Circular No. 04/2024/TT-BTTTT on the planning of the 880-915 MHz and 925-960 MHz frequency bands for the public land mobile network (PLMN) IMT system in Vietnam

This Circular plans the 880-915 MHz and 925-960 MHz frequency bands for the PLMN IMT system in Vietnam from 2024 to 2026, and adjusts their usage from 2026 onwards. CIRCULAR

Frequency Band Planning for the 880-915 MHz and 925-960 MHz Bands for the Public Land Mobile Network (PLMN) IMT System in Vietnam

Pursuant to the Radio Frequency Law dated November 23, 2009; the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law dated November 9, 2022;

Pursuant to Decree No. 48/2022/NĐ-CP dated July 26, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
The Government shall stipulate the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to Decision No. 71/2013/QĐ-TTg dated November 21, 2013 of the Prime Minister promulgating the National Radio Frequency Spectrum Plan; Decision No. 38/2021/QĐ-TTg dated December 29, 2021 of the Prime Minister amending and supplementing certain provisions of Decision No. 71/2013/QĐ-TTg dated November 21, 2013 of the Prime Minister promulgating the National Radio Frequency Spectrum Plan;
The Government shall amend and supplement some articles of Decision No. 71/2013/QD-TTg dated November 21, 2013, promulgating the National Radio Frequency Allocation Plan issued by the Prime Minister;

PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE RADIO FREQUENCY MANAGEMENT AGENCY;

The Minister of Information and Communications issues this Circular on the frequency band planning for the 880-915 MHz and 925-960 MHz bands for the public land mobile network (PLMN) IMT system in Vietnam.The allocation plan for the frequency bands 880-915 MHz and 925-960 MHz for the Vietnamese public IMT ground-based terrestrial system.

Article 1. Scope of Regulation and Applicability

2. Applicability:

This Circular plans the 880-915 MHz and 925-960 MHz bands for deploying PLMN IMT systems in Vietnam.

This Circular applies to organizations and individuals participating in the management and use of radio frequencies; organizations and individuals producing, importing, and trading radio equipment for use in Vietnam.

Article 2. Content of Planning

1. The planning of the 880-915 MHz and 925-960 MHz bands until September 15, 2026 is as follows:

 

a) The 880-915 MHz and 925-960 MHz bands shall be used to deploy PLMN systems according to the IMT-2000, IMT-Advanced, IMT-2020 standards and subsequent versions using the Frequency Division Duplex (FDD) mode (hereinafter referred to as the FDD method);2);

b) The 880-915 MHz band is allocated for the uplink band, divided into four blocks B1, B2, and B3 with corresponding bandwidths of 10 MHz, 8.4 MHz, 8.2 MHz, and 8.2 MHz;1, B2, B3 and B4 with corresponding bandwidths of 10 MHz, 8.4 MHz, 8.2 MHz and 8.2 MHz;

c) The 925-960 MHz band is allocated for the downlink band, divided into four blocks B1', B2', and B3' with corresponding bandwidths of 10 MHz, 8.4 MHz, 8.2 MHz, and 8.2 MHz;1’, B2’, B3’ and B4’ with corresponding bandwidths of 10 MHz, 8.4 MHz, 8.2 MHz and 8.2 MHz;

d) The maximum total bandwidth that an organization may be licensed to use in the 880-915 MHz and 925-960 MHz bands under the FDD method is 2×10 MHz;

e) Organizations licensed to use the band within the 880-915 MHz and 925-960 MHz bands must cooperate with each other to prevent and handle harmful interference;

f) To avoid causing harmful interference to other permitted radio systems operating in certain areas within the 880-915 MHz and 925-960 MHz bands, organizations licensed to use the band within these bands must implement technical measures to address harmful interference in accordance with the guidance of the Ministry of Information and Communications (Radio Frequency Management Department).

2. The planning of the 890-915 MHz and 935-960 MHz bands from September 16, 2026 is as follows:a) The 890-915 MHz and 935-960 MHz bands shall be used to deploy PLMN systems according to the IMT-2000, IMT-Advanced, IMT-2020 standards and subsequent versions using the FDD method.

 

The PLMN system according to the IMT-2000 standard specified herein shall be used until September 14, 2028;

b) The 890-915 MHz band is allocated for the uplink band, divided into three blocks C1, C2, and C3 with corresponding bandwidths of 10 MHz, 5 MHz, and 10 MHz;

b) The 890-915 MHz band is allocated for the uplink band, divided into three blocks C1, Cand Cwith corresponding bandwidths of 10 MHz, 5 MHz and 10 MHz;

c) The 935-960 MHz band is allocated for the downlink band, divided into three blocks C1', C2', and C3' with corresponding bandwidths of 10 MHz, 5 MHz, and 10 MHz;1’, C2’ and C3’ with corresponding bandwidths of 10 MHz, 5 MHz and 10 MHz;

d) The maximum total bandwidth that an organization may be licensed to use in the 890-915 MHz and 935-960 MHz bands under the FDD method is 2×15 MHz;

e) Organizations licensed to use the band within the 890-915 MHz and 935-960 MHz bands must cooperate with each other to prevent and handle harmful interference.

Article 3. Implementation Provisions

1. This Circular takes effect from June 24, 2024.

2. Repeal Clause 2.1.4, Clause 2.2.3 of Article 1 and related provisions concerning the 880-915 MHz and 925-960 MHz bands in Decision No. 25/2008/QĐ-BTTTT dated April 16, 2008 of the Minister of Information and Communications approving the frequency band plan for cellular mobile communication systems in the 821-960 MHz and 1710-2200 MHz bands in Vietnam.

3. Repeal related provisions concerning the 880-915 MHz and 925-960 MHz bands in Circular No. 04/2017/TT-BTTTT dated April 24, 2017 of the Minister of Information and Communications regarding the deployment of IMT systems on the 824-835 MHz, 869-915 MHz, 925-960 MHz, 1710-1785 MHz, 1805-1880 MHz, 1920-1980 MHz, and 2110-2170 MHz bands.

Article 4. Transitional Provisions

1. Licenses issued for the use of the 880-915 MHz and 925-960 MHz bands before the effective date of this Circular shall continue to be valid until their expiration dates.

2. Licenses issued in accordance with this Circular for existing GSM systems on the 880-915 MHz and 925-960 MHz bands shall continue to be valid subject to the following conditions:
880-915 MHz and 925-960 MHz shall continue to be used under the following conditions:

a) As of September 16, 2024, service shall not be provided to terminal devices supporting only the GSM standard, except for providing services to terminal devices connected to the GSM network for the purpose of transmitting and receiving data between devices (M2M) or providing services in the Paracel Islands, Spratly Islands, and DK platforms.

b) Shall continue to be used from September 16, 2024 until September 15, 2026, except for providing services in the Paracel Islands, Spratly Islands, and DK platforms.

Article 5. Responsibilities for Implementation

1. The Director of the Office, the Director of the Radio Frequency Management Department, the Heads of agencies and units under the Ministry of Information and Communications, and related organizations and individuals are responsible for implementing this Circular.

2. During the implementation process, if there are difficulties or obstacles, they are requested to promptly report to the Ministry of Information and Communications (Radio Frequency Management Department) for consideration and resolution./.
