Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;

Based on the Civil Enforcement Law of 2008; Amended and Supplemental amending certain provisions of Civil Enforcement Law of 2014;

Based on Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and agencies at the ministerial level; and other agencies at the ministerial level;

Pursuant to Decree No. 22/2013/NĐ-CP dated March 13, 2013, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Based on Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government stipulating recruitment, utilization, and management of civil servants;

Pursuant to Decree No. 62/2015/NĐ-CP dated July 18, 2015 of the Government detailing and guiding the implementation of certain articles of the Civil Enforcement Law;

On the basis of the unified opinion of the Ministry of Home Affairs regarding the authority to issue and the content of this Circular on the designation, rank codes of the rankand professional standards for the specialized civil enforcement officer ranks at COfficial letter No. 5463/BNV-CCVC dated November 21, 2016;

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

2. This Circular applies to persons engaged in civil enforcement work under the General Department of Civil Enforcement, Civil Enforcement Departments of provinces and centrally-administered cities, and Civil Enforcement Sub-departments of districts, towns, urban districts, and sub-cities of provinces and centrally-administered cities.

2. This Circular applies to those engaged in civil enforcement work under the General Department of Civil Enforcement, Provincial Civil Enforcement Office, and District Civil Enforcement Office.

         Article 2. 1. Total time worked in the following ranks: Court Secretary, Judicial Reviewer, Judge; Prosecutor, Assistant Prosecutor; Investigator in the Investigation Agency of Public Security Organs, People's Armed Forces, Supreme People's Procuracy; Intermediate-level Detective, Intermediate-level Police Officer of the Public Security Force, Intermediate-level Detective of the Security Force; Officer Investigator, Security Guard in the People's Armed Forces; Enforcement Officer, Civil Enforcement Reviewer, Civil Enforcement Secretary, Intermediate-level Civil Enforcement Secretary; Inspector;

1. Total working time assigned to the ranks: Clerk of Court, Judicial Reviewer of the Court, Judge; Prosecutor's Investigator, Prosecutor; Investigator within the Investigation Agency in the People's Public Security, People's Armed Forces, Supreme People's Procuracy; Intermediate-level Detective, Intermediate-level Police Officer of the Public Security Force, Intermediate-level Detective of the Security Force; Military Investigator, Security Protector in the People's Armed Forces; Enforcement Officer, Judicial Reviewer of Civil Enforcement, Clerk of Civil Enforcement, Intermediate-level Clerk of Civil Enforcement; Inspector;

Article 4. General Standards

1. Firm political conviction, steadfast with Marxism-Leninism, Ho Chi Minh Thought, mastering the Party's policies and guidelines; loyal to the country and the Constitution of the Socialist Republic of Vietnam; protecting the interests of the country and the people.

2. Fulfilling all duties of a civil servant as prescribed by law; strictly complying with the assignment of tasks by superiors; abiding by laws, maintaining discipline and administrative order; setting a good example in following internal regulations and rules of the agency.

3. Devoted, responsible, honest, impartial, fair, and exemplary in performing public duties; courteous, cultured, and appropriate in communication and service to the people.

4. Living a healthy lifestyle, being modest, united; thrifty, honest, incorruptible, dedicated; not using public office for personal gain; not being bureaucratic, corrupt, wasteful, or negative.

Chapter II

RESPONSIBILITIES, TASKS AND PROFESSIONAL STANDARDS

 OF THE ENFORCEMENT OFFICER RANKS

Article 5. Senior Enforcement Officer Rank

1. Responsibilities

The Senior Enforcement Officer is the highest-ranking civil servant in civil enforcement and administrative enforcement, directly organizing and supervising the execution of particularly complex civil enforcement and administrative enforcement cases involving various sectors, levels, localities, or foreign elements within the jurisdiction of the Provincial Civil Enforcement Office.

