CIRCULAR
Regulations on the list and periodic rotation terms of positions in the field of Information and Communications at local authorities
for civil servants and officials directly interacting with and handling matters
in the organizational cadre field at local levels
Pursuant to the Anti-Corruption Law dated November 20, 2018;
Pursuant to the Government Decree No. 34/2017/NĐ-CP dated April 3, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to the Government Decree No. 59/2019/NĐ-CP dated July 1, 2019 detailing certain provisions and measures for implementing the Anti-Corruption Law;
At the proposal of the Director of the Cadre Organization Department;
The Minister of Home Affairs issues this Circular prescribing the list and periodic rotation term of positions for civil servants not holding leadership or management positions and officials directly interacting with and handling matters in the organizational cadre field at public institutions under the jurisdiction of provincial and centrally-administered city People's Committees.
Article 1. Scope of Regulation and Applicability
This Circular details the list and periodic rotation term of positions for civil servants not holding leadership or management positions and officials directly interacting with and handling matters in the organizational cadre field at public institutions under the jurisdiction of provincial and centrally-administered city People's Committees.
Article 2. List of Positions in the Organizational Cadre Field Subject to Periodic Rotation
1. Reviewing personnel to submit to competent authorities for appointment, transfer, rotation, training, and capacity building of cadres, civil servants, and officials.
2. Organizing recruitment of civil servants and officials; conducting examinations for promotion of civil servant ranks and official career titles.
3. Reviewing files to submit to competent authorities for approval on organizational structures and staffing.
4. Review proposals for establishing new organizations, restructuring organizations, state-owned enterprises, non-governmental organizations, and professional associations.
5. Reviewing files to submit to competent authorities for decisions on forms of commendation, rewards, and disciplinary actions.
6. Reviewing files to submit to competent authorities for decisions on forms of commendation, rewards, and disciplinary actions.
7. Allocating training quotas and budgets.
8. Managing and implementing salary systems for cadres, civil servants, officials, and workers.
Article 3. Periodic Term for Position Rotation
The periodic rotation term of positions for civil servants and officials directly interacting with and handling matters as prescribed in Article 2 of this Circular is from three to five years.
Article 4. Effective Date
1. This Circular takes effect from June 1, 2022.
2. Abolish Decision No. 05/2008/QĐ-BNV dated November 26, 2008 of the Minister of Home Affairs on issuing the list of positions for civil servants and officials not holding leadership or management positions in the state organization sector subject to periodic rotation.
Article 5. Responsibility for Implementation
Chairmen of provincial and centrally-administered city People's Committees and related organizations and individuals are responsible for implementing this Circular./.
