DECREE
Regarding departure and entry of Vietnamese citizens

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Considering the proposal of the Minister of Public Security,
DECREE:
PART I
GENERAL PROVISIONS
Article 1. This Decree stipulates the departure and entry of Vietnamese citizens.
Article 2. Vietnamese citizens shall be issued a national passport or other appropriate travel documents for departure and entry in accordance with this Decree and international treaties to which Vietnam is a party.
Article 3.
1. Vietnamese citizens holding a national passport as specified in point a, Clause 1, Article 4 of this Decree shall depart from and enter Vietnam through its border gates. In cases where international treaties to which Vietnam is a party provide otherwise, such provisions shall apply.
2. Vietnamese citizens holding other travel documents as specified in point b, Clause 1, Article 4 of this Decree shall depart from and enter Vietnam through its border gates in accordance with regulations applicable to each type of document and international treaties to which Vietnam is a party.
3. Vietnamese citizens holding travel documents issued by competent Vietnamese authorities that have value for departure and entry shall depart from and enter Vietnam without requiring a visa.
Chapter II
PROVISIONS ON TRAVEL DOCUMENTS WITH VALUE FOR DEPARTURE AND ENTRY TO VIETNAM
Article 4.
1. The following documents shall be issued to Vietnamese citizens for departure and entry:
a) National passports, including:
- Diplomatic passports;
- Service passports;
- Ordinary passports.
b) Other documents, including:
- Seaman's passports;
- Border crossing permits;
- Entry-exit permits;
- Repatriation permits;
- Travel permits.
2. Validity periods of travel documents with value for departure and entry:
a) National passports:
- Diplomatic passports and service passports shall not exceed five years from the date of issuance. Diplomatic passports and service passports may be renewed once, with a maximum validity period of three years. Renewal must be completed at least thirty days before the passport expires;
- Ordinary passports shall not exceed ten years from the date of issuance and shall not be renewable;
- The validity period of national passports issued to children under fourteen years old or accompanying children under fourteen years old shall be governed by the provisions of Article 5 of this Decree.
b) Other documents:
- Border crossing permits, entry-exit permits, and repatriation permits shall not exceed twelve months from the date of issuance and shall not be renewable;
- Travel permits shall not exceed six months from the date of issuance and shall not be renewable.
- Seaman's passports shall not exceed five years from the date of issuance. Seaman's passports may be renewed once, with a maximum validity period of three years. Renewal must be completed at least thirty days before the passport expires.
3. A national passport is the property of the Socialist Republic of Vietnam.
A national passport can be used instead of a citizen identification card.
Ordinary passports issued domestically and abroad have the same form and content but have separate symbols for easier management.
Article 5.
5. Diplomatic passports and official passports shall not be issued to individuals specified in Articles 6 and 7 of this Decision when they are sent abroad for study for more than six months."
2. National passports issued to children under fourteen years old shall not exceed five years from the date of issuance until the child reaches fourteen years of age and shall not be renewable.
3. Children under fourteen years of age may be included in their parent's national passport if requested by the parent. In this case, the passport shall not exceed five years from the date of issuance until the child reaches fourteen years of age and shall not be renewable.
Article 6. Diplomatic passports shall be issued to Vietnamese citizens in the following categories who are dispatched or decided by the competent authority of Vietnam as specified in Clause 1, Article 32 of this Decree to go abroad in accordance with the nature of the trip:
- Secretaries, Deputy Secretaries of Provincial Party Committees and Municipal Party Committees directly under the Central Government;
- Heads, Deputy Heads of Departments directly under the Central Committee; Directors, Deputy Directors of the Central Party Office;
- Heads, Deputy Heads of organizations established by the Politburo, the Secretariat, and the Central Committee;
- Secretaries, Deputy Secretaries of the Party Committee of State Agencies and the Party Committee of State Enterprises;
- Special Envoys, Assistants, Secretaries of the General Secretary of the Central Committee;
- Heads and Deputy Heads of Central Party Committees' Departments; Secretaries and Deputy Secretaries of the Central Party Committee Office;
- Directors and Deputy Directors of the National Political Academy; Editors-in-Chief and Deputy Editors-in-Chief of the People's Army Newspaper, Communist Review, and the Party's website; Chairpersons and Vice Chairpersons of the Central Theoretical Council;
- Secretaries and Deputy Secretaries of the Party Committee of Central Agencies and Central Enterprises;
- Special envoys, assistants, and secretaries of the General Secretary of the Central Committee of the Party.