2. Tasks

b) Organize and direct the implementation of administrative enforcement work according to the law;

c) Lead research, propose programs of work, organizational and operational issues related to civil enforcement and administrative enforcement, measures for guidance and organization of enforcement work;

d) Guide, urge, or assist the head of the civil enforcement agency to guide and urge subordinate civil enforcement agencies under their jurisdiction to implement civil enforcement and laws on civil enforcement and administrative enforcement; receive citizens as prescribed;

d) Guide, supervise, or assist the head of the civil enforcement agency in guiding and supervising subordinate civil enforcement agencies under their jurisdiction to implement civil enforcement and administrative enforcement laws; receive citizens according to regulations;

g) Assist the head of the civil enforcement agency in grasping the situation of enforcement work and compliance with laws in enforcement work within their jurisdiction; organize summaries of practical enforcement work and propose solutions to enhance the effectiveness of civil enforcement and administrative enforcement;

h) Study and recommend amendments and supplements to enforcement-related documents, propose improvements to the legal system on civil enforcement and administrative enforcement;

g) Assist the head of the civil enforcement agency in grasping the situation of civil enforcement work and compliance with laws in civil enforcement work in the area; organize summaries of practical civil enforcement and administrative enforcement work and propose measures to enhance the effectiveness of civil enforcement and administrative enforcement work;

a) Profoundly understand the Party's policies and state laws, directives, and resolutions of superiors to apply them to civil enforcement and administrative enforcement work; strategic goals for economic, cultural, and social development;

b) Profoundly understand administrative management knowledge and civil enforcement and administrative enforcement laws; skillfully apply principles, systems, and procedures related to civil enforcement business;

3. Professional Qualification Standards

a) Master and deeply understand the Party's policies and state laws, directives, and resolutions of superiors to apply them to civil enforcement and administrative enforcement work; strategic goals for economic, cultural, and social development;

b) Master and deeply understand knowledge of administrative state management, deeply understand the contents of civil enforcement and administrative enforcement laws; skillfully apply principles, systems, and procedures of civil enforcement operations;

Have the ability to coordinate well with relevant agencies in organizing enforcement;

d) Have the ability to propose, advise on policy formulation, lead the drafting of legislative projects, ordinances, programs, and plans related to civil enforcement work to be submitted to competent authorities for consideration and decision; have the ability to coordinate well with relevant agencies in organizing enforcement;

đ) Have the ability to educate and persuade parties to comply with court judgments and decisions;

e) Be proficient and in control of skills in drafting, presenting, defending, and implementing to develop and implement projects, programs, plans, teaching materials related to civil enforcement and administrative enforcement work;

g) Have the ability to conduct scientific research, summarize broad topics in the assigned field, propose strategic issues about civil enforcement work, administrative enforcement work; have the ability to analyze, generalize, and synthesize across multiple fields related to enforcement work;

h) For civil servants participating in the examination to upgrade to the rank of Senior Enforcement Officer, they must be individuals who have led or participated in drafting at least two (2) regulatory legal documents submitted to competent authorities for issuance, or have led or participated in researching, drafting at least two (2) research topics, projects, programs at the ministerial, sectoral, provincial, or district level that have been reviewed and found satisfactory, or have led or participated in drafting and implementing at least two (2) research topics, projects, initiatives within the scope of the General Office of Civil Execution or the civil execution system and achieved significant results.

i) A civil servant applying to upgrade to the Senior Enforcement Officer rank must have held the Intermediate Enforcement Officer rank for at least five (5) years (sixty months);

4. Educational and Training Standards

a) Hold a Bachelor's degree in Law or higher.

b) Possess a certificate in professional training for the rank of Senior Enforcement Officer according to the content and program of the Ministry of Justice.

c) Hold a Master's degree in Political Theory.

d) Possess a foreign language certificate equivalent to Level 4 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam.

đ) Possess a computer skills certificate meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 issued by the Ministry of Information and Communications regarding the standards for information technology usage skills.

Article 6. Intermediate Enforcement Officer Rank

1. Responsibilities

A mid-level Enforcement Officer is a specialized civil servant responsible for organizing and supervising the enforcement of complex civil and administrative execution cases involving large sums of money or assets, where the execution involves multiple regions under the jurisdiction of the Civil Execution Department or Civil Execution Branch.

