MINISTER OF TRANSPORT

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;

Pursuant to the Government's Decree No. 34/2003/NĐ-CP dated April 4, 2003, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to the Government's Decree No. 71/2006/NĐ-CP dated July 25, 2006, on port management and maritime channels;

Pursuant to the opinion of the People's Committee of Quảng Ngãi Province at Circular No. 2848/UBND-CN dated October 11, 2006;

Considering the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration.

DECISION:

Article 1.

1. The waters of seaports within the jurisdiction of Quảng Ngãi Province, including:

a) The waters before the wharf and pier of Sa Ky Port and Dung Quat Port;

b) The waters of the port channel, branch port channel, pilot station, quarantine zone, anchorage area, transshipment area, and typhoon shelter area of the ports specified in point a of this clause.

2. Other waters before the wharf, anchorage area, transshipment area, and typhoon shelter area shall be announced in accordance with the provisions of the law.

Article 2. The scope of the waters of seaports within the jurisdiction of Quảng Ngãi Province is measured according to the highest tidal level and is defined as follows:

1. Sa Ky Port Area:

a) Seaward boundary: Limited by straight lines connecting the following points: SK1, SK2, SK3, and SK4 with the following coordinates:

- SK1: 15°12’36”N, 108°55’28”E;0- SK2: 15°56’06”N, 108°55’28”E;0- SK3: 15°11’36”N, 108°55’28”E;

- SK4: 15°12’00”N, 108°54’48”E.0- SK2: 15°56’06”N, 108°55’28”E;0b) Landward boundary: From points SK1 and SK4 running towards Sa Ky River mouth, then along both banks of Sa Ky River, continuing to both banks of Chu Me River and Bai Ca River:

- Along both banks of Chu Me River running along the water edge to a straight line cutting across the river, parallel and 100 meters downstream from Tan Duc sluice.0- Along both banks of Bai Ca River running along the water edge to a straight line cutting across the river connecting points BC1 and BC2, with the following coordinates:0b) Landward boundary: From points SK1 and SK4 running towards Sa Ky River mouth, then along both banks of Sa Ky River, continuing to both banks of Chu Me River and Bai Ca River:

+ BC1: 15°12’42”N, 108°54’00”E;0+ BC2: 15°13’06”N, 108°54’00”E.02. Dung Quat Port Area:

a) Seaward boundary: Limited by straight lines connecting the following points: DQ1, DQ2, DQ3, DQ4, and DQ5 with the following coordinates:

- DQ1: 15°23’42”N, 108°44’24”E;

- DQ2: 15°27’30”N, 108°44’24”E;

- DQ3: 15°53’42”N, 108°44’24”E;0- DQ4: 15°19’42”N, 108°45’24”E;0- DQ5: 15°52’45”N, 108°45’24”E (Go Nhan Cape).

b) Landward boundary: From point DQ5 (Go Nhan Cape) running along the water edge towards the north, west, then south, through Tra Bon River mouth to point DQ1.0Pilot station, quarantine zone, anchorage area, transshipment area, and typhoon shelter for vessels entering seaports within the jurisdiction of Quảng Ngãi Province are defined as follows:0a) Pilot station and quarantine zone: The water area limited by a circle with a radius of 0.3 nautical miles, centered at the following coordinates:

12°18’N, 108°55’42”E.

b) Anchorage area, transshipment area, and typhoon shelter for vessels in the water area defined in Clause 1, Article 2 of this Decision.

a) Pilot station and quarantine zone: The water area limited by a circle with a radius of 1 nautical mile, centered at the following coordinates:026°30’N, 108°45’30”E.0b) Anchorage area, transshipment area, and typhoon shelter for vessels in the water area defined in Clause 2, Article 2 of this Decision.

The Quảng Ngãi Maritime Port Office is responsible for:01. Performing its duties and powers as prescribed by the Vietnam Maritime Code and related laws concerning maritime activities in the waters of seaports within the jurisdiction of Quảng Ngãi Province.0b) Anchorage area, transshipment area, and typhoon shelter for vessels in the water area defined in Clause 2, Article 2 of this Decision.

