CIRCULAR

Amending and supplementing certain provisions on the criteria for occupational titles of health sector civil servants

Decree No. 89/2021/NĐ-CP dated October 18, 2021 of the Government amending and supplementing some articles of the Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government on training and capacity building for cadres, civil servants, and civil servants;

Pursuant to Decree No.115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, use, and management of civil servants;

Pursuant to the Decree No.75/2017/NĐ-CP dated June 20, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

The Prime Minister issues this Decision amending and supplementing certain Articles of Decision No.01/2017/QĐ-TTg dated January 17, 2017 of the Prime Minister promulgating the List of education and training in the national education system;

After receiving the unified opinion of the Ministry of Home Affairs at Circular No. 4932/BNV-CCVC dated October 2, 2021 regarding the issuance of the Circular amending and supplementing certain provisions on the criteria for occupational titles of health sector civil servants;

At the proposal of the Director of the Cadre and Civil Servant Department,

The Minister of Health hereby issues the Circular amending and supplementing certain provisions on the criteria for occupational titles of health sector civil servants.

Article 1. Amending and supplementing some articles of the Joint Circular No. 10/2015/TTLT-BYT-BNV dated May 27, 2015 of the Minister of Health and the Minister of Home Affairs stipulating the code number and criteria for occupational titles of doctors, preventive medicine doctors, and medical assistants

3. Amending and supplementing Clause 5 of Article 4 as follows:

b) Holding a certificate of training according to the occupational standards for civil servants in the aviation port service sector."

a) Graduated from a Master's degree in Medicine or a Doctorate in Medicine (except Preventive Medicine); a Master's degree or Doctorate in Dentistry.

b) Hold a certificate in accordance with the criteria for the occupational title of doctor or a practice license for doctors (applicable to all ranks of doctors).”

2. Amending and supplementing point e and adding point g of Clause 3, Article 4 as follows:

“e) Civil servants who participate in the examination or evaluation for promotion from the position of Associate Professor (Rank II) to Professor (Rank I) must have held the position of Associate Professor (Rank II) or equivalent for at least six years. In cases where they have held equivalent positions, they must have held the position of Associate Professor (Rank II) for at least one year (12 months) until the deadline for submitting application forms for the examination or evaluation for promotion.

g) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

3. Amending and supplementing Clause 2 of Article 5 as follows:

b) Holding a certificate of training according to the occupational standards for civil servants in the aviation port service sector."

a) Graduated from a Bachelor's degree in Medicine or a Master's degree in Medicine (except Preventive Medicine); a Bachelor's degree or Master's degree in Dentistry.

b) Hold a certificate in accordance with the criteria for the occupational title of doctor or a practice license for doctors (applicable to all ranks of doctors).”

4. Amending and supplementing point g and adding point h of Clause 3, Article 5 as follows:

“g) Civil servants who participate in the examination or evaluation for promotion from the position of Assistant Professor (Rank III) to Associate Professor (Rank II) must have held the position of Assistant Professor (Rank III) or equivalent for at least nine years for those with a Bachelor's degree in Medicine or a Master's degree in Medicine (except Preventive Medicine), a Bachelor's degree or Master's degree in Dentistry; six years for those with a Master's degree in Medicine or a Doctorate in Medicine (except Preventive Medicine), a Master's degree or Doctorate in Dentistry or a residency degree. In cases where they have held equivalent positions, they must have held the position of Assistant Professor (Rank III) for at least one year (12 months) until the deadline for submitting application forms for the examination or evaluation for promotion.

h) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

5. Amend and supplement Clause 2 of Article 6 as follows:

b) Holding a certificate of training according to the occupational standards for civil servants in the aviation port service sector."

a) Graduated from a Bachelor's degree in Medicine (except Preventive Medicine); a Bachelor's degree in Dentistry.

b) Hold a certificate in accordance with the criteria for the occupational title of doctor or a practice license for doctors (applicable to all ranks of doctors).”

6. Adding point e of Clause 3, Article 6 as follows:

“e) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

7. Amend and supplement Clause 2 of Article 7 as follows:

a) Graduated from a Master's degree in Preventive Medicine or a Doctorate in Preventive Medicine.

b) Hold a certificate in accordance with the criteria for the occupational title of Preventive Medicine Doctor (applicable to all ranks of Preventive Medicine Doctors).”