2. Tasks

b) Organize and direct the implementation of administrative enforcement work according to the law;

b) Implement administrative judgment enforcement work in accordance with the law;

c) Develop plans and organize the implementation of civil execution decisions; propose measures and direct the execution of civil execution decisions within their authority; perform citizen reception tasks as prescribed.

d) Report on the results of civil and administrative judgment enforcement work; make recommendations and propose measures for organizing civil and administrative judgment enforcement within the assigned functions and tasks;

đ) Provide guidance on business practices for初级级执行员、书记员和中级书记员;

e) Draft guiding documents for enforcement work, compile materials and provide guidance on civil and administrative enforcement business practices;

g) Assist the head of the civil enforcement agency in understanding the situation of enforcement work and the compliance with laws in enforcement work within their jurisdiction according to their assigned duties;

h) Participate in researching and summarizing experiences and practical enforcement situations;

i) Study, recommend amendments and supplements to enforcement-related documents, and propose opinions on improving the enforcement legal system;

k) Perform other tasks as prescribed by law or assigned by the head of the civil enforcement agency;

3. Professional Qualification Standards

a) Be thoroughly familiar with the Party's policies and State laws, directives, and resolutions from superiors to apply them to civil and administrative enforcement work;

b) Have a deep understanding of the content of civil and administrative enforcement laws; skillfully apply principles, systems, and procedures related to civil enforcement business practices;

c) Understand the current situation and trends in domestic and international civil enforcement work; organize research to serve management and information processing;

d) Have the ability to coordinate well with relevant agencies in enforcement work;

đ) Have the ability to educate and persuade parties to comply with court judgments, decisions of the Competition Dispute Resolution Council, and arbitral awards and decisions.

e) Have the ability to analyze and synthesize, be proficient in document drafting skills related to assigned responsibilities and tasks, and present on assigned issues;

g) For civil servants participating in the examination to upgrade to the rank of Mid-Level Enforcement Officer, they must be individuals who have led or participated in drafting at least one (1) regulatory legal document, or have led or participated in researching, drafting at least one (1) research topic, project, program at the ministerial, sectoral, provincial, or district level that has been reviewed and found satisfactory, or have led or participated in drafting and implementing at least one (1) research topic, project, initiative within the scope of the Civil Execution Department or Civil Execution Branch and achieved significant results.

h) Civil servants applying for promotion to the rank of intermediate enforcement officer must have held the rank of primary enforcement officer for five years (60 months) or more;

4. Educational and Training Standards

a) Hold a Bachelor's degree in Law or higher.

b) Possess a certificate in professional training for the rank of Mid-Level Enforcement Officer according to the content and program of the Ministry of Justice.

c) Possess a foreign language certificate equivalent to Level 3 of the Vietnamese foreign language proficiency framework as stipulated in Circular No. 01/2014/TT-BGDĐT or possess a certificate in a minority language for positions requiring its use.

d) Possess a computer skills certificate meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT.

Article 7. Junior Enforcement Officer Rank

1. Responsibilities

An entry-level Enforcement Officer is a specialized civil servant responsible for directly organizing the enforcement of simple civil and administrative execution cases involving small amounts of money or assets under the jurisdiction of the Civil Execution Department or Civil Execution Branch.

2. Tasks

b) Organize and direct the implementation of administrative enforcement work according to the law;

b) Implement administrative judgment enforcement work in accordance with the law;

c) Develop plans and implement civil judgment enforcement decisions; perform citizen reception tasks as prescribed;

d) Report on the results of civil judgment and administrative decision enforcement; propose measures to resolve issues;

đ) Provide guidance on enforcement procedures to Secretaries and Intermediate-level Secretaries;

e) Study and propose amendments to enforcement-related documents; contribute suggestions for improving the enforcement legal system;

g) Participate in drafting documents related to civil and administrative execution work within their assigned field, and propose issues concerning the organization of civil and administrative execution work within their authority.

h) Perform other tasks assigned by the head of the enforcement agency;

