CIRCULAR

Regulations on determining the enrollment quotas for bachelor's, master's, doctoral programs and vocational college programs in Early Childhood Education

Pursuant to the Education Law dated June 14, 2019;

On the basis of Law on Education Pursuant to the proposal of the Director of the Higher Education Department and Law Amending and Supplementing Certain Provisions of the Law on Higher Education dated November 19, 2018;

Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 99/2019/NĐ-CP dated December 30, 2019 of the Government detailing and guiding the implementation of certain provisions of the Law Amending and Supplementing Certain Provisions of the Higher Education Law;

regulations on determining the enrollment quotas for bachelor's, master's, doctoral programs and vocational college programs in Early Childhood Education.;                 

The Minister of Education and Training issues this Circular 1. This Circular stipulates the regulations on determining the enrollment quotas for bachelor's, master's, doctoral programs and vocational college programs in Early Childhood Education.

Article 1. Scope of Regulation and Applicability

2. This Circular applies to higher education institutions; other educational institutions permitted to train bachelor's, master's, and doctoral programs; academies and institutes established by the Prime Minister under the provisions of the Law on Science and Technology that are permitted to train doctoral programs; vocational colleges permitted to train vocational college programs in Early Childhood Education (hereinafter referred to collectively as training institutions); organizations and individuals related thereto.

Article 2. Objectives

1. Training institutions base their determination and implementation of annual enrollment quotas on the conditions ensuring quality of training and socio-economic development requirements, exercising autonomy and accountability.

2. Publicly disclose the conditions ensuring quality of training, the basis for determining enrollment quotas, and the employment rate of graduates from training institutions for state management agencies to inspect, supervise, and for society to monitor, and for students to choose training institutions to apply to.

1. The list of training programs is the List of Education and Training Level IV for higher education levels, issued by the Ministry of Education and Training.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

2. A training program is a collection of specialized knowledge and skills within the scope of professional activities, science, and technology, classified and listed in the List of Training Programs.

3. A group of training programs is a collection of several training programs with common characteristics in terms of specialization within the scope of professional activities, science, and technology, classified and listed in the List of Education and Training Level III within the National Education System's List of Education and Training as prescribed by the Prime Minister.

4. A field of training is a collection of groups of training programs with common characteristics in terms of specialized knowledge and skills within the scope of professional activities, science, and technology, classified and listed in the List of Education and Training Level II within the National Education System's List of Education and Training.

5. Full-time lecturers in determining enrollment quotas include permanent lecturers and full-time lecturers under fixed-term labor contracts of at least twelve months currently working full-time at the training institution (collectively referred to as full-time lecturers), specifically as follows:

a) Permanent lecturers are defined according to point e, Clause 1, Article 10 of Decree No. 99/2019/NĐ-CP dated December 30, 2019 of the Government detailing and guiding the implementation of certain provisions of the Law Amending and Supplementing Certain Provisions of the Higher Education Law.

b) Full-time lecturers under fixed-term labor contracts of at least twelve months, working full-time at the training institution according to the current regulations of the Ministry of Education and Training on the working system of university lecturers for the year of determining enrollment quotas (including laboratory and experimental instructors), while not signing labor contracts of at least three months with other employers.

6. Invited lecturers in determining enrollment quotas are those who do not fall under the provisions of Clause 5 of this Article, directly participating in teaching and guiding students of the training institution according to invited lecturer contracts with the training institution in accordance with the law for the year of determining enrollment quotas.

7. Expected graduates in determining enrollment quotas are the number of students, learners, and research fellows expected to graduate in the year of determining enrollment quotas, calculated based on the scale of training of each program/field/form of training divided by the corresponding number of years of training for each program/field/form of training.

7. Students, trainees, and graduate students expected to graduate in determining admission quotas are the number of students, trainees, and graduate students expected to graduate in the year for which the admission quotas are determined and are calculated based on the scale of training for each field/area/form of training divided by the corresponding number of years of training for each field/area/form of training.

Article 4. Principles for Determining Enrollment Targets

1. Training institutions determine the enrollment targets for vocational education in Early Childhood Education majors, undergraduate, master's, and doctoral programs in accordance with this Circular and current laws; they publicly announce these targets, bear legal responsibility and provide explanations regarding the determination of enrollment targets, conditions to ensure training quality, and commitments to meet societal needs, while also being subject to supervision by management agencies and society.

