JOINT CIRCULAR
guiding the implementation of grade transfer and salary assignment for civil servants in the statistics sector
Pursuant to Decree No. 117/2003/NĐ-CP of October 10, 2003 of the Government on recruitment, utilization, and management of cadres and civil servants in state agencies;
Pursuant to Decree No. 204/2004/NĐ-CP of December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces;
Pursuant to Decree No. 48/2008/NĐ-CP of April 17, 2008 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decree No. 116/2008/NĐ-CP of November 14, 2008 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;
Pursuant to Decision No. 03/2008/QĐ-BNV of November 12, 2008 of the Minister of Home Affairs promulgating job titles, code numbers, and professional standards for grades of civil servants in the statistics sector,
The Ministry of Home Affairs and the Ministry of Planning and Investment guide the implementation of grade transfer and salary assignment for civil servants in the statistics sector as follows:
Article 1. Scope of Regulation
This Circular guides the transfer of grades and salary assignment for civil servants entering the grades of civil servants in the statistics sector as prescribed in Decision No. 03/2008/QĐ-BNV dated November 12, 2008 of the Minister of Home Affairs promulgating job titles, code numbers, and professional standards for grades of civil servants in the statistics sector (hereinafter referred to as Decision No. 03/2008/QĐ-BNV).
Article 2. Applicability
Civil servants currently engaged in statistical work within the national statistical organization system include:
1. Civil servants engaged in statistical work within the centralized statistical organization system;
2. Specialized civil servants engaged in statistical work at Ministries, agencies equivalent to Ministries, government agencies, Supreme People's Court, and Supreme People's Procuracy;
3. Specialized civil servants engaged in statistical work at Departments, bureaus, and sectors under provincial and centrally-administered city People's Committees.
Article 3. Principles of Grade Transfer
1. Grade transfer must be based on the responsibilities, positions, and professional qualifications assigned to civil servants.
2. Civil servants eligible for grade transfer must meet the professional standards of the statistics sector civil servant grades as prescribed in Decision No. 03/2008/QĐ-BNV.
3. When transferring from the current civil servant grade to a statistics sector civil servant grade, there shall be no concurrent increase in salary grade.
Article 4. Methods of Transferring to Statistics Sector Civil Servant Grades from Current Civil Servant Grades
1. Transfer to the Senior Statistician grade (grade code 23.261) for specialized statisticians currently holding the Senior Officer grade and equivalents who meet the conditions and standards prescribed in Decision No. 03/2008/QĐ-BNV.
2. Transfer to the Principal Statistician grade (grade code 23.262) for specialized statisticians currently holding the Principal Officer grade and equivalents who meet the conditions and standards prescribed in Decision No. 03/2008/QĐ-BNV.
3. Transfer to the Statistician grade (grade code 23.263) for specialized statisticians currently holding the Officer grade and equivalents who meet the conditions and standards prescribed in Decision No. 03/2008/QĐ-BNV.
4. Transfer to the Statistician with College Degree grade (grade code 23.264) for specialized statisticians currently receiving salary category A0, having a college degree, and meeting the conditions and standards prescribed in Decision No. 03/2008/QĐ-BNV.
5. Transfer to the Statistician with Secondary Technical School Degree grade (grade code 23.265) for specialized statisticians currently holding the Staff grade and equivalents who meet the conditions and standards prescribed in Decision No. 03/2008/QĐ-BNV.
Article 5. Salary Classification
Salary assignment for civil servants transferred to the statistics sector civil servant grades as prescribed in Article 4 of this Circular shall be implemented according to point a, Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding salary assignment when upgrading, transferring, or changing categories of civil servants and public officials.
Article 6. Implementation Organization
Based on the guidance provided in this Circular, the implementation shall be organized as follows:
1. Heads of units directly managing and utilizing civil servants in the national statistical organization system shall carry out the consolidation, inspection, and review of the positions of civil servants engaged in statistical work under their jurisdiction, develop plans for transferring to the statistics sector civil servant grades, submit them to competent authorities for examination and decision.
2. The Ministry of Planning and Investment shall approve the plans for grade transfer for civil servants engaged in statistical work within the centralized statistical organization system from current civil servant grades to statistics sector civil servant grades after reaching consensus with the Ministry of Home Affairs.
3. Ministries, agencies equivalent to Ministries, government agencies, Supreme People's Court, Supreme People's Procuracy, provincial and centrally-administered city People's Committees shall approve plans for grade transfer for civil servants engaged in statistical work within subordinate statistical organizations from current civil servant grades to statistics sector civil servant grades after reaching consensus with the Ministry of Home Affairs; report lists of civil servants transferred to grades to the Ministry of Planning and Investment for consolidation and overall management of the statistics sector civil servant workforce.
4. Ministries, sectors, and localities mentioned in Clauses 2 and 3 of this Article shall submit comprehensive reports on the implementation of grade transfer for statisticians from current civil servant grades to statistics sector civil servant grades to the Ministry of Home Affairs for monitoring before December 31, 2009.
Article 7. Effective Date
This Circular takes effect 45 days from the date of issuance.
During the implementation process, if there are difficulties, ministries, sectors, and localities shall reflect them to the Ministry of Home Affairs for coordination with the Ministry of Planning and Investment to examine and resolve them./.
