CIRCULAR

Regulations on job code, occupational standards and appointment, salary grading for teaching civil servants in secondary schools and supervisory authorities at higher levels; criteria and conditions for appointing and relieving members of the management council in public service units 

Pursuant to the Education Law dated June 14, 2019;

Pursuant to the Civil Servant Law dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law dated November 25, 2019;

Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Based on the proposal of the Director of the Cadre and Civil Servant Department;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, public officials, civil servants, and armed forces; Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, public officials, civil servants, and armed forces;

At the proposal of the Director of the Department of Teachers and Educational Management Staff;

The Minister of Education and Training issues this Circular stipulating job codes, occupational standards and appointment, salary grading for teaching civil servants in public secondary schools. 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates job codes, occupational standards and appointment, salary grading for teaching civil servants in public secondary schools.

Article 2. This Circular applies to teaching civil servants implementing the secondary education program in secondary schools, comprehensive schools with multiple levels including secondary level, centers for continuing education, vocational training and continuing education centers, specialized public schools (hereinafter referred to as public secondary schools), including principals, deputy principals, directors, deputy directors (hereinafter collectively referred to as secondary school teachers) and other related organizations and individuals.

Article 3. Private secondary schools may apply the provisions of this Circular in recruiting, using, and managing teachers.

Article 2. Job Code, Rank of Secondary School Teacher's Occupational Title

The occupational title of secondary school teacher includes:

1. Secondary School Teacher Rank III - Job Code V.07.04.32.

2. Secondary School Teacher Rank II - Job Code V.07.04.31.

3. Secondary School Teacher Rank I - Job Code V.07.04.30.

Chapter II

OCCUPATIONAL STANDARDS

Article 3. Secondary School Teacher Rank III - Job Code V.07.04.32

1. Tasks

a) Develop educational plans for assigned subjects and participate in developing educational plans for subject departments according to secondary education goals and programs;

b) Teach and educate students according to the school’s educational plan and departmental educational plan; manage students in educational activities organized by the school;

c) Use teaching and educational methods that promote students' abilities and qualities, actively engaging students in their activities;

d) Implement activities to assess learning outcomes and discipline according to regulations;

đ) Participate in identifying, nurturing talented students or tutoring underperforming students or guiding student teaching practice (if applicable);

e) Organize psychological counseling and career guidance activities for assigned class students and their parents;

g) Coordinate with relevant organizations and individuals to implement teaching, educational, psychological counseling, and career guidance activities for students;

h) Participate in departmental activities; participate in scientific research; complete the required educational activity management documentation; implement universal secondary education and inclusive education within the assigned scope; participate in organizing competitions (for teachers or students) at the school level or higher (if applicable);

i) Complete training courses and professional development programs as prescribed; self-study and enhance professional capabilities;

k) Performing other tasks assigned by the school principal.

2. Professional ethics standards

a) Adhere to the Party's policies, State laws, and local regulations regarding secondary education;

b) Continuously improve moral character, demonstrate high sense of responsibility, maintain the dignity, honor, and reputation of teachers; set a good example for students;

c) Love, treat students fairly and respect their personalities; protect students' legitimate rights and interests; unite and help colleagues;

d) Strictly follow regulations on teachers' ethics; rules on behavior, conduct, and attire.

3. Educational and Training Standards

a) Hold a bachelor's degree or higher in teacher training for secondary school teachers.

In cases where there are insufficient secondary school teachers with bachelor's degrees in teacher training for specific subjects, they must hold a bachelor's degree in a relevant field and have obtained a professional development certificate for secondary school teachers according to the program issued by the Minister of Education and Training;

b) Hold a professional development certificate according to the occupational standards for secondary school teachers rank III (for newly recruited secondary school teachers rank III, they must obtain the certificate within 36 months from the date of recruitment).

