CIRCULAR
Guidelines on the functions, tasks, and powers of specialized agencies
relating to industry and trade under the People's Committee of the province, centrally governed city, and the People's Committee of the district, town, city under provincial administration, and city under central administration.

Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
WHEREAS, Decree No. 24/2014/ND-CP dated April 4, 2014 of the Government stipulates the organization of specialized agencies under the People's Committee of the province, centrally governed city, and Decree No. 107/2020/ND-CP dated September 14, 2020 of the Government amends and supplements certain articles of Decree No. 24/2014/ND-CP;
On the basis of Decree No. 37/2014/NĐ-CP dated May 5, 2014 of the Government stipulating the organization of specialized agencies under district, town, and city People's Committees under provinces and central city People's Committees, and Decree No. 108/2020/NĐ-CP dated September 14, 2020 of the Government amending and supplementing certain articles of Decree No. 37/2014/ND-CP;
The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.
The Minister of Industry and Trade promulgates this Circular guiding the functions, tasks, powers of the specialized agency on industry and trade under the People's Committee of the province, centrally governed city (referred to collectively as provincial level), and the People's Committee of the district, town, city under provincial administration, and city under central administration (referred to collectively as district level).
PART I
DEPARTMENT OF INDUSTRY AND TRADE
Article 1. Position and Functions
1. The Department of Industry and Trade is a specialized agency under the People's Committee at the provincial level; it performs the function of advising and assisting the People's Committee at the provincial level in managing state affairs in industry and trade, including industries and sectors such as machinery; metallurgy; electricity; new energy; renewable energy; energy use efficiency; oil and gas (if applicable); chemicals; industrial explosives; mining and mineral processing industry (excluding common construction materials); consumer goods industry; food industry; supporting industry; environmental industry; other processing industries; small-scale handicrafts; promoting small-scale handicrafts; commercial activities and commodity circulation within the administrative region; sustainable production and consumption; export and import; border trade (for provinces with borders); trade promotion; e-commerce; trade services; competition management; protecting consumer rights and managing multi-level marketing business activities; trade defense; international economic integration; management of industrial clusters within the administrative region.
2. The Department of Industry and Trade has legal personality, its own seal and separate account; it complies with the directives and management regarding organization, staffing, and work of the People's Committee at the provincial level, while also complying with the directives, inspection, and guidance on professional matters from the Ministry of Industry and Trade.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit to the provincial People's Committee:
a) Draft decisions of the People's Committee at the provincial level related to industries and sectors under the management of the Department of Industry and Trade and other documents as assigned by the People's Committee at the provincial level;
b) Draft plans for industry and sector development; programs, projects, proposals; measures to organize and implement tasks related to industries and sectors within the provincial administrative region under the management of the Department of Industry and Trade;
c) Draft decisions on the delegation of state management tasks in industry and trade to the Department of Industry and Trade and the People's Committee at the district level;
d) Draft decisions detailing the functions, tasks, powers, and organizational structure of the Department of Industry and Trade; draft decisions detailing the functions, tasks, powers, and organizational structure of public service units under the Department of Industry and Trade;
đ) Draft decisions on implementing socialization of activities providing public services in the industry and trade sector within the authority of the People's Committee at the provincial level and according to the delegation from higher-level state agencies.
2. Submit to the Chairman of the People's Committee at the provincial level: Draft decisions, directives, and other documents on industry and trade within the authority to issue of the Chairman of the People's Committee at the provincial level as assigned.
3. Implement legal regulatory documents, strategies, plans, programs, proposals, projects, technical standards, and other documents in the industry and trade sector issued or approved by competent state agencies; provide information, promote, guide, disseminate, educate, monitor, and supervise the implementation of laws in fields under the delegated state management.
4. On industry and small-scale handicrafts:
a) On mechanical industry, metallurgical industry, and electronics industry:
Advise on the establishment, submission for issuance, and implementation of planning, programs, proposals, policies for developing the mechanical industry, metallurgical industry, and electronics industry; develop mechanical and electronic products on the provincial territory.
b) On supporting industry:
Advise on the establishment, submission for issuance, and coordination with relevant agencies to implement plans, programs, proposals, mechanisms, and policies to support the development of the supporting industry on the provincial territory.
