The Minister of Education and Training issues this Circular on the Regulation on the organization and operation of the National Council of Professors, sectoral and inter-sectoral councils of professors, and the council of professors at the basic level.

At the proposal of the Director of the Department of Teachers and Educational Management Staff;

This Circular annexes the Regulation on the organization and operation of the National Council of Professors, sectoral and inter-sectoral councils of professors, and the council of professors at the basic level.

Article 1. This Circular takes effect from May 13, 2019.

Article 2. This Circular replaces Circular No. 25/2013/TT-BGDĐT dated July 15, 2013, by the Minister of Education and Training, promulgating the Regulation on the organization and operation of the National Council of Academic Titles, sectoral and inter-sectoral councils of academic titles, and the council of academic titles at the basic level, and Circular No. 05/2014/TT-BGDĐT dated February 28, 2014, amending and supplementing certain articles of the Regulation on the organization and operation of the National Council of Academic Titles, sectoral and inter-sectoral councils of academic titles, and the council of academic titles at the basic level, attached to Circular No. 25/2013/TT-BGDĐT dated July 15, 2013, by the Minister of Education and Training.

The Director of the Office, the Heads of the Department of Teachers and Educational Management Staff, the Heads of relevant units under the Ministry of Education and Training; the Chairperson of the National Council of Professors; the Heads of higher education institutions; related units and individuals are responsible for implementing this Circular.

REGULATIONS

1. This Regulation stipulates the organization and operation of the National Council of Professors, sectoral and inter-sectoral councils of professors (hereinafter referred to as sectoral councils of professors), and the council of professors at the basic level.

PART I

GENERAL PROVISIONS

 

Article 1Scope of regulation and applicable subjects

2. This Regulation applies to the National Council of Professors, sectoral councils of professors, and the council of professors at the basic level (hereinafter referred to as councils of professors), universities, academies, university-level schools, research institutes authorized to train doctoral students (hereinafter referred to as higher education institutions), and related organizations and individuals.

2. These regulations shall apply to the State Council of Professors, sectoral Professor Councils, and institutional Professor Councils (hereinafter referred to as Professor Councils), universities, academies, university-level institutions authorized to train doctoral candidates (hereinafter referred to as higher education institutions), and related organizations and individuals.

Article 2. Principles of Operation of the Academic Councils

1. Implement the provisions set forth in Article 18 of Decision No. 37/2018/QĐ-TTg dated August 31, 2018, issued by the Prime Minister to stipulate standards and procedures for recognizing qualifications for professor and associate professor positions; procedures for revoking recognition of such positions and removing professors and associate professors from their positions (hereinafter referred to as Decision No. 37/2018/QĐ-TTg).

2. Engage in open and democratic exchange and discussion to make resolutions on issues related to the activities of the Academic Council.

Article 3. Membership Standards of the Academic Councils

1. Members of the Academic Councils are full-time and visiting lecturers at higher education institutions and practical training facilities of health-related higher education institutions in Vietnam, meeting the standards prescribed in Article 17 of Decision No. 37/2018/QĐ-TTg.

2. If members of the Academic Council no longer meet the standards prescribed herein or have been disciplined with a warning or higher penalty, the competent authority establishing the Academic Council shall decide to remove them from their positions and appoint replacements.

Article 4. Inspection and Supervision

1. The head of the higher education institution is responsible for inspecting and supervising the process of recognizing qualifications for professor and associate professor positions conducted by the Academic Council established at that institution.

2. The Ministry of Education and Training's Inspectorate, in collaboration with relevant units under the Ministry of Education and Training, will conduct inspections and supervision of the process of recognizing qualifications for professor and associate professor positions carried out by the Academic Councils; handle complaints and reports according to the law.

Article 5. Handling Violations

Collectives and individuals who cause errors or violations during the process of recognizing qualifications and appointing professor and associate professor positions, as well as revoking recognition of such positions and removing professors and associate professors from their positions, will be dealt with according to the law.

Chapter II

ORGANIZATION AND OPERATIONS OF THE BOARD NATIONAL PROFESSORS

Article 6. Duties and Authorities of the Academic Council State

1. Perform duties as prescribed in Article 14 of Decision No. 37/2018/QĐ-TTg.

2. Approve the annual plan for recognizing professor and associate professor positions proposed by the Office of the National Academic Council.

3. Annually supplement and update necessary contents in line with reality in the forms attached to Decision No. 37/2018/QĐ-TTg.

4. Advise the Chairman in determining special fields and subfields; determine the list of scientific journals and international publishers for scoring points and the list of reputable scientific journals and publishers for different groups of fields; guide the evaluation and development of domestic scientific journals.

5. Participate in building mechanisms, policies, and propose solutions to develop the professor and associate professor workforce and improve doctoral training quality.