3. Professional Qualification Standards

a) Be thoroughly familiar with the Party's policies and State laws, directives, and resolutions from superiors to apply them to civil and administrative enforcement work;

b) Be proficient in the content of laws on civil and administrative execution and skillfully apply principles, systems, and procedures related to execution work in organizing the execution of assigned cases.

c) Understand the economic and social conditions in the locality; be familiar with the area under their responsibility;

d) Possess the ability to coordinate with relevant agencies, units, and individuals in performing assigned tasks;

đ) Have the ability to educate and persuade parties to comply with court judgments, decisions of the Competition Dispute Resolution Council, and arbitral awards and decisions.

e) Possess the ability to draft documents related to their responsibilities and tasks;

g) Civil servants participating in the examination to upgrade to the rank of Entry-Level Enforcement Officer must currently hold the rank of Assistant Specialist or equivalent and have at least three years (36 months) of experience in legal work.

4. Educational and Training Standards

a) Hold a Bachelor's degree in Law or higher.

b) Possess a certificate in professional training for the rank of Entry-Level Enforcement Officer according to the content and program of the Ministry of Justice.

c) Possess a foreign language certificate equivalent to Level 2 of the Vietnamese foreign language proficiency framework as stipulated in Circular No. 01/2014/TT-BGDĐT or possess a certificate in a minority language for positions requiring its use.

d) Possess a computer skills certificate meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT.

 

Chapter III

RESPONSIBILITIES, TASKS AND PROFESSIONAL STANDARDS

 PROFESSIONAL REQUIREMENTS FOR THE RANKS OF EXECUTION AUDITOR

Article 8. Senior Appeals Officer Rank

1. Responsibilities

A Senior Auditor is a civil servant with the highest level of expertise in the field of execution audit, assisting the head of the civil execution management agency or civil execution agency in performing audit and inspection tasks for important and complex civil execution cases involving multiple levels, sectors, fields, and regions; performing other tasks as assigned by the head of the civil execution management agency. enforcement of civil judgments, civil enforcement agency.

2. Tasks

a) Perform duties, powers as specified in Article 67 of Decree No. 62/2015/NĐ-CP dated July 18, 2015 of the Government detailing and guiding the implementation of certain provisions of the Civil Execution Law (hereinafter referred to as Decree No. 62/2015/NĐ-CP).

b) Conduct audits and inspections of civil execution cases that have been and are being executed; develop inspection plans, proactively implement or coordinate with relevant agencies and units to verify and inspect civil execution work according to plans approved by the head of the civil execution management agency or civil execution agency. During the inspection process, if any errors are discovered, they must advise the competent authority to temporarily suspend the execution of the erroneous decision to correct and bear responsibility for their recommendations. construct inspection plans, proactively implement or coordinate with relevant agencies and units to verify and inspect civil execution work according to plans approved by the head of the civil execution management agency or civil execution agency. i) Participate in drafting laws, ordinances, and other regulatory documents related to the functions and tasks of the civil enforcement system;

k)[17] Assist the head of the civil enforcement management agency in directing and guiding the review and inspection of civil enforcement procedures nationwide and proposing measures to ensure the proper and effective organization of civil enforcement in accordance with the law;

k) Assist the head of the civil enforcement management agency or the civil enforcement agency in guiding and directing reviews and inspections of civil enforcement business nationwide (for Senior Reviewers at the Civil Enforcement General Bureau), throughout the province or centrally governed city (for Senior Reviewers at the Provincial Civil Enforcement Bureau), and proposing adjustment measures to ensure that civil enforcement activities comply with the law and are effective;

m) Participate in developing goals, contents, programs, and training materials for appeals officers in civil enforcement;

m) Participate in developing objectives, contents, programs, textbooks for training and enhancing business skills for the ranks of Civil Execution Review Officers;

n) Perform other tasks as prescribed by law or assigned by the head of the civil enforcement management agency or the civil enforcement agency;

3. Professional Qualification Standards

a) Master the Party's policies and State laws, directives, and resolutions of superiors to apply them to civil enforcement and administrative enforcement work; strategic goals for economic, cultural, and social development;

b) Master and understand knowledge about administrative state management, deeply understand contents of laws on civil enforcement and administrative enforcement, laws on handling complaints and reports; skillfully apply principles, systems, procedures for reviewing, inspecting, and resolving complaints and reports in civil enforcement and administrative enforcement work; deeply understand contents of laws on civil enforcement and administrative enforcement; skillfully apply principles, systems, and procedures for civil enforcement business;

