CIRCULAR
ISSUING TECHNICAL AND ECONOMIC STANDARDS FOR TELEVISION PROGRAM PRODUCTION
On the basis of Law on State Budget dated June 25, 2015;
On the basis of Press Law dated April 5, 2016;
Pursuant to Decree No. 201-CP dated May 26, 1981 of the Council of Ministers on the management of technical and economic standards;
On the basis of Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government on the self-management mechanism for public service units;
On the basis of Decree No. 17/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
At the proposal of the Director of the Department of Planning and Finance,
The Minister of Information and Communications issues technical and economic standards for television program production.
Article 1. Technical and economic standards for television program production are promulgated together with this Circular.
Article 2. Scope of Standards
The technical and economic standards for television program production issued together with this Circular specify the maximum direct costs in producing television programs, including: labor costs (excluding transportation costs outside the province or centrally governed city where the television program production agency is headquartered); machine and equipment costs (including shared machines and equipment); material costs used in producing television programs to ensure that the programs meet the conditions for broadcasting or uploading to the Internet as prescribed by press laws.
Article 3. Applicability
Clause 1. The agencies and organizations subject to the technical and economic standards for television program production issued together with this Circular include:
a) Agencies and organizations using state budget funds to organize the production of television programs.
b) News agencies granted permission to operate television services (hereinafter referred to as news television agencies) allocated state budget estimates to produce television programs.
c) Other agencies and organizations related to the production of television programs using state budget funds.
Clause 2. It is encouraged for agencies and organizations not using state budget funds to produce television programs to apply the technical and economic standards for television program production issued together with this Circular.
Article 4. Organization of Implementation
1. This Circular takes effect from July 1, 2018.
Clause 2. Circular No. 30/2010/TT-BTTTT dated December 31, 2010 of the Minister of Information and Communications issuing temporary technical and economic standards for labor and equipment costs in producing television programs shall cease to be effective from the date this Circular takes effect.
Clause 3. Based on the maximum cost standards for producing television programs and the guidance on application issued together with this Circular, ministries, central agencies, and localities shall establish specific production cost standards for television programs suitable to actual conditions but not exceeding the maximum cost standards.
Clause 4. For television programs included in the list of public services issued by the competent authority at the central level but not covered by the technical and economic standards issued together with this Circular, the news television agency producing the program shall organize the establishment of standards and report to the supervising agency to request the Ministry of Information and Communications to consider and issue or approve for the supervising agency to issue.
Clause 5. For the management of the production of television programs included in the list of public services funded by the state budget issued by localities (outside the list of public services issued by the competent authority at the central level), localities shall organize the establishment, review, and issuance of technical and economic standards within their authority or request the competent authority to issue according to the provisions of the law.
Clause 6. In case difficulties arise during implementation, agencies and units are requested to report to the Ministry of Information and Communications for consideration and resolution./.