2. Belonging to the National Assembly:
- State Auditor General, Deputy State Auditor General;
- Heads, Deputy Heads of Committees of the Standing Committee of the National Assembly;
- National Assembly Deputies;
- Assistants, Secretaries of the Chairman of the National Assembly.
- President, Vice Presidents;
- Former Presidents, Vice Presidents;
- Assistants and secretaries of the President of the National Assembly.
- Special Envoys, Assistants, Secretaries of the President.
4. Belonging to the Government:
- Prime Minister, Deputy Prime Ministers, former Prime Ministers, Deputy Prime Ministers;
- Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies; Deputy Ministers, Deputy Heads of Ministries equivalent to Ministries, Deputy Heads of Government Agencies;
- Special envoys, assistants, and secretaries of the State President.
- Special Envoys, Assistants, Secretaries of the Prime Minister;
- Chairmen, Vice Chairmen, Secretaries of Vietnam Sub-Committees in the Joint Governmental Cooperation Committees with foreign countries.
5. Chief Justice, Deputy Chief Justice of the Supreme People's Court.
- Directors-General and Deputy Directors-General and equivalent positions in Ministries, agencies at the level of ministries, agencies established by the Prime Minister; Political Commissars, Deputy Political Commissars, Commanders, and Deputy Commanders of General Departments and Military Commands under the Ministry of Defense; officers with ranks from Major General, Rear Admiral of the Navy upwards currently serving in the Vietnam People's Army and the Vietnam People's Public Security;
7. Belonging to state agencies at local levels:
- Chairmen, Vice Chairmen of Provincial People's Councils and Municipal People's Councils directly under the Central Government;
- Chairmen, Vice Chairmen of Provincial People's Committees and Municipal People's Committees directly under the Central Government.
8. Chairmen, Vice Chairmen, General Secretaries, Members of the Executive Board of the Vietnam Fatherland Front Central Committee.
7. Belonging to state agencies at local levels:
- Chairmen, Vice Chairmen of the Vietnam General Confederation of Labor;
- Chairmen, Vice Chairmen of the Vietnam Farmers' Union;
8. Belonging to central-level mass organizations and people's organizations:
- Chairpersons and Vice Chairpersons, General Secretaries of the Vietnam Fatherland Front Central Committee;
- First Secretaries, Permanent Secretaries of the Central Committee of the Ho Chi Minh Communist Youth Union.
- Chairman, Vice Chairman of the Vietnam Farmers' Association;
- Chairpersons and Vice Chairpersons of the Vietnam Women's Union;
- Chairman, Vice Chairman of the Vietnam Veterans Association;
- First Secretaries and Permanent Secretaries of the Central Youth League of Ho Chi Minh Communist Youth Union;
- Chairpersons of the Vietnam Friendship Association;
- Chairpersons of the Vietnam Literature and Arts Association;
- Chairpersons of the Vietnam Association for Science and Technology;
- Chairpersons of the Vietnam Federation of Trade Unions;
- Chairpersons of the Vietnam Chamber of Commerce and Industry.
9. Those serving in the diplomatic sector who have been conferred diplomatic rank or hold positions from Deputy Defense Attaché onwards at diplomatic missions, permanent delegations to intergovernmental international organizations, and from Consular Attaché onwards at consular offices of Vietnam abroad.
10. Diplomatic couriers and consular couriers.
11. Wives or husbands accompanying the trips of those specified in Clauses 1 to 8 of this Article; wives (or husbands), and children under eighteen years old accompanying or visiting those specified in Clause 9 of this Article during their term of service.