8. Amending and supplementing point g and adding point h of Clause 3, Article 7 as follows:

“g) Civil servants who participate in the examination or evaluation for promotion from the position of Associate Professor in Preventive Medicine (Rank II) to Professor in Preventive Medicine (Rank I) must have held the position of Associate Professor in Preventive Medicine (Rank II) or equivalent for at least six years. In cases where they have held equivalent positions, they must have held the position of Associate Professor in Preventive Medicine (Rank II) for at least one year (12 months) until the deadline for submitting application forms for the examination or evaluation for promotion.

h) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

9. Amending and supplementing Clause 2, Article 8 as follows:

b) Holding a certificate of training according to the occupational standards for civil servants in the aviation port service sector."

a) Graduated from a Master's degree in Preventive Medicine or higher.

b) Hold a certificate in accordance with the criteria for the occupational title of Preventive Medicine Doctor (applicable to all ranks of Preventive Medicine Doctors).”

10. Amending and supplementing point i and adding point k of Clause 3, Article 8 as follows:

“i) Civil servants who participate in the examination or evaluation for promotion from the position of Assistant Professor in Preventive Medicine (Rank III) to Associate Professor in Preventive Medicine (Rank II) must have held the position of Assistant Professor in Preventive Medicine (Rank III) or equivalent for at least nine years for those with a Master's degree in Preventive Medicine; six years for those with a Master's degree in Preventive Medicine or a Doctorate in Preventive Medicine or a residency degree. In cases where they have held equivalent positions, they must have held the position of Assistant Professor in Preventive Medicine (Rank III) for at least one year (12 months) until the deadline for submitting application forms for the examination or evaluation for promotion.

k) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

11. Amending and supplementing Clause 2, Article 9 as follows:

“2. Criteria for educational qualifications and training

a) Graduated from Medicine in the Medical Science group (excluding Traditional Medicine).

b) Hold a certificate in accordance with the criteria for the occupational title of Preventive Medicine Doctor (applicable to all ranks of Preventive Medicine Doctors).”

12. Supplement Point h Clause 3 Article 9 as follows:

“h) Possess basic information technology skills and be able to use a foreign language or a minority ethnic language for civil servants working in areas with ethnic minorities as required by their job positions.”

Article 2. Amend and supplement some articles of Circular Jointly Issued No. 11/2015/TTLT-BYT-BNV dated May 27, 2015, issued by the Minister of Health and the Minister of Home Affairs on the code number and criteria for public health career titles

3. Amending and supplementing Clause 5 of Article 4 as follows:

b) Holding a certificate of training according to the occupational standards for civil servants in the aviation port service sector."

a) Specialized Master’s degree or Doctorate in Public Health; specialized Master’s degree or Doctorate in Health Management; specialized Doctorate in Preventive Medicine.

b) Hold a certificate for training according to the criteria for public health career titles (for public health career title grades).

2. Amend and supplement Point i and supplement Point k Clause 3 Article 4 as follows:

“i) Civil servants who take the examination or are considered for promotion from the grade II public health career title to the grade I public health career title must have held the grade II public health career title or equivalent for at least six years. In cases where they have held equivalent career titles, they must have held the grade II public health career title for at least one year (twelve months) up to the deadline for submitting application forms for the examination or consideration for promotion.

k) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

a) Bachelor's degree in Public Health; Bachelor's degree in Health Management; Doctor in Medicine in the Medical Science group (excluding Traditional Medicine), and postgraduate degree in Public Health or postgraduate degree in Health Management.

b) Hold a certificate for training according to the criteria for public health career titles (for public health career title grades).

4. Amend and supplement Point i and supplement Point k Clause 3 Article 5 as follows:

“i) Civil servants who take the examination or are considered for promotion from the grade III public health career title to the grade II public health career title must have held the grade III public health career title or equivalent for at least nine years. In cases where they have held equivalent career titles, they must have held the grade III public health career title for at least one year (twelve months) up to the deadline for submitting application forms for the examination or consideration for promotion.

k) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

5. Amend and supplement Clause 2 of Article 6 as follows:

a) Bachelor's degree in Public Health; Bachelor's degree in Health Management; Doctor in Medicine in the Medical Science group (excluding Traditional Medicine) and postgraduate degree in Public Health or postgraduate degree in Health Management.

b) Hold a certificate for training according to the criteria for public health career titles (for public health career title grades).