Have the ability to coordinate well with relevant agencies in organizing enforcement;

d) Have the ability to propose and advise on policy formulation, lead in drafting laws, ordinances, projects, programs related to civil enforcement expertise to submit to competent authorities for consideration and decision;

đ) Be proficient and in control of skills in drafting, presenting, defending, and organizing implementation to build and implement projects, programs, plans, teaching materials related to civil enforcement and administrative enforcement work, review, inspection, complaint resolution in civil enforcement;

e) Have the ability to conduct scientific research, summarize broad topics within the assigned field, propose strategic issues regarding civil enforcement work, administrative enforcement work; have the ability to analyze, generalize, and synthesize across multiple fields related to enforcement work;

g) For civil servants applying for promotion to Senior Reviewer, they must be individuals who have led or participated in drafting and submitting to competent authorities for issuance at least two (2) normative legal documents or have led or participated in researching, drafting, and submitting at least two (2) research topics, projects, programs at the ministry, sector, or local level that have been accepted and met requirements, or have led or participated in drafting and implementing at least two (2) specialized topics, projects, initiatives within the Civil Enforcement General Bureau or the civil enforcement system;

h) Civil servants applying for promotion to Senior Reviewer must have held the position of Chief Reviewer or equivalent for at least five years (60 months), including at least two years (24 months) as Chief Reviewer;

4. Educational and Training Standards

a) Hold a Bachelor's degree in Law or higher.

b) Hold a certificate for training in the profession of Senior Reviewer according to the content and program of the Ministry of Justice;

c) Hold a Master's degree in Political Theory.

d) Hold a foreign language certificate equivalent to level 4 of the Vietnamese Foreign Language Proficiency Framework as stipulated in Circular No. 01/2014/TT-BGDĐT;

đ) Hold a computer skills certificate meeting the basic standard for using information technology as stipulated in Circular No. 03/2014/TT-BTTTT;

Article 9. Senior Inspector Rank

1. Responsibilities

A Chief Reviewer is a civil servant with professional expertise in civil enforcement review, assisting the head of the agency directly or participating in reviewing cases that have been or are being enforced, reviewing, inspecting, verifying cases involving complaints and reports on civil enforcement, and performing other tasks as assigned by the head of the civil enforcement management agency or the civil enforcement agency;

2. Tasks

a) Carry out duties and powers as prescribed in Article 67 of Decree No. 62/2015/NĐ-CP;

b) Conduct reviews of case files that have been or are being enforced according to approved plans or assignments by the head of the civil enforcement management agency or the civil enforcement agency, propose solutions and take responsibility for their recommendations. During the inspection process, if errors are discovered, advise the competent authority to temporarily suspend the execution of erroneous decisions to correct and repair, and take responsibility for their recommendations;

c) Developing plans, organizing implementation, or coordinating with related agencies and units to verify, check, and propose measures to resolve assigned tasks;

d) Inspecting and checking statistical reports and data on civil enforcement from mid-level enforcement officers, junior-level enforcement officers, and subordinate civil enforcement agencies;

đ) Advise and assist the head of the civil enforcement management agency or the civil enforcement agency: Respond to objections and suggestions from the People's Public Prosecutor according to their authority; advise on resolving complaints and reports within the jurisdiction of the head of the civil enforcement management agency or the civil enforcement agency;

e) Inspecting, checking, and advising on resolving complaints and reports related to personnel work in the civil enforcement system;

g) Inspecting, checking, compiling reports related to civil enforcement work, and accounting reports on civil enforcement business of subordinate units;

h) Participating in drafting laws, ordinances, and other regulatory documents related to the functions and responsibilities of the civil enforcement organization system;

i) Preparing materials, participating in training for junior-level enforcement officers, inspector ranks, and enforcement clerk ranks;

k) Performing other tasks as prescribed by law or assigned by the head of the agency.

