CIRCULAR
GUIDELINES FOR COMPETITION AND REWARD WORK IN THE CONSTRUCTION INDUSTRY
Pursuant to the Law on Competition and Reward 2003; the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward 2005 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward 2013:
Pursuant to Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing certain provisions of the Law on Competition and Reward (hereinafter referred to as Decree No. 91/2017/NĐ-CP);
Pursuant to Decree No. 81/2017/NĐ-CP dated July 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
At the proposal of the Director of the Cadre and Civil Servant Department,
The Minister of Construction issues this Circular guiding competition and reward work in the construction industry.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Circular guides competition and reward work within the construction industry.
2. This Circular applies to collectives, individuals, families of Vietnamese citizens, overseas Vietnamese, and foreign collectives and individuals who have made contributions to the construction and development of the construction industry.
Article 2. Principles and Bases for Competition and Reward
1. Competition and reward principles are implemented according to the provisions of Article 6 of the Law on Competition and Reward 2003; Clause 3, Article 1 of the Law on Competition and Reward 2013 and Article 3 of Decree No. 91/2017/NĐ-CP.
2. Bases for rewarding are implemented according to the provisions of Article 10 of the Law on Competition and Reward 2003; Article 6 of Circular No. 12/2019/TT-BNV dated November 4, 2019 of the Ministry of Home Affairs detailing certain provisions of Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing certain provisions of the Law on Competition and Reward (hereinafter referred to as Circular No. 12/2019/TT-BNV).
Article 3. Competition and Reward Councils
1. The Competition and Reward Council of the Ministry of Construction:
a) The Competition and Reward Council of the Ministry of Construction is an advisory body to the Minister regarding competition and reward work in the construction industry.
b) The Competition and Reward Council of the Ministry of Construction is established by the Minister, consisting of: The Chairman of the Council is the Minister of Construction; the Vice-Chairman in charge of regular duties is the Deputy Minister assigned to assist the Minister in overseeing competition and reward work; other Vice-Chairmen and members are decided by the Minister; the Standing Member is the Deputy Director of the Personnel Department responsible for competition and reward work.
c) The tasks and powers of the Competition and Reward Council of the Ministry of Construction are carried out according to the provisions of Article 62 of Decree No. 91/2017/NĐ-CP.
2. Competition and Reward Councils at the grassroots level:
a) Organizations with legal personality, separate bank accounts, and seals must establish a Competition and Reward Council at the grassroots level.
For other organizations, the head of the organization shall consider and decide on the establishment of a Competition and Reward Council based on actual circumstances. In cases where a Council is not established, the head of the organization shall cooperate with the party committee and relevant mass organizations at the same level to conduct the review and recommendation for rewards.
b) Grassroots-level Competition and Reward Councils are established by the heads of organizations, consisting of: The Chairman of the Council is the Head of the Organization; the Vice-Chairman and members are decided by the Head of the Organization.
c) Grassroots-level Competition and Reward Councils perform advisory functions for the head of the organization regarding competition and reward work and operate according to regulations issued by the Chairman of the Council.
Article 4. Scientific Council, Initiative Council
1. Scientific Council, Initiative Council of the Ministry of Construction:
a) The Scientific Council, Initiative Council of the Ministry of Construction shall be established by the Minister's decision.
b) The composition, tasks, and principles of operation of the Scientific Council, Initiative Council shall be decided by the Minister and implemented according to the provisions of Decree No. 13/2012/NĐ-CP dated March 2, 2012, issued by the Government on the Regulations on Initiatives (hereinafter referred to as Decree No. 13/2012/NĐ-CP), Circular No. 18/2013/TT-BKHCN dated August 1, 2013, issued by the Ministry of Science and Technology guiding the implementation of certain provisions of the Regulations on Initiatives issued under Decree No. 13/2012/NĐ-CP dated March 2, 2012, of the Government (hereinafter referred to as Circular No. 18/2013/TT-BKHCN), and related legal normative documents.
2. Scientific Council, Initiative Council at the grassroots level:
a) The Scientific Council, Initiative Council at the grassroots level shall be established by the head of the agency or unit at the same level.
b) The composition, tasks, and principles of operation of the Initiative Council at the grassroots level shall be stipulated by the head of the agency or unit at the same level and implemented according to Decree No. 13/2012/NĐ-CP, Circular No. 18/2013/TT-BKHCN, and related legal normative documents.
Article 5. Reward Fund
1. Sources and levels of contribution to the fund:
The sources of formation and levels of contribution for rewards shall be carried out according to the provisions of Articles 64 and 65 of Decree No. 91/2017/NĐ-CP and Circular No. 71/2011/TT-BTC dated May 24, 2011, issued by the Ministry of Finance guiding financial management, implementing reward systems, and related legal normative documents.
2. Management and use of the fund:
Implemented according to the provisions of Articles 66 and 67 of Decree No. 91/2017/NĐ-CP and related legal normative documents.
