REGULATIONS ON CODES, STANDARDS OF PROFESSIONAL TITLES AND SALARY GRADING FOR SPECIALIZED CULTURAL BASED PUBLIC SERVICE STAFF
Pursuant to the Civil Servant Law dated November 15, 2010;
Pursuant to the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Public Service Staff Law dated November 25, 2019;
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces, and Decree No. 17/2013/NĐ-CP dated February 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces;
Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
Pursuant to Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, employment, and management of public officials; In accordance with the proposal of the Department of Cadre Organization;
The Minister of Culture, Sports and Tourism issues this Circular stipulating code numbers, occupational standards, and salary grading for specialized cultural staff at the grassroots level.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Circular prescribes codes, standards of professional titles and salary grading for specialized cultural based public service staff, including: Group of method officers and group of cultural guidance officers.
Article 2. This Circular applies to specialized cultural staff at the grassroots level working in public service units and related organizations and individuals.
Article 2. Code numbers of occupational titles for specialized cultural staff at the grassroots level
Clause 1. The method officer group, including:
a) Method officer grade II Code: V.10.06.19
b) Method officer grade III Code: V.10.06.20
c) Method officer grade IV Code: V.10.06.21
Clause 2. The cultural guide officer group, including:
a) Cultural guidance officer grade II Code: V.10.07.22
b) Cultural guidance officer grade III Code: V.10.07.23
c) Cultural guidance officer grade IV Code: V.10.07.24
Article 3. General ethical standards for specialized cultural staff at the grassroots level
Clause 1. Having a sense of responsibility towards assigned tasks, complying with legal regulations; fulfilling all duties of public service staff in professional activities.
2. Devoted to the profession, honest, objective, straightforward; work scientifically with clear opinions; have a humble and proper attitude when interacting with the people; have a sense of struggle against wrongful and negative behaviors; practice thrift and oppose waste.
Clause 3. Having a spirit of unity, being proactive and actively cooperating with colleagues to fulfill assigned tasks.
Clause 4. Continuously studying and improving moral qualities, competence, and capabilities.
Chapter II
OCCUPATIONAL STANDARDS
Article 4. Method Officer Level II - Code: V.10.06.19
1. Duties:
a) Lead the development of long-term, medium-term, and annual plans on grassroots cultural activities of the unit and organize their implementation after approval;
b) Lead the organization of program development, preparation of operational guidelines, and methods for grassroots cultural institutions with activity scales and scopes from district to provincial levels;
c) Directly stage programs, develop scripts for festivals, competitions, performances, and mass cultural and artistic activities at the sectoral and provincial levels;
d) Lead or participate in organizing and preparing content for workshops, conferences, seminars on operational methods and techniques in mass cultural and artistic activities;
đ) Monitor and provide professional guidance to grassroots cultural institutions within the jurisdiction; evaluate, propose, and disseminate experiences among grassroots cultural institutions;
e) Develop program content, prepare materials, and participate in training and providing professional guidance for method officers of lower ranks;
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher relevant to grassroots culture;
b) Possess a certificate in standard occupational title training for method officers;
3. Qualifications regarding professional expertise and skills:
a) Be thoroughly familiar with the Party's policies and State laws on grassroots culture;
b) Be thoroughly familiar with the history, culture, and society of each region;
c) Understand management methods and have experience in organizational work and operations of grassroots cultural institutions;
d) Have the ability to analyze, synthesize, systematize, and draft documents in the field of grassroots culture;
đ) Have basic computer skills and be able to use foreign languages or ethnic minority languages for staff working in ethnic minority areas as required by job positions;
4. Requirements for staff participating in examination or evaluation for promotion to the professional title of method officer grade II:
Have worked in the professional title of method officer grade III or equivalent for at least nine years (excluding probationary and trial periods). In case of equivalent time, they must hold the professional title of method officer grade III for at least one year (twelve months) until the deadline for submitting application registration for examination or evaluation for promotion.