3. Professional Qualification Standards

a) Be thoroughly familiar with the Party's policies and State laws, directives, and resolutions from superiors to apply them to civil and administrative enforcement work;

b) Understand the provisions of laws on civil enforcement, administrative enforcement, laws on handling complaints and denunciations; proficiently apply principles, systems, procedures for reviewing, inspecting, handling complaints and denunciations in civil enforcement and administrative enforcement work;

c) Understand the current situation and trends in domestic and international civil enforcement work; organize research to serve management and information processing;

d) Possessing analytical and synthesis skills, proficient in document preparation, and presenting issues related to assigned responsibilities;

đ) For civil servants participating in the examination to upgrade to the rank of Senior Reviewer, they must be individuals who have led or participated in drafting at least one (1) legal normative document or led research, drafting, or participated in research, drafting at least one (1) scientific research topic, project, program at the ministry, sector, provincial, or district level, which has been issued or accepted and evaluated as meeting requirements by the competent authority, or have led and implemented at least one (1) research topic, project, initiative effectively within the scope of the Civil Enforcement Agency or the Civil Enforcement Office;

h) Civil servants participating in the examination to upgrade to the rank of Senior Reviewer must have held the rank of Reviewer or equivalent for at least five years (60 months), including a minimum of three years (36 months) holding the rank of Reviewer;

4. Educational and Training Standards

a) Hold a Bachelor's degree in Law or higher.

b) Hold a certificate in training for the Senior Reviewer rank according to the content and program of the Ministry of Justice;

c) Possess a foreign language certificate equivalent to Level 3 of the Vietnamese foreign language proficiency framework as stipulated in Circular No. 01/2014/TT-BGDĐT or possess a certificate in a minority language for positions requiring its use.

d) Possess a computer skills certificate meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT.

Article 10. Auditor Rank

1. Responsibilities

A reviewer is a civil servant with expertise in the field of review of civil enforcement and administrative enforcement, assisting the head of the enforcement agency in directly conducting reviews of cases that have been and are being enforced, verifying cases involving complaints and denunciations according to the assignment of the head of the civil enforcement management agency or the civil enforcement agency;

2. Tasks

a) Carry out duties and powers as prescribed in Article 67 of Decree No. 62/2015/NĐ-CP;

b) Conduct reviews of case files of cases that have been and are being enforced by初级执行官根据计划或根据民事执行管理机关或民事执行机关负责人的分配进行执行,提出解决建议并对其提出的建议承担责任;

c) Review statistics, reports, data on civil enforcement cases handled by primary enforcement officers and subordinate civil enforcement agencies;

đ) Auditing, inspecting, and advising on resolving complaints and reports related to organizational and personnel work within the civil judgment enforcement system.

e) Review, inspect, and compile reports related to civil enforcement work, accounting reports on civil enforcement business of subordinate units;

g) Advising on drafting laws, ordinances, and other regulatory legal documents related to the functions and tasks of the civil judgment enforcement organization system.

h) Drafting and organizing the implementation of audit work according to the assignment of the head of the agency.

i) Coordinating with relevant agencies and units to carry out audit work on assigned cases in accordance with the law.

k) Performing other tasks assigned by the head of the agency.

3. Professional Qualification Standards

a) Mastering the Party's guidelines and state policies, directives, and resolutions of superiors to apply them to civil judgment enforcement and administrative judgment enforcement work.

b) Proficiently understand the provisions of laws on civil enforcement, administrative enforcement, laws on handling complaints and denunciations, and the review and inspection business of civil enforcement, complaint and denunciation resolution business;

c) Understanding the economic and social situation in the locality related to civil judgment enforcement work.

d) Having the ability to coordinate with units and individuals during the performance of tasks.

đ) Mastering the procedures for handling tasks, having writing skills for documents and presenting issues assigned for research and advice.

A civil servant proposed for appointment to the Auditor rank must currently hold the Specialist rank or equivalent and have at least three years (36 months) of experience in legal work.

