JOINT CIRCULAR

REGULATIONS ON CODES AND STANDARDS FOR THE TITLES AND PROFESSIONAL RANKS OF CULTURAL BASED PUBLIC SERVICE STAFF

Pursuant to the Civil Servant Law No. 58/2010/QH12 dated November 15, 2010;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, utilization, and management of civil servants;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public service staff, and armed forces; Decree No. 17/2013/NĐ-CP dated February 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP;

Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

The Minister of Culture, Sports and Tourism and the Minister of Home Affairs issue this Joint Circular stipulating codes and standards for titles and professional ranks of cultural based public service staff.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

This Joint Circular stipulates codes, standards for titles and professional ranks, and appointment and classification of salaries according to professional ranks for cultural based public service staff working in public service units.

Article 2. Codes and Classification of Titles and Professional Ranks of Cultural Based Public Service Staff

1. Titles and professional ranks of cultural based public service staff include: the group of method officers and the group of cultural guidance officers.

2. Group of method officers includes:

a) Method Officer Rank II

b) Method Officer Rank III

Code: V.10.06.20

c) Method Officer Rank IV

Code: V.10.06.21

3. Group of cultural guidance officers includes:

a) Cultural Guidance Officer Rank II

Code: V.10.07.22

b) Cultural Guidance Officer Rank III

Code: V.10.07.23

c) Cultural Guidance Officer Rank IV

Code: V.10.07.24

Article 3. General standards for professional ethics

1. To have a high sense of responsibility for assigned tasks, comply with laws, fulfill all obligations of public service staff in professional activities.

2. To be aware of learning to improve professional knowledge and skills related to grassroots cultural work.

3. To be honest, objective, straightforward, work scientifically, have clear opinions; maintain humility and propriety when interacting with the people; respect colleagues; combat wrongful and negative behaviors; practice thrift and oppose waste.

4. To be cooperative, assist colleagues, share experiences in work.

Chapter II

OCCUPATIONAL STANDARDS FOR PUBLIC OFFICIALS

Article 4. Method Officer Level II - Code: V.10.06.19

1. Duties:

a) Propose and participate in building programs and plans for grassroots cultural activities at the workplace;

b) Draft activity programs, training materials, methods of work, scripts for cultural activities involving mass art and culture at the district, county level and equivalent up to provincial level;

c) Directly organize programs, scripts for festivals, competitions, and other cultural activities at the provincial level and sectoral level;

d) Lead or participate in organizing and preparing content for workshops, conferences, seminars on operational methods and techniques in mass cultural and artistic activities;

d) Monitor and guide professional work for cultural facilities in the area; evaluate, propose, and disseminate experiences among cultural facilities;

e) Plan, organize training and upgrading of professional skills for lower rank method officers;

g) Have the ability to synthesize, research, and develop curricula for grassroots cultural professional training.

2. Qualifications regarding education and training:

a) Hold a bachelor's degree or higher in a relevant cultural field;

b) Have a foreign language proficiency level of B1 as specified in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the 6-level Foreign Language Proficiency Framework for Vietnam;

c) Have basic computer skills as specified in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Basic Computer Skills Standards;

d) Hold a certificate for training standards for Method Officer Rank II.

3. Qualifications regarding professional expertise and skills:

a) Firmly grasp and implement correctly the viewpoints, policies, and guidelines of the Party and the State's policies and laws;

b) Possess the ability to direct and organize specialized work assigned;

c) Be familiar with the historical, cultural, and social characteristics of each region;

d) Understand management methods and have experience in organizational activities and operations of cultural facilities;

đ) Possess the ability to research, synthesize, and draft documents in the field of grassroots cultural work.

4. Public service staff promoted from Method Officer Rank III to Method Officer Rank II must meet all provisions of Clauses 2 and 3 of this Article and have a minimum of 9 years of work experience in the position of Method Officer Rank III or equivalent, including at least 2 years in the most recent period holding the position of Method Officer Rank III.