12. In exceptional circumstances, based on foreign affairs requirements or state hospitality and the nature of the official trip, the Minister of Foreign Affairs shall issue diplomatic passports according to the Prime Minister's directive or consider issuing diplomatic passports upon the request of the competent authority of Vietnam as specified in Clause 1, Article 32 of this Decree for individuals not covered by Clauses 1 to 11 of this Article.
Article 7. A diplomatic passport shall be issued to Vietnamese citizens falling under the following categories, who are dispatched abroad by agencies with the authority prescribed in Clause 1, Article 32 of this Decree to perform tasks within the functions of such agencies:
1. State officials and civil servants as provided for by laws on cadres and civil servants.
2. Officers and professional soldiers in the Vietnam People's Army and Vietnam People's Public Security Force.
3. Staff of Vietnamese representative offices abroad; state news agency and press correspondents permanently stationed abroad.
4. Wives or husbands, and children under 18 years old of those persons mentioned in Clause 3 of this Article accompanying them or visiting them during their term of duty.
5. In cases of necessity, based on the requirements and nature of the trip, the Minister of Foreign Affairs shall issue diplomatic passports upon the directive of the Prime Minister or consider issuing diplomatic passports at the request of agencies with the authority prescribed in Clause 1, Article 32 of this Decree for persons not falling under the provisions from Clause 1 to Clause 4 of this Article.
Article 8. A common passport shall be issued to all Vietnamese citizens.
Article 9. A seafarer's passport shall be issued to Vietnamese citizens who are seafarers for entry and exit aboard ships or inland waterway vessels operating international routes as decided by competent authorities under the Ministry of Transport.
Article 10. Border crossing passes and entry-exit passes shall be issued to Vietnamese citizens traveling across borders with countries sharing borders with Vietnam, pursuant to international treaties between Vietnam and those countries.
Article 11. A repatriation pass shall be issued to Vietnamese citizens residing abroad returning to Vietnam for permanent residence.
Article 12A pass shall be issued to Vietnamese citizens not residing abroad to return to Vietnam for permanent residence in the following cases:
1. Not allowed to reside abroad.
2. Required to return to Vietnam according to the demand of Vietnamese competent authorities without a national passport.
3. Voluntarily wishing to return to Vietnam but without a national passport.
Article 13.
The person receiving travel documents shall be responsible for carefully preserving and managing such documents, shall not erase, alter the contents therein, nor provide them to others, and shall not use them contrary to Vietnamese law.
The person receiving travel documents shall report immediately in writing to the issuing agency or the Exit-Entry Administration if the document was lost by a Vietnamese representative office abroad, as follows:
a) If the person is currently in Vietnam, they must report immediately in writing to the issuing agency or the Exit-Entry Administration if the document was lost by a Vietnamese representative office abroad. In case of loss of a diplomatic passport or a service passport, in addition to reporting, the holder must also report immediately to the agency dispatching them abroad.
b) If the person is currently abroad, they must report immediately in writing to the competent authority of the host country and the nearest Vietnamese representative office abroad.
When Vietnamese agencies mentioned in Clause 2 of this Article receive a written report of the loss of travel documents, they shall be responsible for notifying the Ministry of Public Security (Exit-Entry Administration) to invalidate the use of such documents. Once invalidated, travel documents cannot be restored except for humanitarian reasons or emergencies.
Chapter III
REGULATIONS ON THE ISSUE OF TRAVEL DOCUMENTS WITH EXIT AND ENTRY VALUE FOR VIETNAM
Article 14.
1. Vietnamese citizens residing in Vietnam applying for a diplomatic passport or a service passport shall submit their application to the Consular Department of the Ministry of Foreign Affairs or provincial-level foreign affairs agencies under the Ministry of Foreign Affairs as prescribed.
The documents include:
- Application form for the issuance of a passport as prescribed;
- Written document from the agency with the authority prescribed in Clause 1, Article 32 of this Decree regarding the dispatch or decision to go abroad;
- Copy of birth certificate if the applicant is under 14 years old;
- Documents proving that they belong to the category accompanying or visiting as specified in Clause 11, Article 6 and Clause 4, Article 7 of this Decree.
In the case where a parent wishes to have a child under 14 years old, as specified in Clause 11, Article 6 and Clause 4, Article 7 of this Decree, accompany them on a passport, they should jointly fill out the application form.
