CIRCULAR

JOINT CIRCULAR OF THE MINISTRY OF LABOR, INVALIDS AND SOCIAL AFFAIRS AND THE MINISTRY OF FINANCE NO. 03/2000/TTLT-BLDTBXH-BTC DATED JANUARY 26, 2000 ON GUIDELINES FOR IMPLEMENTING THE ADJUSTMENT OF MONTHLY SUBSIDIES AND ALLOWANCES FOR PERSONS ENGAGED IN REVOLUTIONARY ACTIVITIES, FAMILIES OF VICTIMS OF WAR, WOUNDED VETERANS, DISABLED VETERANS, AND PERSONS WHO HAVE CONTRIBUTED TO THE REVOLUTIONARY CAUSE
REVOLUTIONARY

I. Recipients and levels of monthly allowances effective from January 1, 2000

After being permitted by the Prime Minister, and having reached a consensus with the Central Party Organization Committee and the Government Civil Service Organization Committee, the Joint Circular of the Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance hereby provides guidelines for adjusting monthly subsidies and allowances for persons engaged in revolutionary activities, families of victims of war, wounded veterans, disabled veterans, and persons who have contributed to the revolutionary cause as follows:

I. SUBJECTS AND AMOUNTS OF MONTHLY SUBSIDIES AND ALLOWANCES
IMPLEMENTATION EFFECTIVE FROM JANUARY 1, 2000:

1. Persons engaged in revolutionary activities before 1945:

a. Subsidy amount: 135,000 VND/month

b. Main dependents of persons engaged in revolutionary activities before 1945 who have passed away:

a) Mothers of Vietnam Heroic Martyrs:

Allowance level: 350,000 VND/month.

2. Persons engaged in revolutionary activities before the August Revolution in 1945 ("pre-revolution"):

Care pension allowance level: 290,000 VND/person/month

3/. Dependents of烈士:

a) Mothers of Vietnam Heroic Martyrs:

Allowance level: 350,000 VND/month.

3. Dependents of martyrs:

4. Mothers of Vietnam Heroic Mothers, Heroes of the People's Armed Forces, and Labor Heroes:

a. Mothers of Vietnam Heroic Mothers:

Subsidy amount: 350,000 VND/month.

Subsidy amount for nurturing mothers living alone without support: 400,000 VND/month.

b. Heroes of the People's Armed Forces and Labor Heroes:

Subsidy amount: 80,000 VND/month.

5. Wounded Veterans:

a. Wounded Veterans and persons receiving benefits equivalent to those of wounded veterans:

The monthly subsidy amount is calculated as: 3,588 VND x % disability rate due to injury (see attached appendix).

b. Wounded Veteran Category B (confirmed prior to December 31, 1993, now referred to as military personnel injured in work-related accidents):

- Disability rate from 21% to 30%: Subsidy amount = 62,000 VND/month.

- Disability rate from 31% to 40%: Subsidy amount = 77,000 VND/month.

- Disability rate from 41% to 50%: Subsidy amount = 108,000 VND/month.

- Disability rate from 51% to 60%: Subsidy amount = 123,000 VND/month.

- Disability rate from 61% to 70%: Subsidy amount = 169,000 VND/month.

- Disability rate from 71% to 80%: Subsidy amount = 200,000 VND/month.

- Disability rate from 81% to 90%: Subsidy amount = 246,000 VND/month.

- Disability rate from 91% to 100%: Subsidy amount = 277,000 VND/month.

c. Caregivers for wounded veterans Category A, Category B, and persons receiving benefits equivalent to those of wounded veterans with a disability rate of 81% or higher residing at home:

Subsidy amount for caregivers of wounded veterans with a disability rate of 81% or higher: 132,000 VND/month.

Subsidy amount for caregivers of wounded veterans with a disability rate of 81% or higher with particularly severe injuries: 165,000 VND/month.

d. Main dependents of wounded veterans and persons receiving benefits equivalent to those of wounded veterans with a disability rate of 61% or higher who have passed away:

Basic pension amount: 72,000 VND/person/month.

Nurturing pension amount: 126,000 VND/person/month.

6. Disabled Veterans:

a. Monthly subsidy amount for disabled veterans:

Disability rate from 61% to 70%: subsidy amount = 180,000 VND/month.

Disability rate from 71% to 80%: subsidy amount = 207,000 VND/month.

Disability rate from 81% to 90%: subsidy amount = 249,000 VND/month.