3. Prize money accompanying commendation titles and reward forms:
Implemented according to the provisions of Articles 66, 68, 69, 70, 71, 72, 73, and 74 of Decree No. 91/2017/NĐ-CP and related legal normative documents.
Article 6. Management of Competition and Commendation Files
1. Files managed at the Ministry of Construction:
a) The Department of Organization and Cadres shall be responsible for managing and storing files concerning commendation titles and reward forms within the authority of the Minister of Construction and above, and all other files related to competition and commendation work of the Construction sector according to the authority and responsibility for management of the Ministry of Construction.
b) The file preservation system shall be implemented according to the regulations of the law on archives.
2. Files managed at agencies and units:
Agencies and units shall be responsible for managing and storing files related to competition and commendation work according to their prescribed authority.
Chapter II
ORGANIZATION OF COMPETITION, AWARDS AND AWARD STANDARDS
Article 7. Forms and Content of Organizing Competitive Movements
1. Forms of organizing competitions shall be implemented according to the provisions of Article 4 of Decree No. 91/2017/NĐ-CP.
2. Content of organizing competitive movements shall be implemented according to the provisions of Article 5 of Decree No. 91/2017/NĐ-CP and Articles 4 and 5 of Circular No. 12/2019/TT-BNV.
3. When considering special rewards involving multiple participants, agencies and units entrusted with overseeing the special topic shall be responsible for evaluating and summarizing the competitive movement and leading the consolidation of proposed reward forms to be recommended for commendation by the Ministry of Construction and submitted for consideration for national commendation.
Article 8. Registration for Competitions
1. Agencies and units under the Construction Industry shall be responsible for organizing collective and individual registration for competitions within their agencies and units, compiling and submitting to the Ministry of Construction (the Permanent Office of the Competition and Reward Council of the Ministry of Construction) before March 15 each year.
2. For competition movements conducted in phases or on specific topics, agencies and units shall develop plans and submit their competition registration forms to the Ministry of Construction (the Permanent Office of the Competition and Reward Council of the Ministry of Construction) for monitoring and compilation.
Article 9. Honorary Titles for Competitions
According to Article 20 of the Law on Competitions and Rewards 2003, honorary titles for competitions include:
1. Honorary titles for collectives:
a) Flag of Government Competition;
b) Flag of Ministry of Construction Competition;
c) Excellent Labor Collective;
d) Advanced Labor Collective.
2. Honorary titles for individuals:
a) National Model Worker;
b) Construction Industry Model Worker;
c) Grassroots Model Worker;
d) Advanced Worker.
Article 10. Criteria for the "Flag of Government Competition" Title
Implemented according to the provisions of Article 25 of the Law on Competitions and Rewards 2003; Article 11 of Decree No. 91/2017/ND-CP and Clause 3 of Article 8 of Circular No. 12/2019/TT-BNV.
Article 11. Criteria for the "Flag of Ministry of Construction Competition" Title
The "Flag of Ministry of Construction Competition" title is awarded annually to collectives that meet the criteria stipulated in Article 26 of the Law on Competitions and Rewards 2003, Article 12 of Decree No. 91/2017/ND-CP, and Clauses 1 and 2 of Article 8 of Circular No. 12/2019/TT-BNV, including:
1. Being outstanding examples in various fields, clusters, and groups of competitions within the Construction Industry, exceeding competition targets and assigned tasks for the year;
2. Having new factors and models with significant effectiveness for other collectives in the same field to emulate;
3. Maintaining internal unity, strictly adhering to Party policies and State laws, actively practicing thrift, combating waste, corruption, and social evils.
Article 12. Criteria for the "Excellent Labor Collective" Title
The "Excellent Labor Collective" title is awarded annually to collectives that meet the criteria stipulated in Article 26 of the Law on Competitions and Rewards 2003, including:
1. Innovatively overcoming difficulties to excellently complete assigned tasks and fulfill all obligations to the State;
2. Having ongoing, practical, and effective competition movements;
3. All individuals within the collective completing assigned tasks, with at least 70% of them achieving the "Advanced Worker" title;
4. Having individuals who achieve the "Grassroots Model Worker" title and no individuals being disciplined with warnings or higher penalties;
5. Maintaining internal unity and exemplary adherence to Party policies and State laws.
Article 13. Criteria for the "Advanced Labor Collective" Title
The "Advanced Labor Collective" title is awarded annually to collectives that meet the criteria stipulated in Article 28 of the Law on Competitions and Rewards 2003, including:
1. Successfully completing assigned tasks and plans for the year;
2. Having ongoing, practical, and effective competition movements;
3. Over 50% of individuals within the collective achieving the "Advanced Worker" title and no individuals being disciplined with warnings or higher penalties;
4. Maintaining internal unity and exemplary adherence to Party policies and State laws.
Article 14. Criteria for the title "National Model Worker"
1. The criteria for the title "National Model Worker" shall be implemented in accordance with Clause 1, Article 9 of Decree No. 91/2017/ND-CP and current guiding documents.