c) On power, new energy, renewable energy, and energy use efficiency:
Implement planning, programs, and initiatives for power development, application of new energy, renewable energy, and energy use efficiency, manage power demand, and adjust load on the provincial territory;
Review applications for power operation licenses according to regulations; implement licensing and revocation of power operation licenses when authorized by the People's Committee at the provincial level; conduct inspections, supervision, and ensure conditions stipulated in power operation licenses;
Confirm that distribution networks with voltage levels up to 35kV do not meet the conditions for supplying electricity upon request from distribution companies or distribution and retail companies;
Take the lead and coordinate with relevant power units to submit to the People's Committee at the provincial level for approval of lists of important electricity users prioritized for power supply when the power supplier implements power reduction or shutdown in the power system; conduct inspections, supervision, and ensure compliance with power reduction or shutdown by power units under management;
Promote, disseminate, and educate on laws concerning power operations and electricity usage, power demand management; implement training, examination, and issuance of County Power Inspector cards and Power Inspector cards for power units under management.
||| Carry out the work of resolving disputes regarding electricity purchase and sale contracts with voltage levels below 110kV as prescribed;
||| Carry out inspection, examination, and supervision tasks on retail electricity units within the management area in terms of implementing electricity sales prices as prescribed; inspect, examine, and supervise the implementation of retail electricity prices at rental housing locations within the management area as prescribed;
||| Review and submit to the People's Committee of the province for approval the pricing plan for electricity sales to customer groups using electricity in industrial zones that simultaneously purchase electricity from the national power grid along with other power sources (on-site power plants; purchasing electricity from local power sources such as wind power, solar power, biomass power);
||| Organize the development of plans to inspect and urge key energy-consuming facilities in the locality to apply energy management models; Inspect and supervise the implementation of technical standards, quotas, and regulations on energy-saving and efficient use in industry, business, trade, and civilian sectors; Compile a list of key energy-consuming facilities in the locality, submit it for approval by the provincial People's Committee, publish it on the website www.dataenergy.vn, and send the document to the Ministry of Industry and Trade;
||| Guide, inspect, examine, and supervise the implementation of regulations concerning electric power activities, electricity usage, electrical safety, energy-saving and efficient use, and activities in the energy sector under the management area;
||| Implement tasks within the authority of specialized agencies in project management, construction quality management in the electricity sector according to laws;
||| d) Regarding the mining and processing of mineral industries (excluding common building materials):
||| Take the lead and coordinate with relevant sectors to organize the implementation of exploration, exploitation, processing, and utilization planning for various types of minerals after approval according to authority;
||| Guide and inspect the implementation of technical standards, economic-technical quotas, technology, and labor safety in mining and mineral processing in the province;
||| Take the lead and coordinate with related departments to review feasibility studies, detailed design reports, and other construction design stages of mining and mineral processing projects in the province (excluding common building materials) according to construction laws;
||| Inspect, examine, and supervise the implementation of laws on technical safety in mining; impose administrative penalties according to laws for violations of technical safety laws in mining by individuals and organizations;
||| Advise the Provincial People's Committee on propaganda, dissemination, and education of laws for organizations and individuals engaged in mineral production and business in the locality; organize inspections and examinations of mineral production and business situations; monitor mining sites, transportation, processing, stockpiling, buying, and selling of minerals to promptly detect and handle illegal mineral production and business activities;
||| đ) Regarding chemicals and industrial explosives:
||| Organize the implementation of strategies, plans, and policies for the development of the chemical and industrial explosives industry in the province;
||| Take the lead and coordinate with relevant provincial agencies to disseminate, guide legal provisions, and inspect, examine, and handle violations of laws on the management, use, storage, trading, and transportation of chemicals and industrial explosives according to laws;
||| Review and issue, reissue, amend, and revoke Certificates of Conditions for Producing and Trading Conditioned Chemicals in the Industrial Sector for organizations and individuals;
||| Issue, reissue, or revoke Permits for Using Industrial Explosives according to regulations;
||| Train, inspect training, issue certificates of technical safety training for industrial explosives according to regulations;
||| Perform other tasks related to chemical and industrial explosives activities assigned and classified in the Law on Chemicals, the Law on Management, Use of Weapons, Explosives, and Auxiliary Tools, and related legal documents;
||| e) Regarding safety management in industries and fields under the jurisdiction of the Ministry of Industry and Trade:
||| Take the lead and coordinate with relevant provincial agencies to disseminate, guide legal provisions, and inspect the implementation of laws on safety in industries and fields under the jurisdiction of the industry and trade sector;
||| Take the lead and coordinate with relevant provincial agencies to disseminate, guide legal provisions, and inspect the implementation of laws on safety, including safety in the management, use, storage, trading, and transportation of dangerous goods, petroleum, gas, and equipment with strict technical safety requirements; chemical safety training; technical safety training for gas business activities; training for drivers of motor vehicles, escorts, loaders, unloaders, and warehouse keepers within the management area;
||| Develop training plans, inspections, ranking, and issuing safety certificates for electricity operators and repairers in rural, mountainous, border, and island areas operating under the Electricity Law and related laws, within the scope of rural, mountainous, border, and island areas.
