CIRCULAR

Guidelines for implementing support for individuals participating in revolutionary activities

prior to the August Revolution in 1945 to improve housing according to Decision

No. 20/2000/QĐ-TTg dated February 3, 2000 of the Prime Minister

 

Pursuant to Decree No. 15/CP dated March 4, 1994 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to Decision No. 20/2000/QĐ-TTg dated February 3, 2000 of the Prime Minister on supporting individuals who participated in revolutionary activities prior to the August Revolution in 1945 to improve their housing conditions;

Pursuant to the opinion of the Prime Minister assigning the Ministry of Construction to take the lead in coordinating with relevant ministries and sectors to issue Circulars guiding the implementation of Decision No. 20/2000/QĐ-TTg dated February 3, 2000 (document No. 1945/VPCP-CN dated May 18, 2000 of the Government Office);

After reaching consensus with the Central Organization Committee of the Party, the Central Financial Management Committee of the Party, the Government Office, the Ministry of Labor, Invalids and Social Affairs, the Ministry of Planning and Investment, the Ministry of Finance, and the General Department of Land Administration, the Ministry of Construction provides guidance for implementation as follows:

I. GENERAL PROVISIONS:

1. Decision No. 20/2000/QĐ-TTg dated February 3, 2000 of the Prime Minister (hereinafter referred to as Decision 20) specifically elaborates on the content of support for improving housing that was recorded in the "Ordinance on Preferential Treatment for Individuals Engaged in Revolutionary Activities, Martyrs, and Families of Martyrs, War Invalids, Veterans, and Those Who Contributed to the Revolution," in accordance with economic and social conditions to meet the aspirations of those who participated in revolutionary activities prior to the August Revolution in 1945 to improve their housing conditions, based on the following principles:

For those individuals eligible for support who are currently renting state-owned properties and are permitted to convert them into private ownership, support shall be provided based on the rented property (maintaining the original condition and residence, without addressing the issue of supplementing housing or additional payments for cases currently below the supported standard);

For those individuals eligible for support who are currently renting state-owned properties but are not permitted to convert them into private ownership (due to zoning for other purposes or houses prohibited from being sold), specific regulations for different categories of support with varying levels will be established;

For those individuals eligible for support who do not rent state-owned properties or have returned rented properties to the state before February 18, 2000 (the effective date of Decision 20), financial assistance will be provided;

2. The improvement of housing support must ensure:

Correct target, correct system, and compliance with the prescribed time frame;

Transparency regarding the target, standards, and content of resolution;

Simplification of procedures to the maximum extent while ensuring accuracy in timing and convenience for those receiving support, while also creating favorable conditions for agencies to effectively perform their duties;

During the process of organizing and implementing, provincial people's committees (hereinafter referred to as provincial-level People's Committees) need to compile and reflect to the Ministry of Construction any cases with difficulties or newly arising cases beyond their jurisdiction;

II. GUIDELINES FOR CERTAIN CONTENTS OF DECISION NO. 20/2000/QĐ-TTg DATED FEBRUARY 3, 2000 OF THE PRIME MINISTER:

1. Regarding the application subjects, Decision 20 stipulates that support for improving housing shall be implemented for individuals engaged in revolutionary activities during the period from December 31, 1944, and earlier, who were recognized by competent authorities before June 30, 1999 (the deadline for recognizing revolutionary activists before 1945 according to Joint Circular No. 06/1999/TTLT/BLĐTBXH-BTCTƯ dated February 8, 1999 of the Ministry of Labor, Invalids and Social Affairs and the Central Organization Committee of the Party), and it specifies the exemption or reduction of land usage fees when purchasing state-owned housing for those recognized as cadres engaged in revolutionary activities "Pre-revolutionary."

2. Conditions and standards for support specified in Articles 1, 2, and 3 of Decision 20 are detailed as follows:

a. Currently renting state-owned housing, support is provided for the housing itself at the following levels:

Individuals joining the revolutionary organization before December 31, 1935 are exempt from all house purchase and land usage fees (regardless of the size of the house or land);

Individuals joining the revolutionary organization between January 1, 1936 and December 31, 1944, who have been awarded the Star or Ho Chi Minh or Independence First-Class Medal by the State, are exempt from house purchase fees up to 200 square meters and land usage fees up to 300 square meters;2 use and exemption of land use fee not exceeding 300m2;

Individuals joining the revolutionary organization between January 1, 1936 and December 31, 1944, who have not received any of the three aforementioned medals, are exempt from house purchase fees up to 100 square meters and land usage fees up to the standard rate set for residential land;2 In cases where the rented house has a larger area than the supported level, the beneficiary must pay for the excess area; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).y provincial people's committees;