2. The time for conferring the title "National Model Worker" is the year immediately following the second consecutive year of receiving the title "Construction Industry Model Worker".
Article 15. Criteria for the title "Construction Industry Model Worker"
The title "Construction Industry Model Worker" shall be conferred on individuals who meet the criteria stipulated in Clause 2, Article 9 of Decree No. 91/2017/ND-CP, including:
1. Having outstanding achievements among those who have continuously received the title "Model Worker at the grassroots level" three times.
2. Proposing technical solutions, management solutions, work solutions, operational solutions, or applying advanced technology to increase labor productivity and work efficiency, recognized by the Ministry's Creativity Council or research topics that have been accepted and applied in practice, recognized by the Ministry's Creativity Council, or winning first place in Ministry-level or national competitions, having an impact within the industry.
3. The time for conferring the title "Construction Industry Model Worker" is the third year of receiving the title "Model Worker at the grassroots level".
Article 16. Criteria for the title "Model Worker at the Grassroots Level"
1. The title "Model Worker at the Grassroots Level" shall be conferred annually on individuals who meet the criteria stipulated in Clause 3, Article 9 of Decree No. 91/2017/ND-CP and Article 7 of Circular No. 12/2019/TT-BNV, including:
a) Being exemplary among individuals who have received the title "Advanced Worker";
b) Proposing technical solutions, management solutions, work solutions, operational solutions, or applying advanced technology to increase labor productivity and work efficiency, or having research topics that have been accepted and applied in practice, recognized by the grassroots level.
2. The assessment of the impact of creativity and research topics is conducted by the grassroots level Creativity and Science Council to assist the head of the agency or unit in considering and recognizing them.
3. The proportion of individuals recognized with the title "Model Worker at the Grassroots Level" shall not exceed 15% of the total number of individuals who have received the title "Advanced Worker".
Article 17. Criteria for the title "Advanced Worker"
1. The title "Advanced Worker" shall be conferred on individuals who meet the criteria stipulated in Article 23 of the Law on Encouragement and Reward in 2003 and Clause 10, Article 10 of Decree No. 91/2017/ND-CP, including:
a) Completing assigned tasks well, achieving high productivity and quality;
b) Adhering to Party policies and State laws, demonstrating self-reliance and self-strengthening spirit, being united and supportive, actively participating in competitive movements;
c) Actively studying politics, culture, professional knowledge, and vocational skills;
d) Having a healthy lifestyle and moral conduct.
2. The title "Advanced Worker" shall be conferred on individuals who bravely rescue people or property, resulting in injuries requiring treatment or convalescence, with the treatment and convalescence period counted towards the evaluation for the title "Advanced Worker".
3. Individuals sent for short-term training or development under 12 months, who comply with the regulations of the training or development institution, shall have their study period counted towards their service time at the agency or unit for the evaluation of the title "Advanced Worker". In cases where individuals are sent for training or development for one year or more, who comply with the regulations of the training or development institution and achieve good grades or higher, they may be conferred the title "Advanced Worker".
4. Maternity leave in accordance with regulations shall be counted towards the evaluation for the title "Advanced Worker".
5. For individuals transferred to new agencies or units; the new agency or unit is responsible for evaluating and electing the title "Advanced Worker" (in cases where the individual has worked at the previous unit for six months or more, opinions from the previous unit must be obtained).
6. In cases where individuals are temporarily transferred or detailed to other agencies or units, the evaluation and election of the title "Advanced Worker" shall be decided by the agency or unit that transferred or detailed the individual (with comments from the agency or unit receiving the individual).
7. The title "Advanced Worker" shall not be conferred in any of the following cases:
a) Newly recruited for less than ten months;
b) Disciplined with a warning or higher.
Chapter III
FORMS, OBJECTS AND CRITERIA FOR REWARDS
Article 18. Forms of Reward
According to the Law on Encouragement and Reward in 2003, forms of reward include:
1. National-level reward forms:
a) Orders;
b) Medals;
c) State Honorary Titles;
d) Ho Chi Minh Prize, State Prize;
đ) Certificate of Merit from the Prime Minister.
2. Ministry-level reward forms:
a) Commemorative Medal "For Construction";
b) Certificate of Merit from the Minister of Construction;
3. Organizational-level reward forms:
Certificate of Merit from the head of the unit under the Ministry with legal personality status.
Article 19. Recipients and Standards for State Honorary Titles, High Prizes, Orders, Medals, and Certificates of Merit from the Prime Minister
Implemented according to the Law on Encouragement and Reward in 2003, Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government, Circular No. 12/2019/TT-BNV dated November 4, 2019 of the Ministry of Home Affairs, and related legal normative documents.
Article 20. Commemorative Medal "For Construction"
1. The Commemorative Medal "For Construction" is awarded to individuals who have worked or are currently working in the Construction sector and meet one of the following criteria:
a) Leaders and former leaders of the Ministry of Construction;
b) Individuals honored with the title of Heroic Laborer;
c) Individuals evaluated by their superiors as having successfully completed assigned tasks and having a certain tenure in service.