Guide, inspect the implementation of legal provisions in the field of technical safety inspection for labor safety, technical safety inspection for electrical equipment and tools as prescribed;
Chair the review and approval of safety documents in accordance with the law;
Issue Certificates of Qualification for traders dealing in gas purchase and sale; Certificates of Qualification for gas refilling stations for cylinders, tank trucks, and transport vehicles;
Direct, guide, inspect, and supervise industrial and commercial facilities under management to implement disaster prevention and emergency response work as prescribed;
g) Regarding dam safety management within the scope of management:
Review and submit to the People's Committee of the province for approval: Single reservoir operation procedures; Dam protection plans; Emergency response plans;
Advise the People's Committee of the province to establish a Safety Inspection and Evaluation Board for hydropower dams and reservoirs before the rainy season;
Inspect the project acceptance work of the project owner within the investment decision-making authority of the province and hydropower and irrigation dams constructed on the territory according to the law;
Receive declarations of dam and reservoir safety registration; compile and build a database of technical parameters and management information for hydropower and irrigation dams on the territory; report to the provincial People's Committee, Ministry of Industry and Trade;
Receive applications for permits within the authority of the provincial People's Committee;
Report the results of the implementation of hydropower reservoir operation procedures on the territory to the provincial People's Committee, Ministry of Industry and Trade;
h) Regarding environmental protection and environmental industry development:
Develop and submit for issuance policies, strategies, regulatory legal documents on environmental protection, environmental industry development, and incentives and support for the environmental industry development in line with the law and local conditions;
Promote, disseminate, guide legal regulations, and conduct inspections and checks on the implementation of environmental protection and environmental industry development regulations within the industrial and commercial sector's jurisdiction at the local level as prescribed;
Chair the implementation of the Environmental Industry Development Program, environmental industry development tasks, circular economy tasks, climate change response programs and projects in the sectors under its jurisdiction;
Collect and compile information on environmental statistical indicators within the industrial and commercial sector;
Annually summarize and report to the provincial People's Committee, Ministry of Industry and Trade, and related ministries and agencies on the situation of environmental industry development in the locality as prescribed;
i) Regarding food safety, consumer goods industry, food industry, and other processing industries:
Implement approved policies, strategies, and plans for the development of the consumer goods industry (textiles, footwear, paper, ceramics, glass, plastics), and the food industry (alcohol, beer, beverages, processed milk, vegetable oil, products from starch and flour, and other foods as prescribed by the Government);
Guide and inspect the implementation of technical standards and hygiene and environmental safety requirements for industrial products; implement state management functions for food safety from production, processing, storage, transportation, and sales of alcohol, beer, beverages, processed milk, vegetable oil, products made from starch and flour, pastries, candies, and food packaging materials under the responsibility of the industrial and commercial sector and other products, food safety for markets, supermarkets, shopping centers, and food distribution and storage facilities under the jurisdiction of the Department;
Guide, promote laws, chair, and coordinate inspections on the implementation of regulations to prevent fake food, trade fraud on the market for all types of food, food containers, and packaging materials under the jurisdiction of the industrial and commercial sector in the locality;
k) Regarding promotion of small and medium-sized enterprises:
Chair and advise the provincial People's Committee on the performance of state management functions for SME promotion activities in the locality;
Develop and submit for issuance policies and regulatory legal documents on SME promotion activities in line with the law and local conditions; advise competent authorities to ensure local budget funds for organizing SME promotion activities in the locality;
Develop, submit for approval, and organize the implementation of the local SME promotion program; guide organizations and individuals to implement annual SME promotion plans and projects in the locality; be responsible for organizing project acceptance and supervising the use of SME promotion funds to ensure compliance with the target, purpose, and current regulations;
Advise competent authorities to balance local budget funds for investing in infrastructure and enhancing the operational capacity of subordinate public service units performing SME promotion tasks; train and enhance knowledge for staff and volunteers working on SME promotion in the locality;
Monitor, evaluate, compile reports, and provide relevant information and documents on SME promotion activities in the locality as prescribed;
l) Regarding industrial clusters:
Perform the function of the lead administrative agency for industrial clusters in the province according to the law.
