Circular No. 03/2014/TT-BNV amends Circular No. 03/2013/TT-BNV dated April 16, 2013, issued by the Minister of Home Affairs detailing the implementation of Decree No. 45/2010/NĐ-CP dated April 21, 2010, of the Government on the organization, operation, and management of associations, and Decree No. 33/2012/NĐ-CP dated April 13, 2012, of the Government amending and supplementing certain provisions of Decree No. 45/2010/NĐ-CP.

CIRCULAR

Amending Circular No. 03/2013/TT-BNV dated April 16, 2013, issued by the Minister of Home Affairs, detailing the implementation of Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government on the organization, operation, and management of associations, and Decree No. 33/2012/NĐ-CP dated April 13, 2012 of the Government amending and supplementing certain articles of Decree No. 45/2010/NĐ-CP.

Pursuant to Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government on the organization, operation, and management of associations; Decree No. 33/2012/NĐ-CP dated April 13, 2012 of the Government amending and supplementing certain articles of Decree No. 45/2010/NĐ-CP;

Pursuant to Decree No. 06/2010/NĐ-CP dated January 25, 2010 of the Government defining those who are civil servants;

The Minister of Home Affairs issues this Circular to amend Circular No. 03/2013/TT-BNV dated April 16, 2013, issued by the Minister of Home Affairs, detailing the implementation of Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government on the organization, operation, and management of associations, and Decree No. 33/2012/NĐ-CP dated April 13, 2012 of the Government amending and supplementing certain articles of Decree No. 45/2010/NĐ-CP.

Article 1. Amend Point b Clause 1 Article 7 of Circular No. 03/2013/TT-BNV as follows:

BASED ON THE LAW ON ENACTMENT OF LEGAL DOCUMENTS;

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

"b) For civil servants transferred to work at associations in accordance with Article 12 of Decree No. 06/2010/NĐ-CP dated January 25, 2010 of the Government defining those who are civil servants; the system and policies shall be implemented in accordance with the laws on civil servants."

This Circular takes effect from August 8, 2014.

At the proposal of the Director of the Department of Non-Governmental Organizations;

The Minister, Heads of Ministries equivalent to Ministries, Heads of Governmental Agencies, Chairmen of Provincial People's Committees, Municipal People's Committees directly under the Central Government, and associations are responsible for implementing this Circular./.

Article 1. Amend Point b Clause 1 Article 7 Circular No. 03/2013/TT-BNV as follows:

"b) For civil servants transferred to work at associations as prescribed in Article 12 Decree No. 06/2010/NĐ-CP dated January 25, 2010 of the Government stipulating persons who are civil servants; the regime and policies shall be implemented in accordance with the laws on civil servants."

Article 2. Effective Date

This Circular takes effect from August 8, 2014.

Article 3. Responsibility for Implementation

The Minister, Heads of Ministries equivalent to Ministries, Heads of Governmental Agencies under the Government, Chairpersons of Provincial People's Committees under the Central Government, and associations are responsible for implementing this Circular./.