- For males: Having continuously served for 20 years in the Construction Industry or a total service period of 25 years, including 15 continuous years in the Construction Industry;
- For females: Having continuously served for 15 years in the Construction Industry or a total service period of 20 years, including 10 continuous years in the Construction Industry.
2. The Commemorative Medal "For Construction" is awarded to individuals outside the Construction sector who meet one of the following criteria:
a) Leaders of central and local agencies, departments, ministries, and mass organizations who have contributed significantly to the development of the Construction sector;
b) Individuals with innovative ideas, solutions, or scientific projects recognized by competent state authorities and applied effectively in the Construction sector;
c) Individuals residing abroad or foreigners who have made outstanding contributions to building and strengthening cooperation between countries and international organizations with the Vietnamese Construction sector, actively contributing to the development of Construction in Vietnam;
d) Individuals who have made significant contributions and provided effective support to the development of the Construction Industry.
3. For individuals who have retired from the Construction sector, the retirement management authority is responsible for confirming and preparing files to submit to the Minister of Construction for consideration and awarding the Commemorative Medal "For Construction" as prescribed. In cases where the organization has been dissolved or merged, the successor organization is responsible for confirming and preparing files to submit to the Minister of Construction for consideration and decision.
4. Other cases are decided by the Minister of Construction.
5. The Commemorative Medal "For Construction" is awarded once to an individual and not posthumously. The awarding process takes place annually on the occasion of the Traditional Day of the Construction Industry (April 29) and National Day (September 2) or may be awarded exceptionally at the discretion of the Minister of Construction.
Article 21. Certificate of Merit from the Minister of Construction
1. The "Certificate of Merit from the Minister of Construction" is awarded to exemplary collectives that have conscientiously implemented Party policies, state laws, and regulations, meeting the standards set forth in Article 72 of the Law on Encouragement and Reward in 2003 and Article 39 of Decree No. 91/2017/NĐ-CP, and meeting one of the following criteria:
a) Achieving outstanding results in competitions initiated by the Minister of Construction;
b) Achieving outstanding results with significant impact in specific areas of the Construction sector;
c) Consistently performing excellently for two consecutive years immediately preceding the year of commendation, maintaining internal unity, implementing democratic regulations at the grassroots level, organizing effective competition activities, caring for the material and spiritual well-being of members, practicing thrift, fulfilling all obligations to the state, and implementing policies for workers.
2. The "Certificate of Merit from the Minister of Construction" is awarded to exemplary individuals who have conscientiously implemented Party policies, state laws, and regulations, meeting the standards set forth in Article 39 of Decree No. 91/2017/NĐ-CP, including:
a) Achieving outstanding results in competitions initiated by the Minister of Construction annually;
b) Achieving many notable results (or outstanding results) with significant impact in one of the sectors within the Construction sector;
c) Consistently performing excellently for two consecutive years immediately preceding the year of commendation, during which time they have two recognized and effectively applied scientific initiatives or topics at the organizational level.
3. The "Certificate of Merit from the Minister of Construction" is awarded to exemplary workers who have conscientiously implemented Party policies, state laws, and regulations, meeting one of the following criteria:
a) Achieving many notable results in labor and production with significant impact within the organization;
b) Workers with innovative ideas or solutions that bring high value benefits with significant impact within the organization.
4. The "Certificate of Merit from the Minister of Construction" is awarded to collectives and individuals outside the Construction sector who have made many notable contributions and provided substantial support to the development of the Construction sector, confirmed by competent authorities.
5. The "Certificate of Merit from the Minister of Construction" is awarded to exemplary families who have conscientiously implemented Party policies, state laws, and regulations, making many contributions to the development of the Construction sector.
6. Other commendation cases are decided by the Minister.
Article 22. Commendation Certificate
The commendation certificate of the head of the agency or unit under the Ministry shall be awarded to collectives and individuals within their management authority according to the provisions of Article 76 of the Law on Competition and Reward in 2003; Clauses 41 and 42 of Article 2 of the Law on Competition and Reward in 2013; and Clauses 1 and 3 of Article 40 of Decree No. 91/2017/ND-CP.
Article 23. Reward for Dedication Process
The criteria, time, and procedures for considering rewards for dedication processes for individuals shall be implemented according to the provisions of Articles 41 and 42 of Decree No. 91/2017/ND-CP and the provisions of Article 10 of Circular No. 12/2019/TT-BNV.