2. Enrollment targets are determined annually and independently for each level of training. Based on the determined targets for each level, training institutions must publicly announce the enrollment targets for each major/major group in their project plans and recruitment plans, and be accountable to society and direct management agencies.

3. Undergraduate enrollment targets are set for each major or major group and must not exceed the training capacity of the corresponding field. Master's and doctoral program enrollment targets, vocational education enrollment targets for Early Childhood Education majors, and undergraduate teacher training program enrollment targets are set for each training program and must not exceed the training capacity of the respective training program.

4. Enrollment targets are determined based on the training capacity of the training institution, human resource demand, the employment rate of graduates within 12 months from the date of graduation recognition (for regular full-time undergraduate and vocational training programs), the results of the previous year's recruitment, and the organization of recruitment by the training institution, specifically:

a) The enrollment target of the training institution is determined in accordance with its training capacity as stipulated from Article 7 to Article 12 of this Circular;

b) The enrollment target of the training institution shall not increase in the following cases:

- The total enrollment target of the training institution for each level and each field (for undergraduate programs) or each major (for master's and doctoral programs) shall not increase compared to the previous recruitment year if the training institution has the necessary time to undergo institutional accreditation but has not yet been recognized as meeting the accreditation standards under current laws;

- The enrollment target of the field shall not increase compared to the previous recruitment year if the employment rate of undergraduate graduates within 12 months from the date of graduation recognition is below 80%, or if the implementation rate of the enrollment target of the field in the previous recruitment year is below 80% (applicable to determining undergraduate enrollment targets, except for undergraduate training programs whose curricula have been recognized as meeting the accreditation standards under the law).

5. Training institutions that violate the provisions on the subjects, conditions, and enrollment targets as stipulated in point c, Clause 1, Article 34 of the Higher Education Law (amended and supplemented in 2018) shall not independently determine their enrollment targets for a period of five years from the date when the competent state agency concludes on the violation of the training institution. In such cases, the Ministry of Education and Training will determine and notify the enrollment targets for the training institution according to the following regulations:

a) The training institution registers the enrollment target ensuring full compliance with the principles for determining enrollment targets as stipulated in Clauses 1, 2, 3, and Clause 4 of this Article, then subtracts the number of targets that violated the subjects, conditions, and enrollment targets of the training institution;

b) The Ministry of Education and Training determines and notifies the enrollment targets for the training institution according to Clauses 1, 2, 3, 4, and point a, Clause 5 of this Article.

6. For vocational training programs in Early Childhood Education majors and newly opened undergraduate majors in the recruitment year, the targets are determined within the training capacity of the corresponding field and shall not exceed 30% of the training capacity of the major as prescribed.

7. For majors under the Teacher Training major group, the Ministry of Education and Training will determine and notify the enrollment targets for each vocational and undergraduate regular full-time training program based on the training capacity of the training institution, local and national demand. Training institutions independently determine the enrollment targets for part-time undergraduate and vocational training programs and master's and doctoral program enrollment targets according to this Circular and relevant laws.

8. For majors in the Security and Defense field, the direct management agency of the training institution will determine and notify the enrollment targets for each level and form of training for the training institution based on the training capacity of the training institution and demand, ensuring compliance with this Circular and the regulations of the direct management agency of the training institution, as well as other related laws.

9. The employment rate of graduates from vocational and undergraduate programs as stipulated in Clause 4 of this Article is determined for each training program, surveyed in the year immediately preceding the recruitment year, with the survey target being graduates from the year before the recruitment year, and calculated as the ratio between the number of regular full-time graduates employed within 12 months from the date of graduation recognition and the total number of regular full-time graduates of the same training program and level in that year.

Article 5. Provisions on lecturers in determining admission quotas

1. Each lecturer of the training institution shall be assigned to one field of training for main teaching at the bachelor's level (except for lecturers in teacher training fields and early childhood education at the college level who shall be assigned to one specific training field); and assigned to one training field for main teaching at the master's and doctoral levels to determine admission quotas. The assignment of lecturers to a field of training or a specific training field must be consistent with their expertise and correspond to the scale of training in that field of training or specific training field.