2. Time limit for considering the issuance of a passport: the diplomatic passport or service passport issuing agency shall notify the applicant of the result within no more than 5 working days from the date of receipt of the application.
Article 15.
1. Vietnamese citizens residing within the country applying for ordinary passports may submit their application documents and receive results at the immigration management agency according to one of the following methods:
a) Submitting the application directly and collecting the result at the Exit-Entry Administration of the provincial-level public security agency where the applicant usually resides or temporarily stays.
b) Sending the application by post to the Exit-Entry Administration of the provincial-level public security agency where the applicant usually resides and requesting the result to be sent back by post. The submission and collection of results by post shall be carried out in accordance with procedures prescribed by the Ministry of Public Security and Vietnam Post Corporation.
c) Entrusting an organization with legal personality to directly submit the application and collect the result at the Exit-Entry Administration of the provincial-level public security agency where the applicant usually resides. The entrustment shall be carried out in accordance with regulations prescribed by the Ministry of Public Security.
2. In urgent cases requiring expedited passports (as defined by the Ministry of Public Security), applicants may submit their application documents and receive results at the Immigration Management Department, Ministry of Public Security.
3. The application for a passport includes:
a) For the cases of direct submission as stipulated in points a and c of Clause 1 of this Article:
- Application form for the issuance of a common passport as prescribed.
For children under 14 years old, their parents or guardians shall fill out and sign the application form; if a parent wishes to have a child under 14 years old accompany them on a passport, they should jointly fill out the application form.
- Copy of the birth certificate of children under 14 years old.
When submitting the application, the applicant must present a valid identity card for verification.
b) For the case of submission by post as stipulated in point b of Clause 1 of this Article:
- Application form for the issuance of a common passport as prescribed, certified by the Chief of the Police Station of the place of permanent registration.
- A copy of the valid identity card.
4. When submitting the application, the applicant must pay the passport fee as prescribed by the Ministry of Finance. In the case of submission by post, the fee must be paid together with the application and postage fees must be settled for Vietnam Post.
5. Time limit for processing application documents and delivering results:
a) For the cases stipulated in Clause 1 of this Article, the Exit-Entry Administration shall notify the result within no more than 8 working days from the date of receipt of the application.
b) For the case stipulated in Clause 2 of this Article, the Exit-Entry Administration shall notify the result within no more than 5 working days from the date of receipt of the application.
6. The Chief of Police of the commune or ward where the citizen usually resides shall be responsible under the law for the content confirmed in the application form for passport issuance of the citizen.
7. Organizations with legal personality that are entrusted by the applicant to submit the dossier and receive the result must be responsible under the law for accurately verifying the identity between the passport applicant, their identity card, and their application form.
||| Article 16.
1. Vietnamese citizens residing abroad who apply for a regular passport shall submit the dossier at the Vietnamese representative office abroad.
The dossier includes:
- Application form for the issuance of a passport as prescribed;
- Documents proving Vietnamese nationality;
- A copy of the birth certificate if the passport applicant is under 14 years old.
In case either parent wishes to include their child under 14 years old on their passport, they should jointly declare this on their own passport application form.
2. The Vietnamese representative office abroad shall deliver the result to the applicant within no more than five working days from the date of receiving the dossier.
Article 17. Procedures and steps for issuing seafarer passports shall be regulated by the Ministry of Transport.
Article 18. Procedures and steps for issuing border pass and entry-exit pass shall be regulated by the Ministry of Public Security, in accordance with international treaties signed by Vietnam with relevant countries.
Article 19. Procedures and steps for issuing re-entry passes for Vietnamese citizens residing abroad returning to reside permanently in Vietnam shall be regulated by the Ministry of Public Security and the Ministry of Foreign Affairs.
Article 20. Procedures and steps for issuing re-entry passes for Vietnamese citizens not residing abroad returning to reside permanently in Vietnam shall be regulated by the Ministry of Public Security.
