Frequency band planning for 1710-1785 MHz and 1805-1880 MHz for the public terrestrial mobile communication system

Pursuant to the Radio Frequency Law dated November 23, 2009; the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law dated November 9, 2022;
Pursuant to Decree No. 48/2022/NĐ-CP dated July 26, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Pursuant to Decision No. 71/2013/QĐ-TTg dated November 21, 2013 of the Prime Minister promulgating the National Radio Frequency Spectrum Plan; Decision No. 38/2021/QĐ-TTg dated December 29, 2021 of the Prime Minister amending and supplementing certain articles of Decision No. 71/2013/QĐ-TTg dated November 21, 2013 of the Prime Minister promulgating the National Radio Frequency Spectrum Plan;
PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE RADIO FREQUENCY MANAGEMENT AGENCY;
The Minister of Information and Communications issues this Circular on frequency band planning for 1710-1785 MHz and 1805-1880 MHz for the public terrestrial mobile communication system IMT of Vietnam.
Article 1. Scope of Regulation and Applicability
2. Applicability:
This Circular plans the frequency bands 1710-1785 MHz and 1805-1880 MHz for deploying public terrestrial mobile communication systems IMT1of Vietnam.

This Circular applies to organizations and individuals participating in managing and using radio frequencies; organizations and individuals producing, importing, and trading radio equipment for use in Vietnam.
Article 2. Content of Planning
1. The frequency bands 1710-1785 MHz and 1805-1880 MHz shall be used to deploy public terrestrial mobile communication systems according to the IMT-Advanced, IMT-2020 standards and subsequent versions through frequency division duplex (FDD) transmission methods (hereinafter referred to as FDD method).
IMT-Advanced, IMT-2020 and subsequent versions using frequency division duplex transmission mode (hereinafter referred to as FDD method)2).
2. The frequency bands 1710-1785 MHz and 1805-1880 MHz shall be divided as follows:
a) The frequency band 1710-1785 MHz shall be used as the uplink band, divided into four blocks A1, A2, A3 and A4 with respective widths of 20 MHz, 20 MHz, 20 MHz, and 15 MHz;
b) The frequency band 1805-1880 MHz shall be used as the downlink band, divided into four blocks A1’, A2’, A3’ and A4’ with respective widths of 20 MHz, 20 MHz, 20 MHz, and 15 MHz;
c) The maximum total bandwidth that an organization may be licensed to use within the frequency bands 1710-1785 MHz and 1805-1880 MHz under the FDD method is 2×20 MHz.
3. Organizations granted licenses to use the frequency bands within 1710-1785 MHz and 1805-1880 MHz shall cooperate with each other to prevent and handle harmful interference.
Article 3. Implementation Provisions
1. This Circular takes effect from June 14, 2024.
2. Abolish Clause 2.3.1 Article 1 and related provisions concerning the frequency bands 1710-1785 MHz and 1805-1880 MHz in Decision No. 25/2008/QĐ-BTTTT dated April 16, 2008 of the Minister of Information and Communications approving the frequency band planning for cellular mobile communication systems in the frequency ranges 821-960 MHz and 1710-2200 MHz.
3. Abolish related provisions concerning the frequency bands 1710-1785 MHz and 1805-1880 MHz in Circular No. 04/2017/TT-BTTTT dated April 24, 2017 of the Minister of Information and Communications stipulating the deployment of IMT mobile communication systems on the frequency bands 824-835 MHz, 869-915 MHz, 925-960 MHz, 1710-1785 MHz, 1805-1880 MHz, 1920-1980 MHz, 2110-2170 MHz.
Article 4. Transitional Provisions
1. Licenses issued for the use of the frequency bands 1710-1785 MHz and 1805-1880 MHz before the effective date of this Circular shall continue to be valid until their expiration date as stated in the license.
2. Licenses issued in accordance with this Circular for existing GSM-based mobile communication systems operating on the frequency bands 1710-1785 MHz and 1805-1880 MHz shall continue to be used subject to the following conditions:
b) Shall continue to be used from September 16, 2024 until September 15, 2026, and may only use frequency bands that are not utilized by mobile communication systems based on the IMT-Advanced and IMT-2020 standards,[4]except for providing services in the Spratly Islands, Paracel Islands, and DK platforms.
c) Shall not cause harmful interference to mobile communication systems based on the IMT-Advanced and IMT-2020 standards licensed to operate in the 1710-1785 MHz and 1805-1880 MHz frequency bands.
Article 5. Responsibilities for Implementation
1. The Head of the Office, the Director of the Radio Frequency Management Department, the Heads of agencies and units under the Ministry of Information and Communications, and related organizations and individuals are responsible for implementing this Circular.
2. In the course of implementation, if there are difficulties or obstacles, they are requested to promptly report to the Ministry of Information and Communications (Radio Frequency Management Department) for consideration and resolution./.