Chapter IV
AUTHORITY TO DECIDE AND BESTOW; PROCEDURES AND FILES FOR CONSIDERING AWARDS OF COMPETITION TITLES AND REWARD FORMS
Section 1. AUTHORITY TO DECIDE AND BESTOW COMPETITION TITLES AND REWARD FORMS
Article 24. Authority to Decide on Bestowing Competition Titles and Reward Forms
1. The authority to decide on bestowing competition titles and reward forms of the President, Government, and Prime Minister shall be carried out according to the provisions of Articles 77 and 78 of the Law on Competition and Reward dated November 26, 2003; Clauses 45 and 46 of Article 2 of Law No. 39/2013/QH13 dated November 16, 2013 amending and supplementing certain articles of the Law on Competition and Reward; and Articles 43 and 44 of Decree No. 91/2017/ND-CP.
2. The Minister of Construction decides to bestow:
a) The "Flag of Competition of the Ministry of Construction";
b) The title "Outstanding Labor Collective";
c) The title "Construction Industry Model Competitor";
d) The Merit Award of the Minister of Construction;
đ) The Commemorative Medal "For the Construction Cause";
e) The titles "Model Competitor at the Grassroots Level", "Advanced Worker", and "Advanced Labor Collective" for collectives and individuals under the Departments and the Office of the Party and Mass Organizations.
3. The heads of agencies and units with legal entity status, having bank accounts, and separate seals decide to bestow:
a) The title "Advanced Labor Collective";
b) The title "Model Worker at the Grassroots Level";
c) The title "Advanced Worker";
d) Commendation Certificate.
Article 25. Bestowing Competition Titles and Reward Forms
1. The person authorized to decide on bestowing a particular reward form shall directly present it or delegate someone else to present it.
2. The announcement, presentation, and acceptance of competition titles and reward forms shall be conducted according to the provisions of Decree No. 145/2013/ND-CP dated October 29, 2013 of the Government regarding the organization of commemorative days; the ceremony for presenting and accepting reward forms and competition titles; and diplomatic rituals and welcoming foreign guests.
3. Organizing the presentation of competition titles and reward forms is an opportunity to highlight good people, good deeds, and exemplary models, which should be combined with other events of the agency or unit, ensuring solemnity, practicality, and economy.
4. The Standing Office of the Competition and Reward Council of the Ministry of Construction shall take the lead and coordinate with relevant agencies and units to advise the Minister on organizing the presentation of national-level competition titles and reward forms and those within the Minister's authority.
Section 2. PROCEDURES AND DOCUMENTS FOR AWARDS AND REWARDS, FORMS OF RECOGNITION
Article 26. Procedures for Recognition and Awards
Pursuant to Article 46 of Decree No. 91/2017/NĐ-CP, procedures for recognition and awards include:
1. The level that manages organizational structure, cadres, civil servants, public officials, employees, and salary funds shall be responsible for recognizing and awarding or submitting to the competent authority for recognition and awarding those within its management scope.
2. The level that leads the initiation of competition movements shall select outstanding individuals and groups for recognition and awarding or propose to the competent authority for recognition and awarding.
3. Professional associations under the sectors managed by the Ministry of Construction shall be recognized and awarded by the Ministry of Construction or submitted to the competent authority for recognition and awarding.
4. Procedures for recognition and awarding for enterprises:
a) For state-owned enterprises under the management of the Ministry of Construction, they shall be recognized and awarded by the Ministry of Construction or submitted to the competent authority for recognition and awarding;
b) For enterprises where the State holds more than 50% of the charter capital under the management of the Ministry of Construction, they shall be recognized and awarded by the Ministry of Construction or submitted to the competent authority for recognition and awarding;
c) For enterprises where the State holds less than 50% of the charter capital, the provisions at point d, Clause 6, Article 46 of Decree No. 91/2017/NĐ-CP shall apply;
The Ministry of Construction shall recognize and award groups and individuals from enterprises where the State holds less than 50% of the charter capital who participate in annual competition movements organized and initiated by the Ministry of Construction.
d) For other types of enterprises: The procedures for recognition and awarding shall follow the provisions at point a, Clause 6, Article 46 of Decree No. 91/2017/NĐ-CP and the provisions at Clause 3, Article 10 of Circular No. 12/2019/TT-BNV.
5. For individual workers with outstanding achievements, the Vietnam Construction Union shall compile and submit to the Ministry of Construction for recognition and awarding during the annual Workers' Month.
6. Units with foreign nationals participating in cooperation shall be responsible for submitting recognition and awards for foreign groups and individuals who have made significant contributions to the construction industry.
7. Recognition and awards for leaders of the Ministry of Construction: The Office of the Competition and Award Council of the Ministry of Construction shall propose commendation titles and forms of recognition and awards to the Competition and Award Council of the Ministry of Construction for examination and submission to the State for recognition and awarding of leaders of the Ministry of Construction.
8. Recognition and awards for leaders of central ministries, departments, agencies, and mass organizations: The Office of the Competition and Award Council of the Ministry of Construction shall coordinate with relevant agencies and units to submit to the Minister of Construction for examination and decision.
9. Other cases shall be examined and decided by the Minister of Construction.
Article 27. Documents for Proposing National-Level Recognition and Awards
1. Components of documents for proposing national-level recognition and awards shall comply with the provisions of Articles 49, 51, 52, 54, 55, 56, and 57 of Decree No. 91/2017/NĐ-CP and the attached models of achievement reports under Decree No. 91/2017/NĐ-CP.
