ACTION PROGRAM OF THE MINISTRY OF LABOR - INVALIDS AND SOCIAL AFFAIRS ON PRACTICING THRIFT AND COMBATING WASTE
AND SOCIETY ON PRACTICING ECONOMY AND COMBATING WASTEFULNESS

A. OBJECTIVES AND REQUIREMENTS OF THE PROGRAM
1. Objectives
- To prevent and curb the wasteful practices currently occurring in various fields of the Ministry and sector, enhancing the efficiency of management and utilization of financial resources for the development of these fields, contributing to political stability, social harmony, and economic development.
- To raise the sense of responsibility of heads of agencies, organizations, units, and civil servants, public officials, and employees under the Ministry and sector regarding practicing thrift and combating waste.
- To serve as a basis for units under the Ministry and sector to develop action programs on practicing thrift and combating waste within their areas of management; to make practicing thrift and combating waste a regular task of each agency and unit.
2. Requirements
- To concretize tasks and solutions on practicing thrift and combating waste in all areas of management of the Ministry and sector based on the current system of normative legal documents of the State guiding the implementation of the Law on Practicing Thrift and Combating Waste.
- To organize and implement immediately in 2006 in key areas, creating strong and effective changes in the program on practicing thrift and combating waste.
- To disseminate and ensure understanding of the Law on Practicing Thrift and Combating Waste and guiding documents to units, bases, and civil servants, public officials, and employees of the Ministry and sector.
B. KEY TASKS OF THE ACTION PROGRAM
1. Thrift in financial and asset management
1.1. For primary and secondary budgetary units, the following contents should be strictly implemented:
- Strictly adhere to the provisions of the State Budget Law from the stage of review, consolidation, allocation, and approval of final accounts of the State Budget for subordinate units, ensuring procedures, formalities, policies, standards, and quotas for specific fields.
- Study, establish, and issue criteria as a basis for evaluating the completion of tasks by each directly using budgetary unit; determine the corresponding budget funds that can be settled based on the level of task and plan indicators completed by each unit in the year.
- Guide and inspect directly using budgetary units to build and perfect internal expenditure regulations according to regulations, ensuring the compatibility between state mechanisms and policies with the characteristics of activities and financial capacity of the unit.
- Review, decide on vehicle procurement, disposal, and transfer according to prescribed quotas and standards; those who decide to purchase, transfer, or dispose of vehicles contrary to regulations must bear responsibility for the violations they cause according to the law.
- Save and enhance the effectiveness of State Budget usage in non-routine activities (scientific research, seminars, training...): Review scientific research tasks for 2006; expand tendering, bidding, and selection mechanisms for organizations and individuals to undertake scientific research projects; review regulations on project acceptance and evaluation. Combine conferences, seminars, and training sessions with practical content and expenses according to regulations.
- Conduct comprehensive inspections of land and vehicle management and usage by units under the Ministry to allocate and use them for appropriate purposes, within quotas, saving effectively; resolutely recover all areas of houses and land used for purposes other than intended such as leasing, lending, production, business services not within the scope of functions, or housing for staff interspersed within the premises. Implement vehicle transfers among units under the Ministry from surplus to shortage according to the Ministry of Finance's regulations.
- Strengthen discipline in final account approval for directly using budgetary units according to the principle that those making incorrect payment decisions must compensate materially; heads of units under the Ministry must be accountable to the Minister for any violations by their unit and subordinate units.
1.2. For account holders and accounting managers of directly using budgetary units, the following main contents should be concentrated on:
- Fully disseminate the state mechanism and policy on self-management and self-responsibility for organization, staffing, and finance for administrative agencies and public service units to all cadres, civil servants, and employees of the unit.
- Implement restructuring towards simplicity and suitability with the characteristics of the unit's activities to save and combat waste in labor use.
- Review and reassess economic and technical norms in production, functional rehabilitation treatment, materials for vocational training... amend, supplement or establish internal expenditure regulations in accordance with the guidance of the Ministry of Finance, domestic travel regulations, electricity usage for lighting, office supplies, telephone, fax machine usage, ensuring they are suitable to the actual situation, enhancing the quality of unit activities, saving funds to increase salaries and bonuses for workers.
- Save in organizing commemorative ceremonies, awarding and receiving state honors, medals, flags of excellence, commendation certificates... The organization of commemorative ceremonies should combine multiple contents and subjects into a single event; link commemorative ceremonies with the awarding and receiving of state honors, medals, and commendation certificates for collectives and individuals. Strictly review the number of invited guests, shorten the duration of the ceremony to be practical, not ostentatious or formalistic. From 2006, the organization of such events by units under the Ministry must be approved by the Ministry's leadership.