2. Based on actual conditions regarding weather, waves, draft, and vessel tonnage, designating specific positions for vessels to pick up pilots, undergo quarantine, anchor, transship, and seek shelter from typhoons in the water areas defined in Article 3 of this Decision, ensuring maritime safety, maritime security, and environmental protection.01. Performing its duties and powers as prescribed by the Vietnam Maritime Code and related laws concerning maritime activities in the waters of seaports within the jurisdiction of Quảng Ngãi Province.0Outside the water areas defined in Articles 2 and 3 of this Decision, the Quảng Ngãi Maritime Port Office also has the responsibility to manage state administration over maritime order and safety in the sea areas within the jurisdiction of Quảng Ngãi Province.

This Decision takes effect 15 days after its publication in the Official Gazette and revokes Decision No. 225/2003/QĐ-BGTVT dated January 23, 2003, of the Minister of Transport on the waters of seaports within the jurisdiction of Quảng Ngãi Province and the responsibility area of the Quảng Ngãi Maritime Port Office.0The Head of the Ministry’s Office, the Inspector General, the Heads of Departments under the Ministry, the Directors of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterway Administration, the Director of the Quảng Ngãi Maritime Port Office, the Director of the Quảng Ngãi Provincial Department of Transport, the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Decision./.0Outside the water areas defined in Articles 2 and 3 of this Decision, the Quảng Ngãi Maritime Port Office also has the responsibility to manage state administration over maritime order and safety in the sea areas within the jurisdiction of Quảng Ngãi Province.

- DQ5: 150The Head of the Ministry’s Office, the Inspector General, the Heads of Departments under the Ministry, the Directors of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterway Administration, the Director of the Quảng Ngãi Maritime Port Office, the Director of the Quảng Ngãi Provincial Department of Transport, the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Decision./.052’45”E (Cape Go Nhan).

b) Landward boundary: from point DQ5 (Cape Go Nhan), following the shoreline water edge towards the north, west, then southward through Tra Bong River mouth to point DQ1.

Article 3. The pilot station area, quarantine area, anchorage area, cargo transfer area, and storm shelter for vessels entering marine ports within the jurisdiction of Quang Ngai Province shall be defined as follows:

1. Sa Ky Port Area:

a) Pilot station area and quarantine area: a water area limited by a circle with a radius of 0.3 nautical miles, centered at coordinates:

15012’18”N, 108055’42”E.

b) Anchorage area, cargo transfer area, and storm shelter for vessels within the water area specified in Clause 1, Article 2 of this Decision.

12°18’N, 108°55’42”E.

a) Pilot station area and quarantine area: a water area limited by a circle with a radius of 1 nautical mile, centered at coordinates:

15026’30”N, 108045’30”E.

b) Anchorage area, cargo transfer area, and storm shelter for vessels within the water area specified in Clause 2, Article 2 of this Decision.

Article 4. The Quang Ngai Marine Port Control Office shall be responsible for:

1. Performing its duties and powers as prescribed by the Vietnam Maritime Code and relevant laws concerning maritime activities in the waters of marine ports within the jurisdiction of Quang Ngai Province.

2. Based on actual weather conditions, wave and wind conditions, draft, and tonnage of vessels, designating specific positions for vessels to pick up and drop off pilots, undergo quarantine, anchor, transfer cargo, and seek shelter from storms in the waters stipulated in Article 3 of this Decision, ensuring maritime safety, maritime security, and prevention of environmental pollution.

Article 5. Outside the waters specified in Articles 2 and 3 of this Decision, the Quang Ngai Marine Port Control Office shall also be responsible for state management of maritime order and safety in the sea areas within the jurisdiction of Quang Ngai Province.

Article 6. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and revoke Decision No. 225/2003/QĐ-BGTVT dated January 23, 2003, issued by the Minister of Transport regarding the waters of marine ports within the jurisdiction of Quang Ngai Province and the responsibility zone of the Quang Ngai Marine Port Control Office.

Article 7. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Inland Waterways Administration, Director of the Quang Ngai Marine Port Control Office, Director of the Quang Ngai Department of Transport, Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Decision./.
