CIRCULAR

Supplemental guidance on the tasks, organization, and staffing of the Department of Civil Affairs regarding youth work under the People's Committees at the provincial and district levels.

Pursuant to Clause 2, Article 5 of the Youth Law adopted by the National Assembly, 8th Session, 11th Term on November 29, 2005;

Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Civil Affairs;

Implementing the Notification No. 327/TB-TW dated April 16, 2010 of the Politburo on the Project on the Organizational Structure for State Management of Youth Work;

After receiving the unified opinion of the Ministry of Justice in Circular No. 203/BTP-PLHSHC dated January 17, 2011, the Ministry of Civil Affairs supplements the tasks, organization, and staffing of the Department of Civil Affairs under the People's Committee of provinces and centrally governed cities (hereinafter referred to collectively as the Provincial People's Committee) and the Civil Affairs Office under the People's Committee of districts, towns, urban districts, and cities directly under provinces (hereinafter referred to collectively as the District People's Committee) regarding youth work as follows:

Article 1. Supplementing the tasks, organization, and staffing of the Department of Civil Affairs under the Provincial People's Committee for youth work

1. On tasks:

a) Submit to the Provincial People's Committee for approval planning, programs, projects, and proposals related to youth and youth work; draft decisions, directives; long-term, five-year, and annual plans within the scope of state management of youth work in the province;

b) Organize and implement legal regulations on youth and youth work after they have been approved;

c) Coordinate with departments, agencies, and relevant organizations in the province in disseminating and educating youth about laws; resolving important inter-departmental issues concerning youth and youth work;

d) Coordinate with the Provincial Party Organization Cadre Department, relevant agencies, provincial and city Youth Unions, and other youth organizations in implementing policies and mechanisms for youth and youth work;

đ) Guide and inspect the implementation of legal provisions on youth and youth work; the implementation of policies and systems in organizing and managing youth and youth work in the province;

e) Carry out international cooperation activities on youth work assigned by the Provincial People's Committee in accordance with the law;

g) Conduct inspection, supervision, and handle complaints and petitions related to youth and youth work assigned by the Provincial People's Committee in accordance with the law;

h) Provide professional guidance on youth work to departments, agencies equivalent to departments, public institutions under the province, District People's Committees, and Commune People's Committees;

i) Annually report on the situation of youth work activities to the Provincial People's Committee and the Ministry of Civil Affairs;

k) Perform other tasks related to youth work assigned by the Provincial People's Committee in accordance with the law.

2. Organization and Staffing:

a) The Department of Civil Affairs shall establish a Youth Work Division to perform the state management functions of youth work as prescribed in Clause 1 of this Article;

b) The staffing of the Youth Work Division shall be civil servant positions allocated by the Provincial People's Committee, ensuring sufficient staffing to effectively fulfill the assigned functions and tasks as stipulated in this Circular.

Article 2. Supplement the tasks and staffing of the Civil Service Department under the People's Committee at the district level to handle youth work

1. On tasks:

a) Submit to the People's Committee at the district level for issuance of decisions, directives; long-term, five-year, and annual plans; programs, and measures to implement tasks in the field of state management of youth work assigned;

b) Implement legal normative documents, plans, and programs on youth and youth work after approval;

c) Guide, disseminate, popularize, and educate laws on youth and youth work assigned.

2. The staffing for youth work in the Civil Service Department shall be civil servant positions allocated by the People's Committee at the district level, ensuring sufficient staffing to effectively perform the state management tasks regarding youth work as stipulated in Clause 1 of this Article.

Article 3. Effectiveness

1. This Circular takes effect from March 26, 2011.

2. Based on the guidance provided in this Circular, the People's Committee at the provincial level shall specify the tasks, organization, and staffing of the Civil Service Department concerning youth work, and guide the People's Committee at the district level to define the tasks and staffing of the Civil Service Department concerning youth work in accordance with the specific socio-economic development conditions of the locality, ensuring effectiveness.

3. Any difficulties encountered during implementation shall be reported to the Ministry of Home Affairs for consideration and resolution./.