Article 7. Organizational Structure and Appointment Procedures for Members of the National Academic Council

1. The organizational structure of the National Academic Council includes the Standing Committee and Members. The Standing Committee consists of the Chairperson, Vice-Chairpersons兼任总秘书和其他副部长，由总理任命。

2. The number of Members of the National Academic Council ensures adequacy based on the number of field Academic Councils and is appointed by the Minister of Education and Training, who is also the Chairperson of the National Academic Council.

3. The appointment procedure for Members of the National Academic Council:

a) The field Academic Council in the previous term nominates candidates for Members of the National Academic Council (Form No. 01 attached to this Regulation) and summarizes their scientific resumes (Form No. 03 attached to this Regulation). The number of nominees should not exceed the number of members of the field Academic Council in the previous term;

b) Higher education institutions nominate candidates for Members of the National Academic Council (Form No. 02 attached to this Regulation) and summarize their scientific resumes (Form No. 03 attached to this Regulation). Each field can nominate up to three (3) candidates;

c) Teachers and scientists currently teaching and researching at higher education institutions may be nominated through an online form on the website of the National Academic Council. The Chairperson of the National Academic Council directs the establishment of an appropriate online nomination method each year;

d) The Office of the National Academic Council compiles a list of nominees from sources mentioned in points a, b, and c of this clause and submits it to the Standing Committee of the National Academic Council for unification of the list of Members of the National Academic Council;

đ) Based on the unified opinion of the Standing Committee, the Office of the National Academic Council collaborates with the Department of Organization and Cadres to submit to the Minister of Education and Training, who is also the Chairperson, for the appointment of Members of the National Academic Council;

e) The list of Members of the National Academic Council and summaries of their scientific resumes are publicly announced on the website of the National Academic Council.

4. The membership of the National Academic Council may be adjusted or supplemented according to the provisions of Clause 3, Article 13 of Decision No. 37/2018/QĐ-TTg.

Article 8. Duties and Authorities of the Standing Committee of the National Academic Council

1. The Standing Committee of the National Academic Council performs duties as prescribed in Clause 1, Article 15 of Decision No. 37/2018/QĐ-TTg.

2. Approves work plans of the Academic Councils before submitting them to the Chairperson for approval.

3. Evaluates and decides on the removal of Members who fail to complete assigned tasks or violate their duties; reviews, selects, and decides on adjustments or supplements to Members of the National Academic Council according to regulations. Approves lists of qualified candidates for Members of the National Academic Council and members of field Academic Councils.

4. Organizes, directs, and guides the operations of the Academic Councils.

Article 9. Duties and Authorities of the Chairman of the State Council of Professors

1. Perform duties as prescribed in Clause 2, Article 15 of Decision No. 37/2018/QĐ-TTg.

2. Direct the implementation of the work plan of the State Council of Professors and the Sectoral Councils of Professors.

3. Direct the inspection and supervision of the activities of the Sectoral Councils of Professors and the Institutional Councils of Professors.

4. Represent the Council to sign decisions and certificates recognizing the qualification standards for professors and associate professors according to the resolutions of the State Council of Professors.

5. Participate in the activities of the State Council of Professors as a member of the Council.

6. Be entitled to remuneration as provided by law.

Article 10Duties and Authorities of the Vice-Chairman and Secretary-General of the State Council of Professors

1. Perform the duties of the Standing Committee of the Council as prescribed in Article 8 of this Circular.

2. Represent the Standing Committee of the State Council of Professors to handle regular matters of the Council and other related matters when authorized by the Chairman of the Council.

3. Organize and guide the establishment of Sectoral Councils of Professors and Institutional Councils of Professors. Organize, guide, and inspect and supervise the activities of these councils in recognizing the qualification standards for professors and associate professors.

4. Organize and implement the evaluation of the quality of scientific journals and publishers in the point calculation list of the State Council of Professors to serve the recognition of qualification standards and appointment of professor and associate professor positions.

5. Direct the development and implementation of plans to apply information technology to modernize administrative work of the Office of the State Council of Professors and Sectoral Councils of Professors; direct the development and implementation of online candidate introduction schemes for participation in the State Council of Professors and Sectoral Councils of Professors.

6. Develop work plans and budget estimates for the activities of the State Council of Professors, Sectoral Councils of Professors, and the Office of the State Council of Professors.

7. Directly manage and operate the activities of the Office of the State Council of Professors. Organize the implementation of regulations and policies for civil servants and contractual employees working at the Office according to the provisions of the law.

8. Participate in the activities of the State Council of Professors as a member of the Council.

9. Be entitled to salary and position allowance for the Vice-Chairman and Secretary-General of the State Council of Professors as provided by law.

Article 11. Duties and Authorities of the Vice-Chairman of the State Council of Professors

1. Perform the duties of the State Council of Professors as assigned by the Chairman of the State Council of Professors.

2. Represent the Chairman of the Council to handle Council matters when authorized by the Chairman of the State Council of Professors.

