Pursuant to the Maritime Code of Vietnam dated June 14, 2005;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 136/2007/NĐ-CP dated August 17, 2007 of the Government on exit and entry of Vietnamese citizens;

Pursuant to Decree No. 65/2012/NĐ-CP dated September 6, 2012 of the Government amending and supplementing some articles of Decree No. 136/2007/NĐ-CP dated August 17, 2007 on exit and entry of Vietnamese citizens.

At the proposal of the Director of the Personnel Department and the Director of the Vietnam Maritime Administration,

The Minister of Transport issues this Circular amending and supplementing some articles of Circular No. 07/2012/TT-BGTVT dated March 21, 2012 issued by the Minister of Transport on the positions, duties according to positions of seafarers and registration of seafarers working on Vietnamese ships,

Article 1. Amending and supplementing some articles of Circular No. 07/2012/TT-BGTVT dated March 21, 2012 on the positions, duties according to positions of seafarers and registration of seafarers working on Vietnamese ships

1. Clause 2, Article 69 shall be amended and supplemented as follows:

"2. Seafarer passports shall be issued by the Vietnam Maritime Administration according to the model set out in Appendix III of this Circular. A seafarer passport has a validity period not exceeding ten (10) years from the date of issuance and cannot be extended. If a seafarer passport is still valid, it shall be reissued; when it expires, a new application shall be made."

2. Clause 1, Article 72 shall be amended and supplemented as follows:

"1. A seafarer passport that is still valid but lost, damaged, contains incorrect information, or has run out of pages shall be reissued."

3. Point b, Clause 2, Article 72 shall be amended and supplemented as follows:

"b) A seafarer passport that has been issued for cases where it is damaged, contains incorrect information, or has run out of pages."

4. Amending Clause 3, Item 5 "Provisions on the use of Seafarer Passports" in Appendix III "Model of Seafarer Passport" as follows:

"3. The seafarer passport is valid for 10 years."

Article 2. Effective Date

1. This Circular takes effect from July 1, 2013.

2. Seafarer passports issued pursuant to Decision No. 65/2005/QĐ-BGTVT dated November 30, 2005 of the Minister of Transport on the positions, duties according to positions of seafarers and registration of seafarers working on Vietnamese ships; Decision No. 29/2008/QĐ-BGTVT dated December 16, 2008 of the Minister of Transport on the positions, duties according to positions of seafarers and registration of seafarers working on Vietnamese ships; Circular No. 07/2012/TT-BGTVT dated March 21, 2012 of the Minister of Transport on the positions, duties according to positions of seafarers and registration of seafarers working on Vietnamese ships shall continue to be used until their expiration.

Article 3. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments under the Ministry of Transport, the Director of the Vietnam Maritime Administration, the Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular./.