2. Provisions on lecturers in determining admission quotas for bachelor's and college levels:

a) The total number of full-time and visiting lecturers converted according to the field of training (excluding the conversion of lecturers in bachelor's level teacher training fields and early childhood education at the college level according to specific training fields) to determine the admission quota of the training institution, including the converted full-time and visiting lecturers corresponding to the field of training or specific training field;

b) The maximum number of converted visiting lecturers to determine the admission quota is calculated as 10% of the total number of converted full-time lecturers of the training institution determined according to the field of training. For special training fields in the Arts field and other special training fields with high demand for bachelor's level human resources (as specified in Appendix 2 attached hereto), the maximum number of converted visiting lecturers to determine the admission quota is calculated as 40% of the total number of converted full-time lecturers of the training institution determined according to the field of training; visiting lecturers in teacher training fields are not counted in determining the admission quota;

c) The conversion factor for full-time and visiting lecturers participating in teaching early childhood education at the college level and bachelor's level programs with different titles and qualifications as stipulated in Table 1, Appendix 1 attached hereto; each lecturer can only be counted once at the highest conversion rate;

d) For special training fields with high demand for bachelor's level human resources to meet the requirements of national socio-economic development, including: training fields in the Computer Science and Information Technology field, Tourism, Hotel, Sports, and Personal Services field (as specified in Appendix 2 attached hereto) and training fields approved by the Prime Minister through the Ministry of Education and Training in each phase and adjusted and supplemented based on the needs of human resources to meet the requirements of national socio-economic development according to state policies and directions, visiting lecturers include experts, technical staff, and managers who have a bachelor's degree in the same field or related field as the training field and have at least five years of work experience in enterprises or professional associations related to the training field and sector, serving as assistant lecturers and counted with a coefficient to determine the quota as prescribed in point c of this clause;

3. Provisions on lecturers in determining admission quotas for master's and doctoral levels:

a) The total number of lecturers according to the specific training field to determine the admission quota of the training institution, including full-time and visiting lecturers of the training institution with qualifications/titles meeting the requirements for lecturing in master's and doctoral programs and matching the relevant specific training field;

b) The maximum number of visiting lecturers to determine the admission quota is calculated as 10% of the total number of full-time lecturers of the training institution determined according to the specific training field. For special training fields in the Arts field, the maximum number of visiting lecturers to determine the admission quota is calculated as 40% of the total number of full-time lecturers of the training institution determined according to the specific training field; visiting lecturers in teacher training fields are not counted in determining the admission quota;

4. For training fields of ethnic minority language teachers in Vietnam, Vietnamese Language and Literature and Culture, Foreign Language and Literature and Culture, Physical Education and Sports (as specified in the List of Training Fields), and special training fields in the Arts field, the provisions on lecturers in determining admission quotas shall be implemented according to Articles 2 and 3 of this Article and the following provisions:

a) Assistant lecturers who are Meritorious Artists, People's Artists, Meritorious Artisans, People's Artisans, Meritorious Teachers, and People's Teachers recognized and awarded by the State, and holding a bachelor's degree in the same field or related field as the training field, shall be counted with a coefficient to determine the quota equivalent to the coefficient for lecturers with a master's degree (for assistant lecturers in determining the bachelor's level quota);

b) Lecturers who are People's Artists, People's Artisans, and People's Teachers recognized and awarded by the State, and holding a master's degree in the same field or related field as the training field, shall be counted with a coefficient to determine the quota equivalent to the coefficient for lecturers with a doctoral degree (in determining the bachelor's level quota), and counted to determine the quota equivalent to lecturers with a doctoral degree (in determining the master's and doctoral level quotas);

c) Lecturers with the title of People's Artist, People's Artisan, and People's Teacher recognized and awarded by the State, and holding a doctoral degree in the same field or related field as the training field, shall be counted with a coefficient to determine the quota equivalent to the coefficient for lecturers with the title of Associate Professor (in determining the bachelor's level quota), and counted to determine the quota equivalent to lecturers with the title of Associate Professor (in determining the master's and doctoral level quotas);

d) Lecturers with the title of People's Artist, Folk Artist, People's Teacher recognized and awarded by the State, who also hold a doctoral degree and associate professor academic rank in the same field or group of fields as the training field, shall be considered for the coefficient to determine the corresponding quota coefficient of lecturers with the title of Professor (in determining the undergraduate quota), and shall be considered for the corresponding quota of lecturers with the title of Professor (in determining the master's and doctoral quotas).

