Issuing the Regulation on the organization and operation

of boarding schools for ethnic minorities

 

Pursuant to the Education Law dated June 14, 2019;

Pursuant to Decree No.86/2022/NĐ-CP dated October 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No.Decision No. 127/2018/NĐ-CP September 21, 2018 of the Government stipulating responsibilities for state management in education;

At the request of the Director of the Department of Ethnic Minority Education;

The Minister of Education and Training issues this Circular to issue the Regulation on the organization and operation of boarding schools for ethnic minorities.

Article 1. This Circular promulgates the Regulation on the organization and operation of boarding schools for ethnic minorities.

Article 2. This Circular takes effect from March 18, 2023 and replaces Circular No. 24/2010/TT-BGDĐT dated August 2, 2010 issued by the Minister of Education and Training on the Regulation on the organization and operation of boarding schools for ethnic minorities and Circular No. 30/2015/TT-BGDĐT dated December 11, 2015 issued by the Minister of Education and Training amending and supplementing certain articles of the Regulation on the organization and operation of boarding schools for ethnic minorities promulgated together with Circular No. 24/2010/TT-BGDĐT dated August 2, 2010 issued by the Minister of Education and Training.

Article 3. The Head of the Office, the Director of the Department of Ethnic Minority Education, Heads of relevant units under the Ministry of Education and Training, Chairpersons of People's Committees of provinces and centrally governed cities, Directors of Departments of Education and Training, Directors of Departments of Education, Science and Technology of Bac Lieu Province, and related organizations and individuals shall be responsible for implementing this Circular./.

REGULATIONS

ORGANIZATION AND ACTIVITIES

OF BOARDING SCHOOLS FOR ETHNIC MINORITIES

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Regulation stipulates the organization and operation of boarding schools for ethnic minorities (hereinafter referred to as PTDTBT schools), including: organization and management of the school; educational activities of PTDTBT schools; duties and rights of principals, vice-principals, teachers, staff, and boarding students; relations between the school, families, and society.

2. This Regulation applies to PTDTBT schools and related organizations and individuals.

3. PTDTBT schools shall be organized and operate in accordance with the Charter of Primary Schools, the Charter of Secondary Schools, High Schools, and Multi-grade Schools (hereinafter collectively referred to as the Charter of General Education Schools) and the provisions of this Regulation.

Article 2. Conditions for students to study at boarding schools for ethnic minorities and boarding students

1. Conditions for students to study at boarding schools for ethnic minorities: Students within the age range of primary and lower secondary education in the recruitment area of the school as prescribed by the competent authority.

2. Boarding students: Students who are eligible for support policies approved by the competent authority as they cannot travel to and from school or satellite schools during the day.

Article 3. Boarding schools for ethnic minorities

1. Boarding schools for ethnic minorities are established by the State for ethnic minority students and students from families permanently settled in areas with particularly difficult economic and social conditions to contribute to achieving equality in access to education and sustainable development goals in the field of education for ethnic minority and mountainous regions.

2. Boarding schools for ethnic minorities ensure a stable ratio of ethnic minority students and boarding students as follows:

a) Ratio of ethnic minority students: At least 50% of the total number of students in the entire school are ethnic minority students.

b) Ratio of boarding students:

- For primary boarding schools: At least 20% of boarding students;

- For lower secondary boarding schools: At least 45% of boarding students;

- For primary and lower secondary boarding schools: At least 32.5% of boarding students or at least 20% of primary boarding students and 45% of lower secondary boarding students.

3. The system of boarding schools for ethnic minorities includes:

a) Primary boarding schools;

b) Lower secondary boarding schools;

c) Primary and lower secondary boarding schools.

Article 4. Tasks and Authorities of Boarding Schools for Ethnic Minorities

Boarding schools for ethnic minorities shall perform tasks and authorities as prescribed in the Charter of General Education Schools and the following tasks and authorities:

1. Organize the review and approval of boarding students in accordance with the Government's regulations.

2. Manage, educate, nurture, and care for boarding students.

3. Organize educational activities in accordance with Clause 2, Article 11 of this Regulation.

4. Implement systems and policies for management staff, teachers, employees, and students in accordance with State regulations.

