Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Environmental Protection Law dated November 19, 2005;
Pursuant to the Water Resources Law dated May 20, 1998;
Pursuant to the Ordinance on Fees and Charges dated August 28, 2001;
Considering the proposal of the Minister of Finance.
DECREE:
Article 1. Amending and supplementing some articles of Decree No. 67/2003/NĐ-CP dated June 13, 2003 of the Government on environmental protection fees for wastewater as follows:
1. Amending Clause 2 of Article 6 as follows:
"2. The amount of environmental protection fee for industrial wastewater based on each pollutant shall be stipulated as follows:

2. Amend and supplement Clause 1 Article 8 as follows:
"1. To retain a portion of the collected fees for the agency or unit directly collecting the fees to cover costs related to the collection of fees; to cover costs for assessing, sampling, and analyzing industrial wastewater for the purpose of collecting fees or adjusting emission standards for pollutants."
3. Amend and supplement Article 9 as follows:
"Article 9. The Ministry of Natural Resources and Environment shall announce emission standards for pollutants as the basis for calculating the volume of pollutants in industrial wastewater to determine the amount of fees payable; periodically survey and determine pollutants in industrial wastewater to adjust accordingly.
In cases where competent authorities have measured and sampled wastewater for analysis, the results of such measurements and analyses shall be used to calculate and determine the amount of fees payable. The Ministry of Natural Resources and Environment shall specify the procedures for assessing, sampling, and analyzing industrial wastewater in these cases."
Article 2. This Decree shall take effect fifteen days after its publication in the Official Gazette.
Article 3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees under the central government, and relevant organizations and individuals are responsible for implementing this Decree./.