Article 5. Method Officer Level III - Code: V.10.06.20
1. Duties:
a) Develop annual plans for assigned professional tasks and organize their implementation after approval;
b) Stage programs, contests, performances, and cultural and artistic activities at the district level;
c) Monitor and provide professional guidance to grassroots cultural institutions within the jurisdiction; summarize experiences for application in other grassroots cultural institutions;
d) Participate in organizing training sessions, professional skill enhancement, talent development, club, and interest group activities;
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher relevant to grassroots culture;
b) Possess a certificate in standard occupational title training for method officers;
3. Qualifications regarding professional expertise and skills:
a) Be familiar with the Party's policies and State laws on grassroots culture;
b) Have basic knowledge of grassroots cultural management; have experience in grassroots cultural activities;
c) Understand the history, culture, and society of the area under management;
d) Have the ability to analyze, synthesize, and advise on drafting operational guidelines;
đ) Have basic computer skills and be able to use foreign languages or ethnic minority languages for staff working in ethnic minority areas as required by job positions;
4. Requirements for staff participating in examination or evaluation for promotion to the professional title of method officer grade III:
Have worked in the professional title of method officer grade IV or equivalent for at least two years (excluding probationary and trial periods) for college level or at least three years (excluding probationary and trial periods) for secondary level. In case of equivalent time, they must hold the professional title of method officer grade IV for at least one year (twelve months) until the deadline for submitting application registration for examination or evaluation for promotion.
Article 6. Methodology Officer Level IV - Code: V.10.06.21
1. Duties:
a) Participate in guiding experimental models and patterns of activities of grassroots cultural institutions within the scope of assigned work;
b) Carry out tasks related to organizing programs, contests, performances, and other mass cultural activities of grassroots cultural institutions;
c) Monitor and guide the activities of grassroots cultural institutions under the management area.
2. Qualifications regarding education and training:
a) Hold a diploma at the college level or higher relevant to grassroots cultural affairs;
b) Possess a certificate in standard occupational title training for method officers;
3. Qualifications regarding professional expertise and skills:
a) Know methods of organizing and implementing grassroots cultural activities assigned;
b) Have basic knowledge about grassroots cultural work and related cultural and artistic disciplines;
c) Possess the ability to apply information technology to perform assigned tasks.
Article 7. Cultural Guide Level II - Code: V.10.07.22
1. Duties:
a) Lead the development of long-term, medium-term, and annual plans for assigned grassroots cultural business activities and organize their implementation after approval;
b) Lead the organization of compiling promotional materials and guidance on operational procedures for assigned grassroots cultural activities;
c) Develop plans, organize and guide the masses to participate in activities of grassroots cultural institutions (talent classes, club activities, interest groups, tours, rituals, artistic performances, and other grassroots cultural activities);
d) Lead the development and practice of model activity patterns and advanced work methods for the grassroots level;
d) Lead or participate in organizing cultural and artistic mass activities on holidays, festivals, or important events; organize and participate in specialized symposiums, conferences, and performances within their assigned professional scope;
e) Plan, organize training, and guide methodology officers of lower levels in their professional and operational duties.
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher relevant to grassroots culture;
b) Hold a certificate in professional qualification standards for cultural guides.
3. Qualifications regarding professional expertise and skills:
a) Be thoroughly familiar with the Party's policies and State laws on grassroots culture;
b) Master the forms and methods of conducting mass cultural work and clubs;
c) Master pedagogical principles and skills and methods of professional guidance; have experience in guiding grassroots cultural operational activities;
d) Understand grassroots cultural work within the assigned field;
đ) Possess the ability to analyze, synthesize, systematize, and draft professional guidance documents on grassroots cultural affairs;
e) Possess basic computer skills, be able to use foreign languages or ethnic minority languages for staff working in ethnic minority regions according to job requirements.
4. Requirements for staff participating in examination or evaluation for promotion to the professional title of cultural guidance officer grade II:
Have worked in the professional title of cultural guidance officer grade III or equivalent for at least nine years (excluding probationary and trial periods). In case of equivalent time, they must hold the professional title of cultural guidance officer grade III for at least one year (twelve months) until the deadline for submitting application registration for examination or evaluation for promotion.