Article 4. Professional Competence Standards

a) Understand the policies, laws, regulations, and requirements of the Party, State, industry, and locality regarding secondary education and implement them in assigned tasks;

b) Master the knowledge of the assigned subject; have the ability to develop teaching and educational plans that foster students' qualities and abilities;

c) Have the ability to effectively apply teaching and educational methods that foster students' qualities and abilities, actively engaging students in their activities;

d) Use methods to assess learning outcomes, discipline, and progress according to directions fostering students' qualities and abilities;

đ) Have the ability to provide psychological counseling and career guidance for students; integrate psychological counseling and career guidance activities into teaching and educational activities;

e) Build cooperative relationships with students' parents and relevant organizations and individuals in implementing teaching and educational activities for students;

g) Develop and implement personal study and professional development plans;

h) Have the ability to apply information technology in performing secondary school teacher rank III tasks and have the ability to use foreign languages or ethnic minority languages in specific tasks assigned.

Article 4. Secondary School Teacher Grade II - Code V.07.04.31

1. Tasks

In addition to the duties of secondary school teacher grade III, secondary school teacher grade II must perform the following tasks:

a) Serve as a lecturer or demonstrate teaching in teacher training classes or trial new models, methods, and technologies from the school level upwards; lead content for teacher training and specialized topic activities in subject departments or participate in building electronic learning materials;

b) Participate in guiding or evaluating scientific research and technological products from the school level upwards;

c) Engage in social activities, serving the community; attract the participation of organizations and individuals in organizing teaching and educational activities for students;

d) Participate in external evaluation teams; or work in professional inspection and supervision for teachers from the school level upwards;

đ) Participate in examination committees or question-setting committees or act as advisors in competitions (for teachers or students) from the school level upwards (if applicable);

2. Professional ethics standards

 In addition to the ethical standards of secondary school teacher grade III, secondary school teacher grade II must always set a good example in implementing regulations on teacher ethics;

3. Educational and Training Standards

a) Hold a bachelor's degree or higher in teacher training for secondary school teachers.

In cases where there are insufficient secondary school teachers with bachelor's degrees in teacher training for specific subjects, they must hold a bachelor's degree in a relevant field and have obtained a professional development certificate for secondary school teachers according to the program issued by the Minister of Education and Training;

b) Hold a certificate for training according to the job title standards for secondary school teacher grade II;

Article 4. Professional Competence Standards

a) Firmly grasp the Party's policies, State laws, regulations, and requirements of the industry and locality regarding secondary education and effectively implement them in assigned tasks;

b) Possess the ability to flexibly adjust teaching and educational plans to fit the actual conditions of the school and locality; have the ability to develop interdisciplinary lesson plans;

c) Proactively update and have the ability to flexibly and effectively apply teaching and educational methods and technologies that meet the goals of general education programs, fitting the actual conditions of the school and locality;

d) Proactively update and have the ability to creatively apply forms and methods of assessment to evaluate student learning outcomes, discipline, and progress towards developing student qualities and abilities;

đ) Possess the ability to effectively apply psychological counseling and career guidance measures suitable for each student group in teaching and educational activities;

e) Actively and positively build healthy, trusting relationships with parents of students, related organizations, and individuals in carrying out teaching and educational activities for students;

g) Proactively study and have the ability to promptly update new professional requirements; have the ability to creatively and appropriately apply forms to enhance personal professional capabilities;

h) Have the ability to apply information technology in performing the duties of secondary school teacher grade II and have the ability to use foreign languages or ethnic minority languages in specific tasks assigned;

i) Be recognized as a model worker at the grassroots level; or receive commendations or certificates of merit from the district level upwards; or be recognized as having achieved one of the titles: excellent teacher, excellent class advisor from the school level upwards, excellent Team Leader of the Ho Chi Minh Communist Youth Union from the district level upwards;

k) Civil servants participating in the competition or review for promotion to the job title of secondary school teacher grade II (code V.07.04.31) must have held the job title of secondary school teacher grade III (code V.07.04.32) or equivalent for at least 09 (nine) years (excluding probationary period), calculated up to the deadline for submitting registration applications for the competition or review for promotion.

