CIRCULAR

Guidelines for Competition and Reward Work in the Construction Industry

Pursuant to the Law on Competition and Reward 2003; the Law Amending and Supplementing Certain Articles of the Law on Competition and Reward 2005 and the Law Amending and Supplementing Certain Articles of the Law on Competition and Reward 2013;

Pursuant to Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing the implementation of certain articles of the Law on Competition and Reward (hereinafter referred to as Decree No. 91/2017/NĐ-CP);

Pursuant to Decree No. 81/2017/NĐ-CP dated July 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Cadre and Civil Servant Department,

The Minister of Construction issues this Circular guiding competition and reward work in the Construction Industry.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular guides competition and reward work within the Construction Industry.

2. This Circular applies to collectives, individuals, and families of Vietnamese people, Vietnamese people residing abroad, and foreign collectives and individuals who have made contributions to the construction and development of the Construction Industry.

Article 2. Principles and Bases for Competition and Reward

1. Competition and reward principles are implemented according to the provisions of Article 6 of the Law on Competition and Reward 2003; Clause 3, Article 1 of the Law on Competition and Reward 2013 and Article 3 of Decree No. 91/2017/NĐ-CP.

2. Bases for rewarding are implemented according to the provisions of Article 10 of the Law on Competition and Reward 2003; Article 6 of Circular No. 12/2019/TT-BNV dated November 4, 2019 of the Ministry of Home Affairs detailing the implementation of certain articles of Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing the implementation of certain articles of the Law on Competition and Reward (hereinafter referred to as Circular No. 12/2019/TT-BNV).

Article 3. Competition and Reward Councils

1. The Competition and Reward Council of the Ministry of Construction:

a) The Competition and Reward Council of the Ministry of Construction is an advisory body to the Minister regarding competition and reward work in the Construction Industry.

b) The Competition and Reward Council of the Ministry of Construction is established by the Minister, consisting of: The Chairman of the Council is the Minister of Construction; The Vice-Chairman in charge is the Deputy Minister assigned to assist the Minister in overseeing competition and reward work; other Vice-Chairmen and members are decided by the Minister; The Standing Member is the Deputy Director of the Cadre and Civil Servant Organization Department responsible for competition and reward work.

c) The tasks and powers of the Competition and Reward Council of the Ministry of Construction are carried out according to the provisions of Article 62 of Decree No. 91/2017/NĐ-CP.

2. Competition and Reward Councils at the grassroots level:

a) Organizations with legal personality, separate bank accounts, and seals must establish Competition and Reward Councils at the grassroots level.

For other organizations, the heads of the agencies and units shall consider and decide on the establishment of Competition and Reward Councils based on actual circumstances. In cases where councils are not established, the examination and recommendation for rewards shall be conducted by the head of the agency or unit in coordination with the party committee and relevant mass organizations at the same level.

b) Competition and Reward Councils at the grassroots level are established by the heads of the agencies and units, consisting of: The Chairman of the Council is the Head of the agency or unit; The Vice-Chairman and members are decided by the head of the agency or unit.

c) Competition and Reward Councils at the grassroots level perform advisory functions for the head of the agency or unit regarding competition and reward work and operate according to regulations issued by the Chairman of the Council.

Article 4. Scientific Council, Initiative Council

1. Scientific Council, Initiative Council of the Ministry of Construction:

a) The Scientific Council, Initiative Council of the Ministry of Construction shall be established by the Minister's decision.

b) The composition, tasks, and principles of operation of the Scientific Council, Initiative Council shall be decided by the Minister and implemented according to the provisions of Decree No. 13/2012/ND-CP dated March 2, 2012, promulgating the Regulations on Initiatives (hereinafter referred to as Decree No. 13/2012/ND-CP), Circular No. 18/2013/TT-BKHCN dated August 1, 2013, guiding the implementation of certain provisions of the Regulations on Initiatives issued pursuant to Decree No. 13/2012/ND-CP dated March 2, 2012 (hereinafter referred to as Circular No. 18/2013/TT-BKHCN), and other relevant legal normative documents.

2. Scientific Council, Initiative Council at the grassroots level:

a) The Scientific Council, Initiative Council at the grassroots level shall be established by the head of the agency or unit at the same level.

b) The composition, tasks, and principles of operation of the Initiative Council at the grassroots level shall be stipulated by the head of the agency or unit at the same level and implemented according to Decree No. 13/2012/ND-CP, Circular No. 18/2013/TT-BKHCN, and other relevant legal normative documents.

Article 5. Commendation Fund

1. Sources and levels of contributions to the fund:

The sources of formation and levels of contributions for commendations shall be carried out according to the provisions of Articles 64 and 65 of Decree No. 91/2017/ND-CP and Circular No. 71/2011/TT-BTC dated May 24, 2011, guiding financial management and the implementation of the system of commendation and reward, and other relevant legal normative documents.