6. Supplement Point e Clause 3 Article 6 as follows:

“e) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

b) Holding a certificate of training according to the occupational standards for civil servants in the aviation port service sector."

a) Specialized Master’s degree or Master’s degree or higher in Nursing.

b) Hold a certificate for training according to the criteria for nursing career titles or hold a certificate for practicing medical diagnosis and treatment (for nursing career title grades).

2. Amend and supplement Point g and supplement Point h Clause 3 Article 4 as follows:

“g) Civil servants who take the examination or are considered for promotion from the grade III nursing career title to the grade II nursing career title must have held the grade III nursing career title or equivalent for at least nine years. g) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

a) Associate degree in Nursing.

b) Hold a certificate for training according to the criteria for nursing career titles or hold a certificate for practicing medical diagnosis and treatment (for nursing career title grades).

6. Amend and supplement Clause 2 Article 7 as follows:

b) Holding a certificate of training according to the occupational standards for civil servants in the aviation port service sector."

“đ) Civil servants who take the examination or are considered for promotion from the grade IV midwifery career title to the grade III midwifery career title must have held the grade IV midwifery career title and equivalent for at least three years. In cases where they have held equivalent career titles, they must have held the grade IV midwifery career title for at least one year (twelve months) up to the deadline for submitting application forms for the examination or consideration for promotion.

e) Possess basic information technology skills and be able to use a foreign language or a minority ethnic language for civil servants working in areas with ethnic minorities as required by their job positions.

a) Associate degree in Midwifery.

b) Hold a certificate for training according to the criteria for midwifery career titles or hold a certificate for practicing medical diagnosis and treatment (for midwifery career title grades).

11. Amend and supplement Clause 2 Article 10 as follows:

b) Holding a certificate of training according to the occupational standards for civil servants in the aviation port service sector."

a) Specialized Master’s degree or Master’s degree or higher in Medical Technology; specialized Master’s degree or Master’s degree or higher in Dental Prosthetics Technology.

b) Hold a training certificate according to the occupational title standard for technical medical professions or have a practice certificate for medical examination and treatment (applicable to technical medical profession ranks).

12. Amend and supplement Point g and add Point h of Clause 3, Article 10 as follows:

“g) An employee participating in a promotion examination or review from Technical Medical Profession Rank III to Technical Medical Profession Rank II must have held Technical Medical Profession Rank III or equivalent for at least nine years. In cases where they have held an equivalent rank, they must have held Technical Medical Profession Rank III for at least one year (full twelve months) up to the deadline for submitting application registration for the examination or review.

h) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

13. Amend and supplement Clause 2, Article 11 as follows:

"2. Criteria for education and training

a) Graduated from a bachelor's degree in Medical Engineering or Dental Prosthetic Engineering.

b) Hold a training certificate according to the occupational title standard for technical medical professions or have a practice certificate for medical examination and treatment (applicable to technical medical profession ranks).

14. Amend and supplement Point d and add Point e of Clause 3, Article 11 as follows:

“d) An employee participating in a promotion examination or review from Technical Medical Profession Rank IV to Technical Medical Profession Rank III must have held Technical Medical Profession Rank IV and equivalent for at least three years. In cases where they have held an equivalent rank, they must have held Technical Medical Profession Rank IV for at least one year (full twelve months) up to the deadline for submitting application registration for the examination or review.

e) Possess basic information technology skills and be able to use a foreign language or a minority ethnic language for civil servants working in areas with ethnic minorities as required by their job positions.

15. Amend and supplement Clause 2, Article 12 as follows:

b) Holding a certificate of training according to the occupational standards for civil servants in the aviation port service sector."

a) Graduated from a college degree in Medical Engineering or Dental Prosthetic Engineering.

b) Hold a training certificate according to the occupational title standard for technical medical professions or have a practice certificate for medical examination and treatment (applicable to technical medical profession ranks).

1. Amend and supplement Clause 2, Article 4 as follows:

b) Holding a certificate of training according to the occupational standards for civil servants in the aviation port service sector."

a) Graduated from a Master’s degree or Doctorate in Pharmacy.

b) Hold a training certificate according to the occupational title standard for pharmacy or have a practice certificate for pharmacy (applicable to pharmacy ranks).