3. Be responsible before the Chairman of the State Council of Professors and before the law for the areas of work entrusted.

4. Participate in the activities of the State Council of Professors as a member of the Council.

5. Be entitled to remuneration as provided by law.

Article 12. Duties and Authorities of Members of the State Council of Professors

1. Handle Council matters of the State Council of Professors as assigned by the Chairman.

2. Participate in the work of the State Council of Professors as a member of the Council.

3. Be assigned tasks and appointed as Chairman of the Sectoral Council of Professors by the Chairman of the State Council of Professors, working on a concurrent basis.

4. Organize the development of directions for activities and determine specialized tasks related to the Sectoral Council of Professors under their responsibility in accordance with Decision No. 37/2018/QĐ-TTg and this Regulation, report to the Standing Committee of the State Council of Professors for approval and organize its implementation.

5. Be responsible for managing the activities of the Sectoral Council of Professors under their responsibility as stipulated.

6. Be entitled to remuneration as provided by law.

 

Chapter III

ORGANIZATION AND ACTIVITIES OF SECTORAL COUNCIL OF PROFESSORS

 

Article 13. Duties and Authorities of the Industry Academic Council

1. Perform duties and authorities as prescribed in Article 16 of Decision No. 37/2018/QĐ-TTg.

2. Receive applications from candidates assigned to the industry by the National Academic Council.

3. Review candidate files according to Clause 1 of Article 19 and Article 22 of Decision No. 37/2018/QĐ-TTg.

4. Examine the professor and associate professor titles of candidates according to Article 19 of Decision No. 37/2018/QĐ-TTg.

5. Implement the work plan of the Industry Academic Council approved by the Standing Committee of the National Academic Council.

6. Accept and process complaints and reports related to the activities of the Industry Academic Council, and report to the Standing Committee of the National Academic Council.

7. Revoke the recognition of titles or revoke the recognition of meeting the criteria for professor and associate professor titles for subjects specified in Article 29 of Decision No. 37/2018/QĐ-TTg within the assigned industry or inter-industry.

8. Advise and assist the Minister of Education and Training in reviewing doctoral dissertations that are relevant to the industry and specialty of the Industry Academic Council when requested.

Article 14. Organizational Structure and Procedures for Establishing and Appointing Members of the Industry Academic Council

1. The Industry Academic Council has from seven (7) to fifteen (15) members, including the Chairman, one Vice-Chairman, Secretary, and other members appointed by the Chairman of the National Academic Council based on annual requirements.

2. The Chairman of the Industry Academic Council is a member of the National Academic Council.

3. The number of members from the same higher education institution participating in one Industry Academic Council shall not exceed three (3).

4. Candidates applying for recognition of meeting the criteria for professor title shall not participate in the Industry Academic Council in that year.

5. Procedures for appointing members of the Industry Academic Council:

a) The procedures for nominating members of the Industry Academic Council are carried out according to points a, b, and c of Clause 3 of Article 7 of this Regulation, which can be conducted independently or combined when nominating candidates for the National Academic Council.

b) The Office of the National Academic Council compiles a list of nominees from sources mentioned in point a of Clause 5 of this Article and submits it to the Standing Committee of the National Academic Council for unified approval of the list of Industry Academic Council members, Vice-Chairman, and Secretary.

c) The Office of the National Academic Council bases on the unified opinion of the Standing Committee of the National Academic Council to submit to the Chairman of the National Academic Council for consideration and decision on establishing the Industry Academic Council, appointing the Vice-Chairman, Secretary, and members.

6. In necessary cases, the Chairman of the National Academic Council may exceptionally appoint some members of the Industry Academic Council in accordance with the requirements of the Council.

7. The list of Industry Academic Council members and summaries of their scientific resumes are publicly announced and regularly updated on the website of the National Academic Council.

8. The operating expenses of the Industry Academic Council are covered by the National Academic Council.

Article 15. Duties and Authorities of the Chairman of the Sectoral Council of Professors

1. The Chairman of the Sectoral Council of Professors shall participate in the State Council of Professors and perform duties as a member of the State Council of Professors as stipulated in Article 12 of this Regulation.

2. Chair meetings of the Sectoral Council of Professors.

3. Chair the examination of candidate standards and handle matters of the Sectoral Council of Professors in accordance with regulations.

4. Be responsible to the Chairman of the State Council of Professors and to the law for the activities of the Sectoral Council of Professors.

5. Participate in the activities of the Sectoral Council of Professors as a member of the Council.

6. Be entitled to remuneration as provided by law.

Article 16. Duties and Authorities of the Vice-Chairman of the Sectoral Council of Professors

1. Perform tasks assigned by the Chairman of the Sectoral Council of Professors.

2. Represent the Chairman of the Sectoral Council of Professors to handle matters when authorized by the Chairman of the Council.