5. Promote socialization to serve the school's educational activities.

6. Coordinate with families and society in managing, educating, nurturing, and caring for boarding students.

Article 5. School Name, School Signboard

1. The school name is defined as follows: Boarding General Education School + level of education (elementary; lower secondary; elementary and lower secondary) + specific name of the school.

2. The school name shall be recorded on the decision establishing the school, the school seal, the school signboard, and transaction documents.

3. The school signboard shall include the following contents:

a) Top left corner:

- First line: People's Committee of the district, town, city under province (hereinafter referred to collectively as the District People's Committee) and the name of the district;

- Second line: Department of Education and Training.

b) In the center, record the school name as stipulated in Clause 1 of this Article. For elementary boarding schools and elementary and lower secondary boarding schools with branch schools, the branch school name shall be recorded below the school name.

c) At the bottom, record the school address, telephone number, email, and website (if any).

 

Chapter II

ORGANIZATION AND MANAGEMENT OF THE SCHOOL

 

Article 6. Organizational Structure of Boarding Schools for Ethnic Minorities

1. The organizational structure of boarding schools for ethnic minorities shall be implemented in accordance with the Charter of General Education Schools. Additionally, each school shall have a Student Management Team to carry out the task of managing, nurturing, and caring for boarding students.

2. The Student Management Team shall have a team leader, and if there are seven members or more, a deputy team leader. The team leader and deputy team leader shall be appointed by the principal and shall be subject to the management and direction of the principal. The Student Management Team shall have the following responsibilities:

a) Develop plans and organize the implementation of management, nurturing, and caring for boarding students on a weekly, monthly, semester, and annual basis; coordinate with specialized teams to develop and implement the school's educational plan;

b) Organize meetings at least once every two weeks to review and implement the team's tasks and may hold ad hoc meetings as required by work or when requested by the principal;

c) Carry out other tasks assigned by the principal.

, Clause 1, Clause 2 Article 7a of this Regulation.. Hierarchical Management of Boarding Schools for Ethnic Minorities

1. Elementary boarding schools, lower secondary boarding schools, and elementary and lower secondary boarding schools shall be established and managed by the Chairman of the District People's Committee.

2. The Department of Education and Training assists the District People's Committee in performing state management functions regarding education for elementary boarding schools, lower secondary boarding schools, and elementary and lower secondary boarding schools.

Article 8. Tasks and Rights of the Principal

The principal of boarding schools for ethnic minorities shall perform tasks and rights as prescribed in the Charter of General Education Schools, in addition to the following tasks and rights:

1. Master the Party and State's ethnic policies, understand the culture, customs, traditions of ethnic minorities, and the psychological characteristics of local ethnic minority students.

2. Organize the implementation of the school's tasks as stipulated in Article 4 of this Regulation.

3. Coordinate with local authorities, mass organizations, and social organizations in managing, educating, nurturing, and caring for boarding students.

4. Be provided with training to enhance knowledge about ethnic groups, ethnic minority languages, management of boarding student education, management of special educational activities, and enjoy preferential policies as prescribed by the State.

Article 9. Duties and Rights of the Deputy Principal

The Deputy Principal of the Boarding Primary and Secondary School for Ethnic Minorities shall perform the duties and rights stipulated in the Charter of General Education Schools, in addition to the following duties and rights:

1. Master the Party's and State's ethnic policies, understand the customs, traditions of ethnic minorities, and the psychological characteristics of local ethnic students.

2. Direct and manage boarding students' management, education, care, and nurturing activities as assigned by the Principal.

3. Be entitled to training to enhance knowledge about ethnic groups, minority languages, management of boarding student education, special educational activities, and enjoy preferential policies as prescribed by the State.

Chapter III

EDUCATIONAL ACTIVITIES

OF BOARDING SCHOOLS FOR ETHNIC MINORITIES

 

Article 10. Admissions

The Boarding Primary and Secondary School for Ethnic Minorities shall implement admissions according to the compulsory education requirements for primary education and the universal secondary education requirements as prescribed by law.

