crimes and administrative violations concerning the environment, natural resources, and food safety;

7. The Ministry of Finance

a) Exchanging necessary information and materials on state policies and legal normative documents related to environmental protection and natural resource management; reporting situations and results of inspections, examinations, and handling of administrative violations concerning the environment and natural resources;^[37] a) Reporting situations of violations of laws concerning the environment, natural resources, and food safety and other necessary information related to the functions and tasks of the Environmental Crime Prevention Police Force

a) Inspect, prevent, and handle administrative violations concerning the environment, natural resources, and food safety in export and import activities; smuggling and illegal transportation of goods across borders according to the functions of state management of customs;

b) Transfer case files, documents, means, and objects of cases violating laws on the environment and natural resources, food safety within the authority to handle by the Environmental Police Force;^[38];

c) Guide and support the Environmental Police Force in professional work;^[39] specialized tasks in the field of Customs;

d) Coordinate with the Ministry of Public Security to ensure funding for the operations of the Environmental Police Force^[40] pursuant to Article 18 of this Decree;

8. The Ministry of Science and Technology

a) Exchanging necessary information and materials on state policies and legal normative documents related to environmental protection and natural resource management; reporting situations and results of inspections, examinations, and handling of administrative violations concerning the environment and natural resources;^[41] a) Reporting situations of violations of laws concerning the environment, natural resources, and food safety and other necessary information related to the functions and tasks of the Environmental Crime Prevention Police Force

a) Guide and exchange information and experience on the management and use of technical measurement instruments, analytical, and testing equipment serving inspection and appraisal work concerning the environment, natural resources, food safety, radiation, and nuclear safety;

b) Organize the implementation of calibration and verification of technical measurement instruments used in environmental inspection; advise, evaluate, and recognize the conformity of environmental inspection and appraisal units belonging to the Environmental Police Force^[42] with national and international standards that Vietnam participates in regarding laboratory quality management, testing, inspection, and appraisal;

c) Take the lead and coordinate in inspecting compliance with legal provisions on measurement, electric field, magnetic field, radiation, and nuclear safety;

d) Organize seminars, conferences, training, and education on the application of technical regulations, national and international standards on measurement and quality in the fields of the environment and natural resources, food safety;

9. Responsibilities of Ministries, agencies at the level of ministries, and government agencies

a) Guide and inspect subordinate units to implement the provisions of this Decree;

b) Direct and guide functional agencies to cooperate with the Environmental Police Force^[43] to inspect and handle administrative violations concerning the environment, natural resources, and food safety according to their functions and responsibilities; support and create favorable conditions for the Environmental Police Force^[44] to perform their duties;

10. Responsibilities of Provincial People's Committees and Municipalities directly under the Central Government

a) Guide departments, sectors, and subordinate units to study and implement the provisions of this Decree within their functions and responsibilities;

b) Coordinate with competent state agencies to implement and urge the implementation of policies, strategies, plans to prevent and combat crime and administrative violations concerning the environment, natural resources, and food safety;

c) Direct specialized agencies and lower-level People's Committees to cooperate with the Environmental Police Force^[45] in inspections, detection, and handling of violations of laws concerning the environment, natural resources, and food safety; support and create favorable conditions for the Environmental Police Force^[46] to perform their duties;

d) Allocate local budget funds for environmental crime prevention and law enforcement concerning the environment, natural resources, and food safety in accordance with the current State Budget Law;

Chapter IV. ENSURING OPERATIONS AND REGULATIONS, POLICIES FOR THE ENVIRONMENTAL POLICE FORCE^[47]

Article 15. Training and Selection of Human Resources

Environmental crime prevention and suppression police force^[48] Priority shall be given to selecting outstanding students graduating from academies and universities who meet the required standards for training and supplementing the Environmental Crime Prevention Police force.^[49].

2. The Environmental Crime Prevention Police Force^[50] shall select officers and non-commissioned officers to attend training institutions both domestically and internationally to train in fields and professions suitable for their tasks.

3. The Ministry of Public Security shall take the lead and coordinate with the Ministry of Education and Training, the Ministry of Labor, Invalids and Social Affairs, and relevant agencies to specify detailed regulations on training and procedures for selecting graduates; the selection and dispatch of officers and non-commissioned officers to training institutions.

Article 16. Investment to Enhance Capabilities of the Environmental Crime Prevention Police Force^[51]

1. The Ministry of Planning and Investment shall take the lead and coordinate with the Ministry of Public Security, the Ministry of Finance, and related ministries and sectors to allocate state budget funds to develop projects and programs to enhance the capabilities of the Environmental Crime Prevention Police Force.^[52].

2. The Environmental Crime Prevention Police Force^[53] Investments shall be made in material infrastructure, office premises, equipment, and technical devices to meet the requirements of crime prevention and administrative violations concerning the environment, natural resources, and food safety.

3. The Ministry of Public Security shall cooperate with relevant ministries and sectors, and People's Committees at all levels to invest in and build infrastructure, equipment, and technical devices to meet the operational needs of the Environmental Crime Prevention Police Force.^[54].

Article 17. Allowances

1. Officers and soldiers of the Environmental Crime Prevention Police Force^[55] shall enjoy benefits and policies according to the laws applicable to officers and soldiers of the People's Public Security, in addition to hazardous duty allowances as prescribed by law.

