Regulations on awarding Commendation Medals “For the Cause of Inspection

Pursuant to the Law on Competition and Reward dated November 26, 2003, the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated November 16, 2013;

Pursuant to Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward;No. Decree No. 39/2012/ND-CP dated April 27, 2012 amending and supplementing certain provisions of Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government; Decree No. 65/2014/ND-CP dated July 1, 2014 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward in 2013;i to amend and supplement some articles of the Law on Competition and Rewards 2013;

Pursuant to Decree No. 83/2012/ND-CP dated October 9, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Based on the proposal of the Director of the Legal Department and the Director of the Organization and Cadre DepartmentJune 2024;n bộ,

The Government Inspector General issues this Circular to regulate the award of the Commemorative Medal "For the Cause of Inspection".

PART I

GENERAL PROVISIONS

Article 1.perioda) Clause 1 Article 15 regarding accountability;

This Circular stipulates the principles, recipients, criteria, authority, procedures, and formalities for proposing, deciding to award, organizing the presentation of, and the rights and responsibilities of individuals awarded the Commendation Medal "For the Cause of Inspection".

Point a) Leaders of the Inspector General;

Article 1. The Commendation Medal "For the Cause of Inspection" is a form of reward from the Government Inspectorate for individuals who have made achievements in contributing to the cause of building and developing the Inspection sector in Vietnam (hereinafter referred to as the Commendation Medal).

Article 2. The Commendation Medal has symbols, shapes, sizes, and colors that reflect the characteristics of the Inspection sector in Vietnam, consistent with general regulations of the State, accompanied by the Commendation Medal is a Certificate of Award for the Commendation Medal "For the Cause of Inspection".

Article 3. Principles for awarding the Commemorative Medal

Article 3. The Commendation Medal shall be awarded or posthumously awarded once to individuals meeting the conditions and criteria; it shall not be awarded to individuals who have already been awarded the Order of Merit "For the Cause of Inspection".

- Civil servants, public officials, and workers employed at inspection agencies under bureaus and equivalent organizations as prescribed in the Government's decrees on the organization and operation of inspections;

3. The consideration for the Memorial Medal must be carried out in accordance with the subjects, criteria, procedures prescribed in this Circular.

Chapter II

RECIPIENTS AND CRITERIA FOR AWARDING COMMENDATION MEDALS

Article 4. Recipients of the Commendation Medalenergy

- Officers, non-commissioned officers, and workers employed at inspection agencies as prescribed in the Government's decrees on the organization and operation of defense and police inspections.

a) Civil servants, public officials, and employees working at the Government Inspectorate;

b) Civil servants, public officials, officers, non-commissioned officers, and employees working at the Inspectorate of ministries and agencies equivalent to ministries (hereinafter collectively referred to as the Inspectorate of ministries);

c) Civil servants, public officials, and employees working at the Inspectorate of provinces and centrally-administered cities (hereinafter collectively referred to as the Inspectorate of provinces);

d) Civil servants, public officials, officers, non-commissioned officers, and employees working at the Inspectorate of departments;

đ) Civil servants, public officials, and employees working at the Inspectorate of districts, towns, urban districts, and provincial cities.

Clause 4. Other cases as proposed by departments, bureaus, and units under the Inspector General and the Standing Committee of the Competition and Reward Council of the Inspection Sector.

a) Leaders of the Vietnam Fatherland Front and political and social organizations at the central level;

b) Leaders of ministries, ministerial-level agencies;

c) Secretaries and Deputy Secretaries of provincial Party Committees and municipal Party Committees under the Central Government; Chairpersons and Vice Chairpersons of Provincial People's Councils and Municipal People's Councils under the Central Government, Chairpersons and Vice Chairpersons of Provincial People's Committees and Municipal People's Committees under the Central Government;

d) Leaders of the Vietnam Fatherland Front and political and social organizations at the provincial and centrally-administered city levels; Secretaries and Deputy Secretaries of district, town, and provincial city party committees; Chairpersons and Vice-Chairpersons of People's Councils and People's Committees of districts, towns, urban districts, and provincial cities.

đ) Directors and Deputy Directors of departments and equivalent positions;

3. Individuals who are overseas Vietnamese or foreigners residing in Vietnam who have contributed to the cause of building and developing the Inspection sector in Vietnam.

