Amending and supplementing certain contents of Circular No. 01/2022/TT-BTP dated January 4, 2022, issued by the Minister of Justice detailing certain provisions and measures to implement Decree No. 87/2020/NĐ-CP dated July 28, 2020, of the Government on the Civil Status Electronic Database, online civil status registration,

Based on the Household Registration Law dated November 20, 2014;

Decree No. 98/2022/NĐ-CP dated November 29, 2022, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Decree No. 87/2020/NĐ-CP dated July 28, 2020, of the Government on the Civil Status Electronic Database, online civil status registration;

Pursuant to Decree No. 42/2022/NĐ-CP dated June 24, 2022 of the Government stipulating the provision of information and online public services by state agencies in the digital environment;

Decree No. 30/2020/NĐ-CP dated March 5, 2020, of the Government on archival work;

Pursuant to Decree No. 13/2023/NĐ-CP dated April 17, 2023, of the Government on personal data protection;

At the proposal of the Director of the Department of Household Registration, Nationality, and Notarization;

The Minister of Justice issues this Circular amending and supplementing certain contents of Circular No. 01/2022/TT-BTP dated January 4, 2022, detailing certain provisions and measures to implement Decree No. 87/2020/NĐ-CP dated July 28, 2020, of the Government on the Civil Status Electronic Database, online civil status registration.

Article 1. Amending and supplementing certain contents of Circular No. 01/2022/TT-BTP dated January 4, 2022, detailing certain provisions and measures to implement Decree No. 87/2020/NĐ-CP dated July 28, 2020, of the Government on the Civil Status Electronic Database, online civil status registration

1. Amending and supplementing Clause 1, Article 9 of Circular No. 01/2022/TT-BTP dated January 4, 2022, detailing certain provisions and measures to implement Decree No. 87/2020/NĐ-CP dated July 28, 2020, of the Government on the Civil Status Electronic Database, online civil status registration (hereinafter referred to as Circular No. 01/2022/TT-BTP) as follows:

“1. Issued together with this Circular:

a) Forms: Confirmation of civil status information; Application form for confirmation of civil status information; Death certificate (Annex 1);

b) Content of interactive civil status forms for online civil status registration (Annex 2);

c) Form of electronic copies of civil status documents (Annex 3)”.

2. Supplementing and replacing the Annexes issued together with Circular No. 01/2022/TT-BTP as follows:

a) Supplementing Annex 3 issued together with this Circular.

b) Replacing Annex 1 and Annex 2 with Annex 1 and Annex 2 issued together with this Circular.

Article 2. Responsibilities for implementation and effectiveness

1. This Circular takes effect from August 2, 2023.

2. For civil status registration files received before the date this Circular takes effect but not yet resolved, they shall continue to be processed according to the provisions of Circular No. 01/2022/TT-BTP.

3. The Director of the Civil Status, Citizenship, and Notarization Department, heads of units under the Ministry of Justice, Directors of Provincial Departments of Justice, and relevant organizations and individuals are responsible for implementing this Circular.

During the implementation process, if there are any difficulties, please promptly report them to the Ministry of Justice for research and guidance.