5. For training fields of ethnic minority languages in Vietnam belonging to the group of fields of Vietnamese Languages, Literature, and Culture, lecturers must be ethnic minorities or individuals knowledgeable about the language and culture of the ethnic minority relevant to the language and culture of the training field; those holding a bachelor's degree in the same field or group of fields as the training field shall be considered for the coefficient to determine the corresponding quota coefficient of lecturers with a master's degree (for assistant lecturers in determining the undergraduate quota); those holding a master's degree in the same field or group of fields as the training field shall be considered for the coefficient to determine the corresponding quota coefficient of lecturers with a doctoral degree (in determining the undergraduate quota), and shall be considered for the corresponding quota of lecturers with a doctoral degree (in determining the master's and doctoral quotas); those holding a doctoral degree in the same field or group of fields as the training field shall be considered for the coefficient to determine the corresponding quota coefficient of lecturers with the title of Associate Professor (in determining the undergraduate quota), and shall be considered for the corresponding quota of lecturers with the title of Associate Professor (in determining the master's and doctoral quotas); those holding a doctoral degree and associate professor academic rank in the same field or group of fields as the training field shall be considered for the coefficient to determine the corresponding quota coefficient of lecturers with the title of Professor (in determining the undergraduate quota), and shall be considered for the corresponding quota of lecturers with the title of Professor (in determining the master's and doctoral quotas).

6. Training fields within the Health sector (as specified in the Catalogue of Training Fields) shall implement lecturer quotas according to the provisions of Clause 2 and Clause 3 of this Article and the following provisions:

a) For educational institutions that organize practical training in the Health sector, the instructors of practical training at public practice facilities, as defined in Clause 2 of Article 10 of Decree No. 111/2017/NĐ-CP dated January 5, 2017 on organizing practical training in the Health sector, shall be full-time lecturers of the educational institution if they have been concurrently appointed to leadership and management positions at or above the department level within the educational institution;

b) Lecturers holding a Board-Certified Internist degree or a Specialist I degree in specialties related to the training field shall be considered for the coefficient to determine the corresponding quota coefficient of lecturers with a master's degree (in determining the undergraduate quota); lecturers holding a Specialist II degree in specialties related to the training field shall be considered for the coefficient to determine the corresponding quota coefficient of lecturers with a doctoral degree (in determining the undergraduate quota), and shall be considered for the corresponding quota of lecturers with a doctoral degree (in determining the master's and doctoral quotas).

Article 6. Criteria and method for calculating enrollment targets for regular college and university admissions based on criteria

1. The criterion of the number of regular students per converted faculty member at the training institution by each field of training:

a) Regular students included in determining the admission quota include: regular undergraduate students, regular kindergarten education college students, regular concurrent degree students (including those who concurrently pursue from intermediate level to regular bachelor's degree; from intermediate teacher training programs to regular kindergarten education associate degree; those with associate degrees in other teacher training programs pursuing kindergarten education associate degree; those with bachelor's degrees or higher pursuing other bachelor's degrees); excluding commissioned students studying at the training institution;

b) The maximum number of regular undergraduate students per converted faculty member by field of training is determined according to the standard set forth in Table 2, Appendix 1 issued together with this Circular;

c) The number of regular kindergarten education college students per converted faculty member shall not exceed twenty-five students;

d) Calculation method:

Divide the total number of regular students by field of training by the total number of converted faculty members in that field of training.

2. The criterion of floor area directly serving training of the training institution per regular student for various construction projects and requirements for types and quantities of learning materials and equipment as stipulated by the training program and scientific research:

a) The floor area directly serving training owned per regular student shall not be less than 2.8 square meters;

b) The categories of construction projects counted towards the floor area directly serving training and the requirements for types and minimum quantities of learning materials/equipment for each category are as follows:

- Auditoriums, lecture halls, classrooms of various types, multi-purpose rooms, offices of professors, associate professors, and lecturers of the training institution;

- Libraries, learning resource centers;

- Research centers, laboratories, experimental facilities, practical training bases, practice sites, training grounds;

c) Calculation method:

Divide the total floor area of construction projects identified in point b of this clause by the total number of regular students at the training institution.