2. Management and use of the fund:

Shall be carried out according to the provisions of Articles 66 and 67 of Decree No. 91/2017/ND-CP and other relevant legal normative documents.

3. Prize money accompanying commendation titles and forms of reward:

Shall be carried out according to the provisions of Articles 66, 68, 69, 70, 71, 72, 73, and 74 of Decree No. 91/2017/ND-CP and other relevant legal normative documents.

Article 6. Management of Commendation Files

1. Files managed at the Ministry of Construction:

a) The Cadre and Civil Servant Department shall be responsible for managing and storing files related to commendation titles and forms of reward within the authority of the Minister of Construction and above, and all other files related to the work of commendation and reward of the Construction sector according to the authority and responsibility for management of the Ministry of Construction.

b) The regime for preserving files shall be implemented according to the laws on archiving.

2. Files managed at agencies and units: Agencies and units shall be responsible for managing and storing files related to the work of commendation and reward according to the prescribed authority.

Chapter II

ORGANIZATION OF COMPETITION,

AWARDS AND STANDARDS FOR COMPETITION AWARDS

Article 7. Forms and contents of organizing competition movements

1. Forms of organizing competitions shall be carried out according to the provisions of Article 4 of Decree No. 91/2017/ND-CP.

2. Contents of organizing competition movements shall be carried out according to the provisions of Article 5 of Decree No. 91/2017/ND-CP and Articles 4 and 5 of Circular No. 12/2019/TT-BNV.

3. When considering special rewards involving many participants, the agencies and units entrusted with the main supervision of the special topic shall be responsible for evaluating and summarizing the competition movement and mainly compiling the forms of rewards proposed for commendation by the Ministry of Construction and for consideration and submission to the State for commendation.

Article 8. Registration for Competitions

1. Agencies and units under the Construction Sector shall be responsible for organizing collective and individual registration for competitions within their agencies and units, compiling and sending them to the Ministry of Construction (the Permanent Office of the Competition and Commendation Council of the Ministry of Construction) before March 15 each year.

2. For competition movements carried out in phases or on specific topics, agencies and units shall develop plans and send their competition registration forms to the Ministry of Construction (the Permanent Office of the Competition and Commendation Council of the Ministry of Construction) for monitoring and compilation.

Article 9. Awards for Competitions

According to Article 20 of the Law on Competitions and Rewards 2003, awards for competitions include:

1. Awards for collectives:

a) Flag of Government Competition;

b) Flag of Ministry of Construction Competition;

c) Excellent Labor Collective;

d) Advanced Labor Collective.

2. Awards for individuals:

a) National Model Worker;

b) Model Worker of the Construction Sector;

c) Model Worker at the Base Level;

d) Advanced Worker.

Article 10. Standards for the Award "Flag of Government Competition"

Implemented according to the provisions of Article 25 of the Law on Competitions and Rewards 2003; Article 11 of Decree No. 91/2017/NĐ-CP and Clause 3 of Article 8 of Circular No. 12/2019/TT-BNV.

Article 11. Standards for the Award "Flag of Ministry of Construction Competition"

The award "Flag of Ministry of Construction Competition" is granted annually to collectives that meet the standards stipulated in Article 26 of the Law on Competitions and Rewards 2003, Article 12 of Decree No. 91/2017/NĐ-CP, and Clauses 1 and 2 of Article 8 of Circular No. 12/2019/TT-BNV, including:

1. Being outstanding examples in various fields, clusters, or groups of competitions within the Construction Sector, exceeding competition targets and assigned tasks for the year;

2. Having new factors or models with significant effectiveness for other collectives in the same field to learn from;

3. Maintaining internal unity, strictly adhering to Party policies and State laws, actively practicing thrift, combating waste, corruption, and social evils.

Article 12. Standards for the Award "Excellent Labor Collective"

The award "Excellent Labor Collective" is granted annually to collectives that meet the standards stipulated in Article 26 of the Law on Competitions and Rewards 2003, including:

1. Creatively overcoming difficulties to excellently complete assigned tasks and fulfill all obligations to the State;

2. Having ongoing, practical, and effective competition movements;

3. All individuals in the collective completing assigned tasks, with at least 70% of individuals achieving the "Advanced Worker" award;

4. Having individuals achieving the "Model Worker at the Base Level" award and no individuals being disciplined with warnings or higher penalties;

5. Maintaining internal unity and exemplary adherence to Party policies and State laws.

Article 13. Standards for the Award "Advanced Labor Collective"

The award "Advanced Labor Collective" is granted annually to collectives that meet the standards stipulated in Article 28 of the Law on Competitions and Rewards 2003, including:

1. Successfully completing assigned tasks and plans for the year;

2. Having ongoing, practical, and effective competition movements;

3. More than 50% of individuals in the collective achieving the "Advanced Worker" award and no individuals being disciplined with warnings or higher penalties;

4. Maintaining internal unity and exemplary adherence to Party policies and State laws.

Article 14. Criteria for the title "National Model Worker"

1. The criteria for the title "National Model Worker" shall be implemented in accordance with Clause 1, Article 9 of Decree No. 91/2017/ND-CP and current guiding documents.