4. Other special cases as proposed by departments, bureaus, and units under the Government Inspectorate and the Standing Committee of the Competition and Reward Council of the Inspection sector.

Article 5. Subjects not eligible or not yet eligible for the Commendation Medal

1. The Commendation Medal shall not be awarded to individuals who have been compulsorily dismissed from their positions or stripped of military rank, titles, or police status.

Article 2. The Commendation Medal shall not be awarded to individuals currently under disciplinary review; those subject to disciplinary measures ranging from reprimand upwards; those under investigation, prosecution, trial, or convicted and serving a criminal sentence.

The period of disciplinary action and the period of serving a criminal sentence, including periods during which disciplinary records or criminal convictions have not been expunged, shall not be counted towards eligibility for the Commendation Medal.

1. Individuals specified in Clauses 1, 2, and 3 of Article 4 of this Resolution comply well with the Party's policies and the State's laws and have contributed to the development process of the Vietnamese National Assembly.

Article 1. Individuals belonging to the category specified in Clause 1, Article 4 of this Circular, must have a total service period in state inspection agencies from 10 years up to November 23 of the year the award is proposed.

Article 2. Individuals belonging to the category specified in Clause 2, Article 4 of this Circular must have outstanding achievements in leadership and direction, contributing to the cause of building and developing the Inspection sector in Vietnam, and meet the following standards:

a) Individuals belonging to the categories specified in Points b and c must have held their positions for at least two and a half years.

b) Individuals belonging to the categories specified in Points d and đ must have held their positions for at least five years.

Article 3. Individuals belonging to the category specified in Clause 3, Article 4 of this Circular must have made outstanding contributions in establishing and consolidating international cooperation relations, positively contributing to the cause of building and developing the Inspection sector in Vietnam.

Article 4. Individuals belonging to the special cases specified in Clause 4, Article 4 of this Circular must have achieved particularly outstanding results or have innovative scientific works of practical value, positively and effectively contributing to the cause of building and developing the Inspection sector in Vietnam.

Article 7. Priority Cases for Awarding the Commendation Medal

Civil servants, public officials, public employees, officers, non-commissioned officers, and workers employed in state inspection agencies are prioritized for the award of the Commendation Medal when they meet any of the conditions stipulated in this Article, and only the highest achievement will be considered.

1. Individuals conferred the title of Heroic Laborer or Heroic People's Armed Forces shall be immediately nominated for the Commendation Medal upon receipt of the commendation decision.

2. Individuals awarded the Labor Order of various classes or National Model Worker shall be nominated for the Commendation Medal two years earlier.

3. Individuals awarded a Certificate of Merit by the Prime Minister or conferred the title of Model Worker at the ministry, sector, or provincial level shall be nominated for the Commendation Medal one year earlier.

4. Individuals awarded a Certificate of Merit by the Inspector General or conferred the title of Model Worker at the grassroots level shall be nominated for the Commendation Medal six months earlier.

Chapter III

PROCEDURES FOR AWARDING COMMENDATION PLAQUES

Article 8. Responsibilities for Establishing Nomination Files and Recommending the Commendation Medal

Article 1. The Standing Committee of the Competition and Reward Council of the Inspection sector; Heads of departments, bureaus, and units under the Government Inspectorate are responsible for preparing files and proposing the award of the Commendation Medal to individuals specified in Clause 4, Article 4 of this Circular.

2. Chief Inspectors of ministries are responsible for establishing nomination files and recommending the Commendation Medal for subjects specified in:

a) Point b, Clause 1, Point b, Clause 2, Article 4 of this Circular;

b) Point d, Clause 1 and Point đ, Clause 2, Article 4 of this Circular (for ministries and sectors organized vertically from the central to local levels).

Article 3. The Chief Inspector of the province is responsible for preparing files and proposing the award of the Commendation Medal to individuals specified in:

a) Points c and đ, Clause 1 and Point d, Clause 2, Article 4 of this Circular;

c) Point d, Clause 1 and Point đ, Clause 2, Article 4 of this Circular (for departments under ministries and sectors not organized vertically from the central to local levels).

4. The Director of the International Cooperation Department, Government Inspectorate shall be responsible for chairing and coordinating with relevant units of the Government Inspectorate to establish files and propose the award of Commendation Medals to the subjects specified in Clause 3, Article 4 of this Circular.