Article 5. Method Officer Level III - Code: V.10.06.20

1. Duties:

a) Participate in building programs and plans for a specific field of professional work or part of it based on general programs and plans;

b) Participate in organizing and preparing part of the content for professional conferences and seminars; participate in organizing training and upgrading classes for professional skills, team-building activities, clubs, and skill development activities for target groups;

c) Organize programs, contests, performances, and other cultural activities at the district and county levels;

d) Monitor the activities of cultural facilities in the area to provide professional guidance and assistance; summarize experiences for application in other cultural facilities.

2. Qualifications regarding education and training:

a) Hold a bachelor's degree or higher in a relevant cultural field;

b) Have a foreign language proficiency level of A2 as specified in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the 6-level Foreign Language Proficiency Framework for Vietnam;

c) Have basic computer skills as specified in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Basic Computer Skills Standards;

d) Hold a certificate for training standards for Method Officer Rank III.

3. Qualifications regarding professional expertise and skills:

a) Understand the viewpoints, policies, and guidelines of the Party and the State's policies and laws;

b) Have basic knowledge about managing grassroots cultural work and specialized knowledge about the field assigned to manage;

c) Be knowledgeable about the historical and cultural characteristics of the area assigned to manage;

d) Have experience in grassroots cultural work;

đ) Know research methods, synthesis, and advisory drafting of guiding documents.

4. A civil servant promoted from the title of cultural method officer grade IV to the title of cultural method officer grade III must fully comply with the provisions of Clause 2 and Clause 3 of this Article and have at least two years of service in the position of cultural method officer grade IV for those with a college degree or at least three years for those with a secondary vocational degree.

Article 6. Methodology Officer Level IV - Code: V.10.06.21

1. Duties:

a) Participate in guiding experimental models and examples of activities of cultural institutions within the scope of assigned work;

b) Perform tasks assigned regarding the organization of programs, contests, performances, and other mass cultural activities of cultural institutions;

c) Monitor the activities of cultural institutions in the field of culture and arts within the managed area to provide professional guidance.

2. Qualifications regarding education and training:

a) Hold a diploma in secondary vocational education or higher, relevant to the cultural specialty;

b) Have a foreign language proficiency level of at least Level 1 (A1) as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the Foreign Language Competency Framework for Vietnam;

c) Possess basic computer skills in accordance with the standards set forth in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications on the Standards for Computer Skills;

3. Qualifications regarding professional expertise and skills:

a) Know methods of organizing and implementing cultural and artistic activities assigned;

b) Have basic knowledge about grassroots cultural work and related cultural and artistic disciplines.

Article 7. Cultural Guide Level II - Code: V.10.07.22

1. Duties:

a) Develop plans, programs, contents, and draft guidelines for cultural and artistic activities for different entities and target groups under the assigned authority;

b) Develop plans, organize, and guide the masses to participate in one of the activities of cultural institutions, including talent classes, club meetings, tours, ceremonies, folk art performances, and other activities ensuring alignment with the direction and ideological content for high effectiveness;

c) Lead in guiding subordinate units to practice model professional programs and apply advanced working methods;

d) Plan, organize, and train lower-level cultural guides in their professional duties;

đ) Participate in organizing mass cultural activities on holidays, festivals, or significant events; organize and participate in specialized seminars, conferences, and performances within the assigned professional and technical scope.

2. Qualifications regarding education and training:

a) Hold a bachelor's degree or higher in a relevant cultural field;

b) Have a foreign language proficiency level of at least Level 3 (B1) as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the Foreign Language Competency Framework for Vietnam;

c) Have basic computer skills as specified in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Basic Computer Skills Standards;

d) Hold a certificate for training in professional and technical skills for Grade II Cultural Guides;

3. Qualifications regarding professional expertise and skills:

a) Firmly grasp and implement correctly the viewpoints, policies, and guidelines of the Party and the State's policies and laws;

b) Master forms and methods of conducting mass cultural work and clubs; pedagogical principles and professional skills and methods;

c) Understand grassroots cultural work within the assigned responsibility area;

d) Have experience in guiding professional activities; possess the ability to advise, compile, and draft professional and technical guidelines;

đ) Know how to use technical equipment for professional purposes and occupational safety and health principles;

4. A civil servant promoted from the title of Grade III Cultural Guide to the title of Grade II Cultural Guide must fully comply with the provisions of Clause 2 and Clause 3 of this Article and have at least nine years of service in the position of Grade III Cultural Guide or equivalent, including at least two years in the most recent period holding the position of Grade III Cultural Guide.