2. The time for conferring the title "National Model Worker" is the year immediately following the second consecutive year of receiving the title "Model Worker of the Construction Industry".

Article 15. Criteria for the title "Model Worker of the Construction Industry"

The title "Model Worker of the Construction Industry" shall be conferred on individuals who meet the criteria stipulated in Clause 2, Article 9 of Decree No. 91/2017/ND-CP, including:

1. Having outstanding achievements among those who have consecutively received the title "Model Worker at the grassroots level" three times.

2. Proposing technical solutions, management solutions, work solutions, operational solutions, or applications of technological progress to increase labor productivity and work efficiency recognized by the Technical Innovation Council at the Ministry level or research topics that have been accepted and applied in practice recognized by the Technical Innovation Council at the Ministry level, or winning first place in technical contests or lectures at the Ministry level or national level, having an impact within the industry.

3. The time for conferring the title "Model Worker of the Construction Industry" is the year when the individual receives the title "Model Worker at the grassroots level" for the third time.

Article 16. Criteria for the title "Model Worker at the Grassroots Level"

1. The title "Model Worker at the Grassroots Level" shall be conferred annually on individuals who meet the criteria stipulated in Clause 3, Article 9 of Decree No. 91/2017/ND-CP and Article 7 of Circular No. 12/2019/TT-BNV, including:

a) Being a prominent individual among those who have received the title "Advanced Worker."

b) Proposing technical solutions, management solutions, work solutions, operational solutions, or applications of technological progress to increase labor productivity and work efficiency, or research topics that have been accepted and applied in practice recognized by the grassroots level.

2. The assessment of the impact of technical innovations and research topics shall be conducted by the Technical Innovation and Science Council at the grassroots level to assist the head of the agency or unit in considering and recognizing them.

3. The proportion of individuals recognized with the title "Model Worker at the Grassroots Level" shall not exceed 15% of the total number of individuals who have received the title "Advanced Worker."

Article 17. Criteria for the title "Advanced Worker"

1. The title "Advanced Worker" shall be conferred on individuals who meet the criteria stipulated in Article 23 of the Law on Encouragement and Reward in 2003 and Article 10 of Decree No. 91/2017/ND-CP, including:

a) Completing assigned tasks well, achieving high productivity and quality.

b) Adhering to Party policies and State laws; demonstrating self-reliance and self-improvement spirit; fostering unity, mutual assistance, and active participation in competitive campaigns.

c) Actively studying politics, culture, professional knowledge, and vocational skills.

d) Possessing good morals and healthy lifestyle.

2. The title "Advanced Worker" shall be conferred on individuals who have performed brave actions to save people or property, resulting in injuries requiring treatment or rehabilitation, with the treatment period counted towards the evaluation for the title "Advanced Worker."

3. Individuals sent for short-term training or development under 12 months, who comply with the regulations of the training or development institution, shall have their study period counted towards their service time at the agency or unit for the evaluation of the title "Advanced Worker." In cases where individuals are sent for training or development for one year or more, who comply with the regulations of the training or development institution and achieve satisfactory grades or higher, they may be considered for the title "Advanced Worker."

4. Maternity leave according to regulations shall be counted towards the evaluation for the title "Advanced Worker."

5. For individuals transferred to new agencies or units: The new agency or unit is responsible for evaluating and voting for the title "Advanced Worker" (in cases where the individual has worked at the previous unit for six months or more, opinions from the previous unit must be obtained).

6. In cases where individuals are temporarily transferred or detailed to other agencies or units, the evaluation and voting for the title "Advanced Worker" shall be decided by the agency or unit that transferred or detailed the individual (with opinions from the agency or unit receiving the individual).

7. The title "Advanced Worker" shall not be conferred in any of the following cases:

a) Newly recruited for less than ten months;

b) Disciplined with a warning or higher.

Chapter III

FORMS, OBJECTS AND CRITERIA FOR REWARDS

Article 18. Forms of Reward

According to the Law on Encouragement and Reward 2003, forms of reward include:

1. National-level reward forms:

a) Orders;

b) Medals;

c) State Honorary Titles;

d) Ho Chi Minh Prize, State Prize;

đ) Certificate of Merit of

2. Ministry-level reward forms:

a) Commemorative Medal "For Construction Industry";

b) Certificate of Merit of the Minister of Construction;

3. Organizational-level reward forms: Certificate of Merit of the head of the unit under the Ministry with legal personality.