Article 8. Cultural Guide Level III - Code: V.10.07.23
1. Duties:
a) Participate in developing plans, programs, contents, and guidance materials suitable for the assigned target group;
b) Directly guide the masses to participate in activities of cultural institutions (talent classes, club activities, interest groups, tours, rituals, artistic performances, and other grassroots cultural activities);
c) Practice advanced professional programs and work methods for the grassroots level;
d) Participate in organizing mass cultural and artistic activities on holidays, festivals, or important events; participate in specialized discussions and exchanges on professional and operational matters.
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher relevant to grassroots culture;
b) Hold a certificate in professional qualification standards for cultural guides.
3. Qualifications regarding professional expertise and skills:
a) Be familiar with the Party's policies and State laws on grassroots culture;
b) Understand the forms and methods of conducting mass cultural work and clubs; pedagogical principles and skills and methods of professional guidance;
c) Have basic knowledge about grassroots cultural work within the assigned field;
d) Possess the ability to analyze, synthesize, and draft professional guidance documents on grassroots cultural affairs within the assigned field;
đ) Proficiently use technical equipment and devices serving professional work;
e) Possess basic computer skills, be able to use foreign languages or ethnic minority languages for staff working in ethnic minority regions according to job requirements.
4. Requirements for staff participating in examination or evaluation for promotion to the professional title of cultural guidance officer grade III:
Have worked in the professional title of cultural guidance officer grade IV or equivalent for at least two years (excluding probationary and trial periods) for college level or at least three years (excluding probationary and trial periods) for secondary level. In case of equivalent time, they must hold the professional title of cultural guidance officer grade IV for at least one year (twelve months) until the deadline for submitting application registration for examination or evaluation for promotion.
Article 9. Cultural Guide Level IV - Code: V.10.07.24
1. Duties:
a) Directly guide the masses to participate in one of the activities of cultural institutions (talent class, club activities, interest groups, tours, rituals, artistic performances, and other grassroots cultural activities);
b) Participate in organizing cultural and artistic mass activities on holidays and festivals; participate in seminars and discussions on professional and vocational matters;
c) Participate in proposing plans to organize effective training and vocational guidance sessions.
2. Qualifications regarding education and training:
a) Hold a diploma at the college level or higher relevant to grassroots cultural affairs;
b) Hold a certificate in professional qualification standards for cultural guides.
3. Qualifications regarding professional expertise and skills:
a) Have basic knowledge about methods for guiding grassroots cultural vocational work, community cultural centers;
b) Have experience in guiding the specialized vocational work of grassroots cultural institutions assigned to manage;
c) Know how to use technical equipment for the assigned professional and vocational work;
d) Possess the ability to apply information technology to perform assigned tasks.
Chapter III
GRADING OF SALARIES FOR PROFESSIONAL TITLES OF SPECIALIZED CULTURAL GRASSROOTS STAFF
Article 10. Principles for grading salaries for professional titles of specialized grassroots cultural staff
1. The appointment and salary grading into professional titles of specialized cultural based public service staff prescribed in this Circular must be based on the job position, responsibilities, tasks, and professional expertise currently undertaken by the staff.
2. When appointing and grading salaries for professional titles of specialized grassroots cultural staff, it shall not be combined with salary grade increases or promotions in professional title grades.
Article 11. Salary Grading Method
1. The professional titles of specialized cultural based public service staff prescribed in this Circular shall apply to Table 3 (Table of salaries for professional expertise for cadres and public officials in state-run units) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces, specifically as follows:
a) For the professional title of method instructor:
- The professional title of method instructor Level II applies the salary grade of staff type A2, group 2 (A2.2), from salary coefficient 4.00 to salary coefficient 6.38;
- The professional title of method instructor Level III applies the salary grade of staff type A1, from salary coefficient 2.34 to salary coefficient 4.98;
- The professional title of method instructor Level IV applies the salary grade of staff type B, from salary coefficient 1.86 to salary coefficient 4.06.
b) For the professional title of cultural guide:
- The professional title of cultural guide Level II applies the salary grade of staff type A2, group 2 (A2.2), from salary coefficient 4.00 to salary coefficient 6.38.
