ON THE LEVEL OF SUPPORT AND MECHANISM FOR USING PUBLIC INVESTMENT FUNDS TO IMPLEMENT CERTAIN CONTENTS OF PROJECT 1 AND SUBPROJECT 1, PROJECT 4 UNDER THE NATIONAL TARGET PROGRAM ON ECONOMIC AND SOCIAL DEVELOPMENT IN ETHNIC MINORITY AND MOUNTAINOUS REGIONS FOR THE 2021-2030 PERIOD, STAGE I: FROM 2021 TO 2025

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Public Investment dated June 13, 2019;

Pursuant to the State Budget Law dated June 25, 2015;

Pursuant to Resolution No. 120/2020/QH14 dated June 19, 2020 of the National Assembly, Session XIV, approving the investment orientation of the National Target Program on economic and social development in ethnic minority and mountainous regions for the 2021-2030 period;

Pursuant to Decree No. 27/2022/NĐ-CP dated April 19, 2022 of the Government stipulating management mechanisms and organization of implementation of national target programs;

Pursuant to Decision No. 39/2021/QĐ-TTg dated December 30, 2021 of the Prime Minister stipulating principles, criteria, allocation quotas of central budget funds and the ratio of local budget counterpart funds for implementing the National Target Program on economic and social development in ethnic minority and mountainous regions for the 2021-2030 period, Stage I: from 2021 to 2025;

At the proposal of the Minister, Head of the Committee for Ethnic Minorities;

The Prime Minister promulgates this Decision on the level of support and mechanism for using public investment funds to implement certain contents of Project 1 and Subproject 1, Project 4 under the National Target Program on economic and social development in ethnic minority and mountainous regions for the 2021-2030 period, Stage I: from 2021 to 2025.

Article 1. Scope of Regulation

This Decision regulates the level of support and mechanism for using public investment funds to implement certain contents of Project 1 and Subproject 1, Project 4 under the National Target Program on economic and social development in ethnic minority and mountainous regions for the 2021-2030 period, Stage I: from 2021 to 2025 approved by Decision No. 1719/QĐ-TTg dated October 14, 2021 of the Prime Minister (hereinafter referred to as the Program).

Article 2. Applicability

1. Recipients and implementers of support contents related to residential land, housing, and production land under Project 1 of the Program.

2. Recipients and implementers of investment and construction of centralized water supply facilities under Project 1 of the Program; investment in hardening roads to commune centers under Subproject 1, Project 4 of the Program; investment in construction, renovation, and upgrading of market networks in ethnic minority and mountainous regions under Subproject 1, Project 4 of the Program.

Article 3. Level of Support from the Central Budget

1. The central budget provides maximum support of 40 million VND per household for land leveling and infrastructure development for residential land or for people to stabilize their residence through interlaced settlement.

2. The central budget provides maximum support of 40 million VND per household for building one house according to local customs and traditions, ensuring three solid elements (solid foundation, solid frame-wall, solid roof).

3. The central budget provides maximum support of 22.5 million VND per household for clearing, reclaiming, and improving land for allocating arable land.

4. The central budget provides average support of 3 billion VND per project for constructing centralized water supply facilities.

5. The central budget provides average support of 1.6 billion VND per kilometer for hardening roads to commune centers that have not been hardened.

6. The central budget provides average support of 4.4 billion VND per market for new construction and 800 million VND per market for renovation and upgrading of market networks in ethnic minority and mountainous regions.

Article 4. Level of support from local budgets and other legitimate sources of funds

1. The local budget shall provide a minimum of four million dong per household to create a level playing field, develop technical infrastructure for residential land, or to enable residents to stabilize their housing through interlocking arrangements.

2. The local budget shall provide a minimum of four million dong per household to construct one house according to local customs and traditions, ensuring three hard components (solid foundation, solid frame-walls, solid roof).

3. In addition to the central government's funding support and allocation from the local budget, localities shall mobilize additional legitimate sources of funds to implement support for residential land, housing, production land; invest in constructing centralized water supply facilities; invest in paving roads to the commune center; build, renovate, and upgrade market networks to ensure the completion of the Program's objectives.

Article 5. Mechanism for Supporting the Use of Public Investment Funds to Implement

1. For cases where support is provided according to an investment project approved by the competent authority, implementation shall be carried out in accordance with current laws on public investment.

2. For cases where direct support is provided to households without following an investment project approved by the competent authority, implementation shall be carried out under a special mechanism decided by the competent authority.

Article 6. Implementation Organization

1. The Committee for Ethnic Minorities, the Ministry of Planning and Investment, the Ministry of Finance, and related ministries and agencies, within their assigned functions, tasks, and authorities, shall guide localities in organizing the implementation of the contents stipulated in this Decision.

2. Responsibilities of Provincial People's Committees

a) Promptly organize the implementation of the contents stipulated in this Decision within their assigned functions, tasks, and authorities.

b) Direct the review and determination of beneficiaries for support in priority order, ensuring feasibility, effectiveness, and compliance with current regulations.

Article 7. Effective Date

1. This Decision shall take effect from the date of issuance.

2. The Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, Chairpersons of provincial People's Committees under the Central Government, and Heads of related agencies and units are responsible for enforcing this Decision./.