2. Amend and supplement Point g and supplement Point h Clause 3 Article 4 as follows:

“g) An employee participating in a promotion examination or review from Chief Pharmacist (Rank II) to Senior Pharmacist (Rank I) must have held Chief Pharmacist (Rank II) or equivalent for at least six years. In cases where they have held an equivalent rank, they must have held Chief Pharmacist (Rank II) for at least one year (full twelve months) up to the deadline for submitting application registration for the examination or review.

h) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

Article 5. Amend and supplement some articles of Circular Joint Circular No. 28/2015/TTLT-BYT-BNV dated October 7, 2015, issued by the Minister of Health and the Minister of Home Affairs on the code number and standards for occupational titles in nutrition.

3. Amending and supplementing Clause 5 of Article 4 as follows:

b) Holding a certificate of training according to the occupational standards for civil servants in the aviation port service sector."

a) Hold a Bachelor's degree or Master's degree or higher in the field of Nutrition.

b) Have a certificate of training according to the standards for occupational titles in nutrition (applicable to all levels of nutrition occupational titles).

2. Amending and supplementing point e and adding point g of Clause 3, Article 4 as follows:

“e) An employee participating in a competition or being considered for promotion from the third-level nutrition occupational title to the second-level nutrition occupational title must have held the third-level nutrition occupational title or equivalent for at least nine years. In cases where they have held an equivalent occupational title, they must have held the third-level nutrition occupational title for at least one year (twelve months) up to the deadline for submitting registration forms for the competition or promotion examination.”

g) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

3. Amending and supplementing Clause 2 of Article 5 as follows:

“2. Criteria for educational qualifications and training

a) Hold a Bachelor's degree in the field of Nutrition; a Doctor in the field of Medicine and a postgraduate degree in the field of Nutrition.

b) Have a certificate of training according to the standards for occupational titles in nutrition (applicable to all levels of nutrition occupational titles).

4. Amend and supplement Point e and supplement Point g Clause 3 Article 5 as follows:

“e) An employee participating in a competition or being considered for promotion from the fourth-level nutrition occupational title to the third-level nutrition occupational title must have held the fourth-level nutrition occupational title or equivalent for at least three years. In cases where they have held an equivalent occupational title, they must have held the fourth-level nutrition occupational title for at least one year (twelve months) up to the deadline for submitting registration forms for the competition or promotion examination.

g) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities according to job requirements.”

Article 6. Amend and supplement some articles of Circular Joint Circular No. 08/2016/TTLT-BYT-BNV dated April 15, 2016, issued by the Minister of Health and the Minister of Home Affairs on the code number and standards for occupational titles in population affairs.

3. Amending and supplementing Clause 5 of Article 4 as follows:

b) Holding a certificate of training according to the occupational standards for civil servants in the aviation port service sector."

a) Hold a Bachelor's degree in Public Health or higher; in cases where they hold a Bachelor's degree in another field or higher, they must have a certificate meeting the standard for population affairs civil servants.

b) Have a certificate of training according to the standards for occupational titles in population affairs (applicable to all levels of population affairs occupational titles).

2. Amend and supplement Point h and add Point i of Clause 3, Article 4 as follows:

“h) An employee participating in a competition or being considered for promotion from the third-level population affairs officer occupational title to the second-level population affairs officer occupational title must have held the third-level population affairs officer occupational title or equivalent for at least nine years. In cases where they have held an equivalent occupational title, they must have held the third-level population affairs officer occupational title for at least one year (twelve months) up to the deadline for submitting registration forms for the competition or promotion examination.

i) Possess basic information technology skills and be able to use a foreign language or a minority ethnic language for employees working in areas with ethnic minorities as required by their job positions.

3. Amending and supplementing Clause 2 of Article 5 as follows:

“2. Criteria for educational qualifications and training

a) Hold a Bachelor's degree in Public Health; in cases where they hold a Bachelor's degree in another field, they must have a certificate meeting the standard for population affairs civil servants.

b) Have a certificate of training according to the standards for occupational titles in population affairs (applicable to all levels of population affairs occupational titles).

4. Amend and supplement Point g and add Point i of Clause 3, Article 5 as follows:

“g) An employee participating in a competition or being considered for promotion from the fourth-level population affairs officer occupational title to the third-level population affairs officer occupational title must have held the fourth-level population affairs officer occupational title or equivalent for at least three years. In cases where they have held an equivalent occupational title, they must have held the fourth-level population affairs officer occupational title for at least one year (twelve months) up to the deadline for submitting registration forms for the competition or promotion examination.”

i) Possess basic information technology skills and be able to use a foreign language or a minority ethnic language for employees working in areas with ethnic minorities as required by their job positions.

