CIRCULAR
DETAILING AND GUIDING THE IMPLEMENTATION OF CERTAIN ARTICLES OF THE LAW ON COMPETITION AND REWARD FOR THE INSPECTION SECTOR
Pursuant to the Law on Encouragement and Reward dated June 15, 2022;
Pursuant to the Inspection Law on November 14, 2022;
Pursuant to Decree No. 81/2023/NĐ-CP dated November 27, 2023 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;
Pursuant to Decree No. 98/2023/NĐ-CP of the Government dated December 31, 2023 providing details on the implementation of certain provisions of the Law on Competition and Reward;
At the proposal of the Director of the Personnel Department and the Director of the Legal Department;
The Government Inspector General issues this Circular detailing and guiding the implementation of certain articles of the Law on Competition and Reward for the Inspection Sector.
Article 1. Scope of Regulation
This Circular details and guides the implementation of Clause 4 Article 24, Clause 3 Article 26, Clause 3 Article 27, Clause 3 Article 28, Clause 6 Article 74, Clause 2 Article 75, and Clause 6 Article 84 of the Law on Competition and Reward.
Article 2. Applicability
1. Individuals who have been and are working in inspection agencies.
2. Departments, bureaus, units under the Government Inspector General; Inspectors of Ministries, agencies at the level of ministries (hereinafter referred to as Inspectors of Ministries); Inspection agencies in government agencies; Secretarial Inspectors; Inspectors of General Bureaus, Bureaus under Ministries and equivalent agencies; Inspectors of provinces, centrally-administered cities (hereinafter referred to as Inspectors of Provinces); Department Inspectors; Inspectors of districts, counties, towns, cities under provinces, centrally-administered cities (hereinafter referred to as Inspectors of Counties), Inspection agencies in special administrative-economic units as prescribed by the National Assembly.
3. Departments and equivalent units under agencies and units as prescribed in Clause 2 Article 2 of this Circular.
4. Individuals and groups outside the Inspection Sector who have made contributions to the construction and development of the Inspection Sector.
5. Other cases decided by the Government Inspector General.
Article 3. Criteria for Awarding the Title "Advanced Worker"
1. The title "Advanced Worker" shall be awarded annually to individuals belonging to the Government Inspector General agency meeting the criteria stipulated in Clause 1 Article 24 of the Law on Competition and Reward.
2. Individuals sent to participate in short-term training or enhancement programs lasting less than one year, complying with the regulations of the training or enhancement institution, shall have their study time counted towards their work time at the agency, organization, or unit for consideration of the title "Advanced Worker." In cases where individuals are sent to participate in training or enhancement programs lasting one year or more, the participation time shall be counted towards the consideration of the title "Advanced Worker." In addition to general standards and conditions, during the period of training or enhancement, individuals must comply with the regulations of the training institution, complete assigned tasks, and achieve satisfactory grades or higher (for courses that rank students as average, good, excellent...).
3. Maternity leave time as prescribed by law shall be counted towards the consideration of the title "Advanced Worker."
4. For individuals transferred to the Government Inspector General during the year of award consideration, the proposing unit for commendation has the responsibility to seek comments from the agency where the individual worked before transferring to the Government Inspector General if the individual had worked there for six months or more.
5. In cases where individuals are reassigned or seconded to work at other agencies, organizations, or units for a specific period, the evaluation for the title "Advanced Worker" shall be conducted by the agency, organization, or unit that reassigns or seconds the individual. The receiving agency, organization, or unit shall provide comments on the individual's compliance with Party guidelines and state policies, internal regulations, and completion of assigned tasks during the reassignment or secondment period.
6. The title "Advanced Worker" shall not be considered for the following cases:
a) Individuals with less than six months of recruitment or employment contract duration;
b) Individuals on non-working leave as prescribed by law for three to less than six months during the year, except for the case stipulated in Clause 3 of this Article;
c) Individuals currently under disciplinary review or investigation due to suspected violations, or those with pending complaints or accusations being verified.
Article 4. Criteria and Recipients for the Award of the Flag of Excellence from the Government Inspectorate
1. The Flag of Excellence from the Government Inspectorate shall be awarded annually to units, bureaus, and organizations under the Government Inspectorate, Ministry Inspectors, Provincial Inspectors, Inspectors at government agencies, and Cryptographic Inspectors that meet the criteria set forth in Clause 1 and Clause 2 of Article 26 of the Law on Encouragement and Reward.
2. The recipients of the Flag of Excellence from the Government Inspectorate are outstanding collectives leading the competition movement organized by the Chief Inspector General, including:
a) Units, bureaus, and organizations under the Government Inspectorate;
b) Ministry Inspectors;
c) Provincial Inspectors;
d) Inspectors at government agencies; Cryptographic Inspectors.
3. Units, bureaus, and organizations under the Government Inspectorate that are selected to continue presenting for the award of the Flag of Excellence from the Government Inspectorate must meet the criteria.