Article 5. Secondary School Teacher Grade I - Code V.07.04.30

1. Tasks

In addition to the duties of a Secondary School Teacher Grade II, a Secondary School Teacher Grade I must perform the following duties:

a) Participate in compiling, reviewing, or selecting textbooks, local educational materials, or other teaching materials and teacher training materials;

b) Serve as a speaker, share experiences, or demonstrate teaching in training classes for professional development of teachers at the district level or higher, or participate in online teaching;

c) Lead the implementation and guide colleagues in implementing policies and contents of educational reform;

d) Participate in professional inspection work for teachers at the district level or higher; participate in evaluating or guiding scientific research products and technological products at the district level or higher;

đ) Participate in organizing committees, judging panels, or question-setting committees in competitions (for teachers or students) at the district level or higher (if applicable);

2. Professional ethics standards

Besides the professional ethics standards of a Secondary School Teacher Grade II, a Secondary School Teacher Grade I must be a model example of teacher ethics and encourage, support colleagues in complying with teacher ethics regulations;

3. Educational and Training Standards

a) Hold a master's degree or higher in the field of teacher education for secondary school teachers, or hold a master's degree or higher in a relevant specialty corresponding to the subject taught, or hold a master's degree or higher in educational management;

b) Possess a certificate for professional development according to the criteria for the position of Secondary School Teacher Grade I;

Article 4. Professional Competence Standards

a) Actively and proactively implement and promote, guide colleagues in implementing Party and State policies, regulations, and requirements of the industry and locality regarding secondary education in assigned tasks;

b) Have the ability to implement and guide, support colleagues in building teaching and education plans suitable to the actual conditions of the school and locality; guide, support colleagues in developing interdisciplinary lessons;

c) Have the ability to implement and guide, support colleagues in applying teaching and education methods and technologies towards developing student qualities and abilities suitable to the actual conditions of the school and locality;

d) Apply and guide, support colleagues in using various forms and methods of assessment to evaluate student learning outcomes, discipline, and progress towards developing student qualities and abilities;

đ) Apply and guide, support colleagues in effectively implementing counseling and career guidance measures for students, integrated into teaching and educational activities;

e) Have the ability to propose to the school measures to strengthen close cooperation between the school and related organizations and individuals in carrying out teaching and educational activities for students;

g) Have the ability to guide, support colleagues, and share experiences on developing professional skills and expertise;

h) Have the ability to apply information technology in performing the duties of a Secondary School Teacher Grade I and have the ability to use foreign languages or ethnic minority languages in specific tasks assigned;

i) Be recognized as a Model Worker at the ministry/bureau/sector/provincial level or higher; or receive commendation at the provincial level or higher; or be recognized as having achieved one of the following titles: Excellent Subject Teacher, Excellent Class Advisor, Excellent Leader of the Ho Chi Minh Communist Youth Union from the district level or higher;

k) A staff member participating in the examination or evaluation for promotion to the position of Secondary School Teacher Grade I (code V.07.04.30) must have held the position of Secondary School Teacher Grade II (code V.07.04.31) or equivalent for at least six years, calculated up to the deadline for submitting registration documents for the examination or evaluation for promotion.

Chapter III

GUIDELINES FOR APPOINTMENT AND SALARY GRADING BY PROFESSIONAL TITLES

Article 6. Principles for Appointment to Professional Titles for Secondary School Teachers

1. The appointment of secondary school teachers to professional titles as stipulated in this Circular must be based on the current job position and ensure compliance with the standards for professional title ranks prescribed in Articles 3, 4, 5, and Article 7 of this Circular.

2. When appointing secondary school teachers from professional titles under Circular Joint Circular No. 22/2015/TTLT-BGDĐT-BNV dated September 16, 2015, issued by the Ministry of Education and Training and the Ministry of Home Affairs, which stipulates the code numbers and standards for professional titles of public secondary school teachers (hereinafter referred to as Joint Circular No. 22/2015/TTLT-BGDĐT-BNV), to professional titles for secondary school teachers as stipulated in this Circular, simultaneous promotion of professional title ranks shall not be allowed.

3. The appointment to a higher professional title rank than the one successfully applied for shall not be based on the level of education obtained for newly recruited secondary school teachers.

