JOINT CIRCULAR
Guidelines for Admissions to Universities, Colleges, and Vocational High Schools under the Nomination System

Pursuant to Decree No. 43/2000/NĐ-CP dated August 30, 2000 of the Government detailing and guiding the implementation of certain provisions of the Education Law.
The Ministry of Education and Training, the Civil Service Committee of the Government, and the Committee for Ethnic Minorities and Mountainous Areas provide guidelines for admissions to universities, colleges, and vocational high schools under the nomination system as follows:
This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.
1. The nomination system is an admission system to universities (university), colleges (college), and vocational high schools (vocational high school) without having to take entrance examinations with the purpose of training cadres and civil servants for areas with particularly difficult socio-economic conditions.
2. According to Article 3 of Decree No. 43/2000/NĐ-CP dated August 30, 2000 of the Government detailing and guiding the implementation of certain provisions of the Education Law, areas with particularly difficult socio-economic conditions include ethnic minority regions, mountainous regions, islands, and other difficult regions.
The list of these regions is detailed down to commune level according to Decision No. 1232/QĐ-TTg dated December 24, 1999 and No. 647/QĐ-TTg dated July 12, 2000 of the Prime Minister approving the list of particularly difficult communes and border communes within the scope of the program for economic and social development of particularly difficult mountainous and remote communes, and subsequent supplementary documents pursuant to decisions of the Prime Minister.
3. The candidates for admission to universities, colleges, and vocational high schools under the nomination system include:
Students who are children of ethnic minorities residing and having permanent residence registration for at least five years (as of September 30 of the year of admission) in areas with particularly difficult socio-economic conditions as specified in Clause 2, Section I of this Circular.
4. Admission criteria for universities, colleges, and vocational high schools under the nomination system:
a) Having completed secondary general education (secondary general education) or secondary supplementary education (secondary supplementary education), vocational high school (vocational high school), or vocational education (vocational education), hereinafter referred to as secondary general education or equivalent not more than three years prior to the year of admission; having a grade of good or higher in conduct throughout the final year recorded in the student record book, and a grade of good or higher in academic performance for students of the Kinh ethnicity, and a grade of average or higher for students of ethnic minorities.
b) Age not exceeding twenty-five years old as of September 30 of the year of admission, and being in good health to study and work as stipulated in Joint Circular No. 10/TT-LB dated August 18, 1989 of the Ministry of Health and the Ministry of Higher Education, Vocational High School, and Vocational Training on the health standards for students, trainees, and interns entering vocational schools, vocational high schools, colleges, universities, and postgraduate programs both domestically and internationally, and Document No. 2445/TS dated August 20, 1990 of the Ministry of Education and Training on health standards in training.
c) Being decided by the People's Committee (People's Committee) of the province to be nominated for study under the nomination system.
d) Submitting the application for admission under the nomination system within the prescribed deadline.
5. Application materials for admission under the nomination system include:
a. An application form for admission under the nomination system as prescribed in Appendix 1 of this Circular.
b. A graduation certificate of secondary general education or equivalent. In cases where the application for nomination is made immediately upon completion of secondary general education or equivalent but the graduation certificate has not yet been received, a temporary graduation certificate issued by the principal of the school where the student graduated may be submitted, but the original graduation certificate must be presented for verification by the training institution no later than the beginning of the second semester of the preparatory year.
c. A copy of the final-year student record book.
d. A certificate of achievement in the provincial student excellence examination (if applicable).
đ. An admission confirmation form (according to the model of the Ministry of Education and Training) for students admitted to universities, colleges, and vocational high schools, confirmed by the People's Committee of the commune or ward.
e. A copy of the birth certificate.
g. A permanent residence certificate issued by the Public Security Department of the district.
h. A health examination certificate issued by a Health Center at the district level or higher.
i. Two recent photographs measuring 4x6 cm taken within six months.
k. An envelope with postage stamps affixed and clearly marked with the contact address of the nominated candidate.
