Issuing the List of Plant Protection Products Permitted for Use, Prohibiting their Use in Vietnam.

Prohibiting the Use of Plant Protection Products in Vietnam.

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Law on Plant Protection and Quarantine No. 41/2013/QH13 dated November 25, 2013;

At the proposal of the Director of the Plant Protection Department;

Article 1. Amending and supplementing some articles of Circular No. 21/2023/TT-BTTTT dated December 31, 2023 of the Ministry of Information and Communications on functions and technical features of the Administrative Procedure Handling Information System at the ministerial and provincial levels (hereinafter referred to as Circular No. 21/2023/TT-BTTTT) as follows: The Ministry of Agriculture and Rural Development issues. The List of Plant Protection Products Permitted for Use and Prohibited from Use in Vietnam.

Article 1. Attached herewith are

1. The List of Plant Protection Products Permitted for Use in Vietnam, Appendix I attached to this Circular, includes:

a) Pesticides used in agriculture:

- Insecticides: 785 active substances with 1682 trade names.

- Fungicides: 617 active substances with 1280 trade names.

- Herbicides: 234 active substances with 713 trade names.

- Rodenticides: 9 active substances with 27 trade names.

- Growth Regulators: 52 active substances with 141 trade names.

- Insect Attractants: 9 active substances with 9 trade names.

- Snailcides: 30 active substances with 150 trade names.

- Adjuvants (spreaders): 5 active substances with 6 trade names.

b) Termite Control Products: 14 active substances with 23 trade names.

c) Timber Preservation Products: 8 active substances with 9 trade names.

d) Warehouse disinfectants: 4 active ingredients with 10 trade names.

đ) Golf course chemicals:

- Fungicides: 2 active substances with 2 trade names.

- Herbicides: 1 active substance with 1 trade name.

- Growth regulators: 1 active ingredient with 1 trade name.

e) Seed Treatment Products:

- Insecticides: 11 active substances with 14 trade names.

- Fungicides: 10 active ingredients with 11 trade names.

2. The List of Plant Protection Products Prohibited from Use in Vietnam and Supplementing HS Codes for Certain Plant Protection Products Prohibited from Use in Vietnam, Appendix II issued together with this Circular, includes:

a) The List of Plant Protection Products Prohibited from Use in Vietnam

- Insecticides, Timber Preservation Products: 23 active substances.

- Fungicides: 6 active substances.

- Rodenticides: 1 active substance.

- Herbicides: 1 active substance.

b) Supplementing HS Codes for Certain Plant Protection Products Prohibited from Use in Vietnam to Appendix 02 of Circular No. 24/2017/TT-BNNPTNT dated November 15, 2017 of the Minister of Agriculture and Rural Development on issuing the HS Code Table for Export and Import Commodities under the Management of the Ministry of Agriculture and Rural Development (hereinafter referred to as Circular No. 24/2017/TT-BNNPTNT).

- Insecticides, Timber Preservation Products: 2 active substances.

3. The HS Code Table of Plant Protection Products Permitted for Use and Prohibited from Use in Vietnam shall be implemented according to Appendix 01 and Appendix 02 issued together with Circular No. 24/2017/TT-BNNPTNT and Section 2, Appendix II issued together with this Circular.

Article 2. Effective Date

1. This Circular takes effect from March 28, 2018.

2. This Circular replaces the following Circulars:

a) Circular No. 03/2016/TT-BNNPTNT dated April 21, 2016 of the Minister of Agriculture and Rural Development on issuing the List of Plant Protection Products Permitted for Use and Prohibited from Use in Vietnam and announcing HS Codes for Plant Protection Products Permitted for Use and Prohibited from Use in Vietnam;

b) Circular No. 06/2017/TT-BNNPTNT dated March 8, 2017 of the Minister of Agriculture and Rural Development amending and supplementing certain contents of Circular No. 03/2016/TT-BNNPTNT dated April 21, 2016 of the Minister of Agriculture and Rural Development on issuing the List of Plant Protection Products Permitted for Use and Prohibited from Use in Vietnam; announcing HS Codes for Plant Protection Products Permitted for Use and Prohibited from Use in Vietnam;

c) Circular No. 15/2017/TT-BNNPTNT dated August 14, 2017 of the Minister of Agriculture and Rural Development amending and supplementing certain contents of Circular No. 03/2016/TT-BNNPTNT dated April 21, 2016 of the Minister of Agriculture and Rural Development on issuing the List of Plant Protection Products Permitted for Use and Prohibited from Use in Vietnam; announcing HS Codes for Plant Protection Products Permitted for Use and Prohibited from Use in Vietnam.

Article 3. Responsibility for Implementation

The Director of the Ministry's Office, the Director of the Plant Protection Department, the Heads of Units under the Ministry, the Directors of Provincial Departments of Agriculture and Rural Development under the Central Government, and relevant organizations and individuals are responsible for implementing this Circular./.