Article 7. Transfer to higher salary grade for Grade IV civil servants with college level qualifications currently holding the titles of nursing aide, midwife, medical technical staff, pharmacist, nutritionist, and population officer.

1. Civil servants holding the titles of Grade IV nursing aide, Grade IV midwife, Grade IV medical technical staff, Grade IV pharmacist, Grade IV nutritionist, and Grade IV population officer as stipulated in this Circular shall apply the Salary Table A0, from coefficient 2.10 to coefficient 4.89 as prescribed in Table 3 (Salary Table for Professional and Administrative Staff in State-Owned Public Institutions) issued together with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the remuneration system for cadres, public officials, civil servants, and armed forces personnel (hereinafter referred to as Decree No. 204/2004/ND-CP).

2. Civil servants who have been appointed and assigned a salary grade for the positions of Grade IV nursing aide, Grade IV midwife, Grade IV medical technical staff, Grade IV pharmacist, Grade IV nutritionist, and Grade IV population officer according to the law before this Circular takes effect and have reached the standard college-level qualification in accordance with their major or group of majors as prescribed shall be transferred to the Salary Table A0 as stipulated in Decree No. 204/2004/ND-CP, and the salary assignment shall be carried out in accordance with Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs guiding the assignment of salaries when upgrading, transferring, or changing the category of civil servants.

In cases where civil servants with secondary-level qualifications have been recruited and appointed to the positions of Grade IV nursing aide, Grade IV midwife, Grade IV medical technical staff, Grade IV pharmacist, Grade IV nutritionist, and Grade IV population officer according to the law before this Circular takes effect must standardize their qualifications to reach the college-level qualification in accordance with their major or group of majors as prescribed before January 1, 2025.

In cases where civil servants are sent to study to achieve college-level qualifications but do not participate in the study or fail to meet the required standards, the employing agency or unit shall report to the managing agency or unit to consider reassigning them to other work or implementing reduction in staffing.

Article 8. Transitional Provisions

1. Civil servants who have been appointed to the positions of civil servant specialists in the health sector according to the law before this Circular takes effect, and whose job qualification standards do not require a certificate of training according to the job qualification standards, are not required to obtain such a certificate as prescribed in this Circular. When participating in examinations or evaluations for promotion to higher job titles, civil servants must have a certificate of training according to the job qualification standards for civil servants as prescribed in this Circular.

2. The certificates of training according to the job qualification standards for civil servant specialists in the health sector of all corresponding job titles issued before this Circular takes effect are equivalent to the certificates of training according to the job qualification standards for civil servants as prescribed in this Circular.

3. For training courses issuing certificates of training according to the job qualification standards for doctors, preventive medicine doctors, public health doctors, pharmacists, nursing aides, midwives, medical technical staff, nutritionists, and population officers that are being implemented before this Circular takes effect, they may continue to provide training and issue certificates.

4. Civil servants with a Bachelor's Degree in Obstetric Nursing before this Circular takes effect shall be deemed to meet the educational requirements for the position of Grade III midwife as stipulated in Clause 8, Article 3 of this Circular.

Article 9. Implementation Provisions

1. This Circular takes effect from June 10, 2022.

2. Point b, point c Clause 2 Article 10 of Joint Circular No. 10/2015/TTLT-BYT-BNV dated May 27, 2015 of the Minister of Health and the Minister of Home Affairs stipulating the code and qualification standards for doctors, preventive medicine doctors, and assistant doctors; point b, point c Clause 2 Article 6 of Joint Circular No. 28/2015/TTLT-BYT-BNV dated October 7, 2015 of the Minister of Health and the Minister of Home Affairs stipulating the code and qualification standards for nutritionists; point b, point c Clause 2 Article 6 of Joint Circular No. 08/2016/TTLT-BYT-BNV dated April 15, 2016 of the Minister of Health and the Minister of Home Affairs stipulating the code and qualification standards for population officers shall cease to be effective from the date this Circular takes effect.

3. In case the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents.

Article 10. Responsibility for Implementation

1. Ministers, Heads of Ministries equivalent to ministries, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally-administered cities, and related agencies, organizations, and individuals are responsible for implementing this Circular.

2. During the implementation process, if there are any difficulties, please reflect them to the Ministry of Health for guidance or consideration and resolution.