Each person's application materials should be placed in an envelope measuring 21 cm x 32 cm and sent to the Nomination Admissions Board (Nomination Admissions Board) of the province before August 30 each year.
II. PLAN AND PROCEDURE FOR SELECTION
1. Based on socio-economic development orientation, educational development programs, and cadre training plans, in the second quarter of each year, the People's Committee of the province sends a report to the Ministry of Education and Training regarding the need for cadre training under the nomination system in terms of quantity, level, and field of study.
After reaching consensus with the Civil Service Committee of the Government, the Ministry of Planning and Investment, and the Committee for Ethnic Minorities and Mountainous Areas, the Ministry of Education and Training assigns admission quotas under the nomination system to provinces and training quotas under the nomination system to preparatory universities and universities, colleges, and vocational high schools.
2. Each year, the People's Committee of the province establishes a Nomination Admissions Board to assist the Committee in conducting admissions.
2.1. Composition of the Board:
a. Chairman of the Board: A leader of the People's Committee of the province.
b. Vice-Chairman of the Board: Director of the Department of Education and Training.
c. Five other members including: Leaders of the Civil Service Department, the Ethnic Minorities and Mountainous Areas Department, the Department of Planning and Investment, the Department of Finance, and the Head of the Professional Education Division of the Department of Education and Training serving as a member of the Board's secretary.
For provinces without an Ethnic Minorities and Mountainous Areas Department, representatives from the Provincial Propaganda Department will be invited to serve as members of the Board.
2.2. Functions, duties, and powers of the Board:
a. Based on the nomination quota assigned by the Ministry of Education and Training, propose a distribution plan for each district, submit it for approval by the People's Committee of the province.
b. Announce publicly through local media the nomination quota; direct and guide districts to conduct recruitment and guide students to prepare application materials for admission under the nomination system.
c. Collect applications and select students according to the assigned quota, the specified target group, and the conditions set out in Section I of this Circular, ensuring that the proportion of Kinh people does not exceed 20% of the total assigned quota.
2.3. In cases where the number of eligible nominees is less than the assigned quota, the Board shall submit to the People's Committee of the province for consideration and decision to supplement the nomination list with individuals falling into the following categories:
Children of ethnic minorities who do not have permanent residence registration in particularly difficult communes and border communes but are residing and have had permanent residence registration for five years or more (as of September 30 of the year of admission) in highland villages located in area III within areas II according to Decisions No. 42/QĐ-UB dated May 23, 1997, No. 261/1998/QĐ-UB dated March 18, 1998, and No. 21/1998/QĐ-UB dated February 25, 1999 of the Minister, Chairman of the Committee for Ethnic Minorities and Mountainous Areas recognizing three mountainous and highland regions.
2.4. In cases where the number of applicants exceeds the quota assigned, the Admissions Committee shall consider admissions in the following priority order:
a. Students whose parents are martyrs.
b. Students whose parents are war invalids, disease invalids, or persons enjoying benefits equivalent to those of war invalids (ranked from those with higher degrees of disability downwards).
c. Students who won awards in provincial student excellence competitions (ranked from higher awards downwards).
d. Students with higher academic performance and conduct ratings.
2.5. Each year in September, the Admissions Committee reports to the Provincial People's Committee on the results of selecting candidates for assignment, for the Provincial People's Committee to review and decide. Before September 30, the Provincial People's Committee sends the following documents to the Ministry of Education and Training and the universities:
- To the Ministry of Education and Training: a list of all students who submitted application forms for assignment (in accordance with the form prescribed in Appendix 2 of this Circular), a request for approval, and a list of students selected for assignment.
- To the preparatory universities or universities and colleges designated to provide preparatory education: a request for approval and a list with attached files of students selected for assignment.
The Admissions Committee makes copies of the files of each student selected for assignment to be kept at the Admissions Committee until the student graduates and returns to the province to take up employment.