Article 8. Cultural Guide Level III - Code: V.10.07.23

1. Duties:

a) Participate in developing plans, programs, contents, and guidance materials suitable for the assigned target group;

b) Directly guide the masses to participate in one of the activities of cultural institutions, including talent classes, club meetings, tours, ceremonies, folk art performances, and other activities ensuring alignment with the direction and ideological content for high effectiveness;

c) Practice professional programs to apply advanced working methods for the institution;

d) Participate in organizing mass cultural activities on holidays and festivals; participate in specialized seminars and discussions on professional and technical matters;

2. Qualifications regarding education and training:

a) Hold a bachelor's degree or higher in a relevant cultural field;

b) Have a foreign language proficiency level of A2 as specified in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the 6-level Foreign Language Proficiency Framework for Vietnam;

c) Have basic computer skills as specified in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Basic Computer Skills Standards;

d) Hold a certificate for training in professional and technical skills for Grade III Cultural Guides;

3. Qualifications regarding professional expertise and skills:

a) Understand the viewpoints, policies, and guidelines of the Party and the State's policies and laws;

b) Understand the forms and methods of conducting mass cultural work and clubs; pedagogical principles and skills and methods of professional guidance;

c) Understand grassroots cultural work within the assigned responsibility area;

d) Have experience in guiding professional activities; possess the ability to compile and draft professional and technical guidelines;

đ) Know how to use technical equipment for professional purposes and occupational safety and health principles;

4. A civil servant promoted from the title of Grade IV Cultural Guide to the title of Grade III Cultural Guide must fully comply with the provisions of Clause 2 and Clause 3 of this Article and have at least two years of service in the position of Grade IV Cultural Guide for those with a college degree or at least three years for those with a secondary vocational degree.

Article 9. Cultural Guide Level IV - Code: V.10.07.24

1. Duties:

a) Directly guide the masses to participate in one of the activities of the Cultural House, including talent classes, club meetings, tours, ceremonies, folk art performances, and other activities ensuring alignment with the direction and effectiveness;

b) Participate in organizing mass cultural activities on holidays and festivals; participate in specialized seminars and discussions on professional and technical matters;

c) Participate in proposing solutions to ensure safety in training sessions for guiding professional activities;

2. Qualifications regarding education and training:

a) Hold a diploma in secondary vocational education or higher, relevant to the cultural specialty;

b) Have a foreign language proficiency level of at least Level 1 (A1) as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the Foreign Language Competency Framework for Vietnam;

c) Possess basic computer skills in accordance with the standards set forth in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications on the Standards for Computer Skills;

3. Qualifications regarding professional expertise and skills:

a) Have basic knowledge about methods for guiding grassroots cultural vocational work, community cultural centers;

b) Have experience in guiding professional matters in the assigned professional and technical fields;

c) Know how to use technical equipment for assigned professional and technical purposes and understand the principles of occupational safety and health.

Chapter III

APPOINTMENT AND SALARY GRADING ACCORDING TO PROFESSIONAL TITLES

Article 10. Principles for appointment and salary classification according to occupational titles for grassroots cultural sector officials

1. The appointment to occupational titles for grassroots cultural sector officials must be based on the job positions and specialized tasks currently undertaken by the officials, as stipulated in Article 11 of this Joint Circular.

2. When appointing from the current rank of official to the corresponding occupational title of grassroots cultural sector official, it shall not combine with an increase in salary grade or promotion in occupational title.