2. The Ministry of Public Security shall take the lead and coordinate with relevant ministries and sectors to specify detailed regulations on hazardous duty allowances for the Environmental Crime Prevention Police Force.^[56].

Article 18. Operating Expenses of the Environmental Crime Prevention Police Force^[57]

1. Operating expenses of the Environmental Crime Prevention Police Force^[58]:

a) The state budget shall ensure the operation of the Environmental Crime Prevention Police Force^[59] in accordance with the State Budget Law;

b) Annual expenditure for environmental protection services; donations and contributions from agencies, organizations, individuals, and other lawful sources;

c) The content of expenditures to ensure the operation of the Environmental Crime Prevention Police Force^[60] shall be implemented in accordance with current regulations on environmental protection, natural resources, and food safety.

2. The Ministry of Public Security shall direct the Environmental Crime Prevention Police Force^[61] to prepare annual operating expense budgets^[62] for submission to competent authorities for approval and implementation.

Chapter V. IMPLEMENTING PROVISIONS ^[63]

Article 19. Effective Date of Implementation

This Decree shall take effect from December 5, 2015.

Decree No. 72/2010/NĐ-CP dated August 7, 2010, regarding the prevention and combat of environmental crimes and other illegal acts shall cease to be effective from the date this Decree takes effect.

Article 20. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial and municipal People's Committees directly under the central government, and relevant agencies shall be responsible for implementing this Decree./.

^[1] Decree No. 157/2024/NĐ-CP dated December 16, 2024 of the Government amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance is based on the following:

"Pursuant to the Government Organization Law dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Government Organization Law and the Local Administration Law dated November 22, 2019;

Pursuant to the Environmental Police Ordinance dated December 23, 2014;

The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.

The Government promulgates this Decree amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance".

^[2] The phrase "Environmental Police Force" is replaced by the phrase "Environmental Crime Prevention Police Force" as stipulated in Point a Clause 1 Article 2 of Decree No. 157/2024/NĐ-CP dated December 16, 2024 of the Government amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which shall take effect from December 20, 2024.

^[3] The phrase "Environmental Police" is replaced by the phrase "Environmental Crime Prevention Police Force" as stipulated in Point b Clause 1 Article 2 of Decree No. 157/2024/NĐ-CP dated December 16, 2024 of the Government amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which shall take effect from December 20, 2024.

^[4] The phrase "Environmental Police" is replaced by the phrase "Environmental Crime Prevention Police Force" as stipulated in Point b Clause 1 Article 2 of Decree No. 157/2024/NĐ-CP dated December 16, 2024 of the Government amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which shall take effect from December 20, 2024.

^[5] The phrase "Environmental Police" is replaced by the phrase "Environmental Crime Prevention Police Force" as stipulated in Point b Clause 1 Article 2 of Decree No. 157/2024/NĐ-CP dated December 16, 2024 of the Government amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which shall take effect from December 20, 2024.

^[6] The phrase "Environmental Police" is replaced by the phrase "Environmental Crime Prevention Police Force" as stipulated in Point b Clause 1 Article 2 of Decree No. 157/2024/NĐ-CP dated December 16, 2024 of the Government amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which shall take effect from December 20, 2024.

^[7] The phrase "Environmental Police" is replaced by the phrase "Environmental Crime Prevention Police Force" as stipulated in Point b Clause 1 Article 2 of Decree No. 157/2024/NĐ-CP dated December 16, 2024 of the Government amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which shall take effect from December 20, 2024.

^[8] This clause has been amended as stipulated in Clause 1 Article 1 of Decree No. 157/2024/NĐ-CP dated December 16, 2024 of the Government amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which shall take effect from December 20, 2024.

^[12] This clause has been amended as stipulated in Clause 3 Article 1 of Decree No. 157/2024/NĐ-CP dated December 16, 2024 of the Government amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which shall take effect from December 20, 2024.

^[14] This clause is repealed pursuant to Clause 2, Article 2 of Decree No. 157/2024/NĐ-CP dated December 16, 2024, of the Government amending and supplementing certain provisions of Decree No. 105/2015/NĐ-CP dated October 20, 2015, of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which takes effect from December 20, 2024.

^[15] This clause is amended pursuant to Clause 4, Article 1 of Decree No. 157/2024/NĐ-CP dated December 16, 2024, of the Government amending and supplementing certain provisions of Decree No. 105/2015/NĐ-CP dated October 20, 2015, of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which takes effect from December 20, 2024.

^[16] The phrase "Environmental Police" is replaced by the phrase "Environmental Crime Prevention Police Force" as stipulated in Point b Clause 1 Article 2 of Decree No. 157/2024/NĐ-CP dated December 16, 2024 of the Government amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which shall take effect from December 20, 2024.

^[56] The phrase "Environmental Police" is replaced by the phrase "Environmental Crime Prevention Police Force" as stipulated in Point b Clause 1 Article 2 of Decree No. 157/2024/NĐ-CP dated December 16, 2024 of the Government amending and supplementing certain articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which shall take effect from December 20, 2024.

^[63] Article 3 of Decree No. 157/2024/NĐ-CP dated December 16, 2024, of the Government amending and supplementing certain provisions of Decree No. 105/2015/NĐ-CP dated October 20, 2015, of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance, which takes effect from December 20, 2024, provides as follows:

“Article 3. Effectiveness

This Decree takes effect from December 20, 2024.
