Guidelines for Exporting Construction Materials Minerals

Pursuant to Decree No. 81/2017/NĐ-CP dated July 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
Pursuant to Decree No. 09/2021/NĐ-CP dated February 9, 2021 of the Government on construction materials management;
Implementing Directive No. 38/CT-TTg dated September 29, 2020 The Government Prime Minister von further strengthening state management over exploration, exploitation, processing, utilization, and export of minerals;
At the proposal of the Director of the Construction Materials Department;
The Minister of Construction issues this Circular on guidelines for exporting construction materials minerals.
Article 1. Scope of Regulation and Applicability
Article 1. This Circular guides the list, specifications, technical criteria, and origin of construction materials minerals for export.
Article 2. This Circular applies to organizations and individuals, both domestic and foreign, involved in the export of construction materials minerals in Vietnam (except cases where construction materials minerals from within the country are brought into tax-free zones or customs-specific areas for construction, repair, and maintenance of structures).
Article 2. Interpretation of Terms
In this Circular, the following terms shall be understood as follows:
Point 1. Mineral processing is the process of using separate or combined mechanical, physical, and chemical methods to alter the properties of minerals after mining to produce products with specifications and technical criteria suitable for use and higher commercial value than post-mining minerals.
Point 2. Natural stone blocks for cladding are natural stones extracted from igneous, sedimentary, or metamorphic rock mines that create products with flat surfaces, block shapes, without cracks, and a volume ≥ 0.4 m³.
Point 3. Cladding stones are types of stones processed from natural stone blocks into sheet products (compliant with National Standard TCVN 4732:2016 natural cladding stones) used for cladding and paving in construction projects.
Point 4. Construction stones are types of stones extracted from natural stone mines (listed under the common construction materials mineral catalog according to the law on minerals) processed into products used in construction projects.
Point 5. Artistic stones are types of stones extracted from natural stone mines processed into artistic products with non-standard sizes.
Article 3. Origin, List, Specifications, and Technical Criteria of Construction Materials Minerals for Export
Clause 1. Legally sourced construction materials minerals for export include minerals mined according to mining permits, mining tailings permits, or mining decisions issued by competent authorities and still valid according to the law on minerals.
Clause 2. The list, specifications, and technical criteria of various construction materials minerals for export are stipulated in Appendix I of this Circular (excluding temporarily imported-reexported, transshipped, or transit minerals).
Article 4. Effective date
This Circular takes effect from August 28, 2021, and replaces Circular No. 05/2018/TT-BXD dated June 29, 2018, of the Minister of Construction on guidelines for exporting construction materials minerals and Circular No. 05/2019/TT-BXD dated October 10, 2019, of the Minister of Construction amending and supplementing the appendix of Circular No. 05/2018/TT-BXD dated June 29, 2018, of the Minister of Construction on guidelines for exporting construction materials minerals.
Article 5. Responsibility for Implementation and Organization of Execution
Clause 1. The Ministry of Construction is responsible for implementing, guiding, and monitoring the implementation of this Circular; coordinating with relevant ministries and sectors to organize regular or spot checks on compliance with laws in the export of construction materials minerals in localities.
Clause 2. Provincial People's Committees are responsible for directing competent agencies to conduct regular or spot checks on the export of construction materials minerals according to the law. They must report annually (or promptly when required by authorized agencies) on the situation of mineral exports according to the model specified in Appendix II of this Circular before January 30 each year for the Ministry of Construction to compile and report.
Clause 3. Export enterprises must prepare annual reports (or promptly when required by authorized agencies) to send to the Construction Department for reporting to the provincial People's Committee (where the enterprise has export activities) according to the model specified in Appendix II of this Circular before January 15 each year.
Clause 4. During implementation, if there are difficulties, ministries, sectors, localities, organizations, and individuals should promptly reflect them to the Ministry of Construction for consideration and resolution./.