- Save in organizing conferences; overseas visits and surveys. Limit the organization of conferences, integrate conference contents, shorten conference durations, do not organize receptions and gift-giving, do not combine with sightseeing or vacations; conference expenditures must comply with prescribed regulations. Overseas work trips for surveying and learning must have practical content, not overlap, involve the correct personnel, and not combine with policy resolution and sightseeing or tourism.
- Combat waste in awarding bonuses and gifts outside the prescribed system: Strictly prohibit using State budget and public funds derived from the State budget for giving, presenting, or awarding gifts outside the prescribed regulations. Individuals deciding on the use of State or collective funds for awards, gifts, or presentations that violate the regulations must reimburse the public fund in full and face disciplinary action according to the severity of the violation.
- Save in property management: Property and equipment procurement must comply with established standards and prescribed regulations. Define individual and departmental responsibilities in managing, using, maintaining, and repairing property and equipment of agencies and units...
- Seriously implement measures to practice thrift and combat wastefulness in fuel consumption according to Directive No. 23/CT-TTg dated June 18, 2004, of the Prime Minister. Each agency and unit must review their fuel consumption norms. Strictly prohibit the use of official vehicles for personal matters, transporting officials who do not meet the criteria for private vehicle use from their residence to workplace; reasonably organize and utilize official vehicles for fieldwork, meetings, commemorations, and reception services; strictly handle officials who misuse official vehicles for personal purposes, requiring them to compensate for fuel costs and undergo criticism before the agency or unit and other forms of disciplinary action according to the severity of the violation.
- Study and review the management and payment procedures for preferential allowances for persons who have contributed to the revolution at all stages: increasing or decreasing beneficiaries; adjusting allowances, clearly defining the responsibilities of individuals and units in verifying and reviewing application files, reporting reduced beneficiaries, advance payments, and final settlements. Severely handle cases of false declarations, improper benefits from state policies, individuals or organizations providing improper benefits, and delayed reductions, requiring full reimbursement of improperly paid amounts and facing legal penalties according to the law.
1.3. Practicing thrift for each civil servant and employee
- Strictly adhere to working hours as stipulated by the Labor Code, responsibility systems as prescribed by the Civil Servant Ordinance, internal rules, labor discipline of the agency or unit to enhance the effectiveness of productive work time.
- Actively study and train to promptly update political awareness, professional expertise, and occupational ethics to meet assigned tasks' requirements.
- Practice thrift at the workplace like using telephones, electricity for lighting, office supplies, gasoline for vehicles...
2. Thrift in investment construction management
- Conduct a comprehensive review of all projects scheduled in the 2006 plan to submit to the Ministry for decision-making based on the following principles:
+ For projects currently preparing for investment: Reassess the investment plans, re-examine planning and technical requirements. If deemed ineffective, do not proceed with investment. Temporarily halt or terminate investment for projects not within approved planning and plans.
+ For ongoing projects: Review and calculate, if necessary, modify and supplement technical solutions, ensure synchronization, adjust scale appropriately, guarantee project effectiveness. If continued investment is deemed ineffective, decisively stop investment.
- Review the allocation of investment capital for 2006, ensuring the following priority principles:
+ Pay off debts from previous years' volumes and completed projects already approved for settlement.
+ Allocate sufficient funds for ongoing projects to be completed in 2006.
+ Finally allocate funds for new projects starting in 2006 if conditions and procedures comply with regulations.
Investment capital allocation must ensure that Group C projects are completed within two years, Group B projects within four years, and must be included in the five-year plan (2006-2010) and approved master plans. Publicize investment capital allocation according to Decision No. 192/2004/QĐ-TTg dated November 16, 2004, of the Prime Minister.
- Implement reviews, organize, and streamline project management boards towards simplicity and efficiency, ensuring adequate professional capacity for project management. Strengthen supervision and evaluation of each project, implementing synchronized monitoring through channels: management oversight, technical quality management oversight, independent consultant oversight, community oversight.
- Conduct bidding in accordance with regulations to ensure transparency and fairness, enhancing the quality of bid evaluation work. Strictly prohibit the practice of dividing bids into smaller packages for direct assignment without transparent bidding procedures.
- Implement regular inspection systems for construction investment projects, project sponsors, and construction management units; conduct on-site inspections for ongoing projects. Focus on supervising technical acceptance and quality assessment of each component and section of the works; address delays in finalizing and settling accounts in basic construction, reducing quantities and quality of materials used in projects.