Article 19. Recipients and Standards for State Honorary Titles, High Prizes, Orders, Medals, and Certificates of Merit of the Prime Minister

Implementation according to the provisions of the Law on Encouragement and Reward 2003, Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government, Circular No. 12/2019/TT-BNV dated November 4, 2019 of the Ministry of Home Affairs, and related legal documents.

Article 20. Commemorative Medal "For Construction Industry"

1. The Commemorative Medal "For Construction Industry" is awarded to individuals who have worked or are currently working in the Construction Industry and meet one of the following criteria:

a) Leaders and former leaders of the Ministry of Construction;

b) Individuals honored with the title of Heroic Laborer;

c) Individuals evaluated by the head of the agency or unit as having successfully completed assigned tasks and having a certain tenure of service:

- For males: Having continuously served for 20 years in the Construction Industry or a total service period of 25 years, including 15 continuous years in the Construction Industry;

- For females: Having continuously served for 15 years in the Construction Industry or a total service period of 20 years, including 10 continuous years in the Construction Industry.

2. The Commemorative Medal "For Construction Industry" is awarded to individuals outside the Construction Industry who meet one of the following criteria:

a) Leaders of central and local agencies, ministries, sectors, and mass organizations who have made contributions to the development of the Construction Industry;

b) Individuals with initiatives, solutions, scientific projects recognized by competent state authorities, with practical value applied in the Construction Industry;

c) Overseas Vietnamese individuals or foreigners who have made outstanding contributions to building and strengthening cooperation relations between countries and international organizations with the Vietnamese Construction Industry, positively contributing to the development of the Construction Industry;

d) Individuals who have made significant contributions and provided effective support to the development of the Construction Industry.

3. For individuals who have retired from the Construction Industry, the retirement management authority is responsible for confirming and preparing files to submit to the Minister of Construction for consideration of awarding the Commemorative Medal "For Construction Industry" in accordance with regulations. In cases where the organization has been dissolved or merged, the successor organization is responsible for confirming and preparing files to submit to the Minister of Construction for review and decision.

4. Other cases as decided by the Minister of Construction.

5. The Commemorative Medal "For Construction Industry" is awarded once to an individual and not posthumously. The awarding process takes place annually on the occasion of the Construction Industry Day (April 29) and National Day (September 2) or may be awarded exceptionally at the discretion of the Minister of Construction.

Article 21. Certificate of Merit of the Minister of Construction

1. The "Certificate of Merit of the Minister of Construction" is awarded to exemplary collectives that have conscientiously implemented Party policies, state laws, and achieved standards set forth in Article 72 of the Law on Encouragement and Reward 2003 and Article 39 of Decree No. 91/2017/NĐ-CP, meeting one of the following criteria:

a) Achieving outstanding results in competition campaigns initiated by the Minister of Construction;

b) Achieving outstanding results unexpectedly, with significant impact within their respective fields of the Construction Industry;

c) Consistently achieving excellent performance for two consecutive years immediately preceding the year of commendation; maintaining internal unity, effectively implementing grassroots democracy; organizing good competition campaigns; caring for the material and spiritual life of the collective; practicing thrift; fulfilling all obligations to the state and labor policies;

2. The "Certificate of Merit of the Minister of Construction" is awarded to exemplary individuals who conscientiously implement Party policies, state laws, and meet one of the criteria stipulated in Article 39 of Decree No. 91/2017/NĐ-CP as follows:

a) Achieving outstanding results in annual competition campaigns initiated by the Minister of Construction;

b) Achieving many results (or outstanding unexpected results) with significant impact in one of the fields of the Construction Industry;

c) Consistently achieving excellent performance for two consecutive years immediately preceding the year of commendation, during which time they have two recognized and effectively applied scientific initiatives or topics at the organizational level.

3. The "Certificate of Merit of the Minister of Construction" is awarded to exemplary workers and employees who conscientiously implement Party policies, state laws, and meet one of the following criteria:

a) Achieving many results in work and production with significant impact within the organization or unit;

b) Workers and employees with initiatives or solutions that bring high benefits, with significant impact within the organization or unit.

4. The "Certificate of Merit of the Minister of Construction" is awarded to collectives and individuals outside the Construction Industry who have made many achievements, provided substantial support, and had positive effects on the development of the Construction Industry, confirmed by competent authorities.

5. The "Certificate of Merit of the Minister of Construction" is awarded to exemplary families who conscientiously implement Party policies, state laws, and have made many contributions to the development of the Construction Industry.

6. Other commendations are decided by the Minister.

Article 22. Commendation Certificates

The head of agencies and units under the Ministry shall grant commendation certificates to collectives and individuals within their management authority in accordance with the provisions of Article 76 of the Law on Competition and Rewards 2003; Clauses 41 and 42 of Article 2 of the Law on Competition and Rewards 2013; and Clauses 1 and 3 of Article 40 of Decree No. 91/2017/NĐ-CP.