3. For pilot fields of training primarily conducted through online methods, applying modern scientific and technological achievements in training as proposed by the training institution to meet the demand for university-level human resources to serve economic and social development at the local/regional/national levels approved by the Ministry of Education and Training at each stage, the criteria for determining regular undergraduate admission quotas as prescribed in clauses 1 and 2 of this Article shall be reviewed and decided by the Minister of Education and Training.

4. The criterion of labor market demand and requirements for economic and social development: The training institution must base its admission quota on the labor market demand and requirements for national, local, and sectoral economic and social development.

Article 7. Determining the Enrollment Targets for Regular College and University Programs

1. The enrollment targets for regular college programs in Early Childhood Education and the annual enrollment targets for regular university programs shall be determined at a maximum equal to the total scale of regular training capacity based on the training capacity of each field of study (for each program within the teacher training group of programs), meeting simultaneously the criteria stipulated in Article 6 of this Circular, minus the total scale of regular students currently being trained at the educational institution, plus the number of students expected to graduate in the recruitment year, while ensuring compliance with the general principles prescribed in Article 4 of this Circular.

2. The enrollment targets for integrated undergraduate programs in regular form are included in the total enrollment targets for regular university programs, wherein the ratio of enrollment targets for integrated training from secondary level to college level to bachelor's level is determined according to the current regulations of the Government and the Prime Minister. The enrollment targets for integrated college programs in regular form in Early Childhood Education are included in the total enrollment targets for regular college programs of the educational institution.

3. For the enrollment targets for integrated regular training implementing Decree No. 71/2020/NĐ-CP dated March 30, 2020 of the Government regarding the roadmap for raising the qualification standards of early childhood education teachers, primary school teachers, and lower secondary school teachers, the Minister of Education and Training shall consider, decide, and notify the educational institutions based on the needs of localities and the training capacity of the institutions.

Article 8. Determining the Enrollment Targets for Regular College and University Teacher Training Programs

1. Educational institutions permitted to train teacher training programs shall determine the enrollment targets for regular college programs in Early Childhood Education and the enrollment targets for regular university teacher training programs according to this Circular and current legal regulations, report to the Ministry of Education and Training to register the enrollment targets for teacher training programs of the educational institution.

2. The Ministry of Education and Training shall determine and announce the enrollment targets for regular college programs in Early Childhood Education and the enrollment targets for regular university teacher training programs by field of study for each educational institution based on the training capacity of the institution, local and national demand, and in accordance with this Circular and relevant current legal regulations.

Article 9. Determining the Enrollment Targets for College and University Programs Combining Work and Study

1. The enrollment targets for college programs in Early Childhood Education in combined work and study form (including training for those who have completed high school or those who already hold a college degree and integrated training from college level to college level for those who already hold a secondary level degree) shall be determined at a maximum not exceeding 50% of the total enrollment targets for regular college programs.

2. The enrollment targets for university programs combining work and study (including training for those who have completed high school or those who already hold a bachelor's degree and integrated training from secondary level to college level to bachelor's level) shall be determined at a maximum not exceeding 30% of the regular enrollment targets for each field of undergraduate study of the educational institution. For the Arts field and the Teacher Training group of programs, the enrollment targets for university programs combining work and study of the educational institution shall be determined at a maximum not exceeding 50% of the regular enrollment targets for each field of undergraduate study (by each program for the Teacher Training group) of the educational institution.

3. The enrollment targets for integrated undergraduate programs combining work and study are included in the total enrollment targets for university programs combining work and study of the educational institution, wherein the ratio of enrollment targets for integrated training from secondary level to college level to bachelor's level in combined work and study form is determined according to the current regulations of the Government and the Prime Minister. The enrollment targets for integrated college programs in Early Childhood Education in combined work and study form are included in the total enrollment targets for college programs combining work and study of the educational institution.

4. For the enrollment targets for integrated training in combined work and study form implementing Decree No. 71/2020/NĐ-CP dated March 30, 2020 of the Government regarding the roadmap for raising the qualification standards of early childhood education teachers, primary school teachers, and lower secondary school teachers, the Minister of Education and Training shall consider, decide, and notify the educational institutions based on the needs of localities and the training capacity of the institutions.