Disability rate from 91% to 100%: subsidy amount = 277,000 VND/month.

b. Disabled Veteran Category 3 (confirmed prior to December 31, 1994, now referred to as military personnel suffering from occupational diseases):

- Disability rate from 41% to 50%: subsidy amount = 97,000 VND/month.

- Disability rate from 51% to 60%: subsidy amount = 110,000 VND/month.

c. Caregivers for disabled veterans with a disability rate of 81% or higher residing at home:

Subsidy amount for caregivers of disabled veterans with a disability rate of 81% or higher: 132,000 VND/month.

Subsidy amount for caregivers of disabled veterans with a disability rate of 81% or higher with particularly severe illnesses: 165,000 VND/month.

d. Main dependents of wounded veterans and persons receiving benefits equivalent to those of wounded veterans with a disability rate of 61% or higher who have passed away:

Basic pension amount: 72,000 VND/person/month.

d. Main dependents of disabled veterans with a disability rate of 61% or higher who have passed away:

7. Persons who have contributed to the revolutionary cause:

a. Persons who have contributed to the revolutionary cause before the August Revolution in 1945:

Basic subsidy amount: 90,000 VND/month.

Nurturing subsidy amount: 290,000 VND/month.

b. Persons who have contributed to the revolutionary cause during the resistance war:

Basic subsidy amount: 65,000 VND/month.

Nurturing subsidy amount: 200,000 VND/month.

Any subsidies and allowances not specified in this Circular shall remain unchanged from their levels in December 1999.

II. FUNERAL SUBSIDIES:

For individuals confirmed as martyrs; wounded veterans and disabled veterans with a disability rate of 61% or higher; Mothers of Vietnam Heroic Mothers; main dependents of martyrs and persons who have contributed to the revolutionary cause who have passed away while receiving nurturing subsidies, the person responsible for burial will be provided with funeral expenses (burial fees) equivalent to those for deceased civil servants and government officials (effective from January 1, 2000, the amount is 1,440,000 VND).

III. REGIONAL ALLOWANCES (IF APPLICABLE):

Calculated according to the general regulations of the State based on the current minimum wage (the minimum wage implemented from January 1, 2000 is 180,000 VND/month).

IV. PROCEDURES FOR DOCUMENTATION:

1. The Department of Labor, Invalids and Social Affairs (Department of Organizational Labor and Social Affairs) at the district level shall prepare two copies of the list according to Model No. 01, send one copy to the Provincial Department of Labor, Invalids and Social Affairs, and retain one copy.

2. The Provincial Department of Labor, Invalids and Social Affairs shall compile a summary of subjects eligible for adjustment of subsidies and allowances according to Model No. 02 (three copies), submit it to the Provincial People's Committee for decision, and then send two copies to the Ministry of Labor, Invalids and Social Affairs (Veterans and Persons Contributing to the Revolutionary Cause Bureau), and retain one copy.

3. The Ministry of Labor, Invalids and Social Affairs shall compile a summary of subjects eligible for adjustment of subsidies and allowances, prepare a budget estimate for additional subsidy and allowance funds, and submit it to the Ministry of Finance.

4. The Ministry of Finance shall allocate funds based on the budget estimate of the Ministry of Labor, Invalids and Social Affairs, and delegate the additional subsidy and allowance funds for subjects eligible for adjustment according to the regulations.

5. Upon receipt of the notification of funds, the Director of the Provincial Department of Labor, Invalids and Social Affairs shall report to the Provincial People's Committee to adjust subsidies and allowances according to the approved list.

V. IMPLEMENTATION:

2/. Provisionally, to ensure that the subjects can promptly benefit from the adjusted allowance and subsidy levels as guided by this Circular starting from January 2000, the Ministry of Finance will temporarily allocate the additional allowance and subsidy fund for January and the first quarter of 2000 for localities to implement. From the second quarter of 2000 onwards, the Ministry of Finance will allocate the additional allowance and subsidy fund to localities after the provincial-level approval list has been reviewed.

3/. The Department of Labor, Invalids, and Social Affairs; the Department of Finance and Prices; and the Provincial Treasury have the responsibility to coordinate, guide, and organize the implementation of the contents stipulated in this Circular accurately.

4/. The Ministry of National Defense and the Ministry of Public Security shall, after reaching an agreement with the Ministry of Labor, Invalids, and Social Affairs and the Ministry of Finance, issue guidelines for implementation concerning armed forces under their management.

5/. This Circular takes effect from January 1, 2000.

In the course of implementation, if there are any difficulties, they should be reported to the Joint Ministries for resolution.