4. Educational and Training Standards

a) Hold a Bachelor's degree in Law or higher.

b) Hold a certificate in training for the Reviewer rank according to the content and program of the Ministry of Justice;

c) Possess a foreign language certificate equivalent to Level 2 of the Vietnamese foreign language proficiency framework as stipulated in Circular No. 01/2014/TT-BGDĐT or possess a certificate in a minority language for positions requiring its use.

d) Possess a computer skills certificate meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT.

 

Chapter IV

DUTIES, TASKS AND SPECIALIZATION REQUIREMENTS

ENFORCEMENT RANKS' BUSINESS

Article 11. Clerk of Enforcement

1. Responsibilities

An enforcement clerk is a civil servant specializing in enforcement business, responsible for assisting senior and intermediate enforcement officers in carrying out procedures and formalities in civil enforcement and administrative enforcement work, or assisting senior and chief reviewers in conducting reviews of cases that have been and are being enforced, verifying cases involving complaints and denunciations regarding civil enforcement according to the law;

2. Tasks

a) Assist senior and intermediate enforcement officers in preparing case files and formalities, organizing the execution of complex and particularly complex cases, large sums of money or assets to be enforced, cases involving multiple localities under the jurisdiction of the county-level Civil Enforcement Office or provincial-level Civil Enforcement Agency; assist senior and intermediate enforcement officers in performing tasks related to administrative enforcement work according to the law, or assist senior and chief reviewers in conducting reviews of cases that have been and are being enforced, verifying cases involving complaints and denunciations according to the law;

b) Record minutes of enforcement verification; minutes of enforcement resolution; minutes of service; minutes of handling evidence, seized and temporarily detained assets; minutes of asset seizure; minutes of asset valuation meetings; minutes of asset status inspections; minutes of destruction of evidence; minutes of forced execution; minutes of property transfer; minutes of asset return and other procedural minutes;

c) Assist the Enforcement Officer and the Reviewer in serving enforcement documents;

d) Implement certain verification contents and build civil enforcement files according to the assignment of the Enforcement Officer and the Reviewer;

đ) Coordinate with relevant agencies and units to assist enforcement officers in organizing enforcement work; assist reviewers in conducting reviews of civil enforcement cases assigned according to the law;

e) Perform other tasks assigned by the head of the enforcement agency.

3. Professional Qualification Standards

a) Master the viewpoints, policies, and guidelines of the Party and the state's policies and laws related to civil enforcement work;

b) Master basic knowledge about legal principles and civil enforcement procedures;

c) Possess the ability to synthesize and propose measures to resolve issues related to the duties of the Clerk of Enforcement;

d) Have skills in drafting documents related to assigned responsibilities and tasks;

đ) Civil servants applying for promotion to the position of Clerk of Enforcement must have held the position of Intermediate Clerk of Enforcement for at least three years (36 months);

4. Educational and Training Standards

a) Hold a Bachelor's degree in Law or higher;;

b) Hold a certificate in training for the Enforcement Clerk rank according to the content and program of the Ministry of Justice;

c) Possess a foreign language certificate equivalent to Level 2 of the Vietnamese foreign language proficiency framework as stipulated in Circular No. 01/2014/TT-BGDĐT or possess a certificate in a minority language for positions requiring its use.

d) Hold a Computer Skills Certificate meeting the basic standard for using information technology as stipulated in Circular No. 03/2014/TT-BTTTT;.

Article 12. Intermediate Clerk of Enforcement

1. Responsibilities

An intermediate enforcement clerk is a civil servant specializing in enforcement business, responsible for assisting primary enforcement officers in carrying out procedures and formalities in civil enforcement and administrative enforcement work, or assisting reviewers in conducting reviews of cases that have been and are being enforced, verifying cases involving complaints and denunciations regarding civil enforcement according to the law;