Article 23. Reward for Dedication Process

The subjects, criteria, time, and procedures for granting rewards for dedication process for individuals shall be carried out in accordance with the provisions of Articles 41 and 42 of Decree No. 91/2017/NĐ-CP and Article 10 of Circular No. 12/2019/TT-BNV.

Chapter IV

AUTHORITY TO DECIDE AND BESTOW; PROCEDURES AND FILES FOR BESTOWING AWARDS AND REWARD FORMS

Section 1

AUTHORITY TO DECIDE AND BESTOWCOMPETITION TITLES AND REWARD FORMS

Article 24. Authority to Decide on Bestowing Awards and Reward Forms

1. Authority to decide on bestowing awards and reward forms of

2. The Minister of Construction decides to bestow:

a) The Flag of Competition of the Ministry of Construction;

b) The Excellent Labor Collective title;

c) The Model Competitor in Construction title;

d) The Commendation Certificate of the Minister of Construction;

đ) The Commemorative Medal "For the Construction Cause";

e) The Model Competitor at the Base title, the Advanced Worker title, and the Advanced Labor Collective title for collectives and individuals under the Departments and the Party-Directorate Office.

3. Heads of agencies and units having legal personality, bank accounts, and separate seals decide to bestow:

a) The Advanced Labor Collective title;

b) The Model Competitor at the Base title;

c) The Advanced Worker title;

d) Commendation Certificates.

Article 25. Bestowing Awards and Reward Forms

1. The person authorized to decide on bestowing a particular form of reward shall directly present it or authorize another to present it.

2. Announcing, presenting, and receiving awards and reward forms shall be conducted in accordance with the provisions of Government Decree No. 145/2013/NĐ-CP dated October 29, 2013, which stipulates the organization of commemorative days; the ceremony for presenting and receiving awards and recognition titles; and diplomatic rituals and welcoming foreign guests.

3. Organizing the presentation of awards and reward forms is an opportunity to highlight good people, good deeds, and exemplary models, combined with other events of the agency or unit, ensuring solemnity, practicality, and economy.

4. The Standing Office of the Competition and Reward Council of the Ministry of Construction shall take the lead and coordinate with relevant agencies and units to advise and propose to the Minister regarding the organization of the presentation of national-level competition titles and reward forms within the Minister's authority.

Section 2

PROCEDURES AND FILES FOR BESTOWING AWARDS,FORMS OF REWARD

Article 26. Reward Procedures

According to Article 46 of Decree No. 91/2017/NĐ-CP, the reward procedures include:

1. The level that manages organizational structure, cadres, civil servants, public officials, employees, and salary funds shall be responsible for rewarding or submitting to the competent authority for rewarding those within its management scope.

2. The level that leads the promotion of competition movements shall select outstanding individuals and collectives for rewarding or recommending to the competent authority for rewarding.

3. Professional associations under the sectors managed by the State Construction Ministry shall be rewarded or submitted to the competent authority for rewarding by the Ministry of Construction.

4. Reward procedures for enterprises:

a) For state-owned enterprises under the management of the Ministry of Construction, the Ministry of Construction shall reward or submit to the competent authority for rewarding;

b) For enterprises where the State holds more than 50% of the charter capital under the management of the Ministry of Construction, the Ministry of Construction shall reward or submit to the competent authority for rewarding;

c) For enterprises where the State holds less than 50% of the charter capital, the procedures shall be carried out in accordance with Point d Clause 6 of Article 46 of Decree No. 91/2017/NĐ-CP. The Ministry of Construction shall reward collectives and individuals from enterprises where the State holds less than 50% of the charter capital when participating in annual competition movements organized and promoted by the Ministry of Construction.

d) For other types of enterprises: The reward procedures shall be carried out in accordance with Point a Clause 6 of Article 46 of Decree No. 91/2017/NĐ-CP and Clause 3 of Article 10 of Circular No. 12/2019/TT-BNV.

5. For individuals who are direct workers with outstanding achievements, the Vietnam Construction Union shall compile and submit to the Ministry of Construction for rewarding during the National Workers' Month each year.

6. Units with foreign nationals participating in cooperation have the responsibility to recommend rewards for foreign collectives and individuals who have made significant contributions to the construction sector.

7. Rewards for Leaders of the Ministry of Construction: The Standing Office of the Competition and Reward Council of the Ministry of Construction proposes competition titles and reward forms to the Competition and Reward Council of the Ministry of Construction for rewarding and recommending to the State for rewarding the leaders of the Ministry of Construction.

8. Rewards for Leaders of central ministries, departments, mass organizations, and localities: The Standing Office of the Competition and Reward Council of the Ministry of Construction shall coordinate with relevant agencies and units to submit to the Minister of Construction for consideration and decision.

9. Other cases shall be decided upon by the Minister of Construction.

Article 27. Documents for Proposing State Awards

1. The components of the documents for proposing State awards shall be implemented according to the provisions of Articles 49, 51, 52, 54, 55, 56, and 57 of Decree No. 91/2017/ND-CP and the models of achievement reports stipulated in the Appendix attached to Decree No. 91/2017/ND-CP.