Individuals engaged in revolutionary activities before 1945 (joining the revolutionary organization before December 31, 1944) residing in closed-unit apartment structures within multi-story buildings are entitled to full exemption of house and land usage fees, plus an additional VND 20 million (twenty million dong);

b. Individuals engaged in revolutionary activities before 1945 (joining the revolutionary organization before December 31, 1944) residing in non-closed-unit apartment structures within multi-story buildings are eligible to be relocated to closed-unit apartment structures within multi-story buildings constructed by the state, with full exemption of house and land usage fees, plus an additional VND 20 million (twenty million dong);

c. In cases where the housing of those eligible for support under Clause 1, 2, and 3 of Article 1 of Decision 20 is rented and cannot be converted into private ownership as stipulated in Article 5 of Decree No. 61/CP dated July 5, 1994 of the Government (hereinafter referred to as Decree No. 61/CP), the provincial-level People's Committee shall provide support based on the specific conditions of the locality.

c. In cases where the housing of individuals supported in accordance with Clauses 1, 2, and 3 of Article 1 of Decision 20 is rented housing that cannot be converted to private ownership as prescribed in Article 5 of Decree 61/CP dated July 5, 1994 of the Government (hereinafter referred to as Decree 61/CP), the People's Committee of the province shall provide support based on the specific conditions of the locality as follows:

For persons eligible for support as prescribed in Clause 1, Article 1 of Decision 20, transferring to another residence (existing or newly constructed) or allocating land without payment shall not exceed a maximum of 400 square meters.2 and providing construction funding not exceeding 200 square meters2 floor area to build a new residence;

For persons eligible for support as prescribed in Clause 2, Article 1 of Decision 20, allocating land without payment shall not exceed a maximum of 300 square meters2 and providing construction funding not exceeding 200 square meters2 floor area to build a new residence themselves;

For persons eligible for support as prescribed in Clause 3, Article 1 of Decision 20, allocating land without payment shall not exceed the residential land standard set by the provincial People's Committee but must be less than 300 square meters2 and providing construction funding not exceeding 100 square meters2 floor area to build a new residence themselves.

Determining the area of land for support must be based on planning, land funds, location, and specific conditions of each locality to decide appropriately but shall not exceed the aforementioned standards.

d. In cases where persons eligible for land allocation without payment and construction funding as mentioned above do not have the conditions to build their own residence and request assistance, the provincial People's Committee shall organize the construction of residences in accordance with general regulations, with agreement from the beneficiaries.

e. The basis for calculating the construction funding support is the cost of building a new residence; for those residing in detached houses, the price of a second-class villa applies, while for other cases, the price of a second-class house as stipulated in Decree No. 61/CP applies.

f. Persons who were engaged in revolutionary activities before 1945 (joining revolutionary organizations before December 31, 1944) in urban areas as well as rural areas, who do not reside in state-owned rental housing or have returned such housing to the state before February 18, 2000, shall be supported with fifty million dong (50 million dong). In cases where multiple individuals within a household participated in revolutionary activities before December 31, 1944 (not residing in state-owned rental housing or have returned such housing to the state before February 18, 2000), each person shall be supported with fifty million dong (50 million dong).

g. Persons joining revolutionary organizations between January 1, 1945, and before the August Revolution in 1945, recognized as pre-revolutionary revolutionary cadres, when purchasing state-owned rental housing according to Decree No. 61/CP, shall be exempted from land use fees for multi-story multi-household residences or reduced by 80% for single-story residences and multi-story single-household residences, but the area for calculating the reduction shall not exceed the residential land standard set by Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the provincial People's Committee.

The reduction rate for land use fees applicable to those engaged in "pre-revolutionary" activities also applies to cases supported through land allocation for housing construction.

3. The area of housing and land for persons eligible for support under Article 1 and Article 3 of Decision 20, when purchasing state-owned housing as stipulated in Article 1 and Article 3 of Decision 20, is the current rented area, purchased according to Decree No. 61/CP; if the beneficiary resides in multiple state-owned rental properties (listed in the lease contract), all rented areas will be combined to calculate exemptions and reductions. If the housing and land area (including combined areas) exceeds the support level, the excess area must be paid for according to the prices specified in Decree No. 61/CP for the house portion and Decree No. 87/CP dated August 17, 1994, for the land portion.

4. In cases where revolutionary activists eligible for support under Article 1, Article 2, and Article 3 of Decision 20 have passed away, but their spouse is still alive, the surviving spouse shall enjoy the support standard as prescribed.