- In 2006, complete settlement and approval of settlements for projects completed before 2004 that still have pending issues.
3. Economy in managing and using aid funds
Concentrate on reviewing programs and projects funded by state budget. Utilize foreign aid effectively and in accordance with intended purposes and goals; decisively terminate programs and projects that are behind schedule and have low efficiency; implement integration of similar programs and projects conducted in the same area to reduce project management costs and intermediary costs, focusing funds on beneficiaries.
4. Economy in managing and using capital and assets at state-owned enterprises
4.1. For enterprises, focus on implementing the following contents:
- Conduct reviews and reassessments of investment projects under preparation or implementation to take appropriate measures, ensuring investment effectiveness when projects are completed and put into use.
- Develop and issue internal financial mechanisms, economic and technical norms, labor and material standards, and cost measures; promptly address and prevent asset losses and non-performing debts.
- Effectively carry out internal self-inspection and supervision in areas related to resource mobilization and utilization for production and business operations, labor use and wage payment, compliance with laws and enterprise regulations; promptly identify and handle actions causing wastage of state capital and assets.
- Strictly comply with annual mandatory auditing according to Decree No. 105/2004/NĐ-CP dated March 31, 2004 of the Government, publicly disclose financial statements as required, and annually self-assess and classify their own enterprises.
- Self-inspect the management and use of real estate and vehicles; take measures to thoroughly rectify violations such as recovering improperly allocated land areas, stopping the purchase and use of vehicles beyond standard specifications.
- Develop and submit to the Ministry a proposal to enhance labor productivity of enterprises during the period 2006-2010 in accordance with the spirit of Central Resolution III and Decision No. 155/2004/QĐ-TTg dated August 24, 2004 of the Prime Minister.
4.2. For the Ministry:
- Fully perform the supervisory functions of the owner's representative towards enterprises according to Decision No. 271/2003/QĐ-TTg dated March 31, 2003 of the Prime Minister. Annually organize comprehensive analysis and evaluation of enterprise activities and classify them, proposing solutions to address shortcomings and improve enterprise performance.
- Fully exercise rights and responsibilities of the owner's representative in making investment decisions, providing loan guarantees, etc., as stipulated in Decree No. 132/2005/NĐ-CP dated October 20, 2005 of the Government; supervise the signing and execution of economic contracts in investment, construction, production-business, and monitor management expenses of state-owned enterprises directly under the Ministry.
- Develop and submit to the Government a comprehensive plan to restructure and enhance the operational efficiency of three enterprises directly under the Ministry during the period 2006-2010 in accordance with the spirit of Central Resolution III and Decision No. 155/2004/QĐ-TTg dated August 24, 2004 of the Prime Minister.
5. Practicing economy in wedding, funeral, and longevity celebration ceremonies
- All cadres, civil servants, and employees of agencies under the Ministry must strictly adhere to the regulations on civilized practices in weddings, funerals, and festivals according to Decision No. 308/2005/QĐ-TTg dated November 25, 2005 of the Prime Minister.
- Strictly prohibit cadres, civil servants, party members from taking advantage of weddings, funerals, birthdays, longevity celebrations, promotions, etc., for personal gain. Violations will be handled according to the severity and nature of the offense.
6. Economy in organizational and personnel work
- Review functions and tasks, allocate staffing quotas for administrative management agencies; implement autonomy in organization and staffing for units in accordance with government regulations.
- Inspect and publicize cadre leadership planning; implement training and retraining of cadres according to plans; review, amend, and publicize cadre management decentralization regulations and procedures for promotion and salary increase for cadres, civil servants, and employees of subordinate units.
C. IMPLEMENTATION MEASURES FOR THE ACTION PROGRAM
1. Strengthen information dissemination:
News agencies and magazines, and heads of agencies under the Ministry and sectors shall disseminate and popularize the Law on Thrift and Combating Wastefulness, the Government's Action Program to all cadres, workers, and employees within their units.
2. Establish thrift and anti-wastefulness steering committees at three levels
- At the Ministry level: Establish a Ministry Steering Committee headed by the Minister, with the Director of the Department of Planning and Finance serving as the Deputy Chairman in charge, the Directors of the Cadre Management Department and the Inspectorate serving as Deputy Chairmen, and other members tasked with guiding thrift and anti-wastefulness efforts within the Ministry and reporting periodically to the Ministry of Finance for consolidation and reporting to the Prime Minister.