2. Tasks

a) Advise and assist primary enforcement officers in preparing case files and formalities, organizing the execution of simple cases, small sums of money or assets to be enforced within the jurisdiction of the provincial or county-level civil enforcement agency; assist primary enforcement officers in performing tasks related to administrative enforcement work according to the law, or assist reviewers in conducting reviews of cases that have been and are being enforced, verifying cases involving complaints and denunciations regarding civil enforcement according to the law;

b) Record minutes of enforcement verification; minutes of enforcement resolution; minutes of service; minutes of handling evidence, seized and temporarily detained assets; minutes of asset seizure; minutes of asset valuation meetings; minutes of asset status inspections; minutes of destruction of evidence; minutes of forced execution; minutes of property transfer; minutes of asset return and other procedural minutes;

c) Assist the Junior Enforcement Officer and the Reviewer in serving enforcement documents;

d) Implement certain verification contents and build civil enforcement files according to the assignment of the Junior Enforcement Officer and the Reviewer;

đ) Cooperate with relevant agencies and units to assist primary enforcement officers in carrying out organizational work for civil enforcement proceedings; assist review officers in conducting reviews of civil enforcement cases as assigned in accordance with the provisions of the law;

e) Perform other tasks assigned by the head of the enforcement agency.

3. Professional Qualification Standards

a) Understand the viewpoints, policies, and guidelines of the Party and the state's policies and laws related to civil enforcement work;

b) Master basic knowledge about legal principles and civil enforcement procedures;

c) Possess the ability to synthesize and propose measures to resolve issues related to the duties of the Intermediate Clerk of Enforcement;

d) Possess the ability to draft documents related to assigned responsibilities and tasks.

4. Educational and Training Standards

 

a) Hold a diploma in Law or higher;

b) Hold a certificate in mid-level civil enforcement secretary vocational training in accordance with the content and program of the Ministry of Justice;

c) Hold a foreign language certificate at a level equivalent to Level 1 of the Vietnamese Foreign Language Proficiency Framework as stipulated in Circular No. 01/2014/TT-BGDĐT;

d) Possess a computer skills certificate meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT.

Chapter V

IMPLEMENTING PROVISIONS

Article 13. Implementation Organization

1. The professional standards for specialized civil service ranks within the civil enforcement system serve as the basis for implementing recruitment, utilization, appointment, and management of civil servants engaged in civil enforcement work.

2. The educational and training standards for enforcement officers and review officers under the Ministry of National Defense shall be implemented according to the regulations of the Minister of National Defense, ensuring that they are not lower than the standards set forth for corresponding civil service ranks in this Circular.

Article 14. Transitional provisions and implementation clauses

1. The current rank codes of civil enforcement officers holding the Senior Review Officer (code 03.232) and Review Officer (code 03.230) ranks previously shall be transferred to new rank codes as follows:

a) The Senior Review Officer rank (code 03.232) shall be transferred to the Senior Review Officer rank (code 03.230);

b) The Review Officer rank (code 03.230) shall be transferred to the Review Officer rank (code 03.232).

2. From the date this Circular takes effect, appointments to specialized civil service ranks in civil enforcement must comply with the standards prescribed in this Circular, except for the standards specified in point b, Clause 4, Article 8, point b, Clause 4, Article 9, and point b, Clause 4, Article 10, which will continue to be applied in accordance with point c, Clause 4, Sections I, II, III of Decision No. 01/2007/QĐ-BNV dated January 17, 2007 of the Minister of Home Affairs on the issuance of standards for review officer, senior review officer, and high-level review officer ranks in civil enforcement until December 31, 2017.

3. From the date this Circular takes effect, the provisions regarding the standards for specialized civil service ranks in civil enforcement in Circular No. 10/2010/TT-BNV dated October 28, 2010 of the Minister of Home Affairs; Decision No. 01/2007/QĐ-BNV dated January 17, 2007 of the Minister of Home Affairs; and Decision No. 02/2007/QĐ-BNV dated February 1, 2007 of the Minister of Home Affairs shall cease to be effective, except as provided in Clause 2 of this Article.

Article 15. Effective Date

1. This Circular takes effect from May 22, 2017.

2. Heads of units under the Ministry of Justice, heads of local civil enforcement agencies, and Directors of the Civil Enforcement Bureau under the Ministry of National Defense within their respective duties and authorities shall be responsible for organizing and implementing the provisions of this Circular./.