Article 7. Cases of appointment to the job title of junior high school teacher

1. Civil servants who have been appointed to professional title ranks of secondary school teachers as stipulated in Joint Circular No. 22/2015/TTLT-BGDĐT-BNV, if they meet the standards for professional title ranks as prescribed in this Circular, shall be appointed to professional title ranks of secondary school teachers as follows:

a) Secondary school teachers of Rank III (code number V.07.04.12) shall be appointed to the professional title of secondary school teacher of Rank III (code number V.07.04.32);

b) Secondary school teachers of Rank II (code number V.07.04.11) shall be appointed to the professional title of secondary school teacher of Rank II (code number V.07.04.31);

c) Secondary school teachers of Rank I (code number V.07.04.10) shall be appointed to the professional title of secondary school teacher of Rank I (code number V.07.04.30).

2. Secondary school teachers of Rank II (code number V.07.04.11) who have not met the corresponding standards as prescribed in Article 4 of this Circular shall be appointed to the professional title of secondary school teacher of Rank III (code number V.07.04.32); secondary school teachers of Rank I (code number V.07.04.10) who have not met the corresponding standards as prescribed in Article 5 of this Circular shall be appointed to the professional title of secondary school teacher of Rank II (code number V.07.04.31).

3. Newly recruited secondary school teachers, after completing the probationary period as prescribed and being evaluated by the head of the public service unit as meeting the requirements, shall be appointed to the correct professional title rank of secondary school teacher that they were hired for.

Article 8. Salary Classification

1. Civil servants appointed to the professional titles of secondary school teachers as stipulated in this Circular shall apply the corresponding salary scale promulgated together with Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on the wage system for civil servants, officials, and members of the armed forces, specifically as follows:

a) Secondary school teachers of Rank III, code number V.07.04.32, shall apply the salary coefficient of type A1 civil servant, ranging from coefficient 2.34 to coefficient 4.98;

b) Secondary school teachers of Rank II, code number V.07.04.31, shall apply the salary coefficient of type A2 civil servant, group A2.2, ranging from coefficient 4.00 to coefficient 6.38;

c) Secondary school teachers of Rank I, code number V.07.04.30, shall apply the salary coefficient of type A2 civil servant, group A2.1, ranging from coefficient 4.4 to coefficient 6.78.

2. The classification of salaries when appointing to professional title ranks shall be implemented according to the guidelines set out in Clause 1 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Ministry of Home Affairs guiding the classification of salaries when upgrading, transferring, or changing types of civil servants and officials, and according to the current provisions of the law. When implementing new salary policies, the transition to new salaries shall be carried out according to the regulations of the Government.

Chapter IV

IMPLEMENTING PROVISIONS

Article 9. Transitional Provisions

1. Secondary school teachers of Rank III (code number V.07.04.12) who have not yet met the training standard for secondary school teachers as stipulated in point b Clause 1 Article 72 of the Education Law 2019 shall retain the code number V.07.04.12 and apply the salary coefficient of type A0 civil servant (ranging from coefficient 2.10 to coefficient 4.89) until they meet the training standard, at which point they may be appointed to the professional title of secondary school teacher of Rank III (code number V.07.04.32) or until retirement if they are not required to upgrade their training standard according to Decree No. 71/2020/NĐ-CP dated June 30, 2020, of the Government stipulating the implementation timeline for upgrading the training standard of kindergarten, primary, and secondary school teachers.

2. In cases where secondary school teachers of Rank II (code number V.07.04.11) are appointed to the professional title of secondary school teacher of Rank III (code number V.07.04.32) due to not meeting the standards for Rank II (code number V.07.04.31) as stipulated in Clause 2 Article 7 of this Circular, after meeting the standards for Rank II (code number V.07.04.31), they shall be appointed to the professional title of secondary school teacher of Rank II (code number V.07.04.31) without having to go through an examination or promotion assessment.

3. In cases where secondary school teachers of Rank I (code number V.07.04.10) are appointed to the professional title of secondary school teacher of Rank II (code number V.07.04.31) due to not meeting the standards for Rank I (code number V.07.04.30) as stipulated in Clause 2 Article 7 of this Circular, after meeting the standards for Rank I (code number V.07.04.30), they shall be appointed to the professional title of secondary school teacher of Rank I (code number V.07.04.30) without having to go through an examination or promotion assessment.

Article 10. Provisions on Application

1. Secondary school teachers holding a bachelor's degree shall be recognized as equivalent to the bachelor's degree specified in point a Clause 3 Article 3 and point a Clause 3 Article 4 of this Circular.