Chapter IV
REGULATIONS ON DENIAL OF EXIT FROM THE COUNTRY AND DENIAL OF ISSUE OF DOCUMENTS WITH EXIT AND ENTRY VALUE TO VIETNAM
Article 21. Vietnamese citizens residing in the country shall not be allowed to exit the country if they fall into any of the following cases:
1. Being pursued for criminal responsibility or involved in criminal investigation work.
2. Having the obligation to enforce a criminal judgment.
3. Having the obligation to enforce a civil or economic judgment; waiting for resolution of civil or economic disputes.
4. Having the obligation to enforce administrative penalty decisions, tax payment obligations, and other financial obligations except when there is collateral or other security measures in place to fulfill these obligations.
5. For reasons to prevent the spread of dangerous diseases.
6. For reasons to protect national security and social order and safety.
7. Violating regulations on exit and entry as stipulated by the Government.
Article 22.
1. Authority to decide on denial of exit for Vietnamese citizens:
a) Investigation agencies, Procuratorates, Courts, or enforcement agencies at all levels shall decide on denying exit for those mentioned in Clauses 1, 2, and 3 of Article 21 of this Decree.
b) Ministers, Heads of Ministries equivalent to Ministries; Heads of government agencies; Chairpersons of provincial or centrally-administered city People's Committees shall decide on denying exit for those mentioned in Clause 4 of Article 21 of this Decree.
c) Minister of Health shall decide on denying exit for those mentioned in Clause 5 of Article 21 of this Decree.
d) Minister of Public Security shall decide on denying exit for those mentioned in Clause 6 of Article 21 of this Decree.
đ) Head of the Exit and Entry Management Agency - Ministry of Public Security shall decide on denying exit for those mentioned in Clause 7 of Article 21 of this Decree.
2. Authorities mentioned in Points a, b, c, d, Clause 1 of this Article, when deciding to deny exit for citizens, must send a written notification to the Exit and Entry Management Department - Ministry of Public Security, clearly stating the personal details of the person denied exit and the duration of the denial, for implementation. When revoking such a decision, they must also notify the Exit and Entry Management Department - Ministry of Public Security in writing for implementation.
3. The authority deciding to deny exit for a citizen shall have the responsibility to notify the citizen in writing, except in cases where confidentiality is required for criminal investigation work and for security reasons.
4. The person deciding to deny exit for a citizen shall be responsible under the law for their decision.
Article 23. Vietnamese citizens residing abroad shall not be issued documents with exit and entry value by Vietnamese representative offices abroad if they fall into any of the following cases:
1. Not having documents proving Vietnamese nationality.
2. For reasons to protect national security and social order and safety, as decided by the Minister of Public Security.
Article 24. Those mentioned in Articles 21 and 23 of this Decree shall not be issued documents with exit and entry value to Vietnam. If such documents have already been issued, the Exit and Entry Management Department - Ministry of Public Security shall implement the cancellation of their validity.
Article 25. Agencies, organizations, and individuals, upon discovering persons mentioned in Articles 21 and 23 of this Decree holding passports or other documents with exit and entry value or applying for such documents, shall have the responsibility to report along with specific evidence to the authorities mentioned in Article 22 of this Decree for consideration and decision not to issue passports or other documents with exit and entry value or to prevent their exit.
Article 26.
1. The Ministry of Public Security shall uniformly manage the list of citizens not allowed to exit the country as mentioned in Article 21 of this Decree and citizens not issued documents with exit and entry value as mentioned in Clause 2 of Article 23 of this Decree.
2. In special cases, the Minister of Public Security may decide to allow exit for those not allowed to exit as mentioned in Article 21 of this Decree.
Chapter V
REGULATIONS ON RESPONSIBILITIES AND AUTHORITY OF RELATED AUTHORITIES
Article 27. The Ministry of Public Security is the agency assisting the Government in managing state affairs regarding the exit and entry of Vietnamese citizens, and has the responsibility:
1. To take the lead and coordinate with relevant ministries and sectors in drafting, promulgating, or submitting to the Government for promulgation, or recommending the Government to submit to the National Assembly or the Standing Committee of the National Assembly for promulgation, policies and normative legal documents in the field of exit and entry of Vietnamese citizens.