Develop, submit for approval, and organize the implementation of plans for industrial cluster development, programs to support investment in technical infrastructure for industrial clusters, budgets for activities related to industrial cluster development after obtaining approval from competent authorities; develop and submit to the provincial People's Committee for issuance of regulations on managing industrial clusters, handle procedures for implementing investment projects for technical infrastructure and production and business operations within industrial clusters under a single-window mechanism;
Take the lead in reviewing applications for establishing and expanding industrial clusters;
Serve as the focal point for receiving, handling, or coordinating with competent authorities to decide on investment policies, issue certificates of investment registration for projects on building technical infrastructure and production and business operations within industrial clusters, including procedures for implementing investment in technical infrastructure for industrial clusters (including land recovery, land leasing, detailed planning approval, approval of public investment project proposals, environmental impact assessment reports, fire prevention and firefighting plans) according to regulations, decentralization, and delegation by the provincial People's Committee;
Take the lead in inspecting, supervising, and evaluating the implementation of development plans, policies, laws, and operational effectiveness of industrial clusters; handle violations or propose the provincial People's Committee to address issues arising in industrial clusters; establish and operate a database on industrial clusters within the jurisdiction;
m) Regarding small-scale handicraft industries:
Take the lead and coordinate with relevant agencies to develop, submit for approval, and organize guidance and implementation of programs, plans, projects, and initiatives for developing small and medium-sized enterprises, collective economic organizations, cooperatives, and traditional craft villages in the industry and commerce sector after obtaining approval from competent authorities;
n) Regarding sustainable production and consumption:
Organize the implementation of programs, projects, plans, mechanisms, and policies aimed at promoting and developing sustainable production and consumption in the province;
o) Conduct feasibility study report reviews, economic and technical investment construction reports, and design construction implementation after basic design of industrial construction projects according to legal provisions and assignments or delegations by the provincial People's Committee;
p) Regarding product quality management:
- Take the lead in receiving and processing applications for conformity declaration according to legal provisions on product quality management;
- Inspect compliance with regulations on product quality management by businesses within the jurisdiction;
5. On trade:
a) Domestic market:
Organize the implementation of planning, policies, and mechanisms for managing and developing various forms of commercial infrastructure such as markets, shopping centers, malls, supermarkets, retail stores, commodity exchanges, exhibition centers, auction centers, and other types of commercial infrastructure; various organizational forms, methods, and means of commercial trade such as trade cooperatives, wholesale, retail, trading agencies, franchising, trade services, and logistics activities within the province according to legal provisions;
Take the lead and coordinate with relevant agencies to guide and implement mechanisms and policies encouraging expansion of business networks, development of organizations linking commodity circulation, and formation of stable channels from production to consumption within the province;
Implement, guide, and inspect compliance with regulations on goods and services in sectors requiring conditional business operation such as tobacco, alcohol, oil, gas, and other goods and services within the province according to legal provisions and management levels of the Ministry of Industry and Trade;
Implement preferential policies, incentives, and support for production, business, and people's livelihoods in border areas, mountainous regions, islands, ethnic minority regions, and difficult areas within the province (such as providing essential goods, supporting commodity circulation and trade services...);
Organize the regulation of commodity circulation, ensuring balance between supply and demand for essential commodities, ensuring quality and food safety, stabilizing and promoting the development of the domestic market;
Aggregate and process market information within the province regarding total retail sales of goods and service revenue, total supply and demand, reserve levels, and price fluctuations of essential commodities, policy goods for border areas, mountainous regions, islands, and ethnic minorities. Propose solutions to regulate commodity circulation during each period to the competent authority;
b) On exports and imports:
Advise on the development and implementation of mechanisms, policies, strategies, plans, programs, and projects related to export and import of goods; manage and monitor export and import activities; develop export and import services within the province;
Manage export and import activities of domestic enterprises, foreign-invested enterprises, and traders without a presence in Vietnam;
c) On border trade (for provinces with borders):
Take the lead or coordinate with relevant agencies to implement policies and measures for managing and regulating border trade development according to provincial People's Committee regulations;
Take the lead or coordinate in exchanging information and cooperating with functional agencies across the border to propose measures to resolve issues arising in border trade within the jurisdiction;
Aggregate and analyze border trade activities; recommend amendments and supplements to policies and measures to promote border trade in line with actual conditions within the jurisdiction;