2. The number of documents submitted to the Ministry of Construction for consideration of State awards:

a) Documents for proposing to award the title "National Labor Medalist": 03 sets (originals);

b) Documents for proposing to award the flag "Government's Flag of Merit": 03 sets (originals);

c) Documents for proposing to award Orders of various types: 04 sets (originals);

d) Documents for proposing to award Medals: 04 sets (originals);

đ) Documents for proposing awards through simplified procedures: 04 sets (originals);

e) Documents for proposing to award the title "Heroic Laborer": 04 sets (originals);

g) Documents for proposing to award the certificate "Ministry of Construction's Certificate of Merit"

Article 28. Documents for Proposing Ministry-Level Awards

1. The documents for proposing to award the flag "Ministry of Construction's Flag of Merit" include 01 set of original documents (as prescribed in Clause 2, Article 50 of Decree No. 91/2017/ND-CP), including:

a) The proposal letter of the unit accompanied by the list of collectives proposed for commendation;

b) The minutes of the meeting to consider commendation of the Competition and Commendation Council at the level of commendation;

c) The report on achievements of the collective proposed for commendation with confirmation from the level of commendation;

d) The confirmation document of the tax management agency with authority regarding the completion of tax obligations to the State by the collective proposed for commendation (for agencies, organizations, and units with tax obligations to the State that are proposed for commendation);

đ) The evaluation and assessment document of the People's Committee of the province/city directly under the central government where the unit has its headquarters regarding the implementation of tasks by the unit proposed for commendation (for Departments under the Construction sector); The confirmation document of the People's Committee of the ward/village where the unit has its headquarters regarding the compliance with Party guidelines and State policies by the unit in the locality (for organizations, agencies, units, and enterprises not directly under the Ministry of Construction).

2. The documents for proposing to award the title "Excellent Labor Collective" include 01 set of original documents (as prescribed in Clause 2, Article 50 of Decree No. 91/2017/ND-CP), including:

a) The proposal letter of the unit accompanied by the list of collectives proposed for commendation;

b) The minutes of the meeting to consider commendation of the Competition and Commendation Council at the level of commendation;

c) The report on achievements of the collective proposed for commendation with confirmation from the level of commendation;

d) The confirmation document of the tax management agency with authority regarding the completion of tax obligations to the State by the collective proposed for commendation (for agencies, organizations, and units with tax obligations to the State).

3. The documents for proposing to award the certificate "Minister of Construction's Certificate of Merit" include 01 set of original documents, including:

a) The proposal letter of the unit accompanied by the list of collectives and individuals proposed for commendation;

b) The minutes of the meeting to consider commendation of the Competition and Commendation Council at the level of commendation;

c) The report on achievements of the collective and individual proposed for commendation with confirmation from the level of commendation;

d) The confirmation document of the tax management agency with authority regarding the completion of tax obligations to the State by the collective or individual who is the head of the unit proposed for commendation (for agencies, organizations, and units with tax obligations to the State);

đ) The confirmation document of the People's Committee of the ward/village where the unit has its headquarters regarding the compliance with Party guidelines and State policies by the unit in the locality (for collectives or individuals who are heads of units, enterprises not directly under the Ministry of Construction).

4. The documents for proposing to award the title "Construction Industry Labor Medalist" include 01 set of original documents (as prescribed in Clause 2, Article 50 of Decree No. 91/2017/ND-CP), including:

a) The proposal letter of the unit accompanied by the list of individuals proposed for commendation;

b) The minutes of the meeting to consider commendation of the Competition and Commendation Council at the level of commendation (with secret ballot results);

c) The report on achievements of the individual proposed for commendation with confirmation from the level of commendation;

d) The decision of the competent authority regarding the innovation, solution, or scientific research topic of the individual proposed for commendation;

e) The confirmation document of the tax management agency with authority regarding the completion of tax obligations to the State by the unit (for individuals who are heads of units with tax obligations to the State proposed for commendation).

5. The documents for proposing to award the commemorative medal "For the Construction Cause" include 01 set of original documents, including:

a) The proposal letter of the unit accompanied by the list of individuals proposed for commendation;

b) The minutes of the meeting to consider commendation of the Competition and Commendation Council at the level of commendation;

c) The summary report on achievements of the individual proposed for commendation with confirmation from the level of commendation.

6. The documents for proposing special commendations or commendations discovered by the head of the agency, organization, or unit; commendations for foreign affairs (simplified procedures), include 01 set of original documents, including:

a) The proposal letter of the unit accompanied by the list of collectives and individuals proposed for commendation;

b) The summary report on achievements of the agency or directly managed unit, clearly stating the actions, achievements, and merits of the collective or individual proposed for commendation.

