Issuing the Harmonized System (HS) Code Table for specialized export and import goods

 under the management of

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 187/2013/NĐ-CP dated November 20, 2013 of the Government detailing the implementation of the Law on Trade regarding international trade activities and foreign agency buying, selling, processing, and transiting goods;

The Minister of Agriculture and Rural Development issues the Circular on the HS Code Table for specialized export and import goods under the management of the Ministry of Agriculture and Rural Development.

Article 1. Attached herewith are with the following appendices:

1. Appendix 01: HS Code Table for plant protection products;

2. Appendix 02: HS Code Table for plant protection products prohibited from use in Vietnam;

3. Appendix 03: HS Code Table for objects subject to phytosanitary inspection in Vietnam;

4. Appendix 04: HS Code Table for fertilizers;

5. Appendix 05: HS Code Table for the list of plant-based food imports requiring food safety checks under the management of the Ministry of Agriculture and Rural Development;

6. Appendix 06: HS Code Table for the list of crop seeds permitted for production and sale in Vietnam;

7. Appendix 07: HS Code Table for roundwood and sawn timber from natural forests in Vietnam prohibited from export;

8. Appendix 08: HS Code Table for processed food products of agricultural, forestry, and aquatic origin imported into Vietnam under the management of the Ministry of Agriculture and Rural Development;

Article 2. Effective Date

2. This Circular abolishes Circular No. 31/2016/TT-NHNN dated November 15, 2016 of the Governor of the State Bank of Vietnam amending and supplementing certain provisions of Circular No. 24/2015/TT-NHNN dated December 8, 2015 of the Governor of the State Bank of Vietnam on foreign currency loans by credit institutions and branches of foreign banks to resident borrowers./.

2. This Circular replaces the following documents and appendices:

a) Decision No. 38/2008/QĐ-BNN dated February 28, 2008 of the Minister of Agriculture and Rural Development on issuing the HS code list for specialized aquatic export and import goods;

b) Decision No. 2515/QĐ-BNN-BVTV dated June 29, 2015 of the Minister of Agriculture and Rural Development on issuing the HS code table for objects subject to phytosanitary inspection in Vietnam;

c) Decision No. 2766/QĐ-BNN-CN dated July 13, 2015 of the Minister of Agriculture and Rural Development announcing the HS code for the list of livestock breeds permitted for production and sale in Vietnam;

d) Decision No. 5481/QĐ-BNN-CN dated December 30, 2005 of the Minister of Agriculture and Rural Development announcing the HS code for the list of rare livestock breeds prohibited from export;

đ) Decision No. 4069/QĐ-BNN-QLCL dated October 14, 2015 of the Minister of Agriculture and Rural Development on announcing the list of imported goods requiring food safety checks before clearance under the responsibility of the Ministry of Agriculture and Rural Development;

e) Decision No. 13/QĐ-BNN-TCTS dated January 5, 2016 of the Minister of Agriculture and Rural Development on announcing the HS code for the list of specialized aquatic goods managed in Vietnam;

g) Decision No. 4758/QĐ-BNN-TY dated November 18, 2015 of the Minister of Agriculture and Rural Development on issuing the HS code table for terrestrial animals and animal products subject to quarantine;

h) Decision No. 2432/QĐ-BNN-TT dated June 13, 2017 of the Minister of Agriculture and Rural Development on issuing the HS code table for crop seeds permitted for production and sale in Vietnam;

i) Circular No. 24/2016/TT-BNNPTNT dated June 30, 2016 of the Minister of Agriculture and Rural Development on issuing the list and announcing the HS code for roundwood, sawn timber from natural forests in Vietnam prohibited from export and exported goods such as firewood and charcoal made from natural forest wood;

k) Appendix IB. List of veterinary drugs permitted for importation and circulation in Vietnam issued together with Circular No. 10/2016/TT-BNNPTNT dated June 1, 2016 of the Minister of Agriculture and Rural Development;

l) Part B, Appendix IC. List of aquatic veterinary drugs permitted for circulation in Vietnam issued together with Circular No. 10/2016/TT-BNNPTNT dated June 1, 2016 of the Minister of Agriculture and Rural Development;

m) Appendix III of Circular No. 03/2016/TT-BNNPTNT dated April 21, 2016 of the Minister of Agriculture and Rural Development on issuing the list of plant protection products permitted for use and prohibited from use in Vietnam; announcing the HS code for plant protection products permitted for use and prohibited from use in Vietnam.

3. Repeal the HS code specified in Appendix II of Circular No. 03/2016/TT-BNNPTNT dated April 21, 2016, issued by the Minister of Agriculture and Rural Development on the List of Plant Protection Products Allowed for Use and Prohibited from Use in Vietnam; announce the HS code for plant protection products allowed for use and prohibited from use in Vietnam.

Article 3. Responsibility for Implementation

The Head of the Ministry's Office, the Director of the Legal Department, the Heads of units under the Ministry, and related organizations and individuals shall be responsible for implementing this Circular.

During the implementation of this Circular, if there are any difficulties, please promptly report to the Ministry of Agriculture and Rural Development for guidance and supplementation./.
