Regulations on code numbers and standards for nutrition occupational titles

Cexpenses pursuant to the Civil Servant Law dated November 15, 2010;

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

d) Manage equipment serving technical specialties within their scope of responsibility;

đ) Lead and organize communication, education, counseling, and supervisory work on community nutrition, therapeutic nutrition, and food safety;

e) Lead and organize scientific research, training, and capacity building and bear professional technical responsibility for specialized civil servants, students, and trainees within their assigned scope;a) Fraud in enrollment or study;

Article 3. General standards for professional ethics

n) Participate in the compilation of materials and textbooks on nutrition, therapeutic nutrition, and food safety and teach when required.

2. Understanding and properly implementing the rules of conduct for civil servants in the healthcare sector.

c) Leading the provision of services, counseling, and communication campaigns on population-family planning within the professional scope;

a) Hold a bachelor’s degree or higher in nutrition;

b) Have a foreign language proficiency level of grade 3 or higher as specified in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam or possess a certificate in ethnic languages for positions requiring the use of ethnic languages;

Chapter II

OCCUPATIONAL STANDARDS

c) Have computer skills meeting the basic standard for information technology usage as specified in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on standards for information technology usage;

1. Duties:

d) Possess a certificate in training for the standards of the Nutrition Level II occupational title.

a) Understand the Party's viewpoints, policies, and state laws on health care and improvement of people's health.

b) Identify nutritional and food safety issues, plan, evaluate interventions, and propose appropriate and effective solutions;

c) Have the ability to organize and implement communication, education, and counseling on nutrition and food safety;

d) Be proficient in diagnosing and handling nutritional issues and ensuring food safety;

đ) Serve as the principal investigator, co-investigator, or main participant (at least 50% of the time) in research projects at the institutional level or higher or in scientific inventions/innovations in the field of specialization that have been successfully completed;

e) A civil servant promoted from the Nutrition Level III occupational title to the Nutrition Level II occupational title must have held the Nutrition Level III occupational title or equivalent for a minimum of nine years, including at least two years in the most recent period holding the Nutrition Level III occupational title.

h) Develop and organize the implementation of regulations, procedures, and specialized schemes on nutrition, rationing, and food safety;

i) Organize inspections and supervision of nutrition, rationing, and food safety work;

k) Organize the management of equipment serving technical specialties within the scope of responsibility;

l) Organize the implementation of communication, education, counseling, and supervisory work on nutrition, rationing, and food safety;

m) Organize and implement scientific research, training, and professional development, and bear responsibility for technical and professional skills for civil servants, students, and trainees within the assigned scope;

n) Participate in compiling materials and textbooks on nutrition, rationing, and food safety and teach when required;

2. Qualifications regarding education and training:

a) Hold a bachelor's degree or higher in nutrition;

b) Have a foreign language proficiency level of grade 3 or higher as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam, or have a certificate in ethnic languages for positions requiring the use of ethnic languages;

c) Have computer skills meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications on standards for information technology usage skills;

d) Hold a certificate for professional career qualification training for Nutrition Level II;

3. Qualifications regarding professional expertise and skills:

a) Understand the viewpoints, policies, and guidelines of the Party and state laws regarding health protection, care, and improvement of the people's health;

b) Identify nutritional and food safety issues, develop intervention plans, evaluate nutritional and food safety interventions, and propose appropriate and effective solutions;

c) Possess organizational and implementation capabilities for nutrition and food safety communication, education, and counseling;

d) Be proficient in diagnostic and handling skills for nutritional issues and food safety assurance;

đ) Serve as principal investigator, co-investigator, or main participant (50% or more of the time) in scientific research projects at the institutional level or higher, or scientific inventions/innovations in the field of specialty that have been successfully reviewed;

e) A civil servant promoted from the Nutrition Career Title Level III to Nutrition Career Title Level II must have held the Nutrition Career Title Level III or equivalent for a minimum of nine years, including at least two years in the most recent period holding the Nutrition Career Title Level III;

Article 5. Category III Nutrition - Code: V.08.09.25

1. Duties:

a) Organize and implement regulations, procedures, and specialized schemes on community nutrition, therapeutic nutrition, and food safety;

b) Plan and carry out community nutrition, therapeutic nutrition, and food safety work to prevent and treat diseases;

c) Conduct inspections and supervision of nutrition, therapeutic nutrition, and food safety activities: inspect storage, processing, sample retention, transportation, and distribution processes of food portions that meet quality standards, comply with prescriptions, and ensure safety;

d) Directly manage equipment serving technical specialties within the scope of responsibility;

đ) Implement communication, education, counseling, and line guidance work on nutrition, therapeutic nutrition, and food safety;

e) Participate in scientific research, training, capacity building, and technical guidance for civil servants, students, and pupils within the assigned scope;

g) Participate in compiling materials and textbooks on nutrition, therapeutic nutrition, and food safety and teach when required.