Article 9. Documents and time for nominating to be awarded the Commendation Medal

1. Nomination file for the Commendation Medal (one set), includes:

a) A letter requesting the award of the Commendation Medal;

b) A list of nominees for the Commendation Medal (to be implemented according to Form No. 01 attached to this Circular);

c) A summary of the career (to be implemented according to Form No. 02 attached to this Circular) for subjects specified in Clause 1 Article 4 of this Circular;

d) Copies of commendation decisions and related files confirmed by the managing authority (if applicable) for priority cases;

d) For the subjects specified in Clause 2 and Clause 3, Article 4 of this Circular, the unit proposing the award of the Commendation Medal must submit a report on the achievements of individuals who have contributed to the construction and development of the Vietnamese Inspectorate sector.

e) For the cases specified in Clause 4, Article 4 of this Circular, the unit proposing the award of the Commendation Medal must report on outstanding and exceptional achievements or innovative ideas and scientific works of practical value that positively and effectively contribute to the construction and development of the Vietnamese Inspectorate sector.

2. Agencies and units must submit the nomination file for the Commendation Medal to the Organization and Cadre Affairs Department, Inspector General before September 1 each year.

Article 10. Procedure for awarding the Commendation Medal

1. The Organization and Cadre Affairs Department, Inspector General is responsible for compiling the nomination files for the Commendation Medal and submitting them to the Ministry of Inspection's Commendation and Reward Council before October 1 each year.

2. The Standing Committee of the Competition and Reward Council of the Inspectorate Sector shall be responsible for reviewing and examining the files and proposing the Competition and Reward Council of the Inspectorate Sector to consider and submit to the Chief Inspector General for the decision to award Commendation Medals to individuals meeting the conditions and criteria stipulated in Article 6 of this Circular before October 30 each year.

Article 11. Organizing the Presentation of the Commendation Medal

1. The ceremony for awarding the Commemorative Medal shall take place during the anniversary of the Inspection Agency's traditional day (November 23) every year.

2. Agencies and units with individuals to be awarded the Commemorative Medal shall be responsible for hosting and assisting the Standing Committee of the Department of Competition and Rewards of the Inspection Agency in organizing the award ceremony.

3. The Office of the Inspectorate General shall be responsible for chairing and coordinating with the Organization and Cadre Affairs Department of the Inspectorate General to advise the Chief Inspector General to organize the presentation of Commendation Medals to leaders of the Vietnam Fatherland Front and political-social organizations at the central level, individuals who have worked and are currently working at the Inspectorate General, and some special cases specified in Clause 3 and Clause 4, Article 4 of this Circular.

Article 12. Rights and responsibilities of organizations and individuals proposing to be considered for the award of the Commemorative Medal

1. Individuals receiving Commendation Medals shall be awarded a Certificate of Recognition, a Commendation Medal "For the Cause of Inspection" and a monetary reward not exceeding 0.6 times the general minimum wage, the disbursement of which shall be carried out in accordance with the provisions of the law.

2. Individuals receiving Commendation Medals shall be responsible for preserving and setting a good example in implementing the Party's policies and State laws, continuing to promote the traditions of the Vietnamese Inspectorate sector.

3. Organizations and individuals proposing to be considered for the award of the Commemorative Medal shall be responsible for the accuracy and truthfulness of the application file.

4. Organizations and individuals proposing to be considered for the award of the Commemorative Medal have the right to appeal or report complaints regarding the proposal and consideration for the award of the Commemorative Medal in accordance with the law on appeals and complaints.

Chapter IV

IMPLEMENTATION

Article 13. Implementation Organization

1. This Circular shall take effect from July 6, 2015 and replace Circular No. 06/TT-TTCP dated May 19, 2011 of the Government Inspectorate guiding the award of "Commendation Medals For the Cause of Inspection".

2. The Standing Committee of the Competition and Reward Council of the Inspectorate Sector, Heads of Departments, Bureaus, and Units under the Inspectorate General, Chief Inspectors of Ministries, Chief Inspectors of provinces and centrally-administered cities, and related agencies, units, and individuals shall be responsible for organizing and implementing this Circular.

3. In the process of implementation, if there are difficulties or obstacles, the Heads of agencies and units shall promptly reflect them to the Standing Committee of the Competition and Reward Council of the Inspectorate Sector for reporting to the Chief Inspector General for timely consideration and amendment./.