2. To issue, amend regular passports, border passes, and entry-exit passes for Vietnamese citizens residing in the country, and re-entry passes for Vietnamese citizens residing abroad returning to the country due to non-residence permission abroad.
3. Issue templates for various types of travel documents with exit and entry validity and necessary forms after consulting relevant ministries and sectors; print, manage, and supply blank versions of these travel documents to agencies issuing such documents.
4. Carry out the recovery and invalidate the usage value of various types of travel documents with exit and entry validity; restore the usage value of travel documents with exit and entry validity that have been invalidated as stipulated in Clause 3, Article 13 of this Decree.
5. Supervise and verify travel documents with exit and entry validity for Vietnamese citizens exiting and entering at border gates; guide units controlling exit and entry at border gates managed by the Ministry of National Defense on procedures, forms, and processes for supervising and verifying travel documents with exit and entry validity.
6. Handle administrative violations by individuals and organizations violating regulations on exit and entry of Vietnamese citizens; guide related agencies on methods to detect counterfeit travel documents with exit and entry validity.
7. Implement international cooperation in the field of exit and entry of Vietnamese citizens; take the lead in receiving Vietnamese citizens who are not allowed to reside abroad.
8. Conduct national statistics on exit and entry of Vietnamese citizens; establish mechanisms for coordination among related agencies to ensure a unified management system for information in the field of exit and entry of Vietnamese citizens.
Article 28. The Ministry of Foreign Affairs shall be responsible for:
1. Guide procedures and steps for issuing, extending, and amending diplomatic passports and official passports.
2. Issue, extend, and amend diplomatic passports and official passports within the country; notify the Ministry of Public Security of the list of personnel who have been issued diplomatic passports and official passports immediately after issuance.
3. Notify the Ministry of Public Security of the list of personnel who report lost diplomatic passports and official passports to invalidate their usage value.
4. Coordinate with the Ministry of Public Security to restore the usage value of diplomatic passports and official passports that have been invalidated as stipulated in Clause 3, Article 13 of this Decree.
5. Provide the Ministry of Public Security with necessary information and documents about individuals and organizations violating regulations on issuing and using diplomatic passports and official passports for the Ministry of Public Security to handle.
6. Take the lead and coordinate with the Ministry of Public Security in negotiating, signing, or joining international treaties related to the exit and entry of Vietnamese citizens as prescribed by the Government.
Article 29. The Ministry of Transport shall be responsible for:
1. Guide procedures and steps for issuing, extending, and amending seafarer passports.
2. Issue, amend, and extend seafarer passports; notify the Ministry of Public Security of the list of personnel who have been issued seafarer passports immediately after issuance and the list of personnel who report lost seafarer passports.
3. Provide the Ministry of Public Security with necessary information and documents about individuals and organizations violating regulations on issuing and using seafarer passports for the Ministry of Public Security to handle.
Article 30. The Ministry of National Defense (Border Guard Force) shall be responsible for:
1. Supervise and verify passports and other travel documents with exit and entry validity of Vietnamese citizens when exiting and entering at border gates managed by the Border Guard Force.
2. Update the Ministry of Public Security with lists of Vietnamese citizens who have exited and entered through border gates managed by the Border Guard Force.
3. Exchange with the Ministry of Public Security on the situation and results of handling individuals and organizations violating regulations on exit and entry of Vietnamese citizens at border gates managed by the Border Guard Force; promptly exchange to allow the Ministry of Public Security to coordinate in directing the handling of serious violations or those related to foreign affairs.
Article 31. Vietnamese representative offices abroad shall have the following responsibilities:
1. Issue, extend, and amend diplomatic passports and official passports according to notifications from the Ministry of Foreign Affairs.
2. Issue and amend ordinary passports according to guidelines from the Ministry of Public Security and the Ministry of Foreign Affairs.
3. Issue re-entry permits and travel permits according to notifications from the Ministry of Public Security.
4. Notify the Ministry of Public Security of the list of personnel who have been issued travel documents with exit and entry validity immediately after issuance and the list of personnel who report lost travel documents with exit and entry validity, according to the format of the Ministry of Public Security.
Article 32.