- In các Tổng cục, Cục trực thuộc, thành lập Ban chỉ đạo do đồng chí Thủ trưởng đơn vị làm Trưởng ban, đồng chí phụ trách công tác kế hoạch tài chính là Phó trưởng ban thường trực và một số thành viên khác, có nhiệm vụ chỉ đạo công tác thực hành tiết kiệm, chống lãng phí thuộc phạm vi, lĩnh vực được giao quản lý và định kỳ báo cáo kết quả về Ban chỉ đạo của Bộ, ngành hoặc cấp trên trực tiếp.
- In Sở Lao động - Thương binh và Xã hội và các đơn vị dự toán cấp 3 trực thuộc Bộ: thành lập Ban chỉ đạo do đồng chí Thủ trưởng đơn vị làm trưởng ban, đồng chí phụ trách công tác kế toán là Phó trưởng ban thường trực và một số thành viên khác, có nhiệm vụ chỉ đạo công tác thực hành tiết kiệm, chống lãng phí thuộc phạm vi, lĩnh vực quản lý của đơn vị mình và định kỳ báo cáo kết quả về Ban chỉ đạo của Bộ, ngành hoặc cấp trên trực tiếp.
- Các Ban chỉ đạo họp định kỳ 3 tháng một lần, họp đột xuất theo yêu cầu của Trưởng ban; các thành viên ban chỉ đạo được sử dụng cán bộ của cơ quan mình để giúp việc thực hiện nhiệm vụ được Trưởng ban phân công.
3. Xây dựng kế hoạch hành động
Căn cứ chương trình hành động này và chương trình công tác năm 2006 và hàng năm, các đơn vị thuộc, trực thuộc Bộ, ngành xây dựng chương trình hành động cụ thể của đơn vị mình (gửi về Bộ qua Vụ Kế hoạch - Tài chính), quy định cụ thể về thời gian thực hiện và hoàn thành; phân công cán bộ chịu trách nhiệm từng khâu công việc.
4. Tập trung rà soát các văn bản pháp luật có liên quan đến các quy định của Luật thực hành tiết kiệm, chống lãng phí để có kế hoạch sửa đổi, bổ sung, ban hành theo thẩm quyền hoặc trình cấp có thẩm quyền ban hành.
Kiên quyết loại bỏ các nội dung, quy định không phù hợp với yêu cầu thực hành tiết kiệm, chống lãng phí và các quy định thiếu chặt chẽ, dễ gây sơ hở, lợi dụng gây lãng phí tiền, tài sản của Nhà nước. Riêng năm 2006, các lĩnh vực cần tập trung rà soát gồm:
- Lĩnh vực lao động việc làm:
+ Cơ chế, chính sách gắn kết quy hoạch, kế hoạch, đào tạo, phân bổ, sử dụng nguồn lao động với các chương trình dự án và kế hoạch phát triển kinh tế - xã hội.
+ Cơ chế, chính sách trong quản lý, điều hành, sử dụng vốn cho vay Quỹ quốc gia về việc làm; chính sách hỗ trợ lao động dôi dư do sắp xếp lại doanh nghiệp nhà nước.
- Lĩnh vực xuất khẩu lao động: Cơ chế, chính sách về tiếp cận mở rộng thị trường xuất khẩu lao động; chi phí môi giới, tư vấn, đào tạo, giáo dục định hướng trong xuất khẩu lao động để giảm đến mức thấp nhất chi phí cho người lao động và doanh nghiệp, nâng cao uy tín và sức cạnh tranh của lao động Việt Nam trên thị trường lao động quốc tế.
- Lĩnh vực dạy nghề: Cơ chế, chính sách gắn đào tạo với sử dụng; chính sách đầu tư cho dạy nghề; trách nhiệm dạy nghề của doanh nghiệp sử dụng lao động. Cơ chế đấu thầu chỉ tiêu đào tạo nghề ở tất cả các cấp trình độ.
- Đối với lĩnh vực ưu đãi người có công: Tập trung nghiên cứu, rà soát, sửa đổi, bổ sung kịp thời chế độ điều trị - điều dưỡng; chế độ, định mức trang cấp dụng cụ chỉnh hình cho thương bệnh binh, thực hiện thí điểm tiền tệ hóa dụng cụ chỉnh hình ở một số tỉnh, thành phố. Nghiên cứu cơ chế, chính sách về quản lý và đầu tư công tác mộ và nghĩa trang liệt sĩ. Khắc phục tình trạng đầu tư, phân bổ kinh phí bình quân, dàn trải, không hiệu quả ở các địa phương; thực hiện việc thống kê, đánh giá thực trạng công tác mộ và nghĩa trang liệt sĩ trong cả nước trên cơ sở xây dựng quy hoạch, kế hoạch đầu tư 5 năm, hàng năm; phân định rõ trách nhiệm của Trung ương, địa phương trong đầu tư, quản lý công tác mộ và nghĩa trang liệt sĩ.