Article 11. Cases of appointment to occupational titles for grassroots cultural sector officials

Officials who have been appointed to the ranks of grassroots cultural sector officials as prescribed in Decision No. 428/TCCP-VC dated June 2, 1993 of the Minister - Head of the Government Organizational and Cadre Affairs Department (now the Minister of Home Affairs) promulgating the vocational standards for the rank of civil servant in the Culture and Information sector, and Decision No. 61/2005/QĐ-BNV dated June 15, 2005 of the Minister of Home Affairs on temporarily establishing the occupational titles and rank codes for some ranks of officials in the education and training, culture and information sectors, shall now be appointed to the occupational titles for grassroots cultural sector officials as prescribed in this Joint Circular, as follows:

1. Appointment to the occupational title of Method Officer Level II (code V.10.06.19) for officials currently holding the rank of Senior Method Officer (code 17.173).

2. Appointment to the occupational title of Method Officer Level III (code V.10.06.20) for officials currently holding the rank of Method Officer (code 17.174).

3. Appointment to the occupational title of Method Officer Level IV (code V.10.06.21) for officials currently holding the rank of College-level Method Officer (code 17a.213) or Method Officer without standard attainment (without college level, code 17a.216).

4. Appointment to the occupational title of Cultural Guide Level III (code V.10.07.23) for officials currently holding the rank of Senior Guide (code 17.175).

5. Appointment to the occupational title of Cultural Guide Level IV (code V.10.07.24) for officials currently holding the rank of Guide (culture and information) (code 17.176).

Article 12. Salary Classification

1. The occupational titles for grassroots cultural sector officials prescribed in this Joint Circular shall apply the Professional and Vocational Pay Scale for Civil Servants and Officials in State-run Units (Table 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the remuneration system for cadres, civil servants, officials, and armed forces personnel, as follows:

a) For the occupational title of Method Officer

- The occupational title of Method Officer Level II shall apply the salary coefficient of type A2, group 2 (A2.2), from salary coefficient 4.00 to 6.38;

- The occupational title of Method Officer Level III shall apply the salary coefficient of type A1, from salary coefficient 2.34 to 4.98;

- The occupational title of Method Officer Level IV shall apply the salary coefficient of type B, from salary coefficient 1.86 to 4.06.

b) For the occupational title of Cultural Guide

- The occupational title of Cultural Guide Level II shall apply the salary coefficient of type A2, group 1 (A2.2), from salary coefficient 4.00 to 6.38.

- The occupational title of Cultural Guide Level III shall apply the salary coefficient of type A1, from salary coefficient 2.34 to 4.98;

- The occupational title of Cultural Guide Level IV shall apply the salary coefficient of type B, from salary coefficient 1.86 to 4.06.

2. Salary classification upon completion of probation period and appointment to occupational title.

After completing the probation period as prescribed and being appointed to the occupational title by the competent authority managing the officials, the following salary classification shall be implemented in the appointed occupational title:

a) In case of having a doctoral degree relevant to the method officer or cultural guide profession, the official shall be classified at grade 3, salary coefficient 3.00 of the occupational title of Method Officer Level III (code V.10.06.20) or Cultural Guide Level III (code V.10.07.23);

b) In case of having a master's degree relevant to the method officer or cultural guide profession, the official shall be classified at grade 2, salary coefficient 2.67 of the occupational title of Method Officer Level III (code V.10.06.20) or Cultural Guide Level III (code V.10.07.23);

c) In case of having a college degree relevant to the method officer or cultural guide profession, the official shall be classified at grade 2, salary coefficient 2.06 of the occupational title of Method Officer Level IV (code V.10.06.21) or Cultural Guide Level IV (code V.10.07.24).