3. Preparatory universities and universities and colleges proceed to accept, examine, and admit candidates for assignment, ensuring compliance with the quotas allocated to each province, and then prepare a list of candidates for assignment to report to the Ministry of Education and Training. After obtaining the Ministry of Education and Training's agreement, the universities notify the results of the selection to the Provincial People's Committees and summon qualified candidates to begin their studies.
III. EDUCATION ORGANIZATION
1. Candidates for assignment must complete one year of preparatory university education to enhance their general knowledge before officially entering university, college, or technical secondary school.
2. Upon completion of the preparatory university program, candidates will be admitted to university, college, or technical secondary school based on their academic performance.
The preparatory university education, the admission process for official university, college, or technical secondary school studies, and the education provided in university, college, or technical secondary school for students under the assignment system shall be carried out in accordance with current regulations of the Ministry of Education and Training.
Those with satisfactory grades in preparatory university education (at least good) will be enrolled in regular classes with other students. The rest will be placed in separate classes.
IV. POLICIES FOR STUDENTS UNDER THE ASSIGNMENT SYSTEM
1. Preferential policies for students under the assignment system.
During preparatory university education as well as during official university, college, or technical secondary school education, students under the assignment system shall enjoy the following preferential policies:
a. They shall receive scholarships according to Decision No. 1121/1997/QĐ-TTg dated December 23, 1997, of the Prime Minister regarding scholarships and social assistance for students in public schools and during preparatory university education, and shall benefit from the provisions set forth in Joint Circular No. 126/1998/TTLT/BTC-BGD&ĐT dated September 9, 1998, of the Ministry of Finance and the Ministry of Education and Training guiding certain financial policies for students in boarding schools for ethnic minority students and preparatory universities.
b. They may borrow textbooks and course materials free of charge.
c. They shall be given priority in accommodation in dormitories.
d. They shall enjoy preferential treatment during the training period in accordance with the regulations of the Ministry of Education and Training.
2. Post-graduation service obligations of students under the assignment system.
After graduation, students under the assignment system shall fulfill the obligation to comply with the job assignments and placements arranged by the Provincial People's Committee where they were sent to study. The minimum working period according to the arrangement of the Provincial People's Committee shall be determined by the Provincial People's Committee but shall not be less than twice the duration of their training.
If they fail to comply with the job assignments and placements arranged by the Provincial People's Committee or do not work for the required minimum period, the trained students under the assignment system shall be required to reimburse the scholarship and training costs. The amount and method of reimbursement for each level of training, duration, and field of study shall be implemented in accordance with state regulations.
V. IMPLEMENTATION
1. Universities responsible for training shall, no later than one month after students are recognized as having graduated, send a notification letter listing the students who have graduated under the assignment system to the Provincial People's Committee that sent them to study.
2. Graduates of the assignment system program shall, no later than two months after graduation, appear before the Provincial Civil Service Organization Committee to complete the procedures for taking up employment.
3. Within twelve months from the date of receipt of the list of graduates sent by the training institutions, the Provincial People's Committee shall be responsible for accepting and arranging employment for graduates under the assignment system.
If, after twelve months, the province cannot arrange employment, the graduate has the right to seek employment independently without having to fulfill the obligation to reimburse; in such a case, the Provincial People's Committee shall be responsible for sending a report to the Ministry of Education and Training, the Civil Service Personnel Department of the Government, and the Committee for Ethnic Minorities and Mountainous Areas explaining the reasons why employment could not be arranged for graduates under the assignment system.
The Ministry of Education and Training will jointly with relevant agencies consider reducing the quota for assignment of the province if the personnel trained are not reasonably employed locally.
This Circular shall take effect fifteen days after its signing. All previous regulations contrary to the provisions of this Circular are hereby abolished.
Any difficulties encountered during implementation shall be reported by provinces and universities to the Ministry of Education and Training, the Committee for Ethnic Minorities and Mountainous Areas, and the Civil Service Personnel Department of the Government for consideration and resolution.