2. Number of documents submitted to the Ministry of Construction for proposing national recognition and awards:
a) Documents for proposing the title "National Labor Medalist": three sets (originals);
b) Documents for proposing the flag "Government Competition Flag": three sets (originals);
c) Documents for proposing various types of Orders: four sets (originals);
d) Documents for proposing Medals: four sets (originals);
đ) Documents for proposing simple recognition and awards: four sets (originals);
e) Documents for proposing the title "Heroic Laborer": four sets (originals);
g) Documents for proposing the certificate "Prime Minister's Commendation": three sets (originals).
Article 28. Application for Merit Award at the Ministry Level
1. The application dossier for considering the award of the "Ministry of Construction Flag of Excellence" includes one original set (as prescribed in Clause 2, Article 50 of Decree No. 91/2017/NĐ-CP), including:
a) The proposal letter from the unit accompanied by the list of collectives proposed for commendation;
b) The minutes of the meeting to consider commendation of the Competition and Commendation Council at the level proposing commendation;
c) The report on achievements of the collective proposed for commendation with confirmation from the level proposing commendation;
d) The confirmation document from the competent tax management agency regarding the completion of the obligation to pay state budget by the collective proposed for commendation (for agencies, organizations, units subject to state budget payment obligations proposed for commendation);
đ) The evaluation and assessment document from the People's Committee of the province/city directly under the central government where the unit has its headquarters regarding the implementation of tasks by the unit proposed for commendation (for Departments under the Construction Sector); The confirmation document from the People's Committee of the ward/village where the unit has its headquarters regarding the implementation of Party guidelines, state policies, and laws by the unit at the local level (for organizations, agencies, units, enterprises not directly under the Ministry of Construction);
2. The application dossier for considering the award of the "Outstanding Labor Collective" includes one original set (as prescribed in Clause 2, Article 50 of Decree No. 91/2017/NĐ-CP), including:
a) The proposal letter from the unit accompanied by the list of collectives proposed for commendation;
b) The minutes of the meeting to consider commendation of the Competition and Commendation Council at the level proposing commendation;

e) The confirmation document from the competent tax management agency regarding the completion of the obligation to pay state budget to the State by the unit (for individuals who are heads of units subject to state budget payment obligations proposed for commendation);
5. The application dossier for considering the award of the "For the Construction Cause" Commemorative Medal includes one original set, including:
a) The proposal letter from the unit accompanied by the list of individuals proposed for commendation;
b) The minutes of the meeting to consider commendation of the Competition and Commendation Council at the level proposing commendation;
c) The summary report on achievements of the individual proposed for commendation with confirmation from the level proposing commendation;
6. The application dossier for extraordinary commendation or for cases of commendation discovered by the head of the agency, organization, or unit; foreign affairs commendation (simplified procedures), includes one original set, including:
a) The proposal letter from the unit accompanied by the list of collectives and individuals proposed for commendation;
b) The summary report on achievements of the directly managed agency or unit, clearly stating the actions, achievements, merits of the collectives and individuals proposed for commendation;
7. The application dossier for commendation according to special topics (or competition periods), includes one original set, including:
a) The proposal letter from the unit accompanied by the list of individuals and collectives proposed for commendation;
b) The minutes of the meeting to consider commendation of the Competition and Commendation Council at the level proposing commendation;
c) The report on achievements of the collectives and individuals proposed for commendation with confirmation from the level proposing commendation;
d) The final report on the competition movement according to the period or special topic of the unit proposed for commendation;
đ) The confirmation document from the competent tax management agency regarding the completion of the obligation to pay state budget to the State (for agencies, organizations, units subject to state budget payment obligations or individuals who are heads of units proposed for commendation);
8. The application dossier for commendation of foreign collectives and individuals and Vietnamese collectives and individuals abroad, includes four original sets (for national-level commendation) and one original set (for ministry-level commendation), including:
a) The proposal letter from the unit accompanied by the list of collectives and individuals proposed for commendation;
b) The minutes of the meeting of the Competition and Commendation Council at the level proposing commendation;
c) The report on achievements of the collectives and individuals implemented by the proposing agency with confirmation from the level proposing commendation;
d) The confirmation document from the competent authority regarding the completion of the obligation to pay state budget to Vietnam according to the law (for agencies, organizations, units subject to state budget payment obligations or individuals who are heads of units proposed for commendation);
đ) The opinion of the International Cooperation Department for cases proposed for ministry-level commendation.