- The professional title of cultural guide Level III applies the salary grade of staff type A1, from salary coefficient 2.34 to salary coefficient 4.98;
- The professional title of cultural guide Level IV applies the salary grade of staff type B, from salary coefficient 1.86 to salary coefficient 4.06.
a) In the case where a recruited staff member has a doctoral degree, suitable for the recruitment position, and is appointed to the professional title of method officer grade III or cultural guidance officer grade III: Grade 3, salary coefficient 3.00, category A1 public official;
b) In the case where a recruited staff member has a master's degree, suitable for the recruitment position, and is appointed to the professional title of method officer grade III or cultural guidance officer grade III: Grade 2, salary coefficient 2.67, category A1 public official;
c) In the case where a civil servant with a bachelor's degree suitable for the recruited position is appointed to the profession title of Method Officer Grade III or Cultural Guide Grade III: Rank 1, salary coefficient 2.34, Group A1 civil servant;
d) In the case where a civil servant with an associate degree suitable for the recruited position is appointed to the profession title of Method Officer Grade IV or Cultural Guide Grade IV: Rank 2, salary coefficient 2.06, Group B civil servant;
đ) In the case where a civil servant with a college diploma suitable for the recruited position is appointed to the profession title of Method Officer Grade IV or Cultural Guide Grade IV: Rank 1, salary coefficient 1.86, Group B civil servant;
3. The transfer of salary grade for civil servants from their current profession titles to the specialized grassroots culture profession titles as prescribed in this Circular shall be carried out according to the guidelines set forth in Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Minister of Home Affairs on salary grading when upgrading, transferring grades, or changing categories of civil servants;
Chapter IV
IMPLEMENTING PROVISIONS
Article 12. Implementation Organization
1. This Circular serves as the basis for implementing the recruitment, utilization, and management of specialized cultural staff working in public service units.
2. Heads of public service units directly managing and using civil servants have the responsibility to review the positions within their units; decide or submit to the competent authority for approval the appointment of specialized grassroots culture profession titles for civil servants according to the delegated authority;
3. Non-public organizations may apply the provisions of this Circular to recruit, use, and manage staff working in the specialized grassroots culture field;
Article 13. Transitional Provisions
1. Civil servants who were appointed to specialized grassroots culture profession titles in accordance with the law before the effective date of this Circular shall be deemed to meet the requirements of the profession title standards for specialized grassroots culture civil servants as prescribed in this Circular corresponding to the profession titles they were appointed to;
2. Civil servants who had obtained the training certificate for the profession title standards of specialized grassroots culture civil servants at various levels before June 30, 2022, as stipulated in Clause 3, Article 2 of Decree No. 89/2021/NĐ-CP dated October 18, 2021, amending and supplementing certain articles of Decree No. 101/2017/NĐ-CP dated September 1, 2017, of the Government on training and retraining of cadres, civil servants, and public officials shall be deemed to meet the requirement for the training certificate for the profession title standards of specialized grassroots culture civil servants for the purpose of transferring profession titles, participating in examinations, or being considered for promotion in profession titles, and shall not need to undergo the training program for the profession title standards of specialized grassroots culture civil servants as prescribed in this Circular;
Article 14. Effective Date
1. This Circular takes effect from August 25, 2022.
2. Repeal Circular Jointly Issued No. 06/2016/TTLT-BVHTTDL-BNV dated June 30, 2016, of the Minister of Culture, Sports and Tourism and the Minister of Home Affairs on the code number and standards of profession titles for specialized grassroots culture civil servants;
3. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, implementation shall be carried out according to the amended, supplemented, or replaced documents.
Article 15. Responsibility for Implementation
1. The Minister, the Head of a ministry equivalent to a ministry, the Head of a government agency, the Chairman of the People's Committee of a province or centrally governed city, and related agencies, units, and individuals are responsible for implementing this Circular;
2. During the implementation process, if any difficulties arise, it is requested that agencies, units, and individuals promptly report them to the Ministry of Culture, Sports and Tourism for research and appropriate amendments and supplements./