3. The salary classification into occupational titles for officials as prescribed in Clause 1 of this Article for officials who have already been classified into the ranks of grassroots cultural sector officials as prescribed in Decision No. 428/TCCP-VC dated June 2, 1993 of the Minister - Head of the Government Organizational and Cadre Affairs Department (now the Minister of Home Affairs) promulgating the vocational standards for the rank of civil servant in the Culture and Information sector; Decision No. 78/2004/QĐ-BNV dated November 3, 2004 of the Minister of Home Affairs on establishing the list of civil servant and official ranks; Decision No. 61/2005/QĐ-BNV dated June 15, 2005 of the Minister of Home Affairs on temporarily establishing the occupational titles and rank codes for some ranks of officials in the education and training, culture and information sectors, and Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the remuneration system for cadres, civil servants, officials, and armed forces personnel shall be carried out in accordance with the guidance provided in Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs on salary classification when upgrading, transferring ranks, and changing types of civil servants and officials.

a) In case civil servants meet the conditions to be appointed to the position of grassroots cultural profession with the salary grade coefficient equal to that of the old rank, they shall be assigned the same salary grade and percentage of seniority allowance exceeding the ceiling (if any) currently enjoyed at the old rank (including the time for considering promotion to the next salary grade or enjoying seniority allowance exceeding the ceiling if any at the old rank) to the newly appointed position.

Example 1: Mr. Nguyen Van A was appointed and assigned to the rank of methodist (code 17.174) grade 5, salary coefficient 3.66 since January 1, 2014. Now he meets the conditions and has been appointed by the competent authority to the position of third-grade methodist (code V.10.06.20), then he will be assigned grade 5, salary coefficient 3.66 of the third-grade methodist position from the date of the decision; the time for considering promotion to the next salary grade will be calculated from January 1, 2014.

b) In case civil servants with a college degree in grassroots cultural profession were hired and assigned to the salary of type A0 civil servant according to Decree No. 204/2004/ND-CP, now they are appointed to the position of fourth-grade methodist (code V.10.06.21) or fourth-grade cultural guide (code V.10.07.24), the assignment of salary grade in the position of fourth-grade methodist or fourth-grade cultural guide shall be based on the working time with mandatory social insurance contributions according to the state-defined salary scale (excluding probationary period) as follows:

Starting from grade 2 of the position of fourth-grade methodist or fourth-grade cultural guide, every two years (full 24 months) they will be assigned one higher salary grade (if there is a break in working time without enjoying social insurance benefits, it will be accumulated). In case during the working time there is a year where the assigned tasks are not completed or disciplinary action is taken, the time for considering regular promotion to the next salary grade will be extended accordingly.

After transferring the salary assignment to the position of fourth-grade methodist or fourth-grade cultural guide as mentioned above, if the salary coefficient assigned at the position of fourth-grade methodist or fourth-grade cultural guide plus seniority allowance exceeding the ceiling (if any) is lower than the salary coefficient already enjoyed at the old rank, they will enjoy the retained difference coefficient to equalize the salary coefficient (including seniority allowance exceeding the ceiling, if any) at the old rank. This retained difference coefficient will be enjoyed throughout the time the civil servant is assigned the salary at the position of fourth-grade methodist or fourth-grade cultural guide. Afterwards, if the civil servant is promoted to a higher position, this retained difference coefficient will be added to the current salary coefficient (including seniority allowance exceeding the ceiling, if any) to assign the salary at the new position upon promotion and stop enjoying the retained difference coefficient from the date of receiving salary at the new position.

Example 2: Mr. Tran Van B, with a college degree in fourth-grade cultural guide, was recruited as a civil servant at Center for Culture Province A, contributing mandatory social insurance from January 1, 2008, and was assigned grade 3, salary coefficient 2.72 of type A0 civil servant since July 1, 2014, during which he always completed assigned tasks and was not disciplined. Now he has been appointed by the competent authority to the position of fourth-grade cultural guide (code V.10.07.24), the assignment of salary grade in the position of fourth-grade cultural guide will be as follows:

Mr. Tran Van B's working time from January 1, 2008, excluding the six-month probationary period, starting from grade 2 of the position of fourth-grade cultural guide and every two years being assigned one higher grade, by July 1, 2014, Mr. Tran Van B will be assigned grade 5, salary coefficient 2.66 of the position of fourth-grade cultural guide; the time for enjoying the new salary grade at the position of fourth-grade cultural guide will be from the date of the decision; the time for considering promotion to the next salary grade will be calculated from July 1, 2014, while enjoying the retained difference coefficient of 0.06 (2.72 - 2.66).