Article 5. Criteria and Recipients for the Award of the Excellent Labor Collective Title
1. The Excellent Labor Collective Title shall be awarded annually to collectives meeting the criteria set forth in Clause 1 of Article 27 of the Law on Encouragement and Reward.
2. The recipients of the Excellent Labor Collective Title are collectives of units, bureaus, and organizations under the Government Inspectorate; rooms and equivalent units of units, bureaus under the Government Inspectorate.
Article 6. Criteria and Recipients for the Award of the Advanced Labor Collective Title
1. The Advanced Labor Collective Title shall be awarded annually to collectives meeting the criteria set forth in Clause 1 of Article 28 of the Law on Encouragement and Reward.
2. The recipients of the Advanced Labor Collective Title are collectives of units, bureaus, and organizations under the Government Inspectorate; collectives of rooms and equivalent units of units, bureaus under the Government Inspectorate.
Article 7. Criteria for the Award and Posthumous Award of the Certificate of Merit from the Chief Inspector General
1. The Certificate of Merit from the Chief Inspector General, awarded to collectives, individuals, or posthumously awarded to individuals as specified in Clauses 1, 2, and 3 of Article 2 of this Circular, must meet the criteria set forth in Clauses 1, 2, 3, and 4 of Article 74 of the Law on Encouragement and Reward.
2. Cases specified in Clauses 4 and 5 of Article 2 of this Circular shall be decided by the Chief Inspector General.
Article 8. Criteria for awarding Certificates of Merit
1. Heads of units under the Government Inspectorate shall present Certificates of Commendation to individuals within their management authority according to the following criteria:
a) Completing tasks well or better;
b) Having good moral character; maintaining internal unity; setting a good example in implementing Party policies, state laws, internal regulations, and work rules of the agency or unit; actively participating in competitive movements initiated and promoted by the agency or unit;
c) Continuously studying to improve professional knowledge and skills.
2. Heads of units under the Government Inspectorate shall present Certificates of Commendation to collectives within their management authority according to the following criteria:
a) Completing tasks well or better;
b) Internal unity, no complaints or reports of grievances; effectively implementing grassroots democracy and organizing competitive movements well;
c) Caring for the material and spiritual life of members in the collective, practicing thrift, and combating waste;
d) Fully implementing policies and benefits for members of the collective.
Article 9. Documents for Proposing to Award Merit Titles and Forms of Reward
The documents for proposing to award merit titles and forms of reward shall be implemented in accordance with Clause 1 and Clause 2 of Article 84 of the Law on Competition and Reward. The documents shall be submitted to the Competition and Reward Council of the Inspection Agency including 01 set (original) and electronic documents of the reward dossier, except for documents containing state secrets.
Article 10. Responsibilities of Organizations and Individuals in Competition and Reward Work
1. Heads of departments, bureaus, and units under the Government Inspectorate directly lead, direct, and bear responsibility for competition and reward work; identify collectives and individuals with outstanding achievements to reward within their authority; propose the Chief Inspector General to reward or submit to competent authorities for rewards; promote exemplary models; evaluate achievements of collectives and individuals and bear responsibility for the proposed rewards.
2. Responsibilities of relevant agencies, organizations, units, and individuals:
a) Strictly comply with legal provisions and regulations of agencies, organizations, and units in competition and reward work;
b) Bear legal responsibility for reporting achievements and preparing documents for reward proposals; have the responsibility to preserve and retain reward items.
3. The Information Center, Inspectorate Newspaper, and Inspectorate Magazine are responsible for publicizing the Party's policies, State laws, and the Government Inspectorate's regulations on competition and reward; publishing slogans and competition contents; promoting and setting examples for collectives and individuals with outstanding achievements, exemplary models, good people, and good deeds in competition movements; publicizing the results of competition movements and reward work; promptly reflecting and combating violations of laws on competition and reward.
Article 11. Effective Date
This Circular takes effect from May 15, 2024. Circular No. 01/2016/TT-TTCP dated October 6, 2016 of the Government Inspectorate stipulating competition and reward work in the inspection sector becomes invalid when this Circular takes effect. In case the referenced legal normative documents in this Circular are amended, supplemented, or replaced, they shall be applied according to newly issued documents.
Article 12. Implementation Organization
1. The Competition and Reward Council of the Inspection Sector is responsible for guiding, urging, and inspecting the implementation of this Circular.
2. Heads of departments, bureaus, and units under the Government Inspectorate, Chief Inspectors of Ministries, Chief Inspectors of provinces and centrally-administered cities, Heads of inspection agencies under government bodies, Chief Inspectors of Confidential Services, and related agencies, units, and individuals are responsible for organizing the implementation of this Circular.
3. During the process of implementation, if there are difficulties or obstacles, heads of agencies and units shall promptly report to the Competition and Reward Council of the Inspection Sector to report to the Chief Inspector General for consideration, amendment, and supplementation to ensure suitability./.