5. For cases eligible for support under Article 1 and Article 2 of Decision 20, where both spouses have passed away and the children face housing difficulties, the provincial People's Committee shall provide housing improvement support (reducing the purchase price of state-owned housing, reducing land use fees when allocating land, supporting with money or other forms) but the total amount of support in all forms for all children facing housing difficulties shall not exceed fifty million dong (50 million dong). Determining housing difficulties shall be based on the following criteria: Not having housing;

Having housing but the average area is less than 6 square meters per person or the current housing is dilapidated and cannot be repaired or made of bamboo and thatch.

In cases where the children of persons eligible under Article 1 and Article 2 of Decision 20 request support, the applicant must obtain written consent from other siblings for the local authority to consider, and the provincial People's Committee shall decide according to regulations.

6. Households with members eligible for support under Article 1 of Decision 20 shall not be entitled to preferential benefits stipulated in Decision No. 118. TTg dated February 27, 1996, and Decision No. 64/1998/QĐ-TTg dated March 21, 1998, issued by the Prime Minister.

Cases eligible for support under Article 3 of Decision 20, if there are multiple persons in the household eligible for preferential treatment, shall be entitled to combine the preferential standards stipulated in Decision No. 118/TTg and Decision No. 64/1998/QĐ-TTg of the Prime Minister, but the maximum support level shall not exceed the purchase price of housing.

Persons eligible for monetary support under Clause 4, Article 1 and Article 2 of Decision 20, if they have already received financial assistance from local authorities to improve housing but not up to the level prescribed in Decision 20, shall be supplemented to meet the level prescribed in Decision 20.

7. In cases where persons eligible for support under Decision 20 have purchased state-owned housing according to Decree No. 61/CP or have been supported through land allocation for housing construction according to Decision No. 118/QĐ-TTg, they shall be refunded the difference (if any) between the support level under this Decision compared to the support level under Decision No. 118/QĐ-TTg and Decision No. 64/1998/QĐ-TTg of the Prime Minister.

Persons eligible for monetary support under Clause 4, Article 1 and Article 2 of Decision 20, if they have already received financial assistance from local authorities to improve housing but not up to the level prescribed in Decision 20, shall be supplemented to meet the level prescribed in Decision 20.

III. ON ORGANIZATION AND IMPLEMENTATION:

1. Based on specific circumstances, the People's Committee of the province shall organize a support team comprising the following agencies: Department of Construction, Department of Land Administration, Office of the People's Committee, Department of Finance and Prices, Department of Labor, Invalids and Social Affairs, Department of Planning and Investment, Department of Land Administration, and invite the Provincial Party Organization Committee, City Party Organization Committee, and Administrative Organization Committee to participate in assisting the People's Committee in performing the following tasks:

The Department of Labor, Invalids and Social Affairs shall cooperate with the Provincial Party Organization Committee (City Party Organization Committee) and the Administrative Organization Committee to verify, review, and compile a list of individuals eligible for support in accordance with Decision No. 20 and the guidelines provided in this Circular.

The Department of Construction (Department of Land Administration) shall be responsible for coordinating with the Department of Land Administration and District (County), Ward (Commune) authorities to specifically determine the housing conditions of individuals eligible for support as stipulated in Decision No. 20. On the basis of the results obtained, they shall classify and develop plans and schedules for implementation (supporting housing, funds; constructing new housing, allocating land, providing financial assistance for cases where rented housing cannot be converted into private ownership).

The Department of Finance and Prices shall be responsible for jointly with the Department of Planning and Investment and relevant departments to aggregate financial requirements to implement Decision No. 20 of the province (city) and submit to the People's Committee of the province for approval.

Relevant departments shall aggregate data according to the parameters specified in the attached guidance circular.

2.Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The People's Committee of the province shall approve the list of individuals eligible for support, the level of support for each individual (household) as prescribed; approve detailed plans regarding funding, residential land, construction of new housing, implementation schedules...; direct and monitor the organization of implementation in accordance with the designated subjects and established regulations.

3. For individuals eligible for support who have a need to relocate (after February 18, 2000), the support must be implemented before relocation. Households that have relocated but have not yet transferred their household registration shall be supported at the location where the primary household registration of the supported individual is officially registered.

4. Ministries, sectors, and agencies currently managing housing for individuals eligible for support under Article 1 and Article 3 of Decision No. 20 shall have the responsibility to transfer management of housing to the People's Committee of the province by June 30, 2000 to implement support. The handover shall be carried out in accordance with the guidance provided in Document No. 227/BXD-QLN dated February 25, 2000 issued by the Minister of Construction regarding the transfer of housing funds. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Within one year from February 18, 2000, localities must complete support for cases specified in Clause 1, 2, 3, and 4 of Article 1 and Article 2 of Decision No. 20. Support for these groups can be initiated immediately (without waiting for the completion of the overall plan for all eligible subjects within the entire province (city)). Support for remaining cases must be completed no later than 2002.

