and Circular No. 24/2012/TT-BGDĐT dated June 29, 2012, amending and supplementing certain provisions

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006, promulgated by the Government, detailing and guiding the implementation of certain provisions of the Law on Education; Decree No. 07/2013/NĐ-CP of the Government amending Point b Clause 13 Article 1 of Decree No. 31/2011/NĐ-CP dated May 11, 2011, promulgated by the Government, amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006, promulgated by the Government, detailing and guiding the implementation of certain provisions of the Law on Education;

At the proposal of the Director of the Department of Testing and Quality Assurance,

The Minister of Education and Training issues this Circular amending and supplementing certain provisions of the University and College Regular System Admissions Regulation issued together with Circular No. 09/2012/TT-BGDĐT dated March 5, 2012, and Circular No. 24/2012/TT-BGDĐT dated June 29, 2012, amending and supplementing certain provisions of Circular No. 09/2012/TT-BGDĐT dated March 5, 2012, issued by the Minister of Education and Training

Article 1. Amending and supplementing certain provisions of the University and College Regular System Admissions Regulation issued together with Circular No. 09/2012/TT-BGDĐT dated March 5, 2012, and Circular No. 24/2012/TT-BGDĐT dated June 29, 2012, amending and supplementing certain provisions of Circular No. 09/2012/TT-BGDĐT dated March 5, 2012, issued by the Minister of Education and Training, as follows:

1. Amending and supplementing Point c Clause 2 Article 7 as follows:

“c) Candidates who participate in training for regional and international Olympic teams; those in the team participating in international science and technology innovation contests, who have completed high school education shall be directly admitted to university. If they have not yet completed high school education, their admission will be deferred until after they complete high school education;”

2. Supplementing Point i into Clause 2 Article 7 as follows:

“i) Candidates whose permanent residence has been registered for at least three years, who have studied for three years and graduated from high school in poor counties (students studying in ethnic minority boarding schools are counted based on their permanent residence address), up to the date of submitting the application for registration according to Resolution No. 30a/2008/NQ-CP dated December 27, 2008, of the Government on the Program for Rapid and Sustainable Poverty Reduction in 62 Poor Counties and Decision No. 293/QĐ-TTg dated February 5, 2013, of the Prime Minister on Targeted Support from the State Budget for 23 Counties with High Poverty Rates, applying the investment infrastructure mechanisms and policies stipulated in Resolution No. 30a/2008/NQ-CP on the Program for Rapid and Sustainable Poverty Reduction in 62 Poor Counties; candidates belonging to very small ethnic groups as defined in the Project on Developing Education for Very Small Ethnic Groups for the period 2010-2015 according to Decision No. 2123/QĐ-TTg dated November 22, 2010, of the Prime Minister, and candidates from 20 poor border and island counties in the Southwest region.

These candidates must complete one year of supplementary study before officially starting their studies. The supplementary study program is determined by the Rector of each institution.”

3. Supplementing Point đ into Clause 1 Article 8 as follows:

“đ) Candidates who have graduated from vocational secondary, specialized secondary, college vocational, or college but have not reached 36 months since the issuance of their graduation certificates, as stipulated in Point b Clause 1 Article 9 of Circular No. 55/2012/TT-BGDĐT dated December 25, 2012, issued by the Minister of Education and Training on Joint Training Programs at the College and University Levels, who wish to pursue joint training programs at the college or university level through regular enrollment must submit an application for registration according to the subject group of the intended joint training program, take the exam according to the unified examination questions of the Ministry of Education and Training, and be admitted according to the joint training program declared in the registration form for college or university.”

4. Amending and supplementing Point d Clause 3 Article 9 as follows:

“d) Issuing decisions to establish support staff for the School Admissions Committee including: Secretariat, Exam Question Preparation Board, Examination Supervision Board, Grading Board, Quality Control Board, and Re-examination Board. Depending on the specific circumstances of each school, the Chairman of the School Admissions Committee may establish a Facilities Board or designate a group of officers to manage facilities for the admissions examination. These Boards are directly under the direction of the Chairman of the School Admissions Committee;”

5. Article 14a is added after Article 14 as follows:

“Article 14a. Organization, Duties, and Powers of the Quality Control Board

1. Composition of the Quality Control Board:

a) The Chairperson is assumed by the Rector or Deputy Rector. In the same examination period, the person serving as the Chairperson of the Quality Control Board cannot concurrently serve as the Chairperson of the Grading Board or the Re-examination Board;

b) Members: including officers responsible for grading each subject and graders.

Those who have participated in the Grading Board shall not participate in the Quality Control Board.

2. Duties and Powers of the Quality Control Board

a) The Quality Control Board organizes random grading of at least 5% of the total number of papers for each essay subject;

b) The quality control process is carried out according to the provisions of Clause 1 and Clause 2 Article 28 of this Regulation;

3. Whether to conduct dialogue between grading sessions (if requested) is decided by the Chairman of the Admissions Committee.”

6. Amending and supplementing Points a, b, and e Clause 2 Article 16 as follows:

“a) Group N tests subjects: Literature, two Skill subjects;

b) Group H tests subjects: Literature, two Skill subjects;

e) Group S tests subjects: Literature, two Skill subjects;”

7. Amending the opening paragraph of Clause 1 Article 20 as follows:

“The examination papers, answers, and grading scales for the university and college admissions examinations prior to their public announcement belong to the category of State Secrets classified as "Top Secret". The processes of creating examination papers; transferring examination papers to the Ministry's Admissions Steering Committee; transferring to institutions tasked with printing and duplicating examination papers; printing, duplicating, packaging, and transferring examination papers to examination venues must strictly adhere to the following regulations:”

8. Amending and supplementing Point c Clause 3 Article 25 as follows:

“c) Only writing pens, pencils, compasses, erasers, rulers, calculators without additional memory cards that cannot be used for word processing may be brought into the examination room; recording devices with only recording functions and no transmission capabilities, and which cannot receive direct audio or video signals without additional equipment, are allowed.”

9. Amending Point b Clause 1 Article 33 as follows:

b) Universities and colleges located in the Northwest, Central Highlands, and Southwest regions shall consider for admission candidates who have been registered residents for at least three years, studied for three years, and graduated from high school in these regions (excluding candidates who have been directly admitted to universities and colleges as stipulated in point i, Clause 2, Article 7) with examination results lower than the minimum threshold by 1.0 point and must complete supplementary knowledge courses for one semester before officially starting their studies. The supplementary knowledge program shall be determined by the Rector of each university.

10. Amend and supplement Clause 2 of Article 35 as follows:

“2. Based on the minimum threshold announced by the Ministry of Education and Training, and the established enrollment quota, universities shall independently and responsibly conduct admissions. Universities may implement multiple rounds of admissions, with each round lasting 20 days, calculated from the date of announcement of the admissions process. Details related to admission conditions and timeframes shall be publicly disclosed on the university's website, the Ministry of Education and Training's admissions information website, and through mass media.

The deadline for the admissions process is October 30 each year.

11. Supplement point g to Clause 4 of Article 41 as follows:

“g) Failure to comply with the provisions set forth in point c and point d, Clause 3, Article 36a.”

Article 2. This Circular takes effect from April 5, 2013.

Article 3. The Director of the Office, the Inspector General, the Director of the Testing and Quality Assurance Department, the Deputy Minister in charge of Higher Education, the Heads of relevant units under the Ministry of Education and Training; Ministers, Heads of Ministries equivalent to Ministries, and agencies under the Government; Chairpersons of Provincial People's Committees; Directors of Departments of Education and Training; Presidents of universities and academies; Deans of universities and colleges are responsible for implementing this Circular.