Article 10. Determining Enrollment Targets for Distance Learning University Programs

1. Training institutions must ensure that they fully meet all minimum requirements to implement distance learning programs, including the application of information technology in management and organization of training through computer networks, which includes: electronic learning materials combined with main learning materials, online lectures, and a learning management system (LMS) supporting learners, as well as other relevant regulations currently stipulated by the Ministry of Education and Training. These institutions shall determine enrollment targets for distance learning university programs for fields already permitted to offer undergraduate education in regular form according to the provisions of Clauses 2, 3, and 4 of this Article and current related laws, while being responsible for explaining their decision to offer distance learning for each field of study.

2. The annual enrollment target for distance learning undergraduate programs of training institutions shall be determined separately for each field of distance learning and calculated at most as the total scale of distance learning determined based on the training capacity of each field, meeting simultaneously the criteria stipulated in Clauses 3 and 4 of this Article, minus the actual total scale of undergraduate distance learning students currently being trained at the institution and its remote training stations in the corresponding field, plus the number of undergraduate distance learning students expected to graduate in the recruitment year in that field.

3. Criteria for the number of undergraduate distance learning students per converted full-time equivalent lecturer in each field of training:

a) Lecturers in determining distance learning targets include full-time lecturers and invited lecturers participating in teaching and guiding distance learning at the training institution with an average working time of eight hours or more per week; those participating with less than eight hours of average working time per week will be converted according to the corresponding ratio of participation time;

b) The conversion factor according to level and position for lecturers participating in distance learning, including invited lecturers, shall be applied as the conversion factor for full-time lecturers to determine enrollment targets as stipulated in Article 5 of this Circular;

c) The number of undergraduate distance learning students per converted full-time equivalent lecturer participating in distance learning in each field of training shall be determined at most as in the regular form as stipulated in point b, Clause 1 of Article 6 of this Circular.

4. Criteria for the number of undergraduate distance learning students per dedicated staff member managing and supporting distance learning (for both the training institution and remote training stations):

a) Dedicated staff members managing and supporting distance learning are employees who have signed labor contracts with a term of at least twelve months during the recruitment year and work full-time (as stipulated in the current Labor Code regarding working hours and rest periods for workers) for the management and support of distance learning at the training institution and its remote training stations; those working part-time for distance learning shall be converted according to the corresponding ratio of兼任时间参与管理和支持远程教育;

b) The conversion factor according to level and position for dedicated staff members managing and supporting distance learning shall be applied as the conversion factor for full-time lecturers to determine enrollment targets as stipulated in Article 5 of this Circular;

c) The number of undergraduate distance learning students per converted dedicated staff member managing and supporting distance learning shall not exceed two hundred students.

Article 11. Determining the enrollment quota for master's and doctoral programs

1. The maximum enrollment quota for master's programs of training institutions shall be determined by each field of study, calculated based on the maximum scale of master's training according to the training capacity of that field of study, meeting simultaneously the criteria specified in Clause 3 of this Article and ensuring the ratio of students to one thesis supervisor who meets the qualification standards for thesis supervisors as stipulated in the current regulations on master's program admission and training issued by the Ministry of Education and Training.

2. The maximum enrollment quota for doctoral programs of training institutions shall be determined by each field of study, calculated based on the maximum scale of doctoral training according to the training capacity of that field of study, meeting simultaneously the criteria specified in Clause 3 of this Article minus the current scale of doctoral training plus the number of doctoral candidates expected to graduate in the recruitment year of that field of study.

3. Criteria for determining the enrollment quota for master's and doctoral programs

a) The criterion of the maximum number of doctoral candidates and master's students per full-time lecturer and visiting lecturer, according to their level, title, and expertise, to calculate the enrollment quota of the training institution is determined maximally as prescribed in Table 3 (for full-time lecturers) and Table 4 (for visiting lecturers), Appendix 1 promulgated together with this Circular;

b) The criterion of material and technical facilities: The training institution must ensure sufficient material and technical facilities, laboratories, practical equipment, libraries, lecture halls, offices for lecturers, thesis advisors, doctoral candidates, and master's students, appropriate to the requirements of the field, specialty, and type of training program;

c) The criterion of labor market demand and socio-economic development requirements: The training institution must determine the enrollment quota based on the labor market demand and socio-economic development requirements of the country, locality, and field.