3. Participate in the activities of the Sectoral Council of Professors as a member of the Council.

4. Receive remuneration as prescribed by law.

Article 17. Duties and Authorities of the Secretary of the Sectoral Council of Professors

1. Handle matters of the Sectoral Council of Professors as assigned by the Chairman of the Sectoral Council of Professors. Prepare reports on the examination results of the Sectoral Council of Professors to be submitted to the State Council of Professors.

2. Participate in the activities of the Sectoral Council of Professors as a member of the Council.

3. Receive remuneration as prescribed by law.

Article 18. Duties and Authorities of Members of the Sectoral Council of Professors

1. Handle matters of the Sectoral Council of Professors as assigned by the Chairman of the Council.

2. Participate in the activities of the Sectoral Council of Professors as a member of the Council.

3. Receive remuneration as prescribed by law.

Chapter IV

ORGANIZATION AND ACTIVITIES OF THE INSTITUTIONAL COUNCIL OF PROFESSORS

 

Article 19. Duties and Authorities of the Institutional Council of Professors

1. Perform duties and exercise powers as prescribed in Article 12 of Decision No. 37/2018/QĐ-TTg.

2. Coordinate with higher education institutions to develop solutions for publicizing the activities of the Institutional Council of Professors and candidates' files on the institution's website.

3. Coordinate with the Head of the Higher Education Institution to complete files and report examination results to the State Council of Professors for review and recognition of professor and associate professor qualifications.

4. Coordinate with competent state agencies to resolve complaints and denunciations regarding the examination, recognition, appointment, and removal of professor and associate professor qualifications (if applicable) in accordance with the law.

Article 20. Organizational Structure and Procedures for Establishing and Appointing Members of the Institutional Council of Professors

1. The organizational structure and procedures for establishing the Institutional Council of Professors shall be implemented in accordance with Clause 1 of Article 12 of Decision No. 37/2018/QĐ-TTg.

2. The Chairman of the Institutional Council of Professors must have the title of Professor if there are candidates applying for recognition of professor qualification.

3. The Institutional Council of Professors may use the seal of the higher education institution that established the Council.

4. Candidates applying for recognition of professor qualification shall not participate in the Institutional Council of Professors in that year.

Article 21. Conditions for Establishing the Institutional Council of Professors

1. A higher education institution has candidates who are permanent lecturers applying for recognition of professor or associate professor qualifications and has a need to establish the Institutional Council of Professors.

2. The higher education institution has completed at least three (3) master's or doctoral training programs.

3. In the preceding year immediately before the establishment of the Council, the higher education institution did not violate regulations on educational activities and scientific research.

4. The higher education institution has at least nine (9) permanent lecturers holding professor or associate professor titles. To meet the required number of members, the head of the higher education institution may invite professors and associate professors from within and outside the country who are teaching at the institution to join the Institutional Council of Professors. The number of invited members shall not exceed one-third (1/3) of the total number of Council members.

Article 22. Duties and Authorities of the Chairman of the Council Basic Professor Council

1. Chair meetings and handle matters of the Basic Professor Council as stipulated in Article 12 of Decision No. 37/2018/QĐ-TTg.

2. Be responsible under the law, to the Chairman of the National Professor Council and the head of the higher education institution establishing the Basic Professor Council regarding the examination and recognition of criteria for professor and associate professor titles by the Council.

3. Participate in the work of the Basic Professor Council as a member of the Council.

4. Explain and report to the National Professor Council and the Sectoral Professor Council on matters related to the activities of the Basic Professor Council when necessary.

5. Be entitled to remuneration as provided by law.

Article 23. Duties and Authorities of the Vice-Chairman of the Basic Professor Council

1. Carry out tasks of the Basic Professor Council according to the division of labor by the Chairman of the Council.

2. Represent the Chairman of the Basic Professor Council to handle matters when authorized by the Chairman of the Council.

3. Participate in the work of the Basic Professor Council as a member of the Council.

4. Receive remuneration as prescribed by law.

Article 24. Duties and Authorities of the Secretary of the Basic Professor Council

1. Perform tasks and handle matters of the Basic Professor Council according to the division of labor by the Chairman of the Council.

2. Supervise the working group (if necessary) established by the head of the higher education institution at the request of the Chairman of the Council.

3. Organize the receipt of candidate files, classify them by sector, and report to the Chairman of the Basic Professor Council.

4. Participate in the work of the Basic Professor Council as a member of the Council.

5. Be entitled to remuneration as provided by law.

Article 25. Duties and Authorities of the Member of the Basic Professor Council

1. Carry out tasks according to the division of labor by the Chairman of the Basic Professor Council.

2. Participate in the work of the Basic Professor Council as a member of the Council.

3. Receive remuneration as prescribed by law./.