Article 29. Time for Accepting Nomination Files for Awards
Agencies and units shall submit nomination files for awards to the Ministry of Construction (Department of Organization and Cadres - Permanent Office of the Ministry of Construction's Mobilization and Commendation Council) along with electronic documents (in .doc format for reports, lists, and summary achievement reports; in .pdf format for other related documents) to the email address: [email protected] (in case of submission via post, the time will be calculated based on the postmark) according to the following specified times:
1. Time for accepting nomination files for awards based on achievements and merits:
a) Title of "Heroic Labor": Submission of nomination files for awards before August 15 of the year immediately preceding the year of the National Mobilization Congress of the Construction Industry.
b) Title of "National Model Worker": Submission of nomination files for awards before June 15 each year.
The time for submitting to the Ministry of Construction for examination and recommendation to the Prime Minister for awarding the title of "National Model Worker" is the year immediately following the year in which the decision recognizing the title of Model Worker at the ministry, department, provincial level, or central mass organizations is made.
c) Orders, Medals, and Certificates of Merit from the Prime Minister: Submission of nomination files for awards before April 15 each year.
For educational and training institutions: Submission of nomination files for awards before August 15 each year.
d) Flag of Excellence from the Government, Flag of Excellence from the Ministry of Construction: Submission of nomination files for awards before February 15 each year.
đ) Title of "Model Worker of the Construction Industry", "Outstanding Labor Collective", Certificate of Merit from the Minister of Construction: Submission of nomination files for awards before March 15 each year.
For educational and training institutions: Submission of nomination files for awards before August 15 each year.
e) Titles of "Advanced Labor Collective", "Model Worker at the Grassroots Level", "Advanced Worker" (for Departments, Party and Mass Organizations' Offices): Submission of nomination files for awards before February 15 each year.
2. Time for accepting nomination files for awarding the "Memorial Medal for the Construction Cause":
a) First round: Submission of nomination files for awards before March 15 each year;
b) Second round: Submission of nomination files for awards before August 15 each year.
3. Time for accepting nomination files for outstanding and sudden awards, batch awards, and topic-specific awards:
Units shall submit nomination files for awards no later than 15 days after the collectives or individuals have achieved outstanding and sudden merits or after the completion of the competition period or specific topic work.
4. Time for accepting nomination files for awards recognizing long-term contributions:
Units shall submit to the Ministry of Construction for examination and recommendation to the State for awards recognizing long-term contributions after the decision announcing retirement benefits for the individual has been issued.
5. Time for accepting nomination files for foreign awards and other cases: Submission of nomination files for awards 20 working days prior to the planned award ceremony date.
6. For national honors and high-level awards, implementation shall follow the provisions of the Law on Mobilization and Commendation, Decree No. 91/2017/ND-CP, Circular No. 12/2019/TT-BNV, and other relevant legal documents.
Article 30. Procedures and Formalities for Award Examination
1. Procedures and formalities for awarding national honors and state prizes:
Implementation shall follow the provisions of the Law on Mobilization and Commendation, Decree No. 91/2017/ND-CP, Circular No. 12/2019/TT-BNV, and other relevant legal documents.
2. Procedures and formalities for awarding titles such as Heroic Labor, National Model Worker, Orders, Friendship Medals, Certificates of Merit from the Prime Minister, Flags of Excellence from the Government and the Ministry of Construction, and Model Worker of the Construction Industry:
a) Units shall submit nomination files for awards to the Ministry of Construction (Permanent Office of the Ministry of Construction's Mobilization and Commendation Council) as prescribed.
b) After receiving the files, the Permanent Office of the Ministry of Construction's Mobilization and Commendation Council shall review and widely seek opinions on the list of collectives and individuals nominated for Orders, national honors, state prizes, and the title of National Model Worker, which will be published on information media under the Ministry's jurisdiction (electronic portal, magazine, industry newspaper) before submitting to the Ministry's Mobilization and Commendation Council for examination and awarding.
c) Compile and submit to the Ministry of Construction's Mobilization and Commendation Council for examination and recommendation to the State for awarding to collectives and individuals as prescribed.
d) For national honors, state prizes, the title of National Model Worker, and Independence Orders: The Permanent Office of the Ministry of Construction's Mobilization and Commendation Council shall seek the opinion of the Party Committee of the Ministry of Construction before submitting to the Prime Minister.
đ) Based on the conclusions of the Ministry of Construction's Mobilization and Commendation Council, the Permanent Office of the Ministry of Construction's Mobilization and Commendation Council shall complete the files and submit them to the Prime Minister.
e) After receiving the results of the awards from the Central Mobilization and Commendation Board and the award decisions, the Permanent Office of the Ministry of Construction's Mobilization and Commendation Council shall notify and send the award results to the awardees.
3. Procedures and formalities for awarding Memorial Medals for the Construction Cause, Certificates of Merit from the Minister of Construction, Outstanding Labor Collectives, Model Workers at the Grassroots Level, and Advanced Workers (for units without legal entity status):
a) Units shall submit nomination files for awards to the Ministry of Construction (through the Permanent Office of the Ministry of Construction's Mobilization and Commendation Council) as prescribed.
b) After receiving the files, the Permanent Office of the Ministry of Construction's Mobilization and Commendation Council shall review and compile the nomination files for awards of collectives and individuals and seek opinions from related units (if necessary) before submitting to the Minister for consideration and decision.
c) The Permanent Office of the Ministry of Construction's Mobilization and Commendation Council shall notify the award results.