7. The documents for proposing commendations based on specific themes (or competition periods), include 01 set of original documents, including:

a) The proposal letter of the unit accompanied by the list of individuals and collectives proposed for commendation;

b) The minutes of the meeting to consider commendation of the Competition and Commendation Council at the level of commendation;

c) The report on achievements of the collective and individual proposed for commendation with confirmation from the level of commendation;

d) The summary report on the competition movement according to the period or theme of the unit proposed for commendation;

đ) The confirmation document of the tax management agency with authority regarding the completion of tax obligations to the State (for agencies, organizations, and units with tax obligations to the State or individuals who are heads of units proposed for commendation);

8. The documents for proposing commendations for foreign collectives and individuals and Vietnamese collectives and individuals abroad, include 04 sets of original documents (for State-level commendations) and 01 set of original documents (for Ministry-level commendations), including:

a) The proposal letter of the unit accompanied by the list of collectives and individuals proposed for commendation;

b) The minutes of the meeting of the Competition and Commendation Council at the level of commendation;

c) The report on achievements of the collective or individual carried out by the proposing agency with confirmation from the level of commendation;

d) The confirmation document of the competent authority regarding the completion of tax obligations to the State of Vietnam according to the law (for agencies, organizations, and units with tax obligations to the State or individuals who are heads of units proposed for commendation);

đ) The opinion of the Department of International Cooperation for cases of Ministry-level commendations.

Article 29. Time for Receiving Nomination Files for Awards

Agencies and units shall submit nomination files for awards to the Ministry of Construction (Department of Organization and Cadres - Permanent Office of the Ministry of Construction's Mobilization and Commendation Council) along with electronic documents (in .doc format for reports, lists, and summary achievement reports; in .pdf format for other related documents) to the email address: [email protected] (in case of sending via postal service, the time will be calculated based on the postmark) according to the following specified times:

1. Time for Receiving Nomination Files for Awards Based on Achievements and Merits:

a) Title of "Heroic Laborer": Receive nomination files for awards before August 15 of the year immediately preceding the year of the National Mobilization Congress of the Construction Industry.

b) Title of "National Model Worker": Receive nomination files for awards before June 15 each year. The time for submitting to the Ministry of Construction for review and submission

c) Orders and Medals, "Certificate of Merit of

d) Title of "Flag of Excellence from the Government", "Flag of Excellence from the Ministry of Construction": Receive nomination files for awards before February 15 each year.

đ) Title of "Model Worker of the Construction Industry", title of "Excellent Labor Collective", "Certificate of Merit of the Minister of Construction": Receive nomination files for awards before March 15 each year.

For educational and training institutions: Receive nomination files for awards before August 15 each year.

e) Titles of "Advanced Labor Collective", "Local Model Worker", "Advanced Worker" (for Departments, Party and Mass Organizations' Offices): Receive nomination files for awards before February 15 each year.

2. Time for Receiving Nomination Files for Awarding "Memorial Medal for the Construction Cause":

a) First Round: Receive nomination files for awards before March 15 each year;

b) Second Round: Receive nomination files for awards before August 15 each year.

3. Time for Receiving Nomination Files for Outstanding and Unexpected Awards, Batch Awards, and Special Topic Awards:

Units shall submit nomination files for awards no later than 15 days after the collectives or individuals have achieved outstanding and unexpected merits or after the completion of the batch competition or special topic work.

4. Time for Receiving Nomination Files for Long-term Contribution Awards:

Units shall submit to the Ministry of Construction for review and submission to the State for long-term contribution awards after the decision announcing retirement benefits has been issued to the individual.

5. Time for Receiving Nomination Files for Foreign Affairs Awards and Other Cases: Receive nomination files for awards at least 20 working days prior to the planned award ceremony date.

6. For National Honorary Titles and High Prestigious Awards, follow the provisions of the Law on Mobilization and Commendation, Decree No. 91/2017/NĐ-CP, Circular No. 12/2019/TT-BNV, and other relevant legal documents.

Article 30. Procedures and Formalities for Award Review and Presentation

1. Procedures and Formalities for Awarding National Honorary Titles and National Prizes:

Follow the provisions of the Law on Mobilization and Commendation, Decree No. 91/2017/NĐ-CP, Circular No. 12/2019/TT-BNV, and other relevant legal documents.

2. Procedures and Formalities for Awarding the Title of Heroic Laborer, National Model Worker Title, Orders, "Friendship Medal", "Certificate of Merit of

a) Units shall submit nomination files for awards to the Ministry of Construction (through the Permanent Office of the Ministry of Construction's Mobilization and Commendation Council) as prescribed.

b) After receiving the files, the Permanent Office of the Ministry of Construction's Mobilization and Commendation Council shall conduct an assessment and consolidation of the nomination files for awards of collectives and individuals and seek opinions from related units (if necessary) before submitting to the Minister for consideration and decision.

c) The Permanent Office of the Ministry of Construction's Mobilization and Commendation Council shall notify the results of the awards.