2. Qualifications regarding education and training:

a) Hold a bachelor's degree or higher in nutrition;

b) Possess a foreign language proficiency level of at least Level 2 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training regarding the six-level foreign language competence framework for Vietnam, or possess a certificate in ethnic languages for positions requiring the use of ethnic languages;

c) Possess basic computer skills in accordance with Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding the standard for information technology skills;

3. Qualifications regarding professional expertise and skills:

a) Understand the Party's viewpoints, policies, and guidelines on health care, protection, and improvement of people's health;

b) Be proficient in skills for extracting, collecting information, diagnosing, and handling issues related to nutrition and food safety;

c) Have the ability to identify nutrition and food safety issues and propose appropriate and effective intervention solutions;

d) Have the ability to plan, organize, supervise, and evaluate nutrition and food safety work;

đ) Have the ability to organize and implement communication, education, and counseling on nutrition and food safety;

Article 6. Category IV Nutrition - Code: V.08.09.26

1. Duties:

a) Implement regulations, procedures, and specialized schemes on community nutrition, therapeutic nutrition, and food safety;

b) Carry out community nutrition, therapeutic nutrition, and food safety activities to prevent and treat diseases;

c) Participate in inspections and supervision of nutrition, therapeutic nutrition, and food safety activities: storage, processing, sample retention, transportation, and distribution processes of food portions that meet quality standards, comply with prescriptions, and ensure safety;

d) Directly manage equipment serving technical specialties within the scope of responsibility;

đ) Implement communication, education, counseling, and line guidance work on nutrition, therapeutic nutrition, and food safety;

e) Participate in scientific research and provide practical technical guidance when required;

2. Qualifications regarding education and training:

a) Hold a college degree in nutrition;

b) Possess a foreign language proficiency level of at least Level 1 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training regarding the six-level foreign language competence framework for Vietnam, or possess a certificate in ethnic languages for positions requiring the use of ethnic languages;

c) Possess basic computer skills in accordance with Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding the standard for information technology skills;

3. Qualifications regarding professional expertise and skills:

a) Understand the Party's viewpoints, policies, and guidelines on health care, protection, and improvement of people's health;

b) Possess the ability to extract and collect information on nutrition and food safety;

c) Possess the ability to identify nutrition and food safety issues and propose appropriate and effective intervention solutions;

d) Possess the ability to handle issues related to nutrition and food safety when assigned;

đ) Possess the ability to implement communication, education on nutrition and food safety;

Chapter III

GUIDELINES FOR APPOINTMENT AND SALARY GRADING
ACCORDING TO OCCUPATIONAL TITLES

Article 7. Principles for appointment and salary classification according to occupational titles for civil servants

1. The appointment to professional positions for civil servants as prescribed in this Joint Circular must be based on the job position and tasks assigned to the civil servant;

2. When appointing from the current rank of civil servant to the corresponding professional nutrition position, it shall not be combined with salary grade advancement or promotion of the professional position;

Article 8. Cases for Appointment to Professional Titles

Civil servants who have been appointed to the ranks of civil servants in the health sector according to Decision No. 415/TCCP-VC dated May 29, 1993, issued by the Minister - Head of the Government's Organization and Cadre Affairs Department (now the Ministry of Home Affairs) regarding the issuance of professional standards for civil servant ranks in the health sector, may now be appointed to the professional nutrition positions as prescribed in this Joint Circular, as follows:

1. Appoint to the professional nutrition position of Category II (code V.08.09.24) for civil servants currently working in nutrition and holding the civil servant rank with Class A2 salary (Group A2.1);

2. Appoint to the professional nutrition position of Category III (code V.08.09.25) for civil servants currently working in nutrition and holding the civil servant rank with Class A1 salary;

3. Appoint to the professional nutrition position of Category IV (code V.08.09.26) for civil servants currently working in nutrition and holding the civil servant rank with Class A0 salary;