In addition to the rights prescribed by law, individuals entitled to support standards but awaiting resolution may allow inheritance of the right to enjoy those standards.

The financial resources, distribution methods, and final accounting procedures for implementing Decision No. 20 in localities shall be carried out in accordance with the guidance documents issued by the Ministry of Finance.

7. The support team of the provincial People's Committee as stipulated in Point 1 of Part III shall develop proposals, plans, and the simplest procedures for implementation and submit them to the provincial People's Committee for approval. The provincial People's Committee shall focus on resolving cases specified in Clauses 1, 2, 3, and 4 of Article 1 and Article 2 of Decision No. 20. At the same time, prepare conditions such as land funds, planning, projects, funding, infrastructure construction, and new housing construction to facilitate relocation for individuals eligible for support but living in housing that cannot be converted into private ownership.

8. The provincial People's Committee shall direct the implementation of support based on minimizing cumbersome procedures, assigning competent and credible staff to handle various stages of the policy implementation process to ensure the goal of completion by the end of 2002.

9. The operating costs of the provincial People's Committee support team shall be budgeted by the support team, reviewed by the Department of Finance and Prices, and submitted to the Chairman of the provincial People's Committee for approval (no fees shall be charged from households eligible for support).

10. During the implementation process, localities shall specifically aggregate information (regarding quantity, current housing status, residential land...) for newly arising cases and unresolved issues (households where both spouses are eligible for support and live in rented apartments in multi-story buildings, individuals eligible for support living in rented housing without apartment-like structures in multi-story buildings, individuals who have purchased housing under previous housing price policies... etc.) and promptly report to the Ministry of Construction for consolidation and coordination with relevant ministries and sectors to submit to the Prime Minister for consideration and decision.

The Ministry of Construction shall instruct the Housing Management Bureau to coordinate with relevant agencies of ministries and sectors to assist provincial and municipal people's committees in implementing Decision No. 20/2000/QĐ-TTg dated February 3, 2000 issued by the Prime Minister, and to aggregate and report the implementation results of localities to the Ministry of Construction for consolidation and reporting to the Prime Minister.

Column (3): Record house number, ward (commune), district (county) where the beneficiary has permanent residence;

Column (4): Mark (X) if the house is state-owned;

Column (5): Mark (X) if the house is not state-owned;

Column (6): Mark (X) if living in a Commemorative House;

Appendix number 05

GUIDELINES FOR FINANCIAL EXPENSES TO IMPLEMENT SUPPORT

pursuant to Decision 20/2000/QĐ-TTg of the Prime Minister

A. REGARDING THE DETERMINATION OF EXPENSES :

1)Financial support for individuals within the scope of beneficiaries but not residing in state-owned provincial houses :

Total number of individuals within the scope (columns (5) and (6) of Appendices 2 and 3) x 50 million VND to determine the necessary financial support for those entitled to 50 million VND.

2)Financial support of 20 million VND for individuals within the scope of preferential treatment residing in apartments in multi-story buildings with multiple households:

Total number of individuals within the scope (column (8) of Appendices 2 and 3) x 20 million VND to determine the necessary financial support for those residing in apartments in multi-story buildings with multiple households.

3)Total number of individuals within the scope (column (9) of Appendices 2 and 3) to determine the number of households required to be converted to closed-apartment units and the area needed for construction; determine additional funding required (column 9 of Appendices 2 and 3 x 20 million VND). From this, estimate the construction budget for multi-story buildings with closed-apartment units and the total amount needed for additional support.

4)Total number of individuals within the scope (column (12) of Appendices 2 and 3) to determine the number of people required to convert housing. From this, estimate the housing fund for conversion (existing houses, new construction) or land allocation and financial support needed for new construction based on local conditions and the defined land and building areas in Decision 20; Necessary funds for technical infrastructure preparation, compensation for land clearance, leveling, etc., for the land to be allocated for housing construction;

5) Total number of individuals within the scope but both spouses have passed away (before February 18, 2000), and their children have housing difficulties (if any), from which to estimate the financial support required.

B. DETERMINATION OF FINANCIAL NEEDS BY STAGES:

1)Necessary funds to immediately implement support in 2000, including:

Funds in Section 1 and 2 of Part A                                                           :…VND