d) On e-commerce and digital economy:
Advise on the development and implementation of mechanisms, policies, projects, programs, and plans for electronic commerce aimed at developing infrastructure for electronic commerce applications, enhancing human resources to serve the management of electronic commerce and digital economy, and supporting organizations and individuals in applying electronic commerce within the province;
Carry out other state management tasks related to electronic commerce as prescribed by law and delegated by the Ministry of Industry and Trade;
d) Regarding trade promotion:
Organize the implementation of administrative procedures for trade promotion within its authority;
Inspect, monitor, supervise the compliance with laws on trade promotion by traders and organizations involved in trade activities, and impose administrative penalties according to the law for violations committed by such traders and organizations;
Verify, consolidate, and settle accounts with the corresponding financial management agency regarding the amount of money collected into the state budget, which is 50% of the announced value of unclaimed prizes from promotional programs as decided;
Advise and propose to local authorities on programs, plans, and projects for trade promotion within the province, and implement such programs, plans, and projects as assigned;
Coordinate with the Ministry of Industry and Trade in managing the operations of foreign trade promotion organization representative offices in Vietnam;
e) Regarding competition management:
Promote, disseminate, and guide the implementation of laws on competition within the province;
Identify and recommend relevant agencies to resolve, within their jurisdiction, acts violating competition laws and regulations, and draft documents that are inconsistent with competition laws;
g) Regarding the management of multi-level marketing business activities:
Take the lead in organizing the implementation of laws on the management of multi-level marketing business activities within the province within its jurisdiction;
Develop and submit to competent authorities for issuance a coordination regulation among local agencies involved in inspection, supervision, and monitoring of multi-level marketing business activities;
Identify and handle violations of laws on the management of multi-level marketing business activities within its jurisdiction, or report to competent authorities for handling;
Issue and revoke confirmation of registration for multi-level marketing sales activities locally, and confirmation of receipt of notifications to terminate such activities;
Conduct inspections, supervision of multi-level marketing business activities;
Organize training and professional instruction for officials directly responsible for state management of multi-level marketing sales activities;
Implement publicity and dissemination of laws on the management of multi-level marketing sales activities to enterprises and participants in such activities;
Receive and process notification files for meetings, seminars, and training sessions on multi-level marketing sales activities;
Report annually or as required to the Ministry of Industry and Trade on the management of multi-level marketing sales activities within the province;
h) Regarding trade defense:
Guide the implementation of laws on trade defense including anti-dumping, countervailing duties, safeguard measures, and anti-circumvention of trade defense measures within the province;
Identify and recommend relevant agencies to resolve, within their jurisdiction, regulations issued with contents inconsistent with trade defense laws;
Lead in supporting industry associations and exporting enterprises within the province in responding to investigations and reviews of anti-dumping, countervailing duties, safeguard measures, and anti-circumvention of trade defense measures by foreign countries;
Compile data, operational situations, and import-export information related to trade defense cases within the province, and cooperate with trade defense investigation agencies in early warning of trade defense lawsuits;
Coordinate with trade defense investigation agencies in reviewing, providing information, and addressing issues related to investigations, audits, and specialized inspections of trade defense measures against enterprises within the province;
Serve as the main point of contact for collecting and providing information to trade defense investigation agencies about policies and practices of agencies, organizations, and enterprises within the province in foreign anti-subsidy investigations;
i) Regarding consumer protection:
Propose competent state agencies to issue and organize the implementation of regulatory documents on consumer protection within the locality;
Promote, disseminate, and educate on laws concerning consumer protection; provide advice, support, and enhance awareness on consumer protection within the locality;
Inspect, investigate complaints and reports, and handle violations of laws on consumer protection within its jurisdiction;
Implement control over standard contracts and general terms of transactions in accordance with consumer protection laws within the locality;
Provide professional guidance to county-level consumer protection management agencies on matters related to consumer protection;
Publicly announce the list of organizations and individuals operating goods and services that violate consumer rights within its jurisdiction;
Manage the activities related to protecting consumer rights by social organizations at the local level; create conditions for social organizations to participate in protecting consumer rights; review projects and plans of activities of social organizations participating in protecting consumer rights submitted to the Chairman of the Provincial People's Committee for decision on assignment of tasks linked with state responsibilities; supervise the implementation of assigned tasks when given to social organizations to protect consumers.