By July 1, 2016 (two years later), Mr. Tran Van B meets the conditions to be regularly promoted to grade 6, salary coefficient 2.86 of the position of fourth-grade cultural guide and continues to enjoy the retained difference coefficient of 0.06 (total salary coefficient enjoyed is 2.92).

4. Promotion of civil servants in the grassroots cultural profession shall be carried out after being appointed by the competent authority to the position of methodist or cultural guide as stipulated in this Circular and implementing salary assignment according to the guidance provided in Clause 1 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Ministry of Home Affairs guiding salary assignment when upgrading ranks, changing ranks, or changing types of civil servants.

Chapter IV

IMPLEMENTING PROVISIONS

Article 13. Effectiveness

1. This Circular takes effect from August 15, 2016.

2. Abolish the provisions on professional standards and the list of ranks of methodist and cultural guide (culture - information) civil servants stipulated in Decision No. 428/TCCP-VC dated June 2, 1993, of the Minister - Head of the Organizational and Cadre Department of the Government; Decision No. 78/2004/QD-BNV dated November 3, 2004, and Decision No. 61/2005/QD-BNV dated June 15, 2005, of the Minister of the Ministry of Home Affairs.

Article 14. Transitional Provisions

The competent authority managing and using civil servants shall create conditions for civil servants to supplement the missing criteria of the grassroots cultural profession civil servant positions stipulated in this Circular for those civil servants who have been appointed to the ranks of methodist and cultural guide according to Decision No. 428/TCCP-VC dated June 2, 1993, of the Minister - Head of the Organizational and Cadre Department of the Government (now the Minister of the Ministry of Home Affairs) promulgating the professional standards of the culture - information sector civil service ranks.

Article 15. Implementation Organization

1. This Circular serves as the basis for implementing the recruitment, use, and management of grassroots cultural profession civil servants working in public institutions.

2. The heads of public institutions directly managing and using civil servants shall be responsible for:

a) Review job positions of the unit, develop plans for appointing specialized cultural profession titles within the management authority, submit to the competent authority for examination and decision-making or decide according to the delegated authority;

b) Decide on the appointment of specialized cultural profession titles corresponding to units under public service institutions according to the authority or delegated authority after the appointment plan has been approved by the competent authority.

3. Ministries, ministerial-level agencies, government-affiliated agencies, provincial People's Committees, and centrally-administered city People's Committees shall be responsible for:

a) Directing subordinate units under their management to implement the appointment of specialized cultural profession titles and salary grading for specialized cultural staff;

b) Approving plans for the appointment of specialized cultural profession titles and salary grading for specialized cultural staff from their current civil servant ranks to corresponding specialized cultural profession titles as stipulated in this Joint Circular; resolving issues within their authority during the process of appointing specialized cultural profession titles and salary grading;

c) Deciding on the appointment of specialized cultural profession titles and salary grading for specialized cultural staff under their management to corresponding specialized cultural profession titles in subordinate units;

d) Annually reporting the results of the appointment of specialized cultural profession titles and salary grading for specialized cultural staff under their management to the Ministry of Culture, Sports and Tourism and the Ministry of Home Affairs.

4. Non-public service organizations and units may apply the provisions of this Joint Circular for recruitment, utilization, and management of specialized cultural staff.

Article 16. Responsibility for Implementation

1. The Minister, head of a ministerial-level agency, head of a government-affiliated agency; Chairpersons of provincial and centrally-administered city People's Committees shall be responsible for implementing this Joint Circular.

2. In case of difficulties during implementation, they are requested to report to the Ministry of Culture, Sports and Tourism for consolidation and coordination with the Ministry of Home Affairs to examine and resolve such issues./.
