Pursuant to Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government on recruitment, utilization, and management of civil servants and Decree No. 93/2010/NĐ-CP dated August 31, 2010 of the Government amending certain provisions of Decree No. 24/2010/NĐ-CP;
Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
At the proposal of the Director of the Civil Servant - Public Official Department, Ministry of Home Affairs;
The Minister of Home Affairs hereby promulgates this Circular amending and supplementing Article 9 of Circular No. 13/2010/TT-BNV dated December 30, 2010 of the Ministry of Home Affairs detailing certain provisions on recruitment and promotion of civil servants under Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government on recruitment, utilization, and management of civil servants (hereinafter referred to as Circular No. 13/2010/TT-BNV).
Article 1. Amending and supplementing Article 9 of Circular No. 13/2010/TT-BNV
"Article 9. Recruitment decision and commencement of duty
1. Within fifteen days from the date of the decision approving the recruitment results issued by the civil servant management authority, the head of the authority with the power to recruit civil servants must send a written notification recognizing the successful candidate's result to the applicant at the address registered by the applicant.
2. Within thirty days from the date of receipt of the notification recognizing the successful candidate's result from the authority with the power to recruit civil servants, the successful candidate must go to the authority with the power to recruit civil servants to complete the application file. The application file must be supplemented to be completed before signing the recruitment decision, including:
a) Copies of diplomas, certificates, and academic records according to the requirements of the position applied for, certified by the competent authority;
b) A criminal record certificate issued by the Department of Justice where the applicant resides.
3. In case the successful candidate has a valid reason that prevents them from completing the application file, they must submit a request for extension before the deadline for completing the application file to the authority with the power to recruit civil servants. The extension period shall not exceed fifteen days from the end of the deadline for completing the application file as stipulated in Clause 2 of this Article.
4. After receiving the application file of the successful candidate, the head of the authority with the power to recruit civil servants is responsible for verifying and checking the diplomas and certificates of the successful candidate to ensure accuracy in accordance with the law.
5. After completing the procedures as stipulated in Clauses 2, 3, and 4 of this Article, within fifteen working days, the head of the authority with the power to recruit civil servants must issue a recruitment decision for the successful candidate; if the successful candidate does not complete the application file as required or the authority with the power to recruit discovers that the successful candidate uses illegal diplomas or certificates, the head of the authority with the power to recruit civil servants must issue a decision to cancel the successful candidate's result and report in writing to the head of the authority with the power to manage civil servants.
6. The person recruited as a civil servant must report for duty within the time limit specified in Clause 2 of Article 18 of Decree No. 24/2010/NĐ-CP.
7. In case the successful candidate's result is canceled according to Clause 5 of this Article, the head of the authority with the power to recruit civil servants decides to recruit another candidate with the next lower ranking result at the recruitment position, provided that such candidate meets all the conditions stipulated in Point a and Point b of Clause 1 of Article 11 of Decree No. 24/2010/NĐ-CP (in the case of civil servant recruitment examination) or stipulated in Point a of Clause 1 of Article 14 of Decree No. 24/2010/NĐ-CP (in the case of civil servant recruitment selection). In case there are two or more candidates with the next lower ranking result, the head of the authority with the power to recruit civil servants decides the successful candidate according to Clause 2 of Article 11 of Decree No. 24/2010/NĐ-CP (in the case of civil servant recruitment examination) or Clause 2 of Article 14 of Decree No. 24/2010/NĐ-CP (in the case of civil servant recruitment selection)"
Article 2. Effective Date
This Circular takes effect from May 1, 2015.

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees directly under the Central Government, and relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