4. Procedures and formalities for awarding sudden awards, batch awards, topic-specific awards, or awards for collectives and individuals outside the Construction Industry:
a) Units shall submit nomination files for awards to the Ministry of Construction (Permanent Office of the Ministry of Construction's Mobilization and Commendation Council) as prescribed.
b) After receiving the dossier, the Permanent Office of the Department of Competition and Rewards of the Ministry of Construction shall conduct an examination, compile the dossier recommending rewards for collectives and individuals, and seek opinions from related units (if necessary) before submitting to the Minister of Construction for consideration and decision.
c) The Permanent Office of the Ministry of Construction's Mobilization and Commendation Council shall notify the award results.
Chapter V
IMPLEMENTATION
Article 31. Organization and machinery for implementing competition and reward work
1. The Cadre and Civil Servant Affairs Department serves as the Permanent Office of the Department of Competition and Rewards of the Ministry of Construction, with the function of:
a) Advising the Minister of Construction and the Department of Competition and Rewards of the Ministry of Construction on performing state management functions regarding competition and reward work, directing and organizing the implementation of competition and reward work within the Construction sector;
b) Monitoring, guiding, inspecting, urging, and periodically reporting to the Department of Competition and Rewards of the Ministry of Construction on the results of competition and reward work in the sector.
2. Agencies and units under the Construction sector shall allocate staff to monitor and implement competition and reward work at their units in accordance with regulations.
Article 32. Responsibilities of agencies and units
1. The Minister of Construction directs all aspects of competition and reward work in the Construction sector.
2. The Permanent Office of the Department of Competition and Rewards of the Ministry of Construction shall be responsible for advising and proposing to the leadership of the Ministry on policies, contents, programs, and plans for competition and reward work; organizing the implementation, summarizing, concluding, and inspecting competition and reward work; proposing rewards and suggesting improvements to competition and reward work.
3. Heads of agencies and units under the Construction sector shall be responsible for coordinating with peer-level mass organizations to launch, direct, and organize competition movements within their areas of management; summarizing, concluding, and evaluating the results of competition movements; actively identifying and selecting collectives and individuals with meritorious achievements for rewards or recommending them to competent authorities for rewards; organizing publicity, showcasing exemplary models, good people, and good deeds, and promoting advanced examples.
4. Heads of agencies and units under the Construction sector shall be responsible for directing and inspecting competition and reward work within their authority and shall be accountable to the Minister of Construction for the quality of competition and reward work managed by their units.
5. News and communication agencies under the Construction sector shall be responsible for accurately reflecting the results of competition movements and reward work; regularly publicizing the Party's policies and state laws on competition and reward; identifying collectives and individuals with outstanding achievements in competition movements; praising, honoring, and showcasing exemplary models, good people, and good deeds; combating violations of laws on competition and reward.
6. Agencies and units shall implement administrative reform, apply information technology, and modernize management and implementation of competition and reward work.
7. Every six months and annually, agencies and units shall organize summaries and conclusions to evaluate the results of competition and reward work and submit reports to the Ministry of Construction (Permanent Office of the Department of Competition and Rewards of the Ministry of Construction) in accordance with regulations:
Deadline for submission of reports: Reports on the mid-year summary of competition and reward work shall be submitted before June 15 each year, and annual summary reports on competition and reward work shall be submitted before December 15 each year.
8. When organizing, launching, and concluding competition movements, competition campaigns, and specialized work sessions, units shall send plans and reports on the implementation results to the Ministry of Construction (Permanent Office of the Department of Competition and Rewards of the Ministry of Construction) for monitoring and as a basis for awarding rewards.
Article 33. Handling violations and resolving complaints and reports
Implement according to the provisions of Articles 96, 97, 98 of the Law on Encouragement of Competition and Merit Awarding 2003 and Article 78, 79 of Decree No. 91/2017/NĐ-CP and related regulatory legal documents.
Article 34. Effective Date
This Circular takes effect from February 15, 2021 and replaces Circular No. 06/2015/TT-BXD dated October 30, 2015 issued by the Minister of Construction guiding competition and merit awarding work in the Construction sector.
Article 35. Responsibility for Implementation
1. The Competition and Merit Awarding Council of the Ministry of Construction, heads of agencies and units under the Construction sector, and relevant organizations and individuals shall be responsible for implementing this Circular.
2. The Standing Office of the Competition and Merit Awarding Council of the Ministry of Construction shall take the lead in advising the Minister of Construction to guide, inspect, and urge agencies and units under the Construction sector to implement this Circular.
3. In the course of implementation, if any difficulties arise, agencies and units shall report them to the Ministry of Construction (Standing Office of the Competition and Merit Awarding Council of the Ministry of Construction) for coordination and resolution.