Manage, inspect, and supervise the mediation activities of mediation organizations resolving disputes between consumers and business entities and individuals at the local level in accordance with the provisions of the law.
Report on the results of state management regarding the protection of consumer rights within the province periodically or upon request from higher authority agencies.
k) Regarding market management:
Coordinate with the Market Management Agency located within the province to develop regular inspection plans, special topic measures, and methods to prevent and combat smuggling, commercial fraud, and counterfeit goods within the scope of functions and tasks of local market management forces to avoid overlapping and duplication of inspected subjects and contents with other authorized inspection and supervision forces at the provincial level.
l) Regarding international economic integration:
Implement specific plans, programs, and measures for international economic integration within the province after approval;
Take the lead and coordinate with relevant agencies to promote, disseminate, and guide the implementation of plans, programs, and regulations on international economic integration of the locality;
Actively coordinate with the Ministry of Industry and Trade and related units to implement assigned tasks in the Plan for Implementing Free Trade Agreements, particularly new-generation free trade agreements;
Carry out other state management contents regarding international economic integration in accordance with the law and the delegation of the Ministry of Industry and Trade.
m) Regarding the sale of goods and activities directly related to the sale of goods by foreign traders within the province:
Manage the sale of goods and activities directly related to the sale of goods by foreign traders;
Manage the activities of representative offices of foreign traders.
6. Organize the implementation and be responsible for appraisal, registration, issuance of licenses, certificates, and credentials within the scope of responsibility of the Department of Industry and Trade according to the law and the division of work or delegation by the Provincial People's Committee.
7. Assist the Provincial People's Committee in managing, encouraging, and supporting the development of enterprises, cooperatives, collective economy, private sector businesses operating within the province in the industry and trade sectors; manage associations and non-governmental organizations operating within the scope of the Department of Industry and Trade according to the law.
8. Guide the implementation of self-management mechanisms for public service units under the jurisdiction of the industry and trade sectors according to the law; manage the activities of public and non-public service units within the industry and trade sectors.
9. Implement international cooperation in industry and trade according to the law and the division of work or delegation by the Provincial People's Committee;
10. Provide professional guidance and technical advice to the Economic Department or the Economic and Infrastructure Department and specialized positions under the People's Committee at the commune level within the scope of their management.
11. Organize research, application of scientific and technological progress; build information systems and archives to serve state management in industry and trade.
12. Inspect, audit, and handle violations by agencies, organizations, and individuals in the enforcement of laws within the scope of the Department of Industry and Trade's management; receive citizens, process letters and complaints, resolve grievances and denunciations, and prevent corruption and waste according to the law or as delegated by the Provincial People's Committee.
13. Specify the functions, tasks, authorities, and working relationships of specialized departments, inspection bodies, and the Office under the Department of Industry and Trade; manage organizational structure, civil servant quotas, job positions, and staff structures according to professional titles; implement salary systems and incentive policies, training, commendation, and disciplinary measures for civil servants, staff members, and workers under the Department of Industry and Trade's management according to the law and as delegated by the Provincial People's Committee; advise the Provincial Council on awarding the title "National Master Craftsperson" and "Outstanding Master Craftsperson" in the field of traditional craft and assist the Provincial People's Committee in awarding the titles "Excellent Worker" and "Provincial Master Craftsperson."
14. Manage and be responsible for finances and assets allocated according to the law and as delegated by the Provincial People's Committee.
15. Implement information, statistics, compilation, and periodic and ad hoc reporting on the situation of task implementation in assigned fields of work to the Provincial People's Committee and the Ministry of Industry and Trade.
16. Perform other tasks as stipulated by the law and as delegated by the Provincial People's Committee, the Chairman of the Provincial People's Committee, and higher-level state agencies.
Chapter II
INDUSTRY AND TRADE SPECIALIZED AGENCY
UNDER THE PROVINCE PEOPLE'S COMMITTEE
Article 3. Position and Functions
1. The Economic Department or the Economic and Infrastructure Department is a specialized agency under the County People's Committee, providing advisory support and assisting the County People's Committee in implementing state management functions in industry and trade at the local level (for other areas managed by the Economic Department or the Economic and Infrastructure Department, guidance is provided by the corresponding ministry).