Article 9. Salary Grading Method

1. The professional nutrition positions prescribed in this Joint Circular shall apply the Salary Scale for Professional and Technical Staff in State-owned Public Institutions (Scale 3) promulgated together with Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on the wage system for cadres, civil servants, public officials, and armed forces personnel, as follows:

a) The professional nutrition position of Category II (code V.08.09.24) shall apply the salary coefficient for Class A2 civil servants (Group A2.1), ranging from coefficient 4.40 to coefficient 6.78;

b) The professional nutrition position of Category III (code V.08.09.25) shall apply the salary coefficient for Class A1 civil servants, ranging from coefficient 2.34 to coefficient 4.98;

c) The professional nutrition position of Category IV (code V.08.09.26) shall apply the salary coefficient for Class A0 civil servants, ranging from coefficient 2.10 to coefficient 4.89;

2. Determination of salary upon completion of the probation period and appointment to a professional position:

After completing the probation period as prescribed and being appointed to the professional position by the competent authority managing civil servants, the following steps shall be taken to classify the salary grade in the appointed professional position:

a) In case of having a Ph.D. in nutrition, they shall be classified at Grade 3, with a salary coefficient of 3.00, in the professional nutrition position of Category III (code V.08.08.25);

b) In case of having a master's degree in nutrition, they shall be classified at level 2 with a salary coefficient of 2.67 for the nutrition profession grade III (code V.08.08.25).

3. The classification of salary when appointing to the profession title of staff as stipulated in Clause 1 of this Article for staff who have already been classified under the medical staff ranks and Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, staff, and armed forces shall be implemented as follows:

Staff appointed to the nutrition profession title with the same grade salary coefficient as in the old rank shall implement the parallel grading and percentage of seniority allowance exceeding the ceiling (if any) currently enjoyed in the old rank (including the time considered for the next salary grade increase or for enjoying the seniority allowance exceeding the ceiling if any in the old rank) in the newly appointed profession title.

4. The promotion of the profession title grade for nutrition staff shall be carried out after being appointed to the nutrition profession title as prescribed in this Circular and implementing the salary classification according to the guidance provided in Clause 1 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding the salary classification when upgrading ranks, transferring ranks, and changing types of civil servants and staff.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Effective Date

This Circular takes effect from November 20, 2015.

Article 11. Transitional Provisions

Staff who have been appointed to the ranks of health sector staff and are now appointed to the nutrition profession title as prescribed in this Circular, the competent authority managing and using staff shall be responsible for creating conditions for staff to supplement the missing criteria of the appointed nutrition profession title.

Article 12. Implementationimplement

1. This Circular serves as the basis for implementing the recruitment, utilization, and management of the nutrition staff team in public non-profit organizations.

2. Non-public organizations may apply the provisions of this Circular to recruit, utilize, and manage the nutrition human resources team within their organization.

3. The head of the public non-profit organization directly managing and utilizing staff shall be responsible for:

a) Reviewing the job positions of the unit, developing a plan to appoint the nutrition profession title within the management authority, submitting it to the competent authority for examination and decision-making or deciding according to the delegated authority after the appointment plan has been approved by the competent authority;

b) Deciding on the appointment of the profession title for nutrition staff under their management to the corresponding nutrition profession title according to the authority or delegated authority after the profession title appointment plan has been approved by the competent authority.

4. Ministries, agencies equivalent to ministries, agencies under the Government, People's Committees of provinces and centrally-administered cities are responsible for:

a) Directing units under their management to implement the appointment of profession titles and salary classification for nutrition staff in public non-profit organizations;

b) Approving the plan for the appointment of profession titles and salary classification for nutrition staff in public non-profit organizations under their management from the current staff rank to the corresponding nutrition profession titles prescribed in this Circular; resolving issues within their authority during the process of appointing profession titles and salary classification;

c) Deciding on the appointment of profession titles and salary classification for staff under their management to the corresponding nutrition profession titles in public non-profit organizations according to their authority.

d) Reporting the results of the appointment of profession titles and salary classification for nutrition staff in public non-profit organizations under their management to the Ministry of Health and the Ministry of Home Affairs.

Article 13. Responsibility for Implementation

1. The Minister, Head of a ministerial-level agency, Head of an agency under the Government; Chairman of the People's Committee of a province or centrally governed city and related agencies, organizations, and individuals shall be responsible for implementing this Circular.

2. During the implementation, if there are any difficulties, agencies, organizations, and individuals are requested to report to the Ministry of Health for consolidation and coordination with the Ministry of Home Affairs to examine and resolve them./.