Article 11. Educational Activities of the Boarding Primary and Secondary School for Ethnic Minorities

1. Educational Programs and Plans

The Boarding Primary and Secondary School for Ethnic Minorities shall implement educational programs and plans as stipulated in the Charter of General Education Schools.

2. Educational Activities

The Boarding Primary and Secondary School for Ethnic Minorities shall carry out educational activities as stipulated in the Charter of General Education Schools and the following special educational activities:

a) Educate students on the Party's and State's ethnic policies; the cultural identity and fine traditions of ethnic groups; life skills and environmental protection;

b) Organize labor and hygiene activities at school and classroom levels, improve living and learning conditions for boarding students;

c) Organize cultural, artistic, physical education activities; field trips, festivals, ethnic holidays, cultural exchanges to contribute to preserving and promoting the cultural identity of ethnic groups;

d) Organize collective cooking for boarding students ensuring food hygiene and safety; provide health care for students.

 

Chapter IV

DUTIES AND RIGHTS OF TEACHERS, STAFF, AND STUDENTS

EMPLOYEES AND STUDENTS

 

Article 12. Duties and Rights of Teachers

Teachers of the Boarding Primary and Secondary School for Ethnic Minorities shall perform the duties and rights stipulated in the Charter of General Education Schools and the following duties and rights:

1. Understand and master the customs, traditions, and psychological characteristics of local ethnic students.

2. Apply appropriate teaching methods for the target students; participate in managing, educating, nurturing, and caring for boarding students; organize the implementation of special educational contents within the school.

3. Be entitled to training to enhance knowledge about ethnic groups, minority languages, management, education, nurturing, and caring for boarding students, organizing the implementation of special educational contents within the school, and enjoy preferential policies as prescribed by the State.

Article 13. Duties and Rights of Staff

Staff of the Boarding Primary and Secondary School for Ethnic Minorities shall perform the duties and rights stipulated in the Charter of General Education Schools and the following duties and rights:

1. Understand the customs, traditions, and psychological characteristics of local ethnic students.

2. Coordinate with teachers and other staff to fulfill management, nurturing, and caring responsibilities for boarding students and organize the implementation of special educational contents within the school.

3. Be entitled to training to enhance knowledge about ethnic groups, minority languages, management, education, nurturing, and caring for boarding students, organizing the implementation of special educational contents within the school, and enjoy policies as prescribed by the State.

Article 14. Duties and rights of boarding students

Boarding students shall perform the duties and rights stipulated in the Charter of General Education Schools, in addition to the following duties and rights:

1. Adhere to the internal regulations of the dormitory.

2. Preserve the cultural identity of their own ethnic group and respect the cultural identities of other ethnic groups.

3. Be accommodated for meals, lodging, and daily activities within the dormitory area and enjoy benefits and policies as prescribed by the State.

Chapter V

RELATIONSHIPS BETWEEN SCHOOL, FAMILY AND SOCIETY

 

Article 15. Parent Representative Council

The duties, powers, organization, and activities of the Parent Representative Council at each class and school under the Program for Ethnic Minority Students are implemented according to the Charter of the Parent Representative Council and the following duties and powers:

1. The Parent Representative Council of each class shall cooperate with the class teacher, subject teachers, support staff, service personnel, and parents to manage, educate, nurture, and care for boarding students.

2. The Parent Representative Council of the school shall cooperate with the school to manage, educate, nurture, and care for boarding students; mobilize resources from parents to improve living and learning conditions for boarding students.

Article 16. Relationships between school, family, and society

1. The school under the Program for Ethnic Minority Students shall proactively and closely coordinate with the families of students in managing, educating, nurturing, caring for the safety of boarding students, and implementing special educational activities as prescribed in Clause 2 of Article 11 of this Regulation.

2. The school under the Program for Ethnic Minority Students shall cooperate with local authorities, mass organizations, social organizations, and related individuals to achieve educational goals; mobilize community forces and resources to build a healthy, safe educational environment and manage, educate, nurture, and care for boarding students./.