2. The Economic Department or the Economic and Infrastructure Department has legal personality, its own seal and bank account; it follows the directives and management of organization, staffing, and personnel work of the County People's Committee, while also adhering to professional and technical directives, inspections, and guidance from the Department of Industry and Trade.
Article 4. Tasks and Powers
1. Submit to the People's Committee at the district level: draft decision; medium-term and annual development plans; programs and measures to organize the implementation of state administrative reform tasks in the industry-commerce sector.
2. Submit to the Chairman of the People's Committee at the district level for draft decisions and other documents within the Chairman’s authority according to assigned duties.
3. Organize, guide, and implement policies encouraging collective economic organizations and private enterprises to invest in developing industry and expanding production and business activities; organize advisory services for technology transfer, information provision, trade promotion, and human resource training for production and business establishments in the industry-commerce sector. Implement trade promotion programs, brand building, and development plans on the local area according to the assignments of competent authorities.
4. Advise the People's Committee at the district level on managing industrial clusters within the district:
Serve as the focal point for the People's Committee at the district level to manage industrial clusters within the district according to the分级授权和法律规定;组织实施本区工业集群发展的活动,按照规定;
提出制定发展、成立、扩大工业集群的方案;
协同乡级人民委员会实施收回土地、租赁土地、补偿拆迁、安置、工人住房以及在工业集群内投资项目的手续工作;

5. Take the lead, advise the People's Committee at the district level on drafting and submitting for promulgation plans for promoting industry that comply with laws and local conditions; advise the competent authority to ensure local government budget funds for organizing promotional activities in the industry-commerce sector on the local area.
6. Advise the People's Committee at the district level on implementing state management over consumer protection according to the provisions of the law.
7. Implement legal documents, planning, and plans after approval; provide information, propaganda, dissemination, and education on laws related to the industry-commerce sector; monitor the enforcement of laws related to the industry-commerce sector.
8. Assist the People's Committee at the district level in performing and being responsible for reviewing, registering, and issuing various types of permits within the scope of responsibility and authority of the specialized agency according to the provisions of the law and according to the division of labor or delegation of the People's Committee at the district level.
9. Assist the People's Committee at the district level in managing state administration over collective economic organizations, private enterprises, associations, and non-governmental organizations operating in the industry-commerce sector according to the provisions of the law.
10. Provide professional guidance on the industry-commerce sector to cadres and civil servants under the People's Committee at the commune level.
11. Organize the application of scientific and technological progress; establish information and storage systems to serve state administration work and professional tasks of the Economic Department or the Economic and Infrastructure Department.
12. Carry out regular and urgent reporting on the implementation of assigned tasks according to the regulations of the People's Committee at the district level and the Department of Industry and Trade.
13. Monitor and inspect organizations and individuals in the implementation of laws related to the industry-commerce sector; receive citizens, handle complaints and denunciations; prevent and combat corruption and waste according to the law and the division of labor of the People's Committee at the district level.
14. Manage organizational structure, job positions, civil servant quotas, civil service grade structures, implement salary systems, incentive policies, rewards, disciplinary actions, and professional training and development for civil servants within the scope of management according to the law and the division of labor of the People's Committee at the district level.
15. Manage and be responsible for finances and assets allocated according to the law and the分级管理授权的县人民委员会;
16. Perform other tasks assigned by the People's Committee, the Chairman of the People's Committee at the district level, and according to the law.
Chapter III
IMPLEMENTATION
Article 5. Effective Date
1. This Circular takes effect from March 15, 2022.
2. This Circular replaces Joint Circular No. 22/2015/TTLT-BCT-BNV dated June 30, 2015, issued by the Minister of Industry and Trade and the Minister of Home Affairs guiding the functions, tasks, powers, and organizational structure of specialized agencies in charge of the industry-commerce sector under provincial and district-level People's Committees.
Article 6. Responsibility for Implementation
1. The People's Committee, and the Chairman of the People's Committee at the provincial level shall be responsible for directing and organizing the implementation of this Circular.
2. During the implementation of this Circular, if there are any difficulties or need for supplementation or amendment, please report to the Provincial People's Committee, the Department of Industry and Trade, and relevant organizations and individuals for consideration and resolution according to their authority./.