4. Procedures and Formalities for Awarding Unexpected Awards, Batch Awards, Special Topic Awards, or Awards for Collectives and Individuals Outside the Construction Industry:

a) Units shall submit nomination files for awards to the Ministry of Construction (Permanent Office of the Ministry of Construction's Mobilization and Commendation Council) as prescribed.

b) After receiving the files, the Permanent Office of the Ministry of Construction's Mobilization and Commendation Council shall conduct an assessment and consolidation of the nomination files for awards of collectives and individuals and seek opinions from related units (if necessary) before submitting to the Minister of Construction for consideration and decision.

c) The Permanent Office of the Ministry of Construction's Mobilization and Commendation Council shall notify the results of the awards.

Chapter V

IMPLEMENTATION

Article 31. Organization and machinery for implementing commendation and reward work

1. The Cadre and Civil Servant Department shall be the Standing Office of the Ministry of Construction's Commendation and Reward Council, with the functions of:

a) Advising the Minister of Construction and the Ministry of Construction's Commendation and Reward Council on performing state management functions regarding commendation and reward work, directing and organizing the implementation of commendation and reward work within the Construction sector;

b) Monitoring, guiding, urging, and periodically reporting to the Ministry of Construction's Commendation and Reward Council on the results of commendation and reward work within the sector.

2. Agencies and units under the Construction sector shall allocate staff to monitor and implement commendation and reward work at their units in accordance with regulations.

Article 32. Responsibilities of agencies and units

1. The Minister of Construction shall direct all aspects of commendation and reward work within the Construction sector.

2. The Standing Office of the Ministry of Construction's Commendation and Reward Council shall have the responsibility to advise and propose to the Ministry Leadership on policies, contents, programs, and plans for commendation and reward work; organize the implementation, mid-term review, final assessment, and inspection of commendation and reward work; propose rewards and suggest reforms to commendation and reward work.

3. Heads of agencies and units under the Construction sector shall be responsible for coordinating with peer-level mass organizations to launch, direct, and organize competition movements within their areas of management; conduct mid-term reviews, final assessments, and evaluate the outcomes of competition movements; proactively identify and select collectives and individuals with meritorious achievements for rewards or recommend them to competent authorities for rewards; organize publicity, set examples of good people and deeds, and promote exemplary models and good practices.

4. Heads of agencies and units under the Construction sector shall be responsible for directing and inspecting commendation and reward work within their authority and shall be accountable to the Minister of Construction for the quality of commendation and reward work managed by their units.

5. News and communication agencies under the Construction sector shall be responsible for accurately reflecting the results of competition movements and commendation work; regularly publicizing the Party's policies and state laws on competition and commendation; identifying collectives and individuals with outstanding achievements in competition movements; praising, honoring, and setting examples of exemplary models, good people, and good deeds; combating violations of laws on competition and commendation.

6. Agencies and units shall implement administrative reform, apply information technology, and modernize management and the implementation of commendation and reward work.

7. Agencies and units shall regularly conduct mid-term reviews and final assessments to evaluate the results of commendation and reward work every six months and annually, and submit reports to the Ministry of Construction (Standing Office of the Ministry of Construction's Commendation and Reward Council) in accordance with regulations: Deadline for submitting reports: Mid-term report on commendation and reward work for the first half of the year shall be submitted before June 15th each year, Final report on commendation and reward work for the year shall be submitted before December 15th each year.

8. When organizing, launching, and concluding competition movements, competition campaigns, and special topics of work, units shall submit plans and reports on the results of implementation to the Ministry of Construction (Standing Office of the Ministry of Construction's Commendation and Reward Council) for monitoring and as a basis for awarding commendations.

Article 33. Handling of violations and resolution of complaints and denunciations

Implement in accordance with the provisions of Articles 96, 97, and 98 of the Law on Competition and Rewards 2003 and Articles 78 and 79 of Decree No. 91/2017/ND-CP and related regulatory legal documents.

Article 34. Effective Date

This Circular takes effect from February 15, 2021, and replaces Circular No. 06/2015/TT-BXD dated October 30, 2015, issued by the Minister of Construction guiding competition and reward activities in the Construction sector.

Article 35. Responsibility for Implementation

1. The Competition and Reward Council of the Ministry of Construction, heads of agencies and units under the Construction sector, and relevant organizations and individuals are responsible for implementing this Circular.

2. The Standing Office of the Competition and Reward Council of the Ministry of Construction shall take the lead in advising the Minister of Construction to guide, inspect, and urge agencies and units under the Construction sector to implement this Circular.

3. In the course of implementation, if any difficulties arise, agencies and units shall report to the Ministry of Construction (Standing Office of the Competition and Reward Council of the Ministry of Construction) for coordination and resolution./.