1. Agencies authorized to send persons specified in Articles 6 and 7 of this Decree abroad include:
a) Belonging to the Communist Party of Vietnam:
- The Central Party Politburo;
- Central Party Committee Secretariat;
- Central Party bodies;
- Central Party Office;
- Provincial Party Committees directly under the Central Committee.
b) Under the National Assembly:
- Standing Committee of the National Assembly;
- National Assembly's Ethnic Council;
- National Assembly Committees;
- Various Committees of the Standing Committee of the National Assembly;
- The Office of the National Assembly.
c) The Office of the President.
d) Belonging to the Government:
- Prime Minister;
- Ministries, ministerial-level agencies, and government agencies.
đ) The Supreme People's Court.
e) The Supreme People's Procuracy.
g) Belonging to local state agencies:
- People's Councils of provinces and centrally governed cities;
- People's Committees of provinces and centrally governed cities.
h) Belonging to central mass organizations and people's organizations:
- Vietnam Fatherland Front Central Committee;
- Vietnam General Confederation of Labor;
- Vietnam Women's Union;
- Ho Chi Minh Communist Youth Union Central Committee;
- Vietnam Farmers' Association;
- Vietnam Veterans' Association;
- Vietnam Friendship Association;
- Vietnam Journalists' Association; Journalists' Associations of provinces and centrally governed cities;
- Vietnam Association for Science and Technology;
- Vietnam Union of Cooperatives;
- Vietnam Chamber of Commerce and Industry.
2. Heads of ministries, ministerial-level agencies, and Chairmen of provincial and municipal People's Committees directly under the Central Committee may delegate subordinate units to send officials and civil servants abroad.
3. Heads of agencies authorized as stipulated in Clause 1 of this Article shall be responsible for promulgating regulations governing the dispatch of officials and civil servants abroad under their management.
Chapter VI
IMPLEMENTING PROVISIONS
Article 33.
1. Individuals and organizations committing acts in violation of the provisions of this Decree shall be subject to administrative penalties or criminal prosecution depending on the nature and severity of the violation, as prescribed by law.
2. Vietnamese citizens have the right to lodge complaints in accordance with the law if they are refused issuance of travel documents with exit and entry validity, if they are notified of non-permission to exit, or if agencies issuing travel documents with exit and entry validity fail to comply with the provisions of this Decree.
Article 34. This Decree takes effect fifteen days after its publication in the Official Gazette and replaces the following provisions:
- Decree No. 05/2000/NĐ-CP dated March 3, 2000 of the Government on exit and entry of Vietnamese citizens.
- Provisions on exit and entry of Vietnamese citizens stipulated in Decision No. 210/1999/QĐ-TTg dated October 27, 1999 of the Prime Minister on certain policies for overseas Vietnamese.
Article 35The Minister of Public Security shall take the lead and coordinate with relevant ministries to guide the implementation of this Decree.
Article 36. The Ministry of Foreign Affairs and the Ministry of Transport shall organize the connection of computer networks with the Ministry of Public Security to transmit data on personnel information of individuals issued travel documents immediately upon issuance; The Ministry of Foreign Affairs shall guide overseas Vietnamese representative offices to implement the connection of computer networks with the Ministry of Public Security to transmit data on personnel information of Vietnamese individuals issued travel documents immediately upon issuance; The Ministry of National Defense shall organize the connection of computer networks with the Ministry of Public Security to transmit data on exit and entry control information of Vietnamese individuals passing through border gates managed by the Ministry of National Defense immediately upon their exit and entry.
Article 37The Ministry of Finance shall take the lead and coordinate with the Ministry of Public Security, the Ministry of Foreign Affairs, and the Ministry of Transport to stipulate fees for issuing, extending, supplementing, and amending travel documents; provide guidance on allocating funds from the collection of fees for issuing travel documents to be used for purchasing, maintaining, and repairing materials, machinery, and equipment for issuing travel documents; machinery and equipment for detecting suspected fake travel documents; handling administrative violations and other matters serving the management of citizens' exit and entry.
Article 38. The Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairpersons of provincial People's Committees under the central city shall be responsible for implementing this Decree./.