2. In the case where a teacher participating in the examination or being considered for promotion to the secondary school teacher position grade II (code V.07.04.31) already holds a master's degree before recruitment, meets the training qualification standards for secondary school teacher position grade II, and has held the secondary school teacher position grade III (code V.07.04.32) or equivalent for at least six (6) years (excluding the probation period), calculated up to the deadline for submitting the application registration for the examination or promotion, then such teacher shall be deemed to meet the requirements regarding the time spent in the grade as stipulated in Point k Clause 4 Article 4 of this Circular.

3. The certificate of training according to the standards for the position grade I and grade II teachers as prescribed in Joint Circular No. 22/2015/TTLT-BGDĐT-BNV shall be recognized as equivalent to the certificate of training according to the standards for the position grade I and grade II teachers as prescribed in this Circular.

4. The programs of training according to the standards for the position grade I and grade II secondary school teachers (issued together with Decision No. 2513/QD-BGDĐT dated July 22, 2016; Decision No. 2512/QD-BGDĐT dated July 22, 2016 of the Minister of Education and Training) shall continue to be implemented until replacement training programs are available.

5. The requirement for the certificate of training according to the standards for the position grade III secondary school teachers as prescribed in Point b Clause 3 Article 3 of this Circular applies to secondary school teachers recruited after this Circular takes effect.

6. For those tasks according to the position grade of secondary school teachers that public secondary schools are not assigned or do not have the conditions to implement, the head of the public secondary school shall report to the competent authority directly deciding on the conversion to other related tasks.

Article 11. Implementation Organization

1. This Circular serves as the basis for determining job positions, the structure of staff members according to the position grades of secondary school teachers, and implementing the recruitment, utilization, and management of secondary school teachers in public secondary schools within the national education system. The Department of Teachers and School Management Staff shall take the lead and provide detailed guidance on the implementation of this Circular.

2. The heads of public secondary schools directly manage and utilize staff members shall be responsible for:

a) Developing the Job Position Plan; specifically determining the staff structure according to the position grades of secondary school teachers in accordance with the school's conditions and ensuring the implementation of the school's development plans and strategies; reviewing the Job Position Plan, establishing the appointment plan for position grades and salary grading for secondary school teachers under their management authority, and submitting it to the competent authority for consideration and decision-making or making decisions according to the delegated authority;

b) Reporting to the competent management authority as prescribed the results of the appointment of position grades and salary grading for secondary school teachers;

c) Developing training and development plans for secondary school teachers; creating conditions for secondary school teachers to receive training and development to meet the position grade standards as prescribed by law;

d) Assigning and distributing tasks to secondary school teachers based on the duties of the position grade, reasonably utilizing their capabilities and enhancing their work efficiency.

3. The heads of the competent management authorities of public secondary schools shall be responsible for:

a) Approving the appointment plan for position grades and salary grading for secondary school teachers in public secondary schools under their management scope; resolving issues within their authority during the process of appointing position grades and salary grading for secondary school teachers in public secondary schools under their management scope;

b) Deciding according to their authority or delegated authority on the appointment to position grades and salary grading for secondary school teachers in public secondary schools;

c) Reporting the results of the appointment of position grades and salary grading for staff members who are secondary school teachers in public secondary schools under their management scope to the competent authority as prescribed.

Article 12. Effectiveness and responsibility for implementation

1. This Circular shall take effect from March 20, 2021.

2. The Director of the Office, the Director of the Department of Teachers and School Management Staff, the Heads of relevant units under the Ministry of Education and Training; the Chairmen of the People's Committees of provinces and centrally-administered cities; the Directors of Departments of Education and Training, and the Directors of Departments of Education, Science, and Technology of Bac Lieu Province shall be responsible for implementing this Circular.

3. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, implementation shall be carried out according to the new documents.

4. This Circular replaces Joint Circular No. 22/2015/TTLT-BGDĐT-BNV dated September 16, 2015 of the Ministry of Education and Training and the Ministry of Home Affairs prescribing the code numbers and standards for the position grades of public secondary school teachers.

5. Any difficulties encountered during the implementation should be reported to the Ministry of Education and Training for consideration and resolution./.