5. Thực hiện nghiêm quy chế tự kiểm tra, công khai dân chủ
Các đơn vị phải tổ chức thực hiện nghiêm túc quy chế dân chủ cơ sở, quy chế tự kiểm tra, giám sát theo Quyết định số 67/QĐ-TTg và Quyết định 271/2003/QĐ-TTg ngày 31/3/2003 của Thủ tướng Chính phủ.
Thủ trưởng đơn vị phối hợp với Thanh tra nhân dân lựa chọn hình thức công khai phù hợp để toàn thể cán bộ, công nhân viên trong cơ quan tiếp cận, kiểm tra đầy đủ các thông tin về dự toán, sử dụng, quyết toán các nguồn kinh phí, về mua sắm tài sản, dự án đầu tư, tiếp nhận viện trợ, xử lý tài sản; Đơn vị nào chưa thực hiện đầy đủ quy chế tự kiểm tra, công khai về tài chính là chưa đủ điều kiện để cơ quan quản lý cấp trên thẩm tra, phê duyệt quyết toán.
Trong quá trình thẩm tra quyết toán hàng năm, cơ quan kế toán cấp trên thực hiện việc lấy ý kiến công khai tập thể cán bộ, công nhân viên ở cơ sở đối với những đơn vị có nhiều sai sót trong quản lý tài chính để phát hiện những vi phạm, lãng phí, tiêu cực ở cơ sở.
6. Đẩy mạnh công tác thanh tra, kiểm tra.
- Cần xác định công tác thanh tra, kiểm tra là biện pháp quan trọng để ngăn ngừa, phát hiện các hành vi lãng phí, làm cơ sở để xử lý các vi phạm pháp luật về thực hành tiết kiệm, chống lãng phí. Thanh tra, kiểm tra thực hành tiết kiệm, chống lãng phí phải được đưa thành nội dung của kế hoạch hàng năm của Bộ, ngành và từng đơn vị cơ sở.
- Trong năm 2006, công tác thanh tra, kiểm tra thực hành tiết kiệm, chống lãng phí cần tập trung vào một số lĩnh vực chủ yếu gồm: các dự án đang thực hiện đầu tư và kết thúc đầu tư có quy mô lớn; các chương trình mục tiêu quốc gia về việc làm, xóa đói giảm nghèo; quản lý sử dụng trụ sở làm việc, đất đai; kinh phí Trung ương thực hiện chính sách ưu đãi người có công với cách mạng; quản lý, sử dụng các nguồn viện trợ của nước ngoài.
7. Phát hiện, xử lý nghiêm minh các trường hợp vi phạm quy định về thực hành tiết kiệm, chống lãng phí
Thủ trưởng các đơn vị thuộc Bộ, ngành cần xử lý dứt điểm các vi phạm trong thực hành tiết kiệm, chống lãng phí qua kiểm tra, thanh tra. Việc xử lý vi phạm phải đảm bảo đúng người, đúng tính chất, mức độ vi phạm và phải thông báo công khai trong đơn vị và các phương tiện thông tin đại chúng theo quy định của pháp luật...
8. Thực hiện chế độ báo cáo
- The content of the report must focus on reflecting the situation of implementing the measures for thrift and anti-waste set forth in the Ministry's Action Program; the results achieved in practicing thrift and anti-waste in managing and using funds and assets (land, office premises, public service housing...), construction investment, aid sources, capital and assets at state-owned enterprises, labor and working hours, thrift in wedding and funeral ceremonies, longevity celebrations; thrift in organizational and personnel work; thrift and anti-waste in the performance of duties and responsibilities by each civil servant and officer; evaluating the situation of practicing thrift and anti-waste within the scope and field of management.
- Reporting time: The report shall be submitted to the Ministry of Labor, Invalids and Social Affairs (Planning and Finance Department) before the 10th day of the first month of the next quarter for quarterly reports; the annual report compiled based on reviewing and assessing the results of each quarter and forecasting the results of the fourth quarter shall be submitted before September 10 each year./.