Article 12. Determining and Announcing the Enrollment Quota of Training Institutions

1. Training institutions shall determine and announce the enrollment quota of the training institution in accordance with the provisions of this Circular and relevant laws currently in force, wherein the school council is responsible for explaining the orientation of the recruitment method and the development of the scale of training, increasing or decreasing by field and area of training, consistent with the development orientation of the training institution, meeting social needs, ensuring compatibility with the human resource needs of ministries, sectors, localities, and the whole country, ensuring international integration; the director, institute director, or rector of the training institution decides on the determination of the quota and is responsible for explaining the specific quota of each field, group of fields, and area of training, ensuring compatibility with the training capacity of the training institution as stipulated in this Circular and other relevant legal provisions.

2. Training institutions shall update all detailed information and data about the criteria for determining the enrollment quota, the determined enrollment quota, and the results of implementing the enrollment quota into the management software of the Ministry of Education and Training.

3. Training institutions shall publicly and transparently announce the conditions ensuring the quality of training, database, criteria for determining the enrollment quota, enrollment quota, recruitment plan, employment rate of graduates within 12 months from the date of graduation, and other necessary information of the training institution on the training institution's website and update the database into the management software of the Ministry of Education and Training. For fields of training under the security and defense sector, training institutions shall publicly and transparently announce the conditions ensuring the quality of training and other necessary information as prescribed by the direct management agency of the training institution and update the database into the management software of the Ministry of Education and Training.

4. Training institutions shall prepare annual reports on determining the enrollment quota according to the report templates (prescribed in Appendix 4 promulgated together with this Circular) and implement reporting according to the guidance letter of the Ministry of Education and Training.

Article 13. Responsibilities of Training Institutions

1. Implement the correct procedure for determining and announcing quotas.

2. Ensure the truthfulness and accuracy of reported data and the basis for determining admission quotas, annual admission quota results, and bear responsibility for explaining to state management agencies and society.

3. Implement admission quotas for each field of undergraduate training (excluding majors within the group of undergraduate teacher training programs and Early Childhood Education majors at the college level that recruit students by major), and for each major at the master's and doctoral levels, ensuring compliance with the quotas determined and publicly announced by the training institution, while also being within the training capacity as stipulated in this Circular.

4. Provide complete information on the determination and implementation of admission quotas when requested for verification, inspection, and examination by the Ministry of Education and Training and competent authorities.

5. Training institutions that implement specialized programs with high demand for university-level human resources to meet national socio-economic development needs must establish and publish public information on the implementation in their Admissions Plan and quality assurance evidence on the school's website in accordance with the current Admissions Regulations.

6. The directors, institute presidents, and rectors of training institutions are responsible for explaining to the Ministry of Education and Training and society about the determination and implementation of admission quotas of their institutions in accordance with current regulations.

Article 14. Inspection, Examination, and Handling of Violations

1. The Ministry of Education and Training organizes inspections and examinations of the determination of admission quotas by training institutions in accordance with the law.

2. Educational institutions violating regulations on the determination of admission quotas will be handled according to the law. Directors, institute presidents, and rectors of training institutions who commit errors in determining admission quotas and individuals who carry out acts violating regulations on the determination of admission quotas will be handled according to the law.

Article 15. Effective Date

1. This Circular takes effect from March 4, 2022, and applies to admissions for Early Childhood Education majors at the college level; undergraduate, master's, and doctoral levels starting from 2022 onwards.

2. This Circular replaces Circular No. 06/2018/TT-BGDĐT dated February 28, 2018, issued by the Minister of Education and Training regarding the determination of admission quotas for secondary vocational education, college teacher training programs; undergraduate, master's, and doctoral levels, amended and supplemented by Circulars No. 01/2019/TT-BGDĐT dated February 25, 2019, and No. 07/2020/TT-BGDĐT dated March 20, 2020.

3. The Director of the Office, Heads of the Higher Education Department, heads of relevant units under the Ministry of Education and Training; related ministries and sectors; directors of universities; rectors of university-level institutions; rectors of colleges offering Early Childhood Education majors at the college level; institute presidents authorized to offer doctoral programs; heads of schools of state agencies, political organizations, political-social organizations, and people's armed forces authorized to offer higher education programs are responsible for implementing this Circular.
